The Planning Commissionofthe City 01 Arcadia met in regular session on Tuesday, August 23; 1994 at 7:15 p.m. in
the Council Chambers 01 the Arcadia City Hail, 240 West Huntington Drive, with Chairman Bob Daggett presiding.

In response to a question by Commissioner Kovacic, she. indicated that the revised Modilication Committee Chairman
memo had'a typographical error; the meeting dates did not change.

2. PUBLIC HEARING CUP 94-008

Consideration of condilional. use permil to operate.a credit and finance vocational school.
The staff report was presented.
In response to questions from Commissioner Kovacic. stall said that condition 1 is a standard condition for schools. It
is more applicable to tutorial schools where parents drop the children 011 and the purpose is to countertrallic
congestion, but in this case, it is anticipated thilt the students will be.of driving age.
Staff went on to say that the applicant indicated they would have amaximum of 15 students and based on this
information, ConditiCln 5 restricts them to have no more than 15 students at anyone time. The Fire Department would
allow a maximum of 18 students.
In answer to Ii question from Commissioner Huang, Ms. Butler replied that the fire Department conducts,annual
inspectionsaf1d if they have any more students than what they are approved for. the Planning Division will be notified
and appropriate action will be taken. ' .
To a question posed by Commissioner Murphy, Ms. Butler remarked that parking is.based on lixedseating lis. floor
area. Since this school does nollall under fixed seating regulations,the,floorarea.regulation was applied. Under the
floor area regulations. they must have 1 space for ever 35 square feet or33 spaces, fixed seating.regulations.is 1
space for every 5 seats or'5 parking,spaces; The fixed seating parking requirement is applied to schools, churches or
places of assembly and the floor area regulations apply to uses that'do not have .fixed seating.
Commissioner Murphy was concemedthat the school might pose.a problem for the existing tenants and found It
dillicuil to justify approving a parking modification where tlie parking Is already deficient by 2 spaces.
Ms. Butler explained the parking regulations for fixed seating vs.,floor area. She indicated that itwouldbe
unreasonable.to require 33 parking spaces for a business thatwill have only have 15 students.
The public hearing was opened.
qregory Forrest, 2000 E. Orange Grove, Pasadena, the applicant was in agreement with all of the condilionsin the
staff report. He said they receive funds for their students who are displaced aerospaceWOrkeis or workman's compo
cases.
Commissioner Kovacic expressed concerns that if theywere to send 15 students to the collection agency, they would
have another 15 in the classrooms, bringing the total of the students to 30.
Mr. Forrest said they would not be utilizing the collection agency located at this address for training.
Commissioner Murphy was concerned about the requested parking modification and the existing deficiency.
Mr.. Forrest replied that they would need approximately 15 parking spaces for 15 students. He indicated that they did
not discuss the proposed usewiih the existing tenants oflhe office building.

Ms. Butier further explained that property owners are notified of the public hearings and not tenants of the office
building.
Seth Caplan, 23327 Hartland SI. West Hills, introduced himse~ and said he is one of the partners and briefly explained
his experience. He indicated that he has a similar schoolin Downey. He remarked that the existing Qn-site parking
would be adequate and did not anticipate a parking problem. He thought they would need 18-19 parking spaces, 1 for
each student, 2-3 for employees and 1 for a visitor. He said the classes would be in six week increments for 5 1/2 to 6
'hours a day. They would only have one class per day and they would not be scheduling a class in the morning and
one in the evening. They would never have a situation where some students would be leaving and a second session
arriving.
In response to questions by the Commission, he indicated they would not want to have two sets of classes - one in the
classroom and the other in the 'practical learning center. He indicated that it would be difficutt to shuffle,them from one
area to the other.
Ms. Butler-said that the other office uses in the building do not require CUP.
No one else spoke in favor or in opposition to this, item.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Huang to close the pUblic hearing. The
motion passed by voice vote with none dissenting.
Commissioner Murphy'was'concerned "about. the deficiency in the parking and remarked thatthe Code is already
overextended and he did not want to add to it by a use that would need 20 more. parkillg spaces., Although he was in
favor of the proposed use,. he wanted a better solution to the parking problem and felt the other tenants should be
made aware of the proposed application.
Ms..Butler explained the Code requirements for p.arking and said the definition Is broad, Since there is 110 "flxed
seating" o~ "permanent seats" the requirement is 1 space for every 35 square foot.. In "places of assembly" such'asa
church, schools or theaters, the requirement is 1 space for every 5 seats. ~ tlie latter would apply, they would only
needto,have 5 parking spaces for 15 spaces.
Commissioner MurphY'was still concemed and said Code requires 58 parking spaces for this office building but there
are only 56 and he was apprehensive about the additional deficiency added by the proposed use and the. possible
inconvenience for the existing tenants who are unaware of this proposal and the possible problems caused for them.
Mr. Miller suggested approving the CUP conditionally and explained the Commission can request that a report be
forwarded to the Commission after the school is in operation fora certain period of time to see n there' are any
problems.
In response to a question, Ms. Butler commented that a collection. agency is an office, use and does not require a CUP.
Commissioner Kovacic remarked that one advantage of a CUP is the power to control and monitor the use.. He shared
the. same concerns as Commissioner Murphy but liked Mr. Miller's suggestion. Since other uses in the City have been
encouraged to post signs regarding carpooling, he feltthe school should also encourage it and.that a location should
be determined for dropping and picking up of students.
Commissioner Clark agreed and Commissioner Murphy.felt it is a good use and were both in'favor of a conditional
approval with the opportunity to review it in the future.
MOTION
It was moved by Commissioner Kovacic, seconded by Commissioner Clark to approve CUP 94-008.subject
to the conditions in the staff report with the additional condition that signs be posted Ina visible area regarding
encouraging carpools and drop off locations; and that.staff pre.sent a report to the Commission regarding any
and all parking and traffic problems as a result of the proposed use and that the Commission reserves
juriSdiction to'take a~ditional action as necessary in six months.

Chairman Daggett noted there is a five working day appeal period after the adoption of the resolUtion. The
resolution will be adopted on Sept. 13 - appeals should be filed by Wednesday, Sept. 21.

Consideration of modifications to permit a 13'-0. side yard setback in lieu of 20'-0. for a proposed extension of
the exisllng second floor.
The ArchItectural Review Board of.the Rancho Santa Antta Residenfs Assoc. has approved the design and
the requested encroachment.
The staff report was presented,
Commissioner Kovacic said the next public hearing on the agenda is similar to this project and wondered why one has
several conditions that the other does not?
Ms. BUller explained that the modifications listed: are standard conditions that staff checks for during the plan .check
process. These condilions don't have to be listed in the staff report because they are automatically applied, In answer
to a question by Commissioner Kalemkiarian,.she said that staff encourages the applicant to obtain a letter of approval
from the adjacentneighboiwho WOuld be most affected by the addition.
Stattsaid that the applicant has verbally indicated that no trees would be removed. The Architectural Design Review
Board has. reviewed and approved the planS as proposed.
The public hearing was opened.
Jun Farol, 22407 Denver,Ave., Torrance, said the applicant will not be displacing any existing trees.

motion passed by voice vote With none dissenting.
The consensus of the Commission was favorable.

to the condttions inihestaff report wilhthe addilional condilion that no trees shall be displaced.

Consideration of a mOdification for a 10'.0" westerly side yard setback.in lieu of 12'-0" fora second-story room
addition to the main dwelling.
Staff Indicated that In reviewing the plans, staff discovered that additional modifications were required, and indicated
the public hearing must be continued to comply with notification requirements. New notices have already been mailed
to. the residents within 100 feet radius.

Eric Au, 1n2 Paseo Verano, San Dimas, said the homes in this area are tract homes and are identical. The house
across .the street has tl'1e same.street frontage and the proposed redesign is the exaci floor plan from said house.

Ms. Butler read the title of the resolution
Mr. Miller indicated that Commissioners Bell and Kalemkiarian cannot vote on the resoiution and should abstain.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Huangto adopt Resolution 1514, and to
formally affirm the decision of August 9, 1994 and the votes thereon.

CITY CO!JNCIL REPORTS / ANNOUNCEMENTS / STATEMENTS
Council Member Kuhn welcomed Commissioners Bell and Kalemkiarian to the Commission.
MATTERS FROM THE PLANNING COMMISSION
REPORTS/ANNOUNCEMENTS/STATEMENTS
Commissioner Kalemkiarian indicated that he attended the "Planning' Commission Workshop. on Saturday and was
impressed. It was very informative and helpful.
Commissioner Huang said thathe also attended andfound,it Interesting that some of the Commissioners from other
cities were paid between'$10-$100 to attend meetings.
It was noted that Commissioner Bell also attended the,workshop and thatCommissioner Murphy will be attending at a
later date.
MODIFICATION COMMITTEE MEETING ACTIONS
Commissioner Huang recapped the Modltication Committee's actions and explained the actions taken. He indicated
that the. Item was continued because It was unclear as to who the wall belonged to and the Committee was reluctant to
grant It.It the wall did not belong to the,applicant. Hopefully,.by the cOntinuance the applicant will be able to,provided
documents as.to the ownership of the wall.
MATTERS FROM STAFF
1. CITY COUNCIL ACTIONS
Ms. Butler gave a brief summary of the actions taken at the City Council's .last meeting and the Items that were before
them for consideration.
2. UPCOMING AGENDA ITEMS
MS.Butler announced the applications that have been filed and will be before the Commission as public hearings.
Ms. Butler announced the new City Hall hours. She welcomed the two new Commissioners and said shewas pleased
that they attended the workshop. She indicated that she is working with the City Attorney on setting up a training
session for the Commission that will deal with legalissues and will focus on issues that are unique to Arcadia, such as
the architectural review boards, homeowners association and the Modification Committee.
