MINUTES ARCADIA CITY PLANNING COMMISSION REGUlAR MEETING Tuesday, October 10, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, September 12, 1989 at 7:30 p,m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Pro Tem Thomas Clark presiding. PLEDGE OF AllEGIANCE ROLL CALL: PRESENT: ABSENT: MOllON Commissioners 'Amato, Hedlund, Szany, Clark Commissioner Papay It was moved by Commissioner Hedlund, seconded by. Commissioner Amato to excuse Commissioner Papay from tonight's meeting. The motion passed by voice vote with none dissenting. MINUTES MOTION Commissioner Clark noted that on the last page of the Minutes, it was Commissioner Szany who seconded the motion to adopt the resolution. It was moved by Commissioner Hedlund, seconded by Commissioner Szany to approve the Minutes of September 26, 1989' as amended. The motion passed by voice vote with none dissenting. If the required three votes are not obtained the motion would fail. If the required three votes are not obtained (1) an applicant may request continuance and, it is up to the Commission to decide whether or not th.ey want .to grant it; (2) the matter could be heard and then deferred for final decision pending participation of the absent members as long as they review the records of this proceedings which would be made available to them or (3) the matter could simply go forward to the City Council. CONTINUED PUBLIC HEARING MC-89-074 1150 Fallen Leaf Rd. Paul Chen for Pacific Gentry Co. Consideration of an appeal of the Modification Committee's approval for 6'-0" high masonry pillars with 5'-6" high wrought iron fencing, and two light fixtures on the pillars adjaceni to the driveway (9283.8.7 & 92'83.8.8). The staff report was presented and the public hearing was opened. Edward Butterworth, 1145 Singlngwood, the appeliant stated that fences in the front yard are limited to 4' in height and if the property Is within 25' of an intersection it should not exceed 3'. The subject property falls within the latter and the requested modification is, asking for 500kincrease over what is permitted. He remarked that although flexibility in the zoning regulations are necessary for hardship cases, this one would certainly not fall into that'category. The applicant's reason for the fence is that it is nice. That is ,!lo reason to grant the modification. In talking with the Police Chief, it was noted tilat the fence would appear to provide security, but on the contrary it would aliow a burglar to easily enter the house without detection. The fence would create undue hazard for the intersection, since Hampton is a heavily traveled street and is the area's access street from Pasadena. The fence would create a blind intersection which'wouldbe very dangerous. Martha Turner, 1130 Fallen Leaf, said that she originally signed the approval for the fence and would like to take her signature off of the form. She concurred with Mr. Butterworth that this is a very heavily traveled street and the fence with the brick posts would add to the danger and would create a hazardous situation. Mack Turner, 1130 Fallen Leaf, Vice President of the Home Owners Association, referred to the fence at Dexter and Hampton and said that it is.a monstrosity and it shields possible burglars from the public view. He remarked thath~ Is with the Neighborhood Watch Program and fences such as.this are advantageous to burglars. He suggested an alarmsysleiTl that could be wired directly to the Police Department and that It would be less costly and not aesthetically displeasing. Judie Draper, 939 Hampton, submitted a petition and asked for a 60 day continuance to allow the HOA and the residents to consider the desirability of iron and steel fences in excess of those permitted by c:ocE. Paul Chen, 1835 S. Del Mar, San Gabriel, representing Mr. and Mrs. Un, the owners, stated that they would like to improve the neighborhood. They were asked to get signatures of the neighbors and they were able to obtain 11 signatures. They have foliowed,the visibility standards set by the City and the proposed iron fence will be replacing the existing old chain link fence. Val Realty, representing the owners, said that his clients purchased the home in this neighborhood because of the beautiful, elegant and quite neighborhood. Their intention Is to beautify the area and not to destroy the looks of the neighborhood. In regard to security, he stated that they would feel secure by having the fence and shrubbery and flowers which would also enhance it. He commented that this will not bea solid fence and it wouldn't hamper the Neighborhood Watch Program because tfley would be able to see through the fence. In regard to traffic, he said that anything over 4' can block the view from a car, since cars sit low, so the posts should not be viewed as blocking the view. In response to a question from Councilman Gilb, Mr. Wu stated that his clients Intend to spend a lot of money upgrading the property and are not planning on splitting the lot. In rebuttal, Mr. Butterworth explained the circumstances that'the chain link fence was erected under. There were no additional persons desiring to speak in favor of or In opposition to this Item. MOTIaII It was moved by Commissioner Szany, seconded by Commissioner Hedlund to close the public flearing. TIle motion passed by voice.vote with none dissention. Commissioner Amato felt that II the ARB approved the fence, then he would be In favor of the fence. Commissioner Szany,said that in driving in the area, he had a feeling of openness and spaciousness and . he remarked that the fence would take away that feeling. He was ccincerned about the'comer and said that he would like to maintain ihe open feeiing in the area. He asked how the Commission should review. this appeal. Mr. Woolard said that the Commission should review this and determine whether the modification for the fence is appropriate or not. Commissioner Hedlund didn't think that this matter should be taken lightly. Even thougMhis is an improvement over the existing condition, it is massive and it should not be granted, Chairman Pro Tem Clark agreed with Commissioner Szany and said that 4' is high enough and a modification should not be granted. PUBLIC HEARING TM 48467 303-309 S. Second Ave. Peter Lin Consideration of a tentative map for an il-unit residential condominium project. The staff report was presented and the public hearing was opened. Peter Un, 34,10 Condor Ridge, Vorba Linda. stated that they are in agreement with all of the conditions in the staff report. There were no additional persons desiring to speak in favor of or in opposition to this item. MOTlON It was moved by Commissioner Hedlund, seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. Staff stated that they comply with 'all code requirements. The consensus of the Commission was favorable. MOllON It was moved by Commissioner Szany, seconded by Commissioner Hedlund to approve TM 48467 subject to ihe conditions in the staff report. Third Michael Chiu Consideration of modifications to delete a 5'-0. wide planting buffer between the driveway and the property line and between the guest parking space and the property line' for two detached units on an R'2 lot. The staff report was presented and the public hearing was opened. Michael Chiu, 2555 Huntington, Sierra Madre, said that the width of the lot necessitates the need for the requested modifications. They are in agreement with all of the conditions in the staff report. Jason Fan, 12961 S. Ramona, Irwindale, the builder of the properly to the south, said that he is in favor of this development and it would look nice with his project. No one else spoke in favor of or in opposition to the this item. The molion passed by voice vole with none dissenting. Commissioner Hedlund was opposed to eliminating Ihe landscape buffer. He didn't Ihink !hatlhe code should be ignored because of the width of the lot and Commissioner Amato agreed. Commissioner Szany agreed wilh Commissioner Hedlund but said thal'!he property is zoned R-2 and the Proposed units are low key and would fit in well. Chairman Pro Tem Clark stated that although he prefers landscaping, each project should be reviewed based on Its merits, He thought thallhis would be a nice development. tJOllON It was moved by Commissioner Szany, seconded by Chairman Pro Tern Clark to approve MP 89- 013 subject to the conditions In the staff report. It was determined to contlnuethe public hearing to allow Commissioner Papay to vote on this it!lm. Duarte,Suile H Noriyuki Okamoto Consideration of a conditional use permit to operate a restauranr wilh sealing for 32 palrons. and a modi fica lion request for 53 existing on-site parking spaces in lieu of 60 spaces required. The staff report was presented. Staff said that they were not aware of a parking deficiencies at the International House of Pancakes (IHOP). Parking is based on !he square footage of the store. a take out establishment'wo~ld need 5 spaces per 1000 sq; ft. but a sit down eating establishment requires 20 spaces per 1000 sq. ft. Lexington, Glendale, representing the owners said that this is a Japanese seafood restaurant and it would not be a'take out establishment. Most of the business is during the evening and the liJnch would probably not be as busy as dinner. In talking with the owner of the site, he stated that the center is 80% occupied and the parking is at a 60% use at peak hour of the day which is during the noon hours. Michael Pashaie, Golden West Properties, 8500 Wilshire Blvd, Beverly Hills, said that Guardian Savings is utilizing the adjacent space as their loan office and Onyx Hair Salon has just leased the space next to them. and they are in iheprocess o/expansion. A Japanese restaurant would be welcomed in the area since there is no other Japanese restaurant in the vicinity. When Mandarin Cafe was being reviewed, the Commission was concerned with possible parking problems but they have been in operation for almost 3 months and there has been no problems. The parking Problem at the subject site occurred when the patrons from IHOP and the office building employees were using the parking lot but they have been notified and since the notification there has not been any parking problems at the site. The pet shop went out of business because there wasn't enough traffic at the site and they are presently in the process of negotiating to lease to another pet store. As the owners of the site. it would not be advantageous to have.a parking problem. Ricardo Cruz, Onyx Hair and Skin Care, concurred with Mr. Pashaie and said that they are expanding and have leased the store adjacent to them. Peggy Sou, 9829 Kio Dia PI., Arcadia, said that she would like to see a Japanese restaurant in the area. Anthony Oropello, 658 Camino Real, said that he driVes by.the center otten and would welcome a Japanese restaurant since it would be a convenient, stop to make after going to the Post Office. No one else desiring to speak in favor of or jn opposition .to the proposed use. Staff said that post office customers use this property to drive around and get to the boxes to drop off theif mall. That property b~longs to the' same owners (Golden West Properties) and they put the mall boxes there to avoid a parking problem on the subject site. It was noted that some uses don't require Planning Commission approval such as a hair. salon which is an intense use. Mr, Woolard said that the post office patrons use this property to get to the mall boxes and without the use of this property the post office customers would use this lot to park and get to the post office. Chairman Pro Tern Clark like having a Japanese restaurant. He shared concern with staff regarding the traffic on Duarte since it is a busy intersection. Councilman Glib stated that he drops his mail off at the post office and this site is usually empty. He didn't think that there was a parking problem at the subject site. Commissioner Amato wondered if the salon takes over the adjacent space it would require more parking and asked if the seating was reduced would they comply with the parking requirement? Mr. Woolard said that evenings would be no problem but was concerned with the lunch crowd. Chairman Pro, Tern Clark remarked that the applicant stated that they didn't expect a lot of customers at lunch but dinner would be the busy time. MOllOO It was moved by Commissioner Szany, seconded by Commissioner Amato to approve CUP 89- 016 subject to the conditions in the staff report. PUBUC HEARING MP 89'014 315-321 Diamond Mur-Sol, Inc. Consideration of a modification for 10'_0' between buildings In lieu of 20'-0. for a 6-unit residential condominium project. The staff report was presented and the public hearing was opened. Greg Butler, 218 E. Longden"lrwlndale, remarked that detached units that are more desirable than attached units. They can attach the units and would not need any modifications butthey would create a less desirable project. The front doors face the street which gives the affect of single-family homes. There was no one else desiring to speak in favor of or In opposition to this Item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the publiC hearing. The motion passed by voice vote with none dissenting. 'CciriimissiorieiHedlund didn't like to have 10' between the buildings versus a development that would be 135' in length and would not require any modifications. He thought thathaliing detached units doesn't jusiity the modification. Chairman Pro Tem Clark said that they could have proposed 7 units instead of the 6 and said .that he likes detached units versus an attached development. RESOLUTION 1418 A resolution granting CUP 89-015 to construct a 9.200 sq. ft. restaurant with parking modifications at 430 Huntington Drive (Arcadia Gateway Centre) and amending Resolution 1397 to allow only two eating establishments with a maximum seating for 12 persons each in the retail building at 300 E. HLintington. Mr. Woolard read the title of the resolution. It was noted that Commissioner Hedlund abstained from the pUblic hearing but will vote on the resolution. MallON It was moved by Commissioner Szany, seconded by Commissioner Amato to adopt Resolution 1422 to formally affirm the decisions of September 26, 1989, reflecting the findings of the Commission and the votes thereon.
