NG Tuesday, February 9, 1988 The PlannIng Commission of the 'City of Arcadia met in regular session on Tuesday, February 9, 1988 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Dave Szany presiding. PLEDGE Of AlLEGIANCE ROLL CAlL PRESENT.: Commissioners Amato, Hedlund, Clark, Papay, Szany ABSENT: None MINUTES MOTION It was moved by Commissioner ,Clark, seconded by Commissioner Papay to approve the Minutes of January 26, 19B8 as published. The motion passed by voice vote with none dissenting. MOTION It was moved by ~ommissioner Papay, seconded by Commissioner Clark to read all resolutions by title only and waive reading the full body of the resolution. CONTI NUED PUBLIC HEAR! NG C.U.P. 87-23 758 W. Anoaki. Lane Anoakia School Consideration of a conditional use permit for the expansion of school enrollment to 400 students (Anoaki a School). The staff report was presented and the public hearing was opened. David Pinkerton, 701 W. foothill Blvd., representing the applicant, read a letter from the owner of the property, whith in part stated that the time limits set forth in the staff report would not be sufficient to comply with the 26 conditions and asked for addi tional . Commissioner Amato commented that he would be in favor of ,granting a 60-day time limit to comply with Code. Commissioner Papay commented that the pool should be fenced off. Mr. Miller, the City Attorney, said that some of the conditions set in the staff rep!lrt are to bring the property to comply with present Code. Since the ,bu'ildings are seismically hazardous, he didn't think that the Commission should grant additional time liinit. In his opinion, the applicant should comply with the time limit set be staff. Mr. Wool ard remarked that the Ci ty is concern with the bui I di ngs that are unrei nforced and with the fact that there is nothi ng in place to keep peopl e away from the vacant stl'uctu,res. These unrei nforced masonry buil di ngs are presumed to be unsafe based on the date of construction and type of materials that were used. These buildings don't meet the standards set by the City of Los Angeles, Chapter 88 of their building code standards for seismically sare structures whic;h is also the same standards that the State has put out as a mOc:lel ordi nace fOr cities like Arcadia to adopt and apply to all similar type unreinforced masonry buildings. He suggested an alternative to the pond area and said that the area could be fenced off. He said that the pergola could be dangerous and should be repaired as soon as possible. He said that the hazal'dous situation should be taken care ,especi alJy wi_th the number:.. of children that are there. He remarked that fenci ng off the hazardous areas would be a quick remedy to the problem. Mr, Pinkerton said that the pond will be drained and it is off to the side of the property and away from the children, it is approximately 100 yards away from the nursery. In regard to the number of cars parked on the di.rt road, he indicated that approximately 10-15 cars are parked there during the day and about 125 cars bring kids to the school and then return to pick them up after school. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the publ ic heari ng. The motion passed by voice vote with none dissenti ng. Chairman Szany felt that the dates suggested by staff 'should remain, however, the applicant should have the option of fencing the area. Commissioner Papay didn't think that additional time should be granted because of the safety reasons. He said that it would be a good idea to give the applicant the opt; on to either fence off the area or demo 1 i sh the bui 1 di ngs. He was concerned about the parking and the dust that might be created by parking on the unpaved areas for neighbors to the west. MOTION It was moved by Commissioner Papay, seconded by Commissioner Amato to approved C.U,P. 87-23 subject to, the conditions in the staff report with the fo.llowfng modifications: Insert "or repaired or fenced off" after the word "demolished" in conditions 19, and insert "or repaired or fenced off" after the word "demolished" in condition 20 and also adopt Resolut'ion 1360 accordingly and to formally affirm the decisions of february9, reflecting the findings of the Commission and the votes thereon. PUBLIC HEARING MP-88-002 113-115 Diamond St. OWen Development Co. Consideration of modifications for a proposed 3-uni tapartment 'bui 1 di ng. . The staff repqrt was presented and the pu~Uc hearing was opened. frank, Macciola, 2728 Caroline Way, the owner was present. He said that the new buildings will improve the site and remarked that he agrees with the conditions set in the staff report. MOTION It, was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none di ssent i ng. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve MP-88-002 subject to the conditions in the staff report. Barton Payne Consideration of a conditional use pennit for an eating establishment with seating for 12 people. The staff report was presented Mr. Woolard explained the parking requirements for an eating estabhshment versus a retail center. He didn't anticipate any problems with the parki ng with only one eating establishment in the center ,but there is a cumulative effect if there is to be more o,f these type of estab Ii shments there woul d be a need for a traffi c study. Commissioner Amato was concerned with the flow of traffic and par.king. The public heari ng was opened. G. Barton Payne" 1020 Si ngi ngwood, the appl i cant was present. He expl a i ned that this would be a yogurt shop and remarked that he is in agreement with all the conditi,ons set in the staff report. In his opinion, he didn't think that the business would have an impact on the traffic. He commented that th~ Commission should keep in mind that this application is for the yogurt shop only and not for any other s-iinilar type busfnesses-tliat may reqtiire modificatlon' on the number' of parki ng spaces. He stated that he is in agreement with the conditions in the staff report. Ron Rossiter, 962 Paloma, the owner of the property said that he has had many business inquiri ng about leasi ng space in the subject site. One convenience store that would sell beer and wine signed an agreement but had to go before the ABC for approva I of the sa I e of I iquor at whi ch the time the school board opposed to its application due to its proximity to the high school. He said that he didn't want a large tenant turn over and wanted the right mix of business at the Arcadi a City Planni ng Commi ssion 2/9/88 Page 4 i . . site. He remarked that he anticipated leasing to 2-3 eating stablishments with incidental seating and said that he has signed an agreement with a I-hour photo busi ness. .He i ndi cated that they are in the process, of doi ng a traffi c study. MOTION It was moved by Commissioner Papay, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none di ssent i ng. Commissioner Clark commented that he has no problem with the proposal but was concerned about traffic if addi~ional eatjng establishments are to be going there. Commiss,ioner Papay was concerned about the parking and said that it is an ideal location for an eating establishment but the center has a potential for parking problem. Commissioner Amato felt that only one eating establishment should be at the site due to the number of parki ng spaces. MOTION It was moved by Commissioner Papay, seconded by Commissioner Clark to approve C.U.P. 88-004 subject to the conditions in the staff report. AUDIENCE PARTICIPATION Herb Fletcher, 175 W. Lemon. He remarked that with all the new homes that are bei ng constructed in the Ci ty, it seems that the garage and dri veways are ri ght off the street. He refommended that maybe theConfmfsston should discuss the possib~lity of adopting an ord,nance which wo~ld regulate garages facing the streets.
