MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday. September 12, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, September 12, 1989 at 7:30 p.m. in the Council Chambers of the Arcadia City Hl!II, 240 West Huntington Drive, with Chairman Larry Papay presiding. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve the Minutes of August 22,1989 as amended. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark to read all resolutions by title only and waive reading the full body of Ihe resolution. The motion passed by voice vote with none dissenting. . . \ The City Attorney announced that the City Charter'requlres that for any action to be adopted or approved a majority of the entire membership must vote in favor of the particular motion. If the required three votes are not obtained the motion would fail. If the required three votes are not obtained (1) an applicant may request continuance and it is up to the Commission to decide whether or not they want to grant it; (2) the matter could be heard and then deferred for final decision pending participation of the absent members as long as they review the records ofthis proceedings which would be made available to them or (3) the matter could simply go forward to the City Council. PUBLIC HEARING Z-89-003 324 N. Second Ave. Robert W. & Donald P. Johnson Consideration of a zone change to add an ~H" (high rise) overlay to the existing CPD-1 zoning designation. The staff report was presented and the public hearing was opened. Robert Johnson, 2102 Business Center Drive, Irvine, one of the owners of the property and eXplained the reason tor the high ceiling and noted that they would like to have a truck door ora roll up door at the rear of the building to move office equipment in and out of the building. He noted that Ihey would like to present a dramatic view from the freeway and said that most of the building will be at a 40' high. There were no additional persons desiring to speak in favor or in opposition. MOTtON It was moved by Commissioner Szany, seconded by Commissioner Clalkto close the public hearing. The motion passed by voice vote with at dissention. Commissioner Amato was in favor of having the higher ceiling. Commissioner Szany liked the design of the building. MOllON It was moved by Commissioner Clark, seconded by Commissioner Amato to recommend approval of Zone Change Z-89-003 to the City Council. The staff report was presented and the public hearing was opened. Lijiuan Fan, 13501 "B" Tracy St., Baldwin Park, said that they are in agreement with all of the conditions in the staff report. Duarte Rd. Robert Nese Consideration of modifications for a proposed 3-unit residential condominium project. The staff report was presented and the publiC hearing was opened. Robert Nese, 1441 Glengarry, Pasadena. the owner said that they are in agreement with all of the conditions in the staff report. ~ Reverend Daniel Carpenter, 330E. Duarte, asked,what the zoning of the property is and wondered if the owners would be in favor of any development on their lot. . Chairman Papay stated that the Commission is only hearing this Item and the owner is not obligated to say that he would be in favor of any future developments that may take place on Rev. Carpenter's site. He noted that at the time of any proposals for the Reverend's site Mr. Nese might not be the owner at 325 E. Duarte. He explained that when he wants to develop his lot he will have to approach the City. No one else spoke ~in favor or in opposition to the this Item. MOllON It was movetlby Commissioner Clam, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. In respons~'to Commissioner Amato's question, staff said that code permits a 12 1/2 foot driveway for those development that have a driveway under 125' in length and anything over is required to have a minimum 20 foot driveway. It was noted that the side yard setback for R-2 is 10'. Staff remarked that it would be an improvement over the existing situation. MOTION 11 was moved'by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. MOTION II was moved by Commissioner Clark, seconded by Commissioner Amato to approve TM 45361 subject to the conditions in the staff report. Huntington Drive II S. Yu (Burrito Flats) Consideration of a conditional use permit for an eating establishment for 16 persons. Parking modification required. The staff report was presented. Mr. Woolard stated that the prior eating establishment at this location was grandfathered in and did not need a CUP. Arcadia City Planning Commission September 12, 1989 Page 4 . . The public hearing was opened. John'Yu, 415 S. San Andrews, Los Angeles, said thaUhey would like to have 16 seats. MOllON II was moved by Commissioner Clark. seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark preferred to have 12 seats as recommended by staff. Chairman Papay stated that the applicant can request for additional seatings al a later date. Staff said that there will not be a drive-thru window. MOllON It was moved by Commissioner Clark, seconded by Commissioner Szanyto approve CUP 89- 014 subject to the conditions in the staff report. PUBLIC HEARING REVISED TM 47904 516-520 W. Longden Ave. & 511 W. '<'>alnut Ave. Chris Construction Co. Consideration of a tentative map to create an 8-lot'single" family subdivision with a cul-de-sac off of Longden Avenue. The staff report was presented and the public hearing was opened. Chris Bade. 909 S. Santa Anita, said that they are in agreement with all of the conditions In the staff report. ' n _n_' ' - - Dick Haltom, 536 W. Walnut. asked if he could see a copy of the tentative map. Stan Keith, 471 W. Walnut. asked about the style and the archilecture of the new homes and wondered if Ihey will be single or two story homes? He was concerned that several families would move in. Chairman Papay,said that the tentative map procedure does not require the applicant to provide the design of the homes and:itallows the developer to subdivide. Two-story homes are permitted in the R-1 zones and the second-story has to meet special setbacks. The City can not dictate as to number of families living in one home. Arcadia City Planning Commission September 12, 1989 Page 5 . . \ Mr. Miller said that Mr. Keith can pick up the definition of a family from his office for zoning purpose. Lorren Armst. 4842 Doreen, Temple City, said that he is the owner of 544 Longden and asked about the development. Chairman Papay said thatthe Commission does not know the size of. the homes and when the plans are submitted to the City and if modifications are necessary then the properties within 100' witt be notified. In rebuttal, Mr. Bade said that"the homes built by Chris Construction are very attractive homes and the homes are designed to fit the lot and the neighborhood. MOTlClN It was moved by Commissioner Clark,seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting, . Commissioner Clark remarked that the new lots will be larger than the previous map. Commissioner Szany liked the design of the new lots. Huntington Drive. " The staff report was presented and the public hearing was opened. PUBLIC HEARING MP 89-012 133.137 E. Huntington Drive A.L. Landsperger ALLandsperger, 1047 Loganrlta, said that he Is in agreement with all of the conditions in the staff report. He remarked that they would like to make the front unliorm with the other buildings and have an aesthetlcary pleasing building. The ability to have storage will raise the value of the property. The earthquake restoration Is 95% complete and the building Is now safe to occupy. MOllON It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. Consideration of an appeal of the Modification Committee's approval of 27'-0' high chimneys in lieu of the 21'-0' height prescribed by the 40 degree plane projected from the front property line. The staff report was presented and the public hearing was opened. PUBLIC HEARING MC 89-072 518 & 519 E. Connie Rae Way Mur-sol, Inc. Don Crenshaw, 132 La Porte, the architect of the project said that the two homes are at the end of the cul-de-sac. Staff said that the requested modification will not impact any of the surrounding neighbors. In answer to Commissioner Amato's question, Mr. Crenshaw said-that he was aware of the 40 degree plane. Commissioner Szany asked if the fireplace can be put on the other side. Mr. Crenshaw stated that they canput the fireplaces on the other side and noted that both houses are identical. The chimneys'project 4' into the 40 degree plane. He remarked that this Is not a hardship. MOllON It was moved"byCommisSioner $zany, seconded by Commissioner-Clark to close the public -- - hearing. The motion passed by voice vote with none dissenting. Commissioner Amato was concerned abouHhe projection Into the 40 degree plane. He felt that they should comply with the requirement. Commissioner Clark agreed. Chairman Papay said that modifications are for hardship cases and since this does'not pose a hardship then it should not be approved. AUDIENCE PARTICIPATION None RESOLUTION 1418 A resolution amending condition No.1 of Resolution 1333 (CUP 87-6) 10 permit 10 additional seating stools within the Vons Pavilions store at 745 Naomi Ave. RESOLUTION 1419 A resolution granting CUP 89-013 to operate a church at 422 W. Lemon Avenue (The Baldwin Stocker Elementary Sch~ol). RESOLUTION '1420 A resolution approving a two-story addition to the existing dwelling and modifications to the front yard setback at 851 Palo Alto Drive and approving an appeal of the Santa Anita Village Architectural Review Board's decision. Mr. Woolard read the title of the resolutions.
