MINUTES ARCADIA CITY PLANNING COMMISSION REGUlAR MEETING Tuesday, November 14, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 14, 1989 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. . PLEDGE OF ALlEGIANCE ROLL CALL: PRESENT: ABSENT: MINUTES MOTION Commissioners Amato, Clark, Hedlund, Szany, Papay None Commissioner Clark noted that on the last page of the Minutes, it should be "Foothill Jr. High" instead of "First Jr. High". It was moved by Commissioner Clark, seconded by Commissioner Szany to approve the Minutes of November 24,1989 as amended. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to read all resolutions by title only and vvalve reading the full body of the resolution. The motion passed by voice vote with none dissenting. PUBLIC HEARING MC-89-D89 1 D2D Singing Wood Chia Hsiung Un Consideration of a modification for a 37'-0" front yard setback in lieu of the 62'-6" average of the two nearest developed lots (1004 & 1032 Singing Wood) for a proposed new two-story residence. The staff report was presented. Staff stated that the subdivision was approved In May of 1988. A tree preservation plan was required but they were not required to save any specific tree. Mr. Woolard said that each Homeowner's Association (HOA), in their resolutions, are required to save certain trees that have a diameter larger than 6"'and anything bigger will need HOA approval. Councilman Gilb felt that they can build around the.tree and wouldn~t need any modification. The public hearing was opened. An-Chi Lee, 3711 Long Beach Blvd., Long Beach, showed the model of the proposed home and said that they are trying to preserve the oak tree and the tree dictates the location of'the home which necessitates the need for the modification. The proposed house is 6;600 sq. ft. and from the street will look like a one-story home since it will be 5'.3" below street level. The HOA approved the removal of the tree and he reassured the Commission thatthey will plant more trees to replace the old oak tree. He explained'thal'lhey can't move the house back because of the tennis court and that would mean that they would have to remove 2 oak trees. The maximum height of the building from the street is 25'. Robert Henkel, 1065 Singing Wood, Architectural Review Board (ARB), remarked that the two homes on either side of this property have a setback 01'62'-6" and it would be odd to have this house encroach into the front yard setback as proposed. This house .would not be iJ:1 compliance and would be out of place with a 37'-0" front yard setback. Originally, the ARB looked at the existing house which had a 40'-0" seiback but after demolition'the ARB realized that the new house would be out of place. Mary Meeker, 1025 Singing Wood, was concerned that the builders are building for speculation and thought that the modification would be detrimental to the area. Alfredo Jose, 1004 Singing Wood, said that he is to the east of this property and said that in the peginnlng he was in favor of the house but after being made aware ofthe modification on the setback he is against it. The old house was a single-story home but this house will stand out with a front yard 'setback'rriuch lessthan'thelOldjacenrneighbors'horTles which'have'much greater setbacks: Judy Draper, 939 Hampton, President of HOA, felt that it is not worth saving a tree and destroying a neighborhood. At the time of the subdivision they were aware that the tree would be a problem. Heidi Rosenbluth, 1001 Singing Wood, said that if the setback modification was approved it would destroy the lines of homes. Mr. Henkell, submitted a plot plan of the home which is being proposed next to this property which shows the setbacks. In rebuttal, John Piccari, 1020 Singing Wood, said that they never intended to ask for a modification. They have worked with the,ARB before designing a house so that it would meet'all their concerns. the Arcadia City Planning Commission November 14, 1989 Page 2 . . proposed house will be a two story home but will appear to be single story since it is 5'-0" below street level. There were no additional persons desiring to speak in favor of or in opposition to this item. MOTiON It was moved-by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissention. In answer to questions from the Commission, Mr. Woolard said that the house met all of theARS's requirements but not the City's. Commissioner Hedlund felt that they should redesign the house to fit the lot and eliminate the need for the modification and,they should save the tree. Commissioner Clark agreed and said that he doesn't want them to deviate from Code and they should comply with the 62'-0' setback, The house is not the same profile from the,streetas the house which was torn down; it is a lot higher than the previous house. Commissioner Amato thought that they should meet Code and that it should be enforced. Commissioner Szany said tha,t although he feels for the owner and the architect who has gone through such great length to draw the plans he thought that the modification is too severe. Chairman Papay said that they should be able to design a house to fit on this lot. There should be uniformity in the setbacks. MallON It was moved by Commissioner Clark, seconded by Commissioner Hedlund to deny MC 89-089 with the findings that it would not secure an appropriate improvement, or promote uniformity of development. Lu Consideration of a tentative parcel map for a 3'unit residential condominium. The staff report was presented and the public hearing was opened. Robert W. Kirk, 423 California St., said that they will build three detached units ranging from 1400 to 1700 sq. ft. and they'will reside In tile larger unit. They are in agreement with all of the condiUons in the staff report. No one else spoke In favor of or in opposition to the tnis Item. The staff report was presented and the public hearing was opened. Mark Chow, 603 S, Russell, Monterey Park, stated that they are in agreement with all of the conditions in the staff report. He noted that his brother is the developer and he will be living in one of the units. No one else desiring to speak in favor of or in opposition to the proposed use. MOTION It was moved by CommissionerSzany, seconded by Commissioner Clark to ciose the public hearing. The motion passed by voice vote with none dissenting. The Commission liked the project. PUBLIC HEARING Z 89-004 The area bordered on the north by Orange Grove Avenue, on the east by Oakmeadow Road, HaCienda Drive and San Carlos Road, on the south by Foothill Blvd, and on the west by Baldwin Avenue. Consideration of a zone change from R-Q & D 15,000 to R-O & D 22,000. The staff report was presented and the public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to ciose the public hearing. The motion passed by voice vote with none dissenting. L1m Consideration of a tentative map for an 8-unit residential condominium. The staff report was presented and the pUblic hearing was opened. II Ung L1m, 45 Fano, said that he is in agreement with all of the conditions in the staff report. There was no one else desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. PUBLIC HEARING REVISED TPM 89-018 1000 Fourth Ave. Kenneth Huang on behalf of Romani Construction Consideration of. a tentative parcel map to create two single-family lots from one lot. The staff report was presented and the public hearing was opened. Kenneth Huang, 8369 Windon, San Gabriel, the engineer of the project stated that they are in Arcadia City Planning Commission November 14, 1989 Page 6 . . agreement with all of the conditions in the staff report. In response to a question from the Commission Mr. Huang said that the special 35'-0' setback off of Fourth Ave. would not be a problem and they will comply with it. In response to a question from the commission, he noted that the two new homes will be consistent and compatible with the other houses on the cul-de-sac. Ilene Steven, 1000 S, Fourth, said that although she was notified of this public hearing, she was not noticed at an earlier date when Chris Construction was proposing a development and asked that it be researched. There was no one else desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. Chairman Papay indicated that they'are on record as frowning on setback eilcroachfnentsunless there is a good and compelling reason. AUDIENCE PARTICIPATION None . - - - - - - - - --. - - - - - - - - - - - - - - - - - - - - - - - RESOLUTION 1425 A resolution granting CUP 89-017 for the expansion of an existing service station at 4 W. Foothill Blvd. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark. to adopt Resolution 1425 to formally affirm the decisions of October 24, 1989, reflecting the findings of the Commission and the votes thereon. MATTERS FROM COUNCIL t-tme - - - - - - - - - - - - - - - - - - - - - - - - - - -,- - - - - MATTERS FROM COMMISSION In. response to Commission's concerns, staff said that usually the public is unaware of setback violations until they approach the City. He also said that the development of condominiums on south Santa Anita and California are consistent with the General Plan. Commissioner Hedlund felt that a study and a possible teXt amendment should be done for R-2 and R-3 properties that are not suitable for development because of their size and don't fit. Chairman Papay thought that this would leave the City with a greater potential for law suits because it would be Interfering with the owner's economic situation.
