MINUTES ARCADIA CITY PLANNING COMMISSION REGUlAR MEETING Tuesday, August 8, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, August 8, 1989 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive. with Chairman Larry Papay presiding. The motion passed by voice vote with none dissenting. . . \' PUBLIC HEARING CUP 89-011 29 E. Huntington Dr. Lyle Patterson Consideration of a conditional use permit to expand the existing Steerburger Bar/Restaurant and related modifications for the dish antenna, parking and landscaping. The staff report was presented. Staff commented that the Fire Department has limited the seating to 85. The public hearing was opened. Peter Panta. 6454 Golden West. was representing the applicant and said that they are in agreement with all of the conditions in the staff report. He noted that they had no problems with moving the dish antenna. There were no additional persons desiring to speak in favor or in opposition. MOTION It was moved by Commissioner Clark. seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with at dissention. It was the consensus of the Commission that the proposed expansion woulcl be an improvement. MOllON It was moved by Commissioner Szany, seconded by Commissioner Amato to approve CUP 89-011 subject to the conditions in the staff report. ROLL CALL: AYES: Commissioners Amato, Clark. Hedlund. Szany, Papay ~ None Chairman Papay noted that there Is a five working day appeal period after the adoption of the resolution. PUBLIC HEARING CUP 89-012 36 E. Live Oak Ave. Bonnie L Cho Consideration of a conditional use permit for a school. Maximum number of students 69, students will be 18 years of age or younger. The staff report was presented. Staff noted that this is similar to the Kumon school The Fire Department requires 20 sq. ft. for each student. The public hearing was opened. Arcadia City Planning Commission August 8. 1989 Page 2 . . \, Bonnie Cho, 517 W. Palm, the applicant stated that she is in agreement with all of the conditions in the staff report. She explained that the average student will attend twice a week and remarked that this would not be like a classroom type school and the program is Individualized. The classes will be approximately 40 minutes and the length of class will depend on the age of the students. The classes for younger students would be shorter than older students since their attention span is shorter than the older students. She noted that she Is asking for a maximum of 69 students. Julie Hoff, 275 W. Foothill, asked if the restrooms would comply with the .Building Code and Staff commented that they would have to comply with all Building Code regulations. MOTlON It was moved by Commissioner Clark"seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund thought the use was too intense for the property. He was concerned about the parking. He thought that this was a much worse situation than the school on Foothill Boulevard. Chaionan Papay said that if the Commission approved the CUP, they can limit the maximum number of students at anyone time. Commissioner Clark agreed with Commissioner Hedlund and said that 69 students would be maximum utilization of the area and thought the number approved should be reduced. Commissioner Szany said that he has dealt with this site in the past and explained that his children take classes in the immediate area and noted that he has never had any problems with the parking. He said that most of the parking lot is empty by the time he takes his children which is about 4:00 pm and remarked that he drops them off in the back and the parking lot is almost empty, approximately 4-5 cars. Commissioner Hedlund said that they have access from both the street and the parking lot. Staff remarked t~at condition 8 of the staff report is to allow staff to review the situation in one year and take any action necessary. The school on Foothill Blvd. is 400 sq. ft. and is for 10-12 students. Commissioner Amato wondered if the front door could be utilized as an emergency exit only? Staff remarked that that would restrict walk-ins and staff is not against the walk-in traffic. Commissioner Hedlund didn't like that idea. He felt that the use is too intense. _____u__ _ _ _. ___ __ _ __ -- -- -- - ---. ~ - - - .-- .----~- ~ -- ---- Chairman Papay said that condition 8 In the staff rElport makes the applicant aware that during the upcoming year the property will be monitored and if any complaints are received the Commission can reiliew the CUP and can possibly revoke it. CommissionerSzany suggested reducing the number of students to a maximum of 40 students at any one time and after the firSt year the applicant can request an increase in that number. In response to some questions by the Commission, Mike Miller, the City Attorney, said that if the applicant decides to modify the CUP and increase the number of students, she would have to pay the CUP fee and only the City Council can waive that fee. If the Commission reviews the CUP then the applicant would not have'to pay any fee. If any complaints are received and the CUP comes before the CommissiOn then there'would be no fee. " Chairman Papay was in favor of the 40 students and said that the Commission can review the CUP for the possibility of increasing the number of students to 69. M0110N It was moved by Commissioner Szany, seconded by Commissioner Clark to re-open the public hearing. The motion passed by voice vote with none dissenting. Ms. Cho explained that there would not be a substantial Increase in the number of cars because there would be more than 1 child in most cars and the students would carpool. She anllclpated a maximum of;20 cars and said that some of the children walk, ride a bike or their skateboards to the school. The students would be from the Immediate area and wouid not be traveling from other cities. MOTION It was moved by Commissioner Clark. seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Chairman Papay was concemed with the parking and the traffic flow and noted that the applicant can come back prior to the one year'to increase the number of students. It was noted that Uve Oak Is a highly traveled street. between the hours 4-6 pm. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve CUP 89- 012 subject to the conditions in the staff report with the additional condition 13 to state that the Planning Commission car) review the, CUP in its first meeting in August 1990 for possible expansion and that condition 3 to be modified to read a maximum of 40 students. The staff report was presented and the public hearing was opened. No one spoke in favor or in opposition to the'tentative map. Mr. and Mrs. Frank Hung Consideration of an appeal by the homeowner of the Santa Anita Village Homeowner Association's conditional approval of a 6'-0. high redWood fence along the easterly properly line. The. staff report was presented. Mr. Miller suggested that the Commission go with staffs recommendation and reminded the board of its limitations. The pubnc hearing was opened. Mr. and Mrs. Frank HiJng, 927 Victoria, said that there is no easement between the properties. David Freeman, 150 N. Santa Anita, was the attorney representing the Sommers at 921 Victoria Drive. He remarked that the Sommers have had the usage of this property for over 20 years and if the fence was to be built where. proposed It would be very difficult for the Sommers to get to and from their garage. The fence would be aesthetically displeasing and Incompatible. He remalked that there was an agreement for the Sommers' to utilize the portion of the driveway. Mr. Miller noted that the dispute between the two property owners doas not come under the jurisdiction of the either the Village Homeowners Association or the Planning Commission. Mr. Hung stated that thllre..was never an agreement to allow the Sommers the use of that portion of the driveway. Commissioner Hedlund feltthat the fence would'create undo hardship for the Sommers and was against the appeal. Arcadia City Planning Commission August ", 1989 PageS . . ,. Commissioner Hedlund made an appeal to uphold the Architectural Review Board's decision and the motion failed due to a lack of a second. Chairman papay said that this is beyond both the ARB's and the Commission's jurisdiction. Commissioner Hedlund thought that the fence would be aesthetically an eye sore. It was noted that the, ARB had determined that the fence material was compatible. Mr. Miller said that the Code does not take into consideration any hardship and it is not under the Commission jurisdiction. MoTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve MP 89- 009 and to reverse the ARB's decision and to recommend to the City Council to refund the appeal fee to the applicant. Staff explained that the Architectural Review Board (ARB) denied the proposed addition based on incompatibility. He-explained :thatthe porch has a setbaCk of 32'-0" in-lieu of -35"0", Sncrthe bay window has a setback of 33'-6" In lieu of 35-0". No modification is required for the oval window on the second-fioor. The entry behind the porch is in line with the existing entry way. The bay window Is an architectural feature. The public hearing was opened. Doug Olbrich, 330 La Serena, West Covlna, the contractor of the project subi'nitted several pictures to the Commission of similar homes in the Immediate area. The original proposal was French provincial and the design was changed at the request of the ARB who didn'lllke the stucco look and preferred wood siding, which looks more like ranch style homes, and a wood shake roof to be compatible with the existing homes in the neighborhood. He remarked that no modification is required for the entry. Arcadia City Planning Commission August 8, 1989 Page 6 . . , Mr. Faire, 339 Val/ombrosa, Pasadena, said that their house will look like the house at 1010 Coronado with the exception that it will be a two-story home. The house has a very nice design and will be compatible with the area. The. bay window and the porch will enci'oach180 into the front yard setback. The proposed house will blend in nicely with the existing homes in the area. The neighborhood Is not made up of tract homes and each house is of a different style and design. Most of the homes are custom made which enhances the-area. Charles George, 331 S. Old Ranch, an ARB member said that the were not agalnstthe two-story portion ot the house but didn't like the modifications. They were concerned with the tower look over the entry way, and although it is not a turret it looks like one. They thought that it should be lowered not-to look like a tower. Tom Crosby, 601 S. Old Ranch, the president ot the ARB said thatthey were against the style 01 the roof. They would like to see it Softened up a bit from the outside and, still have the same affect from the inside. James and Rita Curtis, 850 Palo Alto Dr., felt that the style ot the new house is out of character with the neighborhood. He saldthatthe modification lor the porch was never brought up at the ARB meetings. In rebuttal, Mr. Olbrich said the plans have not been changed and the ARB had the same plans that the Commission is reviewing. Commissioner Hedlund suggested that the house be redesigned to bring into more compatibility with the area. Mr, Faire said that the house is compatible with the area and fits in well. The house is not an ostentatious house and it doesn't have the towering affect, rather It Is a simple structure. Mr. Olbrich said that they will have all wood windows and all the features will reflect a ranch style house which is the style in the Village. MOllON It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none dissenting. Both Commissioners Amato and Szany agreed with Commissioner Clark. Commissioner Hedlund suggested giving the applicant the option and the opportunity to soften up the house and recommencled,continuing the hearing. MOllON It was moved by Commissioner Hedlund. seconded by Commissioner Szany to re-open the public hearing. The motion passed by voice vote with none dissenting. Mr. Olbrich sald that they will try to redesign and were in favor of continuing the hearing. Arcadia City Planning Commission August 8, 1989 Page 7 . . \ Mr. Crosby asked if the ARB would be notified to review the plans and what if the plans were changed drastically? Chairman Papay said thanhe plans would not go baclc'to the ARB. If the Planning Commission denies,the appeal then any subsequent plans woulcl go to the ARB for its review. The only things that should change on the plans should be the architectural features. ~ It was moved by Commissioner Szany, seconded by Commissioner Amato to continue the hearing to August 22, 1989. Old Ranch, asked how.many dogs,cana resident In the City have and is raising pedigree dogs against the Code and does it need a license.
