Tuesday, March 8, 1988
The Plilnning Commi.ssion of the City of Arcadia met in regular session on Tuesday,
March 8, 1988 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240
West Huntington Drive, with Chainnan Dave Szany presiding.

MOTION
It was moved by Commissioner Clark, seconded by Commissioner Hedlund to
approve the Minutes of February 23, 1988 as published. The motion passed by
voice vote with none dissenting.

Chairman Szany noted that item no. 6 would be continued and said that the' public
hearing would be opened for any person who wishes to speak on that item.
The Ci ty Attorney announced that because there were o'n1y three members of the
Commi ssion. in attendance that the City Charter requi res that for any act ion to be
adopted or approved a majori ty of th'e ent i re membershi p must vote in favor of
that particular motion. For the Planning Commission this would mean three votes.
If the required three votes are not obtained the motion would fail. In view of
that the possibilities are that (1) an appiicant may request continuance and it
is up to the Commission to decide whethe'r or not they want to grant it; (2) the
matter could be heard and then deferred for final decision p,ending participation
of the absent members as long as they revi ew the records of thi s proceeding which
would be made available to them or (3) the matter could simply go forward to the
City Council.

Consideration of a conditional use permit
to operate a church.
The staff report was presented
In answer to C,ommission's questions, staff said that parki ng space #8 does comply
with Code and that there is adequate back out space. Staff fel~ that by using a
grasscrete.type of paving and by eliminating one space the tree can be saved.
The public hearing was opened.
John Maynard, 639 Marianne Lane, Monrovia. He commented that they have spent a
great deal of time and money upgrading the site. He asked that the Commission
a 11 ow the use of the sanctua ry after the buil di ng and safety issues have been
taken care of. He mentioned that he didn't think that parking would be a problem
and explained that he has spoken to Lincoln Savings, The Pantry and Alpha Beta
(all are withi n walking di stance ) and has asked them if they coul d utilize thei I'
parki ng and none of them objected to the proposal.
Commissioner Hedlund commented that it will be very difficult to determine the
hazardous conditions.
Staff felt that all major safety problems should be corrected in the sancturay
before occupyi ng the buildi ng. The Bui 1 di ng and Fi re Departments shoul d inspect
the sanctuary and. deem it to be safe prior to occupation. Staff recommended
setting a time limit for the applicant to complete all other conditions.

John Maynard, Pomona, the contractor was present. He felt that all work,
including the Public Work improvements, sidewalks and driveways can be completed
within 6 months. He said that all work will be completed before the demolition
of the pa rso nage.
MOTION
It was moved by Commissioner Hedlund, .seconded by Commissioner Clark to
close the public hearing. The motion passed by voice vote with none
di ssent i ng.
Staff felt that a one year limit is acceptable to complete all conditions.
Chairman Szany was concerned about parking but since Mr. Maynard has talked with
the Pantry in regard to using their parking he was in favor of the proposal.
Commissioner Clark said that .it is a signif,icant upgrade from what was originally
proposed.
MOTION
It was moved by Commissioner Hedlund, seconded by Commissioner Clark to
approve C.U.P. 88-005 subject to the conditions in the staff report with the
additional condition that the sanctuary may be used when all bui'lding code
defi ci enci es are compl eted to the sat is fact ion of the Bu,il di ng Department
and fire safety is provided to the satisfaction of the Fire Oepartment. All
other improvements with the exception of the construction of the parsonage
must be completed within one year after adoption of' the resolution.

Consideration of ~n appeal of the
Modification Committee's denial to allow
a ~uest house io contain more than 600 sq.
ft. and to be attached to another accessory
building.
The staff report was presented.
Staff expl ai ned that the buil di ng was red tagged by a buil ding inspector who
happened to notice t~e construction taking place. He commented that prior to the
Modification Committee's meeting staff inspected the site and saw that the .frame
work had been done. Staff inspected the building again on March 2, and noticed
that it was dry waned and was intended to be used as a bedroom.

Philys Dale, mother of the applicant was present. She explained that her son is
in the furniture movlng business and is out of town most of the time. She said
that the guest house is for her mother, who wi n be stayi ng with her son. She
concurred with staff and explained the reason the structure was dry wa1,led was
because. her mother needed a place to .stay. They would take the dry wall down if
the Commission denied the appeal. She explained that the guest house has one
bedroom and a living room and would not have a kitchen. The enclosure of the
breeze way which already has. a roof and floor is logical and would have natural
flow. She commented that her son was unaware of the inconvenience that he was
causing his neighbors and ever since he'sbeen aware of his neighbor's feelings
no trucks have been parked in the area. She mentioned that he has rented space
in El Monte '(Ihere the trucks are bei ng parked. She.i ndicated that based upon all
the letters that they have received from the neighbors'., none of-them ,were opposed
to the guest house but all are concerned with the trucking business.
Douglas Turner, 215 W. Lemon, spoke against the proposal. He submitted a letter
and some photographs to the Commission and commented that he was concerned about
the trucks being parked there again, after the approval of the modification. He
said that si~ce the Modification Committee meeting, no trucks have been parked
there with the exception of one that was parked for a very short period of time.
He asked the Commission that if the application is approved, there be a condition
prohibiting the vans.

Cliff Moore, 240 W. Lemon, was against the modification. He was very unhappy
with the truck situation and said that on several occasions the trucks were
parked in front of his driveway making it hard for ingress and egress. He said
that the trucks have been repaired and fue,led on the street. Even though the
change has been positive. the trucks are very annoying and are inconvenient.
Byron Dickson, '225 W. Lemon, was present. He asked when does a guest house
become a secondary dwell i ng and wondered what ki nd of recourse the ne.i ghbors
would have if after approval trucks return to the site.
Staff explained the guest house ordinance and said that in the Code the guest
house is defined as follows: "The accessory living quarters, guest houses are
living quarters within accessory building for the sole use of members of the
family occupying the main building, persons employed by or rendering services
exclusively to the family occupying the main building and rendering such services
primarily on the property and/or the temporary use by guests of the family
occupying the main building." The above definition would include family members.
Mike Miller commented that if trucks return to the area, it would constitute a
violation of the zoning code, after the City is informed of the violation, the
City woul d attempt to verify that thorugh an independent investigation and would
warn them to stop the violation. There would be enforcement and judicial
remedies for that problem once the City is notified.
In rebuttal, Ms. Oale apologized for her son's actions and assured the Commission
that no more trucks would come to the house. She further stated that the guest
house would be an asset and not deterimental to the area.

It was moved by Commissioner Hedlund, seconded by Commissioner Clark to

dissenting.
Mr. Woolard stated that permits cannot be issued until they comply with the
zoning regulations. He noted that 600 sq. ft. provides enough area for a one-
bedroom/one-bath structure.
Commissioner Hedlund felt that it is a nice improvement and the use is within the
intent of the orainance.
Commissjoner Amato was concerned that it might set a precedent.
Chai rman Szany said that it seems natural to fill in the area.
Commissioner Clark was bothered with the fact that construction was continued
after the denial and the truck situation. He thought it is a nice improvement
and looks good and would be an appropriate improvement.

Consideration of modifications for a
2-unit condominium project.
The staff report was presented.
Staff remarked that the guest parking size is adequate. The master bedrooms on
the second f1 001' have bay windows.
Chai rman Szany commented that theoretically the appl icant coul d have proposed a
3-un.i t project.
The public hearing was opened.
Aldo Liou, 24 El Dorado, the designer of the project, stated that the owner will
occupy one of the units and noted that each unit will have 4 bedrooms. The first
unit will have a 3-car garage.
Rita Dupree, 146 Genoa, spoke aginst the development. She objected to the
setback modifications and said that if the Commission approved it as proposed,
the bu.ilding would be much too close to the three units on her property. She
thought that the 4-bedrooms indicated that many people would be living there and
:there might be a pal'king problem _sjnce the parking is for 2 units and explained
that even though there would be only 2 Uliits 4':bedrooms each, a tot-al ofB
bedrooms, it is the same as 4-units with 2-bedrooms each.
Chairman Szany asked if she woul d be in favor of the project if it was reversed
on the lot.
Ms. Dupree commented that it would be more desirable.
In rebuttal, Mr. Liou stated that they didn't want to reverse the building
because the bedrooms would face west and noted that the parking meets code.

Wei Un, 3137 Concord, Alhambra, the owner ,sa i d that hei ntends to occupy one
unit and infonned the Commission that the first unit has a 3-car garage and the
project has .sufficient parking.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato to close
the public hearing. The motion passed by voice vote with none
di ssent i ng.
Chainnan Szany commented that t~e project provides additional off-street parki ng
whereas 01 del' developments don't. He commented that the parki ng i,s more than
adequate and asked what the setback was on Ms. Oupree's property.
Commissioner Hedlund co~mented that 4-bedrooms indicate that there will be more
cars and was concerned with the parki ng ratio.
Mr. Woo'lard noted that there is more parking required in the multiple-family
zones than in a residential zone.
Staff remarked that Ms. Dupree's building was probably built to the old standard
of 5' for the first and second fl oors. Staff noted that 1 and scapi ng and trees
which could be adde<! adjacent to the garages and this would help mitigate the
proximity to the property line.
Commissioner Amato didn't think that 5' would make much of a difference and liked
the project but preferred to reverse it.

approve MP 88-005 subject to the conditions in the staff report with the
addit,ional condition that landscaping and/or trees be added subject to the
approval of the Planni ng Department.

The staff report was presented and the public hearing was opened.
Ming Nang Chen, 600 W. Main St., Alhambra, the architect was present. He
commented that there are 5 existing units on the site and said that per Code they
can build up to 10 units. They have read the conditions and are in agreement
wi th them.
Rose MinaIi, 1019 Fairview, was present. She said that she has spoken to the
property owner at 1017 Fairview and they are both in favor of the project which
woul d improve the area.

Staff explained that the project is a condominium type housing but resembles
single-family dwellings.
