The Planning Commission of the City of Arcadia met in regular session on Tuesday,
May 10, 1988 at 7:30 p.m. in the Council Chambers of the Arcadia city HaD, 240

It was moved by Commissioner Clark, seconded by Commissioner Papay to
approve the Minutes of April 26, 1988 as pUblished. The motion passed by

MOTION

Consideration of a tentative parcel map
for a lot line adjustment. Two lots will
be created from two lots.
The staff report was presented and the public hearing was opened.
Mike Masoodnia, Ace Civil Engineering, 2335 Honolulu, Montrose, the engineer for
the project stated that no new lots will be created. The proposed building will
be a one-story retail building. He commented that they are in agreement with all
of the conditions in the staff report.
Art D'Egidio, 1710 Bayon St, Pasadena, ex,lpained that there were no specific uses
as yet and that there could be 5 retail uses on the site each approximately 1000
sq. ft.
Joe Logsdon, 919 Rod~o. commented that he favored offices because they are
usually closed at 5:00 wher:eas stores could remain open to as late as midnight.
He stated that traffic on Foothill is very congested and a retail store would
only add to that problem.
William Dillon, 131 W. Forest, said that he has seen up to service station 20
cars parked on the service stat.ion and feared that a retail center would just add
to the parking and would force ,the patrons to park on the streets.
Charlene Peay, 28 W. Floral, felt there would be some problems with litter from
retail uses.
I n rebuttal, Mr. D 'Egidi 0 remarked that he didn I t know what type of a use wou1 d
go on the site.
Staff noted that parking for a retail center is 5 spaces for 1000 sq. ft., and
indicated that the applicant is not Obligated to lease to 5 different types of
uses. It waS mentioned that C~2 is a general commercial zone and there would not
be adequate parki ng for medical offices. Code wil 1 all ow a takeout eati ng

gone through architectural design review and parking and landscaping meet code.

Commissioner Papay noted that the owner can build on the lot without going
through this procedure for a lot line adjustment. He stated that the request is
for the lot line adjustment and not for the type of uses that might go there. He
said that if the request is granted, certain retail uses would require reivew and
approval by the Commission.
Commissioner Hedlund agreed with Commissioner Papay.
Mike Miller noted that anything that would need approval by the Commission would
require notice in the paper and public hearing with notices mailed to the
nei ghbors.
Commissioner Amato felt that Foothill Blvd. is already too congested and was
concerned with the amount of traffic.
Chairman Szany was concerned with the driveway leading to Floral Avenue.
Mr. Woolard explained the lot line adjustment and said that if a commercial lot
is immediately adjacent to residential there would be a requirement for a 6' wall
and as' 1 andscapi ng buffer but in thi s situation there is the street and the 5'
landscape puffer and the parking area which actualiy gives more of separation
than in other situations where residential uses are adjacent to C-2 zone. He
noted that the Commi ssion shoul d grant or deny the lot 1 i ne adjustment only and
not what uses may go on the site. .
MOTION

approve T.P.M. 88-6 subject to the conditions in the staff report.

Consideration of modifications for a
proposed two-stroy house.
The staff report was presented and the public hearing was opened.
George Wiegand, 1425 Melanie Lane, the applicant stated that the main issue
discussed at the Planning Commission's hearong on the Tract was the issue of
privacy for one neighbor and said that upon their request no windows would be
facing her yard and a 6' high wall be built.

Ben Kau, 1623 lee Avenue, commented that the proposed house i,s directly behind
his property and strongly objected to a 7' setback and said that he would lose
hi s privacy.
Linda and Jerry Johnson, 1625 lee Avenue, spoke against the, reque~ted
modification. They felt that the situatic)O is self imposed and the neighbors
should not have to pay for it. They tought that 7' setback was an invasion of
privacy. .
Marge Tudor, 1624 lee Avenue, spoke against the project.
Roger Johnson, 140 E. Camino Real, commented that there would be a loss of
privacy with new two~story homes.
In rebuttal, Mr. Wiegand said that the wall situation has been resolved.
Staff noted that in order to provide a 6' high walla modification wou,ld be
required becuase the wall on Mr. Kau's side would be 71/2'.
MOTION
It was moved by Commissioner Papay, seconded by Commissioner Clark to
close the public hearing. The motion passed by voice vote with none
dissenting. .
Commi ssioner Cl a rk commented that he vi sited the site and he was not in favor of
the 7' setback because it would be too close to Mr. Kau's house.
Chai nnan Szany noted that the subject lot is one of the largest lots in the cul-
de-sac.
Commis~ioner Papay said that the lots in the subject cul-de~sac are oddly shaped
and felt that the design should fit the lot and not use the modification
procedure to fit the lot to the desi gn. He didn '.t thi nk that a 7' setback was
acceptable. .
MOTION

Me 88-28 becuase it would not secure an 'appropr;ate improveme'n't and direcY
staff to prepare the appropriate resolution.

Rick Schrodes, Civiltec Engineering, 2610 California, Monrovia the, applicant. He
commented that the proposed lot split would be consistent with the General Plan
and the zoni ng ordinan<;eand note(j that they are in agreement with all of the
conditions in the staff report. They don't have the design for the house on lot
3.
Staff indicated that lots 1 and 2 would be facing Caroline Way and lot 3 would
face Live Oak.
John Butler, 2812 Holly, said that he recently purchased this property and was
concerned that he woul d lose the vi ew and hi s privacy by a two-story home on lot
3. He remarked that 10ts.I and 2 are goi ng to be very small and I'/as affraid th~t
it might affect property values.
Nathen Rei 1 ey, 2811 Holly" commented that his backya rd woul d abut the side yard
of lot 3 and remarked that he couldn't visualize how this would enhance the area.
He was concerned with the size of the homes that would be built on the new lots.
Joanne Wayne, 2817 Holly, was concern,ed about the loss of a big lot, who will buy
the houses and with the increased traffic. .
In rebuttal, Mr. Schrodes, said that the new house will comply with the new
regulations.

It was moved by Commissioner Clark, seconded by Commissioner Amato to close
the public hearing. The motion passed by voice vote with none
di ssent ing.
Chai nnan Szany commented that the square footage of lot 3 well exceeds the,
minimum requirement. He sympathized with the neighbors on Holly and said that
for years their back yard has been adjacent to another back yard and now if this
request is granted they would have a slde yard abutting their back yard. He said
that lot 3 would create problems for 3 neighbors on Holly.
Commissioner Clark wondered if the code is doing what it originally was set out
to do.
Commissioner Papayccmmented that lot 3 due to its orientation would create
prOblems for the 3 lots on Holly. He noted that if the applicant desired he
could build two very 1.arge homes on the two lots due to the size of the property.
He wondered if the side yard setback, could be increased to 10' in lieu of the 5'
Commissioner Amato agreed with Commissioner Papay.
Commissioner Hedlund commented that the Commiission does not have to approve the
request just because it complies if it cause hardship for the neighbors.
MOTION
It was moved by Commissioner Papay, seconded by ,Commissioner tlark to re~
open the public hearing.
Mr. Schrodes suggested cond.itioning lot 3 to only have single-story dwelling.
MOTION
It was moved by Commissioner Amato, seconded by Commissioner Papay to close
the public hearing.
Mike Mlller advised that the Commission can approve this request conditioning lot
3 to single-story dwel-ling and said-.that-the a'ppropriate documents would be drawn
up to ensure that condition.
Chairman Szany summarized the conditions and said that the height of the building
not to exceed 20' and the side yard setback on the west side to be a minimum of
10'-0" .

approve TPM 88-009 subject to the condition that a covenant and/or any other
agreement deemed necessary by the City Attorney shall be recorded for lot 3
restricting the dwelling on lot 3 to single-story and a maximum height of
20'-0". Also, a minimum 10'-0" westerly side yard setback shall be
maintained for all structures and buildings. Said ~ovenant shall be
recorded prior to or concurrent with the recordation of the final parcel
map. Said covenant shall be subject to the approval of the Planning
Department and City Attorney.

The staff report was presented the public hearing was opened.
Adrienne Gracia. 5419 Cochen, stated that they have plenty of parking and that
she is in agreement with all of the conditions in the staff report. She remarked
that there would be no more than 6 patrons at anyone time and hours of operation
on Saturdays would be from 8:00 a.m. to 12:00 p.m.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato to close
the public hearing. The motion passed by voice vote with none
dissenting.
Commissioner ,Clark approved of the proposed use.
Commissioner Papay was pleased that there would be a max.imum of 6 patrons and
that there is no parking problem.

PUBLIC HEARING MP 88-016
5935 S.Baldwin Ave.
Simon and Wendy Shum
Consideration of modifications for ,a
proposed 4-unit condominium project.
The staff report was presented the public hearing was opened.
Simon Shum, 31 E. Colorado, the designer of the project said that the proposal
would enhance the existing area. The reason for the requested modifications are
due to the narrow width of the lot. He commented that the a/c units would be
either underneath the stai rs ori n the attiC.
John Mudnich, asked how many units would they be able to build if they didn't ask
for any modification. 'He commented that he is not opposed to improving the area
but felt that there is too much bui 1 di ng and densHyfor the lot. He asked the
Commission to deny the request.
Chainnan Szany commented that they probably would only be able to build one unit
and explained that even if they were to build 2 units they would still require
all but one of the requested modifications.
Joe Alacantre, 49 W. Camino Real, was there to represent the Temple City Baptist
Church and said that there are too many modifications requested. He felt that
anything would be better than what is existing but thought 4-units are too much
for the property.
MOTION
It was moved by Cominissioner Amato, seconded by Commissioner Papay to close
the public hearing. The motion passed by' voice vote with none
diSsenti n9.
Staff commented that the parking lot to the south belongs to the church and they
need all the parking.
Commissioner Hedlund felt that it is too much density and suggested a ,duplex.
Chainnan Szany noted that the lot is deeper than most of the 50' wide lots in the
city. He commented that it is a tight design but fits very well.

Commiss,ioner Clark liked the project and said that it is a nice development.
Commissioner Papay said that if nothing is done the existing situation will
continue to get worse. He said that the property is zoned multiple-family and
the modifications are due to the narrow lot.

Consideration of a conditional use, permit
to operate an eating establi:shment with
seating for 33 patrons and a modification
request for parking.
The staff report was presented the public hearing was opened.
John .Karamaras, 9414 E. eami no Real, the appl i cant was present and said that they
are in agreement ,with aJ I of the conditions in the staff report. It would be sit
down and take out and they would, be serving sandwiches and no alcholic beverages
will be se rved,.
Rebecca Fortshnzider, 810 Naani, president of the homeowners association, said
that they have always had problems with the center. She commented that the
yogurt shop attracts many younger people who loiter in the parking lot after
closing and make a lot of noise, play loud music and speed in the parking lot
even after the speed. bumps were put in and this causes many prOblems for the
neighbors directly across the street. She asked that this request be denied.

Adra Richmond, 800 W. Naomi, al so spoke about the noi se and the confusi on in the
evenings. She said that they can never park on Naomi and it is extremely
difficult to go in and out of thei r driveways.

Staff noted that on several site inspections the maximum number of cars on Naomi
haven't exceeded 7. It may be more congested towa rds Hi nshaws but in this
vicinity by Vons there is always parkin'g on Naomi. The Planning Department
hasn't re<:eived any calls pertaining to parking problems and Golden West
Properties (owners) are also concerned with parking and try to control the
situation.
Commissioner Papay commented that the proposed shopi s the closest to the
residential properties on Naomi and his main concern was not whether there is
sufficient parking but that it would be difficult to get all the patrons to park
close to the shop. If they shop at Vons they probably would want to park closer
to the eating establishment rather than walk to it across the parking lot. The
part,icular spot is probably the worst spot for an eat.ing establishment becuase of
its proximity to the residential zone and an eating establishment that has take
out can lead to problems. He remarked that the on site parking is not focused
for the shops to the west side and was mainly against the location of the
proposed shop.
Chai nnan Szany said that he was at the center on Chri simas Eve (one of the
busiest times of the year) and he was ,able to find a parking spot without any
problems. He indicated that he never had a problem parking there and they shop
there quite often. He was concerned about the proposed shop being too close to
the residential areas on Naomi. He stated tha,t there might bea tendency to want
to park on the street for take out o,rders but wasn't sure if that woul d create a
problem. He said that an eating establishment is not the best use for the end
unit.
Commissioner Clark said that he has been there on weekends and had never noticed
any problems.
Mike Miller stated that the Commission should determine whether to approve or
disapprove the c.u.p.- and not what type of a use should go in the eriil 'unit.

MATTERS FROM COMMISSION
Commissioner Clark was concerned about develop.ing .lots and felt that there should
be some way of controli ng the impact on the neighborhood. He wondered if the lot
sizes could be enlarged.
,Mr. Woolard said that when a developer approaches the city to develop a lot, the
Planning Department tries to inform the developer as to potential problems with
developing the lot. The Planning Department has to advise both the neighbors and
the developer how to support or oppose a particular project. He suggested hav'ing
something in the Code in regard to reverse corner lots if there is a consensus
that they are not desirable. .
Commissioner Hedlund felt that it is important to have a provlslon in the code
against reverse corner lots. In regard to the units on Baldwin, he commented
that they are encouraging maximum density in the City and said he would prefer to
see less units than what the maximum allowed. He asked if developers could be
required to go through the c.u.p. procedure for cul~de-sacs.
Councilwoman Young said that the developers try to get as much a,s they can and
remarked that the developer should try and design a house that fits the lot. She
felt that the Commission should suggest the changes to the Council and Counci I
will discuss the changes.
Commissioner Papay spoke about the back, yard vs. the side yard situation on the
lot split on Caroline Way, He felt that there should be some type of buffer to
reduce the impact of the cul-de-sac on the homes surrounding the cul-de-sac where
there has been an increased number of homes. He wondered if the Commission
should suggest increasing R-l 7,500 to R~1 10,000. He thought that in
considering new subdivisions the Commission should keep in mind how the new .homes
will affect the surroundi ng neighbors.
Both Commissioners Hedlund and Papay sympathized with the neighbors whom the side
yards of the new lots woul d abut thei r back yard.
Mr. Woolard explained the de,finition for rear lot line. It makes it difficult to
develop lots as proposed. He commented that the project on Baldwin would need
modifications even if there were only 2 units pl"oposed due to the 50' wide lot.
He remarked that if the Commission is concerned with density then they should
suggest i ncreasl.ng the density -requi rement to CounCi I, ratnerthan trying'to'
limit density through the modificat.ion procedure.
Commissioner Amato discussed the project on Baldwin and was in favor of
increasing the lot sizes in the R-l zone.
Chairman Szany felt that the project on Baldwin had excellent design and complied
with the new density requirements. He 'indicated that the City of Monrovia has
several residential zones and will not allow condominiums to have less than 5
uni ts.

Staff said that they always try to convey Commission's feelings to the
developers. Staff will try to outline the concerns expressed by the Commission,
for discussion at the June 14th meeting. The Commission's concerns would then be
forwarded to the City Council.
