REGULAR MEETING
Tuesday, January 24, 1989
The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 24, 1989 at 7:30
p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Papay
presiding.

Amato from tonight's meeting. The motion passed by voice vote with none dissenting.

It was moved by Commissioner Hedlund, seconded by Commissioner Clark to approve the Minutes of
January 10, 1989 as published. The motion passed by voice vote, with none dissenting.

title only and waive the reading of the full body olthe resolutions. The motion passed by voice vote

Consideration of a tentative parcel map to
create ihree new single-family lots from
two existing lots
The staff report was presented.
In response-to a question from Chairman Papay staff indicated that the setbacks of the existing house on
Lot 4 will still comply with code.
Chairman Papay indicated that prior to opening the public hearing the City Attorney had a statement to
make, since they had received information concerning legal matters which were not germane to the
public hearing.
The City Attorney noted that the Commission had received a great deal of material including
correspondence from legal ,counsel, mostly with reference to whether or not this mailer proceeds this
evening or should be continued. II is the Commission's prerogative to continue a matter and they can or
cannot exercise that discretion. However, most of the items pertain to a civil dispute between the
parties, there are no court orders restraining or in any way precluding the city from p'rocesding this
evening. The materials are not gsrmane to the I,and use decision which is spelled out in the staff report,
so only with reference to the continuance do they have ,any bearing and In that regard the Commission
may proceed and conduct the public hearing this evening. It has been determined 'by staff and the City
Attorney's office that for purposes of the tentative parcel map the mattei is properly before the
Commission this evening and there is no restraint; to their proceeding to adjudicate this item.
Chris Bade, 909 South Santa Anita Avenue, dsveloper of the project spoke in favor of the proposal. He
noted that they were trying ,to complete the cul-ds-sac street and were asking for minor modifications
on three of the lots. The ,lots are compatible with those on the south side of the. street. Ths new lots
will exceed 7500 square feet; they will range from 9,460 sq. ft. to 10,59t sq. ft. The lots have
ample 'building area and they intend to match-tne'design oftl\e homes whichare'locatsd on the;south side -
of the street. When they developed the south side they had made provisions for three new houses. All
the sewer laterals and underground utilities were installed. They agreed with all the conditions of
approval set forth in the staff report and they had no problem with a corner lot of 80'-0". Many of the
neighbors feel that three new homes could only approve what is there now.
Chairman Papay asked if he agreed with the 80'-0" width on the corner lot? Mr. Bade indicated he did.
ChaIrman Papay asked with the realignment between IO,ts3 and 4 would the side yard setback on Lot 4
comply with code? Mr. Bade said it would; it was originally designed with the possible subdivision in
mind.
Gordon Maddock, gOO South First Avenue, Arcadia, spoke in, favor of this application. He noted th,at his
company had represented Chris Construction!n the original development and at that tims the pian was

to develop 7 lots, however, they were unable to acquire the property at 1000, South Fourth Avenue. He
felt the property was ideal for a 7 lot subdivision. He indicated that their office had submitted
signatures of property owners who were in favor of this project as proposed.
Vince Salvador, one of'the two owners of t 000 ,South Fourth, spoke in favor of the project. He thought
the development of the property as proposed would be an asset to the City of Arcadia.
Eileen Stephens the other owner of the property requested that tliis hearing be postponed until the title
is cleared.
Harold Ellis spoke in opposition to the proposed parcel map. He was in opposition to the "variances"
which were requested on the lots and recommsnded that the Commission deny the request for three lots
based upon the "variances" and let the applicant resubmit for a two lot subdivision.
Gordon Maddock, 'spoke in rebuttal stating that even if they created two lots, a modification to the lot
frontage would be required.
The City Attorney stated that the subject matter of this proceeding was not a variance and that the
word "vilriance" was being loosely used by everybody. There was no variance being considered tonight
before this body; there, were some modifications, but not a variance as prescribed In the California
Government Code or any other Planning or Land Use Law in California.

Motion was made by Commissioner Clark, seconded by Commissioner Szany to close the public
hsaring. The motion passed by voice vote with none dissenting.
Commissioner Clark felt the modifications were minor, however, he would like to see Lot 1 widened to
80'-0"; other than that he had no problems with the subdivision.
Commissioner Szany noted that tbls parcel map finishes off the sl,ngle-sided cul-de-sac. He noted that
there is,a one story home off of Fourth Avenue on the corner and it would be nice to see this,on the
north side. He fell it was better to have this cul-de-sac than not.
Commissioner Hedlund indicated he thought it was a good idea to complete the cul-de-sac, however, he
would like to see the lot line between 2 and 3 drawn radial. He was opposed to Lots 1 and 2 being ,
substandard.
Chairman Papay said this was an oppOrtunity to complete the cul-de-sac and as far as deficiencies, he
nofelfthat if we did riot allow any deficiencies, t1iere woUld be no need for-the Planning Commission.
One of the reasons the Commission was here was to use some judgment in cases where some variations
are required.
It was the consensus of the Planning Commissioners in favor of the project to go with an 80'-0" wide
lot on the corner.

Motion was made by Commissioner Clark, seconded by Commissioner Szany to approve TPM
89-01 with findings and motions A-I through A-3 with the condition that Lot 1 be Increased to
80'-0" and the width of Lot 2 be reduced to 60.66'.
