Tuesday, November 28. 1989
The Planning Commission of the City of Arcadia met in regular session on Tuesday,November 28,
1989 at 7:30 p,m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with
Chai,rman Larry Papay presiding.

MOTION
It was moved by Commissioner Suny, seconded by Commissioner Amato to approve the
Minutes of November 14, 1989 as published. The motion passed by voice vote with none
dissenting.

It was moved by Commissioner Suny, seconded by Commissioner Amato to read all
resolutions by title only and walve reading the full body of the resolution. The motion passed
by voice vote wiih none dissenting.

The City Attomey announced that the City Charter requires that lor any action 10 be adopted or approved a
majority of the entire membership must vote in favor of the particular motion. If the required three
votes are not obtained the motion would tail. If the required three votes are nol obtained (1) an applicant
may request continuance and Itls up to Ihe Commission to decide whether or not:they want 10 grant It;
(2) the matter could be heard and then deferred for final decision pending participation of the absent
members as long as they review the records o~ Ihese proceedings which would be made avallable to them
or (3) the matter could simply go forward to the City Council.

Consideration of modifications for a proposed3"unit
apartment building.
The staff report was presented and the public hearing was opened.
Nimer Matta, 1679 Alta Oaks, said that he was .n agreement with all of the conditions in the staff
report.
There were no additional persons desiring'to speak In favor of or in opposition to the modifica~tions.
MOTION
It was moved by Commissioner Clarl<, se<xlndedby Commissioner Amato to close the public
hearing. The motion passed by voice vote with none dissenting.
Commissioner Clarl< commented that the requested modifications are similar to ones that,other
projects have required.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato to approve MP
89-015 subject to the conditions In the staff report.

Consideration 01 a text amendmerit to:
1 . Amend the maximum "Lot Coverage"
requirements In the R-M, RoO and R-1 zones
from 45% to a sliding scale ranging from a
maximum 01 35% to a maximum 01 20%
(based on lot size).
,2. Add a section to the RoM, R-O and R-1 zones
setting Iorth a maximum percentage,of
allowable building lloorarea ranging from a
maximum of 50% to a maximum 01 400/.

in lavor of the text amendment He said that he would like to see further reduction In lot area and
commented that many large homes are being proposed lor smaU lots. He noted that this change doesn~t
go far enough and would stili allow large homes on small lots.
William Wyman, 507 Monte Vista Rd., was pleased with the proposed change and asked how this
would affect porches?

.' William Woolard, Planning Director, saicl that he was not prepared to answer Mr. Wyman's question
but it would be addressed.
James Allaire, 1619 Highland Oaks, an ARB member. was in support of the text amendment and
thought that this in conjunction with the previous ordinance will help control development of "castle"
type homes.
Forrest Hartline, 314 Old Ranch, President of the Lower Rancho HOA, thought that there should be a
clearer definition of "a building" and said that he wouicllike to see it reduced further.
Judy Draper, 939 Hampton, President of the Upper Ranch HOA, asked for a continuance to allow their
association which is comprised of new members to review and discuss the matter. She thoughi i1wasa
good text amendment but it needs to be discussed more.
Gordon Maddock, 900 S. First Ave." represented a group of buiiclers and developers who are active in
the City. He remarked that he is aware of projects being proposed the City which maximize
everything but this has not been the intention of the group that he Is representing. He stated that 75-
80% of property value is In the structure and reducing the size of the structure only devalues the
property. He asked to continue the hearing to February to study the matter so they can propose an
alternative to accomplish what the City is looking for.
David Olson, 502 E. Camino Real, representing Chris ConstructiOn Co.. also asked fora continuance,
He stated that in the past 3 years they have built 7 single-story homes in the area which would not
comply with the proposed changes. H~ tlioughtthatlhe proposed 101 coverage wouicl restrlct the
building of single-story homes. He felt that further study was needed before changing the regulations.
In answer to Commissioner Amato!s question, Mr. Olson said that they build approximately 50 homes
in the past year, 7 of which were single-story. The proposed change dlscourages,the building of
single-story homes.
Don Crenshaw, 142 La Porte, said that this will Impact persons who would like to do additions as well
as those who would like to build new homes.
Tom Crosby, 601 S. Old Ranch, said thann speaklng with two other associations they all feel more,
comfortable with reviewing this more and continuing the hearing.
Councllman'Gilb said that If the hearing was continued It ,wouicl just give more time for new
applications to be submitted to the City which would not be affected by the proposed text amendment.
Mike Miller, the City Attorney, said that this matter Is before the Commission, and the Commission
can continue the matter or render a decision and refer the Item to City Council who makes the ultimate
deCision -and wiil also hcild a- public hearlng'to allow fOr additlonaltestirnony. -
Patricia Hartline,314 Old Ranch, said that she, Is pleased that she lives in an HOA area and sald,that
she was in, favor of the proposed changes and urged the Commission to approve It.
Gordon Maddock, felt that It would be best If this matter was resolved at the Commission level before
going before the City Council. He did not think thaUhere would be a flood of applications submitted.
He thought that an attempt should be made to meet with all interested persons to resolve the problem.
He noted that builders dO not like seeing large homes either.
Councilman Glib said that the people that are buildlng these large homes don' attend the Councilor
Commission meetings and said that when a situation such as the 12,000 sq, ft. house ai'lses, it trigger:

~ other people because they know that the builders are not building the large house for just for one
family. He stated tfiatthese large homes are not in areas with ARB review.
Chairman Papay remafked that the City Council is concerned with people who take adVantage of the
situation and they may have a moratorium if a rash of applications are filed with the City before this
text amendment is adopted.
Judy Draper, 939 Hampton, asked for continuing the hearing to the first meeting in January.
;Jim Allaire, 1.619 Highland Oaks, said that the City Council and the Commission are the representative
of all the bUilders, architects, realtors, residents and HOAs. He didn't think that a continuance was
necessary and suggested a moratorium on all new applications that cIon't comply with the proposed
regulations.
Chris Bade, 909 S. Sal)ta Anita, Chris Construction, said that the builders in the City are not the ones
who are building large homes. In his opinion, to stop all buildings ,in the City would be ridiculous
because of one homeowner who is proposing a 12,000 sq. ft. dwelling on a 16,000 sq. ft. lot.

approval of this text, amendment to the City Council.

It was moved by Commissioner Szany, seconded by Commissioner Clark to close the pUblic
hearing. The motion passed by voice voie with none dissenting.
Coml'!llssioner Szany said that single-story homes should be encouraged and bonuses should be given to
them and he suggested a 8% bonus for a single-story home. In reviewing the list of most new lots and
new homes In the City, most meet standards set by the City. He was against any moratoriums.
Commissioner Amato agreed with Commissioner Szany in regard to bonuses for single-story homes.
He didn't think that a moratorium Is needed if the text amendment is approved.
Commissioner Ciark stated that his concern is for areas without ARBs which need more control. He
was in favor of the text amendment and would be In agreement with continuing the hearing to January.
Chairman Papay noted that he is In favor of bonuses for single-story homes. He wondered if a
moratorium Is possible for constructIOn.

In answer to a question from the Commission, Mr. Woolard said that a car port is something that
should'be included In this text amendment. whereas, a'porch should not be Included. "As used in this
section, buildings shall include but not be limited to carports, storage sheds, play houses, garages and
buildings shall not Include Unenclosed spas and swimming pools, porch, pallo or trellis structure
which has a perimeter which Is open from floor to the underside of the roof or overhead covering' on
least 50% Qf its side." II' a situation comes up that Is not covered by these definitions, there Is a
procedure In the Code where the question can be,broughtbefore thePI~nlng Commission for
Cletermlnation. If significant Input Is received. the Council can refer this back to the Planning
Commission for more review. Staff will look into the range for bonuses for single-story buildings
between 5-8% bonus.

j Chairman Papay said that the Commission should rllOllmmend a specific number t6 the Council and staff
can review that number and Council may change the bonus percentage.
Commissioner Szany said that he thought an 8% bonus would be preferred over 5% bonus for single-
story homes.

of TA 89-007 to the City Council and add an 8% bonus for single-story homes and provide a
definition of "building" as used in this text change .

Gordon Maddock, 900 S. First, said that they will send out notices to all interested parties as well as
the HOAs and will get together with them for a meeting discussing this matter.
RESOLUTION 1426
A resolution denying MC 89-089 for a 3T-0"
front yard setback in lieu of the 62'-6" average of
the two nearest residences for a proposed new two
story house at 1020 Singing wood Drive.
Mr. Woolard read the tide of the resolution.

1426 and to formally affirm the decision of November 14, 1989, reflecting the
firldings of the Commission and the votes thereon.
