MINUTES ARCADIA CITY PlANNING COMMISSION REGUlAR MEETING Tuesday, December 12, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, December 12, 1.989 at 7:30 p.m. in the .Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. It. detached garage. PUBLIC HEARING MC-89-096 1026 Singing Wood Dr. Phil & Mary Catania The staff report was presented and the public hearing was opened. Tim Good, Booth & Good Architects. 855 S. Millkan, Ontario, tl)e architect of the project was representing,the applicants. He stated that they have reduced the height to 27'-6" and the design is consistent with the architectural style of the house. He explained that the reason for the modification is that it is impossible to maintain the architectural style throughout the project and comply with the required 16'-0" height limitation. He commented that they would be In agreement to signing a covenant restricting the building to be single-story, not to have a kitchen or to be used as a rental unit. He explained that the required side setback is 10'-0" and they are providing a 15'-0" side ~ ... . . .' setback, the rear setback is 67'-0" which exceeds code and the building is 190' from the curb. He noted that the property slopes and the building height would be 17'-6" above curb height. There were no additional persons desiring to speak in favor of or In opposition to this item. MOTION It was moved .by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark said the the setbacks far exceed code. He thought the garage looks better detached and is consistent in design and in symmetry with the house. Both Commissioners Amato and Szany agreed. Commissioner Hedlund felt that it would be a disservice to require them to meet the 16'-0" height limitation and It would be out of proportion with the existing dwelling on the lot. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve MC 89-096 subject to the conditions in the staff report. PUBLIC HEARING TM 48607 1141-1147 Falrvlew Ave. Robert.G. Riddle Consideration of a tentative map for a proposed 15-unit residential condominium project. The staff report was presented and the public hearing was opened. Victor Chen, 1141 W, Duarte, 1M, said that they are in agreement with all of the conditions in the staff report. No one spoke in favor of or in opposition to this Item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. The consensus of the Commission was favorable. Consideration of a tentative parcel map for a 4-unit residential condominium. Victor Jasniy, 1975 Uliano Dr., Sierra Madre, stated that they are in agreement with ali of the conditions In the staff report. No one else spoke in favor of or in opposition to this item. M01DII It was moved by Commissioner Clark, seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. Uve Oak Ave. George Hsu Consideration of a conditional use permit to operate a restaurant The staff report was presented and the public hearing was opened. George Hsu, 822 S. Coldstream Ct., Diamond Bar, explained that a color study by a designer showed that the building needs to be painted with bright colors fn order to promote business and attract potential patrons' attention Marina Chang, 616 N. Hidalgo Ave., Alhambra, said that her firm did the color study and as explained by Mr. Hsu the colors were to attract attention and bring in customers to the center. Most-of the buildings in the area are dull and dusty looking. She submitted before and after pictures of the building and also some of Pasadena and Alhambra commercial buildings with bright colors. She noted Arcadia City Planning Commission December 12, 1989 Page 3 \ . that the colors will take sometime to get used to but this will Improve the look of the area. change the image of the street and bring in customers to the area. Tony Goon. .920 S~ Sunnyhill Place. Diamond Bar. said that he was one of the owners of the proposed restaurant and was in favor of the CUP. . . No one else cleslred to speak in favor of or in opposition to the proposed use. MOllON It was. moved. by Commissionsr Szany. seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. In answer to Commissioner Szany's question. William Woolard. the Planning Director. said that the consultant who did the downtown study suggested a color board which has examples of base and' accent colors for the downtown area. In other areas of the City the colors don't have to be selected from that color board. Commissioner Szany said that although he Is in favor of the restaurant and was pleased to see that the restaurant provides plenty of parking. He did not like the bright yellow and In his experience as an architect bright colors are not as popular and don't necessarily bring In customers. He thought that the colors don't go well together. He said that a color scheme should be submitted to the Planning Department for review. Commissioner Clark agreed and said that he would also prefer softer colors and did not think that bright colors will bring in customers. He felt that if the restaurant is good then it won't need bright colors to promote business. Commissioner Hedlund did not like the colors and thought that they were inappropriate. Commissioner Amato agreed. Chairman Papay said that he did not want to dictate color but did not'thlnk they were attractive. He felt that the colors should go through architectural design review. MOTION It was moved by Commissioner Clark. seconded by Commissioner Amato to approve CUP 89- 018 subject to the conditions In the staff report. (See changes under Audience Participation). PUBUC HEARING ADR 89,.119 154 E. Duarte Kathleen Borrelli Consideration of an appeal of the Planning Department's conditional approval for a proposed wall sign. The staff report was presented and the public hearing was opened. Arcadia City Planning Commission December 12. 1989 Page 4 '~ . . \ . Kathleen Borrelli, 208 E. Magna Vista, stated that she has had a lot of problems getting customers into her shop. People are unaware of the store in the center and customers on several occasions have said that ihe sign does not attract attention irom the street. She commented that she chose the pink color because it will attract female customers. George Chen, 427 Diamond, said that he is the owner of Hair Une Salon. When he opened the store in August he did a lot of remodeling and changed the sign to one which would attract more attention but he has customers who come in and wonder how long he has been in business and tell him thauhey were unaware of it being in the center. He thought that the proposed sign is very attractive and the pink would attract attention to Ms. Borrelli's. store. No one else spoke in favor of or in opposition to this item. MallON It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing; The motion passed by voice vote with none dissenting; Commissioner Szany thought that they did not need bright colors to attract attention but large legible letters would be a good altemative. Commissioner Hedlund agreed and said that the center Is old and needs to be upgraded. The existing signs are visually confusing and more color would add to the visual confusion and remarked that modem centers have uniform signs. Commissioner Clark thought that the pink is too bright. Commissioner Amato felt that the chosen background is more like a bright pink and not light pink. Chairman Papay didn't think that the problem would be solved by a sign with pink background. He felt that they should have a sign with white background and with legible letters with borders. Hedlund, Szany, Papay JIO:S: None Chairman Papay noted that there is a five working day appeal period. AUDIENCE PARTICIPATION Anthony Pel, 810 Coldstream, Diamond Bar, asked about the plans for the donut shop at 600 E. Uve Oak. He said that they will repaint the building at 612-614 E. Uve Oak and asked If the Commission would grant a time extension of 12-16 months before requiring them to repaint the building. He stated that they have done a iotof.remodeling of the site and have a negative cash flow since the center has had a.high vacancy rate and has had 1 tenant In the last 9 months. He aSked if the restaurant can be opened first before palnting the building. Arcadia City Planning Commission December 12. 1989 Page 5 . .." . a . . \, , Mr. Woolard stated that the Commission will have to re-open the hearing before considering the request. - - . - - ~ - - - - - - - - - - - - - - - --- - - . - - - - - - MOl1O'I It was moved by Commissioner Hedlund, seconded by Commissioner Clark to re-open the hearing on C.U.P. 89-018. The motion passed by voice vote with none dissenting. Mike Miller, the City Attorney, said that If the Commission chose to give a time extension it can be enforced by covenants and any documents or can keep its decision and the applicants may appeal it to the City Council. Commissioner Hedlund felt that it would be acceptable to him to allow the restaurant to open and give them 6 months to repaint the building. Mr; Miller said that the Commission may move to amend condition 5 and add that the applicants will have to sign documents and acknowledgements In regard to repainting the building. Mr. Miller remarked that the owner will have to sign any documents deemed necessary to ensure the repainting of the building. Mr, Pei said that they have exhausted their funds and asked for a 12.16 month postponement in repainting the building. Staff said that repainting the building is only part of the problem, the other is choosing the colors which are acceptable to the applicant and the City. In response to a question from the Commission, staff said that if the business does not do well, goes out of business or if the property is sold, the-covenants required by the City Attorney will still be enforced and the property owner at the set date will have to compty. Marina Chang, 616 N. Hidalgo, Alhambra, asked how does the Planning Department determine appropriate colors for businesses and explalned,that she Is doing a color st\ldy In the City and would like to know what Is permitted. She was in favor of bright colors and said that even though there are no businesses in the area that have bright colors there will always be a first and others eventually will follow. Mr. Woolard explained that there Is no color chart for this specific area and noted that the only area In the City..whlch has set colors.is.ln.the downtown area. The.colorsln:the other areas.ofthe.City are considered and determined by what Is existing In the neighborhood and what will fit In and look harmonious. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to close the publiC hearing. The motion passed by voice vote with none dissenting. Chairman Papay said ihat the colors should .be subject to staffs review and approval. Mr. Woolard felt that the colors should be determined early, possibly before the restaurant Is opened, to reduce the chance of any delay. Mr. Miller stated that his office will draw up any necessary documents to ensure the repainting of the building by the set date. MOTION It was moved by Commissioner Hedlund. seconded by Commissioner Amato. to approve CUP 89. 018 and amend condition 5 to read 'the applicant has until January 31. 1990. or when the restaurant opens. whichever is sooner. to determine the colors of the building. subject to the review and approval of the Planning Department. and. has until July 1. 1990. to repaint the building and should sign any covenants and documents required by the City Attorney. MAlTERS FR~ COUNCIL None Iv1AlTERS FR~ COMMISSION Commissioner Hedlund commented about 333E. Huntington. and asked ii the City has taken any steps to remove the trailer on the lot. Mr. Woolard said that a letter was sent to them requiring them to remove the trailer by 12/22189 and noted that it has been removed.
