M I K UTE S ARCADIA CITY PLAKKING COMMISSION REGULAR MEETING Tuesday, April 26, 1988 The Planning Commission of the City of Arcadia met in regular session on Tuesday, April 26, 1988 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chainnan Dave Szany presiding. The motion passed by voi ce vote with none dissent i ng. MINUTES MOTION It was moved ~y Commissioner Amato, seconded by Commissioner Clark to approve the Minutes of March 22, 1988 as published. The City Attorney announced that the City Charter requi res that for any action to be adopted or approved a majority of the entire membership must vote in favor of the particular motion. If the required three votes are not obtained the motion wou1 d fail. If the required three votes are not obtai ned (1) an app1 i cant may request continuance and it is up to the Commission to decide whether or not they want to grant it; (2) the matter could be heard and then deferred for final deci s i on pendi ng part i ci pat ion of the absent members as long as they revi ew the records of this proceeding which would be made available to them or (3) the matter could simply go forward to the City Council. -------------~------------------------ PUBLIC HEARING MC 88-014 1619 Oakhaveri Dr. Darwi n Duncan Consideration of an appeal of Modification Commi ttee' s approval of an attached pati 0 structure with a 10 '_0" rear setback to the support posts, and overhangs to maintain a 5'-0" clearance from the rear property line. The staff report was presented and the public hearing was opened. Wallace Qua, 1605 Hyland, the appellant felt that the building is out of character with the neighborhood. He commented that everyone in the immed.iate area is against the structure and questioned the value of the building code if this was granted. He indicated that the extension of the main buildin9 takes all the backyard and was done without a pennit and cOfl1mented that work was conti nued on the structure even after Mr. Duncan was cited by Code Enfonncement for construction of the patio cover without a building pennit. He stated that he and his neighbors are strongly in favor of maintaining the area as is and commented that the project cannot be accepted as it stands. Darwin Duncan, 1619 Oakhaven Drive, the applicant explained the requested modi fications. MOTION - It was moved by Commissioner Papay, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none di ssenting. In answer to the Commission's questions, Mr. Woolard indi,cated that the photos shown are as the structure was origina1:1y constructed and is not what the Modification Committee has approved. The Modification Committee approved the structure subject to the condition that the structure shall not interfere with theaccessibil ity of the Sanitary Sewer Easement and that any such exi sting interference shall be remedied at the property owner's expense. He remarked that if the structure was not attached to the main building it could come within 3' of the property line. Arcadia City Planning Commission 4/26/88 Page 2 . . Commissioner Clark recalled the Modification Committee meeting and commented that there were no objections to the request and said that the Committee felt that it would be an appropriate improvement. Commis.sioner Papay wondered how the structure would affect Mr. Qua if it was moved back 3'. Commissioner Amato said that if it was moved back 3' then it probably would not be as garrish. Chainnan Szany suggested placing the posts and the overhang 10' and 7', respect i vely. from the property li ne. The Commission favored Chainnan Szany's suggestion. MOTION It was moved by Commi ssioner Papay, seconded by Commissioner Amato to deny the appeal and approve the modification for the structure to have a 10'-0" rear setback to the support posts, and overhangs to maintain a 7'-0" clearance from the rear property line. Ghainnan Szany abstained from this item since he is the architect of the prjoect. PUBLIC HEARING MP B8-009 123 Dimaond St. Dave Szany & Assoc. Consideration of modifications for a 3-unit apartment building. The staff report was presented and the public hearing was opened. Ed Potter, 314 N, First Avenue was present to answer any questions, and commented that they are in agreement with all of the conditions in the staff report. MOTION It was moved by Commissioner Amato, seconded by Commissioner Clark to close the public heari ng. The motion passed by voice vote with none dissenting. ROLL CALL: AYES: NOES: A8SENT: ABSTAI N: Commissioners Amato, Clark, Papay None Commissioner Hedlund Chairman Szany There is a fi ve wo rki ng day appeal peri od. --.---.------------------------------- PUBLIC HEARING MP 88-010 525 Campesina Road Ronal d Staebler Consideration of an appeal of the Rancho Santa Anita Architectural Review Board's approval of a 4.600 square foot, two-story residence and three car garage. The staff report was presented and the. public hearing was opened. Ron Staebler,532 Call)pesina, the appellant stated that all the residents on both sides of the street feel that the proposed house is incompatible with the neighborhood. Bill Spuck, 531 Campesina, was there to represent a group of the .residents who are against the proposed house. He said that the residents are concerned that the proposed house is not compatible and in harmony with the immediate area. He remarked that the purpose of the resolution is to protect the architecture of the area and for buildings to be in harmony and compatible with each other. The proposed house is very large and will be deterimental to the other neighbors and is twice as large as the largest house on the street. The walls of the house woul d make the house look much larger and -noted tnat no other house in the area has a 3-car garage. He commented that 50%. of the first floor is the garage and 50% of the front yard would be paved. He asked the Commission that if the house is approved that the size be limited to not exceed 10% of the area of the biggest house on the street; the garage and the structure to be consistent with the other houses on the street; the front elevation be redesigned to look like a one-story dwelling; no more than 1/3 of the frpnt yard be paved; the front yard setback be the average of the two houses to either side and for the ARB to review the landscape pl ans and there be. a requi rement that trees be pl anted in the front yard. Arcadia City Planning Commissi.on 4/26/88 Page 4 . . Edith Post, commented that the proposed house will block her view of the mountains. She felt that the proposed house will set a precedent. Ed Zarreh, 1051 Catalpa, spoke against the proposed house. He said that when he first moved in the area he was told by the ARB that the house that he wanted to build had to be at least 1400 sq. ft. and was suprised that the proposed house would be 4600 sq. ft. Kai Chen, 730 Evelyn Or., San Gabriel, the architect was present. He submitted a model of the house to the Commission and commented that the ARB unanimously approved the proposed house and said that they cOOlply with the new regulations. He commented that they w~ll maintain a IS" side yard setback and noted that their total lot coverage is 25% and remarked that code allows a maximum of 45% lot coverage,. The new house w.ill replace an old unattractive building, improve the area and increase property values. Chen Chen, 1140 Singingwood, cOOlmented that 8 persons who signed the petition were present at the ARB's meeting and none of them spoke in opposition or showed any objection to the proposed house. He concurred with Mr. Chen and said that the new house will improve property values and will improve the area. Oavid Robi nson, 144 Alta, spoke on bahalf of the applicant. He stated that the proposed house has been approved by the ARB and commented that at the ARB's meettng rone of the neighbors spoke against the proposal. He said that the architect chose to comply with the new regulations which are much more restrictive than what the present code allows and said that the proposal will have 25% lot coverage in lieu of the maximum of 45% allowed by code. He cOOlmented that the neighbors would like to see a ranch style house which doesn't reflect the owner's taste and asked the Commission to deny the appeal. Bill Wyman, 507 Monte Vista, Chainnan of the ARB stated that their only concern at the time of thei r meeti ng was that the proposed house woul d be a two-story herne. He noted that with the exception of a small area in the living room the project complies with the new code. Jim Rostron, 422 Monte Vista, ARB member agreed with Mr. Wyman and said that the propose!! house complies with the new code. Even .though the house may not be compatible with the houses in the immediate area, it is compatible and hannonious with the Lower Rancho. area. Vern Leeper, 518 N. Altura, an ARB member, said that his property touches the subject property. He commented that at the heari ng the drawi ngs were incomplete but he felt that if the material was compatible with the area he would be in favor of the house. He stated that he voted for the project because the owner w.ill reside on the property; the house meets code; arch.itectura.l style and material are compatible with the Lower Rancho area and there is no prohibition for two-story homes in the area. He remarked that there was no major objection to the project at the meeting. Mike Flaaten, the realtor representing the seller and the buyer, stated that he also attended the ARB's meeting and there was no objection to the proposed house. Steven Wu, 143 Alta, son of the owner canmented that he encouraged his parents to move to Arcadia because of all that Arcadia has to offer. They have spent a lot of time and money to comply with the new regulations and asked the Planning Canmission to deny the appeal. Valerie Simola, 526 Campesina, asked if the la'rger tree on the lot would be remvoed. In rebuttal, Mr. Spuck, said that they don't object to the two-story house but they woul d prefer a low profile home. He reiterated that the house woul d be neither canpatible nor harmonious. Mr. Chen, the architect, canmented that they will reduce the height of the living room from 14' to 12', to fully comply with code. MOTION It was moved by Commissioner Amato, seconded by Commissioner Clark to close the public hearing. Th'e motion passed by voice vote with none dissenting. Commissioner Clark commented that the structure wi 11 comply with the new regulat ions, since Mr. Chen has offered to reduce the hei ght of the 11 vi ng room. He said that it is a very attractive house. COmmissioner Amato agreed with Commissioner Clark. Commi,ssioner Papay felt that the ARB should approve the design of the house and not the Planning Commission. Chairman Szany commented that if the height of the living roOl1! was reduced it would help soften the front elevation. He was pleased that the house will be able to maintain the IS' setback. PUBLIC HEARING MP 88-011 Southwest corner of Second Avenue and Co 1 orado Boul eva rd Superior Electrical Advertisi ng Consideration of a modification for a projecting sign for the proposed mini- storage facil Hy. The M-l zone does not pennit projecting signs. The staff report was presented. Staff commented that there doesn't seem to be any projecting signs in the City over 27' hig~. The pub 1 i c hea ri ng wa s opened. Michael Gray, Superior Electrical Advertising, 1700 W. Anaheim, Long Beach, was present. He said th<!t they had no problems reducing the s.ize of the sign to 25'. He asked if they coul d rai se the wall 8' and, pl ace the sign on the wa.ll. He said that their's is a unique situation and they have no visibility. Frank Rashal, 391 Euchrist Dr., objected to the sign and said that he owns property there and his tenants have complained to him about the ingress and egress since they all use the alley and remarked that the signs would probably be visible from the units.. Mr. Woolard commented that all the signs with the exception of the projecting sign meet code and if the sign was put on the buil ding it woul d then comply with code. In rebuttal, Mr. Gray said that the sign will face the freeway and if they are allowed to increase the height of the wall by 8'the sign will be visible. The only direction that any advertising will be facing will be the freeway and the back of the sign will not be visible to any direction. He said that they would 1 ike to put the sign on the southerly wall of the two-story buil ding and if it could be ra,ts,e.cl an(j mO,,!nted on the north side 'of that wall faci ng the freeway which would give them adequate Visibility. . Mr. Woolard felt that that would be very unattractive and the Planning Department would not like that type of a sign. MOTION It was moved by Commissioner Papay. seconded by Commissioner Amato to close the pUblic hearing. The motion passed by voice vote with none dissenting. He remarked that he would be in favor of the sign if it was built on the back part of the building faci ng the freeway. Commissioner Clark agreed arid said that the sign should be on the wall and not on the roof. Duarte Road Mobil Oil Corp. Consideration of a conditional use pennit to construct a new service station with three service bays. The staff report was presented the public hearing was opened. Dave Wattson., 1815 Pepper Tree Court, thousand Oaks, was thereto represent Mobil Oi L He commented that they wi 11 rebui 1 d the existi ng stat ion. The new stat ion will be able to facilitate 12 cars at anyone time. Service bays would be to the side, the snack shop would be computerized and the overall atmosphere will be a very pleasant environment. He felt that the changes would bea major improvment to what is presently there anct indicated that they are in agreement with an of the conditions in the staff report. Toni Gabarian, the dealer of the station, said that he is looking forward to a more modern station. Main, #205, Alhambra, the architeCt of the project was present and said that they are in agreement wHh all of the conditions in the staff report. The staff report was presented and the public hearing was opened. larry Chalk, Cornwall Assoc., 13431 Borden, Silmar, the architect of the project, said that the colors of the building will match the existing building. The building will be used for offices and noted that they are in agreement with all of the conditions in the staff report. Glen Merkly, 715 E. Wifln1.e Way, the church official stated that the building will improve the area and the lot to the west. Commissioner Amato felt that the request was not unreasonable and that it is a good project. PUBLIC HEARING MP 88-012 32~-333 Genoa St. Miner & Jasniy Ent., Inc. Consideration of modifications for a proposed II-unit residential condominium project. Arcadia City Planning Commission 4/26/88 Page 11 . . The staff report was presented. Staff explained the modification for the. density and said that there is a provision in the code which states "when the maximum number of units permitted in the R-2 and R-3 zones has a fractional 'remainder greater than one half, the Modification Committee may allow the maximum number of units to be rounded off to the next highest whole number". The public hearing was opened. Robe rt Miner and Vi ctor Jasniy, 3670 Lombardy, Pasadena, 1975 Lorrai na, Si erra Madre, the buil del's were present. They noted that the lots are very deep and submitted photos of the existing houses and remarked that no one takes care of the yards. They explained that the project will give more open space and private yards that exceed the 300' requi red by code. They agree with the conditions in the staff report. Jim Younessi, 718 San Luis Rey Rd., spoke in favor of the project. He said that as a realtor he has sol d some of thei-r properti es and commented that they are good developers. Wilber Wood, 323 Genoa, asked if there would be adequate parking spaces on the lot. He felt that 10 units are much better than the 11 units as proposed and thought that they ,should not be allowed to round up the density to the next higher number. Staff explained that the parking does meet code. Chai Mnan Siany said that the parki ng does meet code and there is parki ng for all of the eleven units. Mrs. Wood, 323 Genoa, sp.oke against a two-story structure and said that they will now have two-story dwelli,ngs on either side. MOTION It was moved by Commissioner Papay, seconded by Commissioner Amato to close the public hearing. The mot.ion passed by voice vote with none di ssent-ingi Commissioner Amato remarked that the project meets code. Chairman Szany liked the size of the dwellings. Commissioner Clark commented that it is an attractive development. MOTION It was moved by Commissioner Papay, seconded by Commissioner Amato to approve MP 88-13 subject to the conditions in the staff report with the additional condition that additional architectural treatment shall be provided to enhance the building's rear elevation, subject to the review and approval of thePlanhing Department. Third Ave. Lyle and Karen Schmidt - - .Considerationof a modification to allow a guest house to be attached to another accessory building. Arcadia City Planning Commission 4/26/88 Page 14 . . The staff report was presented and the public hearing was opened. Lyle Schmidt, 2300 S. Third, explained the reasons for his request and said that they would like to expand and enlarge their kitchen area in the house. The room attached to the garage would be. a recreation roan and there is a possibiltity that his mother-in-law might stay with them. MOTION It was moved by Commissioner Clark, seconded by Commissioner Papay to close the public hearing. The motion passed by voice vote with none dissen'ting. Commissioner Clark commented that he drove by that area and it didn't seem to be a probl em and he was in favor of it. Commissioner Papay commented that the square footage is well below the maximum allowed by code. Chainnan Szany was in favor 'of the request. Councilwoman Young asked staff to define "guest house". Staff explained that the intent was that a guest house may be utilized by any members of the family or any persons employed by the family o,r may be used by guest for not more than 30 days during the calendar year. MOTION It was moved by Commissioner Clark, seconded by Commi ssioner Papay to approve MP 88-15 subject to the conditions in the staff report. Staff indicated that due to incorrect labels provided by the applicant the public hearfng should be continued to the Commissfon's next meeting of May 10, 1988. MOTION It was moved by Commissioner Papay, seconded by Commissioner Clark to cotinue the public hearing to May 10, 1988 meeting. The motion passed by voice vote with none dissenting. Lot 1 wi 11 be 60,849 sq. ft. and Lot 2 wfl I be 60,851 sq. ft. The staff report was presented and the pub 1 i c heari ng was opened. Al Derenzee, L & 0 Engineering, 106 W. Lime, Monrovia, the engineer was present and stated that they are in agreement with all of the conditions in the staff report. MOTION It was .moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. The consensus of the Commission was favorable. MOTION It was moved by Commissioner' Clark, seconded by Commissioner Amato to approve TPM 88-7 subject to the conditions in the staff report. PUBLIC HEARING CUP 88-008 42 W. Live Oak Ave. William Skibsted Consideration of a conditional use permit for the expansion of the existing auto body garage. The staff report was presented and the public hearing was opened. William Skibsted, 42 W. Live Oak, commented that he is in agreement with all of the conditions in the staff report. MOTION It was moved bY Commissioner Clark, seconded by Commiss.ioner Papay to close the public hearing. The motion passed by voice vote with none. di ssent i ng. Staff indicated that a 6' high wall would be requi red for the storage of the cars. MOTI ON It was moved by Commissioner Papay, seconded by Commissioner Clark to approve CUP 88-8 subject to the conditions in the staff report with the additional condition that the wall along the westerly property line (Welland Avenue) shall be a solid 6'-0" high decorative masonry wall .except when adjacent to a driveway open wrought iron fence shall be used. He said that the variance would be for two properties and he would have to pay a fee of $230 for each property and felt that that is a substantial amount. He asked that someone from the Planning Department inspect the site prior to the submission of any application for a building code variance. Mr. Miller indicated that the Planning Coml1lissi.on cannot address Mr. Jossi's question and suggested for him to meet with Mr. Woolard. Mcadi a. City Planning Commission 4/26/88 Page 17 . . Chairman Szany informed Mr. Jossi that he should contact the Planning Department. Mr. Woolard recOOlmended that Mr. Joss; come to the Planning Department during business hours. Commissioner Papay suggested draw;ng up a plan. Ms. Butler stated that the Building Department has visited the site and noted that Mr. Jossi was informed that the only solution to his problem would be a Building Code variance. She indicated that Mr. Joss; would like to put a roof structure to the property line and remarked that Building Department rquires a minimum of 30" d;stance from the property line as well as the zoning code which requi res a mi nimum of 3' and 5' on the side. Even though he owns the two adjoining lots he cannot build to the property line because they are separate lots. Planning Commission discussion on size of corner lots ;n residential subdivisions. Staff read and expl a i nedthe staff report wh ich woul d requi.re the fo j 1 owi ng changes to the A.M.C.: 1. In order to better accommodate the speci al setbacks throughout the City and to create more buildable lots, that the minimum lot width on corner lots in the R-1zone should be increased to 85'-0". 2. Section 9113.6 relating to modifications on tentat,;ve maps which requires approval by the City Council be changed to provide for approval by the Plaj1ning Commission. This change would provide consistency in the processing of applications which are acted on by the Planning Commission. 3. The State Subdivision Map Act allows a maximum time extension of 12 months for Tentative Maps and Section 9115.12 of the A.M.C. .allows an extension period of 24 months. The A.M.C. should be changed to be consistent with the Subdivision Map Act. RESOLUTION 1364 A resolution granting MP 88~008, approving an appeal of the Rancho Santa Anita Architectural Review Board's denial of a wrought iron fence in the front and street side yards, and a modification to allow the subject fence to be 6'-0" high in lieu of 4'-0" in height at 1435 N. Baldwin Avenue. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to adopt Resolution 1364 and to formally affirm the decision of March 22, 1988, reflecting the findi ngs of the Commission and the votes thereon. He felt that HOAs should try staggered terms. - The consensus of the Commission was that the applicants were very well prepared.
