Planning Commission proceedings are tape recorded and on file in the office of the Planning Department MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, July 11, 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday, July 11, 1989 at 7:30 p.m. in the Colincll Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry PapaY presiding. The motion passed by voice vote with none dissenting. MOTION It was moved by CommissionerSzany, seconded by Commissioner Amato to read all resolutions by title only and waive reading the full body of the resolution. It was moved by Commissioner Hedlund, seconded by Commissioner Amato to nominate Commissioner Clark for Chairman Pro-Tem. Consideration of an appeal of the Modification Committee's conditional approval of the 10'-0" height from the lowest adjacent grade in lieu of 6'-0' for a mason,ry wall along the southerly property line (9283.8;7 & 9283.8.8). The staff report was presented and the public hearing was opened. Jim Clark, 1434 San Carlos, asked that the Commission decide on the matter and deny the request for continuance. He was in agreement with the Modification Committee's decision although he remarked that it was not ideai because there is ioss of privacy. He objected to the construction of the wall. There were no additional persons desiring to speak in favor or in opposition. MO'TlON It was moved,by Commissioner Clark, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with at dissention. Chairman Papay noted that the appellant has requested the continuance. Mike Miller, the City Attorney, cautioned the Commission on moving without hearing the appellant. Unless the Commission is not,satisfied with the .reason for the continuance, the Commission can. deny the continuance,butthe Commission has had a chance to hear the neighbor and should afford the same opportunity to the appellant. Commissioner Hedlund was in favor of the continuance and felHhat the applicant should be given the opportunity to pr~s~t his case to_ the Commissi~": Mr. Miller said that'the neighbor had an opportunity to present his case to the Commission. If the Commission is not satisfied with the applicant's request for continuance,. it is their privilege to deny the continuance. Mr. Woolard, the Planning Director, noted that the contractor is out of town. A wall can be 6' high from the lowest adjacent grade without requiring a modification. The building code requires that between adjacent p~operties there'd be some type of protection. Commissioner Amato was against granting the continuance. He commented that at the Modification Committee's first meeting Dan Grohs was present and the applicant was not there and when that hearing was continued then the properly owner was present and the contractor was not there. Staff commented that a building permit was issued fora 6' high wall. The site plan which didn't show any variation in grade was liIPproved by the Homeowner'sAssociation. When the Building Department discovered the problem the contractor was informed that a modification would be required. The contractor measured the wall from their property instead of the lowest adjacent grade. It was noted that the site plan didn~ show any variation of grade and it was shown as a typical perimeter wall. Commissioner Szany agreed with Commissioner Hedlund and remarked that if there is a safety problem with the wall he would like to be aware of it ahead of time. MOllON It was moved by Commissioner Clark, seconded by Commissioner Amato to re-open the public hearing. The motion passed by voice vote with none dissenting. ,Mr. Ciark remarked that Mr. Franta, Chief Building Official, Inspected the wall and acknowledged a problem with the pouring of the driveway and as a result of ,the inspection he required them to put pilasters 5'-6' down and then pour concrete and put reinforcement in several different locations. Chairman Papay commentlld that it would be useful to have as much technical information on a variety of options in the area including the one suggested by the Modification Committee. Mr. Woolard remarked that the Planning Department will not review the plans and determine whether it Is structurally okay. The property owner may be required to do more engineering to make the cut outs. The staff report was presented and the public hearing was opened. Dean Efstathiou, 1425 Oriando Drive, said that they are In agreement with all of the conditions in the staff report. This projeCt was built as an apartment but the property owner decided to Subdivide. Arcadia City Planning Commission July 11, 1989 Page 3 . . \ Arly Barton, 51,8 Fairview, said that her fence was damaged due to construction and wanted to know if a perimeter wall would be built. Staff commented that a wall is required around the perimeter of the property. MOllON It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. J:. to 18'-0.-:1; variation in the distance between buildings in lieu of 20'-0. or a proposed 20-unit residential condominium project (9253.2.14& 9255.2.14). The staff report was presented and the public hearing was opened. David Mi, 1260 Huntington, S. Pasadena, representing the liIPplicant said that they are in agreement with all of the conditions in the staff report. Elaina Cox, 4002 California, asked if the modification between distance of the buildings would be the one between the new buildings or the one between the two properties? Staff explained that the modification is for the distance between the new buildings and noted that they have complied with all the setback requirements to the adjacent properties. RESOLUTION 1413 A resolution granting CUP 89-009 for truck instruction and outdoor repair and maintenance of driving school vehicles at 11629 Clark Street. RESOLUTION 1414 A resolution granting CUP 89-010 to operate an art school at 19 E. Uve Oak Avenue. Mr. Woolard read the title of the resolutions. Mr. Woolard commented that it is di.fficult to impose architectural design review for new subdivisions and remarked. that the subdivider may not be the eventual builder of the new homes, and requiring new homes to undergo such review SUbjects them to unequal treatment. Most complaints and problems have been with respect to individual new single-family dwelling projects. Items 2 and 3 are being taken careof,one by a staff report to the Council and'one with a proposed text amendment. Item 4 is a very small problem and not worth the effort to attempt to promulgate reguiations. Commissioner Hedlund said that most cities that Impose architectural design reviews on new homes are new cities. Councilman Harbicht noted that the government is not'agood desigrler and there should be no restriction on freedom of desig!1- j-le ~rl1me!lteqJbliIt sioce.the buildingotall the new. homes in the Cliy, the Older homes are-now the ones that liIre sticking out like a sore thumb.
