MINUTES ARCADIA CITY PlANNING COMMISSION REGULAR MEETING Tuesday, May 9. 1989 The Planning Commission of the City of Arcadia met in regular session on Tuesday , May 9, 19.89 at 1:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with. Chairman Larry Papay presiding. Las Tunas Dr. Edmund & Lal Wan U Lowe Consideration of a conditional use permit, and parking and landscaping modilications to expand an eating establishment and provide seating for 24 people. The staff report was presented and the public hearing was opened. Edward Lowe, 1092 Calle Carrillo, San Dimas, said that he has read and is in agreement with all of the conditions in the staff report. He remarked that they were able to utilize the unit adjacent to them and commented that the increase in the number of seating is for customers who eat there during lunch hours and Is his primary business Is stili take-out. There were no additional persons desiring to speak in favor or in opposition. MOT1C)II It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with at dissention. Commissioner Clark remarked that the additional seating will not cause a problem with perking In the center. Robert Lee -- - .- Consideration of a tentative map for a 6-unit residential condominium project. The staff report was presented and the public hearing was opened. Alex Chan, 8730 Huntington Dr., San Gabriel, was there representing the owner and said that they are in agreement with all of the conditions in the staff report. He said that,the garage will be approximately 4' below the street elevation and noted that the ramp will comply with Code. There were no additional persons desiring to speak in favor or in opposition. Commissioner Clari< liked the project. Commissioner Hedlund preferred having the driveway from Fifth Avenue so the ramp would not be so close to the Intersection. PUBLIC HEARINGTPM 89-007 1915 S. Santa Anita Ave. (NW corner of Santa Anita & Wistaria) Mur-Sol, Inc. The staff report was presented. Staff explained that the setback for a front and side yard off of Santa Anita and Wistaria are 50'and 20' respectively,. The house on Lot 1 wllf face Santa.Anita.and the house on Lot 2 will face Wistaria. The required side setback for Lot 1 Is 20' and the average front yard setback based on aerial maps for properties on Wistaria is 39'. Consideration of a tentative parcel map to create two single-family lots from one lot. The public hearin~ ~ open~._ Richard Rulz. 132 La Porte. said that they are in agreement with all of the conditions In the staff report. In response to questions from. the Commission, he sald that they have not designed homes for the new lots but said that they would desIgn homes that best fit the lot and the area. He said that they will try and design the homes so they are set back from the street. Mr. Woolard remarked that the exisllng house could have a 20' sIde yard setback from Wistaria. Commissioner Clark noted that he would like the homes to have larger setbacks. Edwin Johnson, 1905S. Santa Anita, asked what the rear yard setbacks would be and explained that the subject lot is to the south of his property._ , _ _ Arcadia City Planning Commission May 9, 1989 Page 3 . . \ Staff noted that the back yard of one of the new homes and the side yard of the other new home would back up to Mr. Johnson's property. The front setback of the house facing Santa Anita is SO' and the side setback off of WIstaria Is 20'. The rear yard setback for Lot 1 Is 25' for single-story and 35' for the second-floor. The rear yard setback for lot 2 Is 2S' for single-story and 3S' for second- floor. She noted that a detached garage can come as close as 10' to the rear property line. Raymond Kenz, 68 W. Wistaria, spoke in opposition and said that this might set a precedent In the area. In rebuttal, Mr. Ruiz said this lot is the largest in the area which can be split and the others would not meel..code requirement so.the lot split would not set a precedent. There were no additional persons desiring to speak in favor or in opposition. MOTION It was moved by Commissioner Clark. seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissen~ng. Commissioner Amato said that the lot split complies and he could not see any reason to deny It. Commissioner Clark remarked that he would prefer going beyond the required 20' setback off of Wistaria for the house on lot 1. He said that he would like there to be a 2S' setback. Chairman Papay said that on the south side of the street on Wistaria there is a similar type of a split with the same dimensions. CommissionerSzany agreed with Commissioner Clark and wondered ifthe setback could bea condition of approval for the 101 split and remarked that he would like to see thE! side setback on lot 1be 2S'. He wasconcemed because this Is a corner lot and commented that he'd like a condition imposed on the side yard setback. Commissioner Hedlund asked about the maximum "height 01 the building on a 100' wide lot. He said that he would like to encourage them to maintain the setback. Staff said that the maximum helghtallowed for a 100' wide lot Is 35. Mr. Miller said that if the Commission imposes a side yard setback condition on the lot split then they have to show a direct relationship between the .Iot split and the requested setback. He noteclthat the applicant can appeal that condition to the City Council. He felt that the Commission should not design the house. Mr. Woolard said that he did not see a reason for requiring a greater side yard setback and remarked that the existing required setback is 20' from Wistaria. In response to Chairman Papay's comment In regard to setbacks, Mr. Woolard said that the lot spilt would provide for a better transition. He reminded the Commission that they should only consider the matter before the Commission whlcl1ls the lot split and not what may be built there. He commented that if the Commission Imposes a side yard setback on this property, Ihen they should also apply It to ail the lot splits located on comer lots that come before the Commission. Chuck Hickman Consideration of a tentative parcel map for a 9-unit industrial condominium subdivision. The staff report. was presented and the public hearing was opened. Chuck Hickman, 120 E.Duarte, Monrovia, said that the new units will enable small business owners to own instead ofTent. He remar1ted that they are in agreement with all of the conditions in the staff report. There were no additional persons desiring to speak in favor or In opposition. Commissioner Clar1t said that the project complies and Is an appropriate use. Commissioner Amato said that the lot Is large enough and was in favor of the project. Consideration of' a condltlot1al use permit 10 allow a residential manager's apartment wllhln a self.storage facility in the C-M zone, and 10 construct a building of more Ihan 20,000 sq. ft. within 100' of residentially zoned property. The staff report was presented. Staff sald that this project and Its modification are similar to 3 other self-storage facilities in the City. He noted that a survey!lhowed that most cities require 5-11 parking spaces and most fell \hat was too much.. A 6' high wall is required and in most cases it should be of decorative or stucco material but It is not.required in this case. The resident manager on \he premises is to controHhe property. In response to a question from the Commission, staff noted that In an event \hat auto repairs are done on the site the CUP can be revoked. Chairman Papay remarked that this is a benign use In a commercial zone. The public hearing was opened. Jeff Talbot, Icon Companies, Inc., 1301 W. Newmark Ave., Monterey Park, said \hat they are in agreement with all of the conditions In the staff report. He noted \hat the resident manager will have his own 2 car garege and remarked that in most self-storage warehouses the manager has only a one car garage. In regard to \he colors of the building, he said that the colors'will be \he same as what has been indicated in the plans. ' Commissioner Suny thought the parking was adequate. Commissioner Clark said \hat it Is a good use of the property. Commissioner Amato liked the 2-car garage for the resident manager and felt that the overall project was a good one. Chairman Papay saId..that It would be a definite Improvement. PLANNING COMMISSION DETERMINATION That the proposed sale of Aood Control property adjacent to 2641 Foss Ave. Is consistent with the General Plan. The staff report was presented. Arcadia City Planning Commission May 9. 1989 Page 7 . . .l RESOLUTION 1407 A resolution granting CUP 89-003 to operate an eating establishment with seating for.6 persons at 529 E. Uve Oak, Unit B. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to adopt Resolution 1407 to formally affirm the decision of April 25, 1989, reflecting the findings of the Commission and,the votes thereon. ROLL CALL: AYES: Commissioners Amato, Clark. Hedlund, Szany, Papay r-m: None Chairman Papay noted that there is a fIVe working day appeal period. MATTERS FROM COUNCIL Councilman Harbicht said that they had a mee!ing with Xavier Hermosillo who is the Chief Organizers with the LA Raiders coming to the San Gabriel Valley. He noted that they were informed that the original site looked doubtful and remarked that they could not reach an agreement with the County. However, several other sites that were taken into consideration by the EIR are now being considered as alternatives. He commented that Mr. Woolard expressed concern with the location of the stadiiJm and the heavy traffic that it would generate going west bound on Uve Oak. The Council expressed their concerns and he said that.he felt adamantly opposed to the project and would work against it. He noted that this would have a significant impact on Arcadia and would not be anything but a problem for the City. Mr. Hermosillo had stated that in addition to the 11 Raiders games at the site there would also be concerts, college games and similar type functions. Mr. Woolard saJd that the additional on and off ramps were addressed in the EIR.
