The Planning Commission ofthe City of Arcadia met in regular Session on Tuesday, June 14, 1994 at 7:15.p.m.in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Oarkpresiding. Discussion ensued regarding MC 94-028, for modifications to rebuild and add to a single-story reSidence at270 W. Le!"on Avenue. Commissioner. Kovacic explained that the addition was consistent with. the foundation that was still in. place. The contractor had to remove some of the walls because of the dry rot. Ms. Butler expanded on that and said the original plans showed wails but they removed all exte.rior walls due to dry-rot. They did keep some of the in~rior framing but theirintEmt was to keep the exterior walls.but as the construction progressed,.they had to remove more of the walls due to damage. Staff utilizes a formula that sets forth what is conSidered a rebuild and what is considered a remodel. Commissioner Kovacic went on to explain his reason for voting againstitem 6, Me 94-032, for a 60'-0" front yard setback in lieu of 87'-6" at 115 E. Longden. He felt that the reason for requesting a modification should be a good one and that reason ought to be something other than "it gives mea bigger house than lean build". He did not think that the applicant met the burden. Anytime someone requests an encroachment into a setback, they should consider it a serious request and unless they meet that burden,.!t should. not be granted. . . , MOnONREGARDING RESOLUTIONS It was mov~ by Commissioner Daggett, seconded by Commissioner Kovadc to read all resolutions by title only and Waive reading the full bOdy of the resolution. He asked that the last paragraph'on Page 3 should be "the location of parking in the lot:in.rear" and not'1ack of parking". A spelling error. on page 4 of the Minutes. The word "elude" Should be changed tQ"al1ude" in the comments made by Mr. Speight. On page 7, his concern was "with definition of 'events'" and not the "discussion with events". Motion It was moved by Commissioner KovaciC,seconded by Commissioner Daggett to approve the Minutes as amended. The motion passed by voice vote .with none dissenting. ptJBuc HEARINGS 2. PUBUC HEARING CUP 94-006 16E. Huntington Drive Paula Zdara, Doris Ferguson and Larry Lorin Lorin: Oub 101 Sports Bar and Grille Consideration of a conditional uSe permit with parking and landscaping modifications to extend the operating hours to 10:00 a.m. to 2:00 a.m., and add karaoke entertainment at an existing restaurant and cocktail lounge. The staff report was presented. In answer to questions from the CommisSion, staff said that the current CUP has not lapsed and they can continue to operate the business as long as they comply with the conditions set forth in the existing CUP. The.applicants are requesting extension of the business hours. With the existing CUP,the business hours are from 11:30 a.m. to 10:00. p.rn. Sunday through Thursday and 11:30 a.m. to 11:00 p.m. on Friday and Saturday. Staff further stated thanhis is the same restaur~t that several months ago, a public hearing was held to revoke the CUP, they were violating the hours of operation. The. difference between. the two uses is that the proposal is more of a restaurant than a bar. In answer to Commissioner Kovacic's questions, staff explained condition 5 on page 5 of the staff report which deals wi~ st~t "visibility to illlow direct inspection and response by emergency personnel". He said that when one comes into the restaurant, he should be able to have a clear and unobstructed view of the entire restaurant and bar area. No rooms should be enclosed. Staff explained that the minor alteration in hours and the addition of Arcadia City Planning COmmission 6/14/94 Page 2 . . . karaoke does not affect the parking. Employees can be asked to park in the parking district and noted that two of the parking spaces would become handicap parking. Chairman Clark explained the.background of the karaoke regulations to Commissioner Kovacic and how the conditions werederive<\; In response to questions from Commissioner Huang, staff said that the eating establishments in this block that stay open late, are legal non-conforming and do not have.CUPs. They stay open until 2:00 a.m. Ms. Butler expanded and said that Baker's Square stays open until 12:00 a.m., because it is adjacent to residential properties and does have a CUP. With regard to the parking, she indicated that the restaurants have a lot of on- street parking, in the evening hours, when the other businesses are closed. This offsets the lack of parking. In answer to Commissioner Daggett's question, staff said that coin operated pool machines are considered an arcade machinecandthey can have up to seven without an additional CUP. In response to inquiries from Commissioner-Huang, staff. said that just because a business has a modification for parkjng does not. mean there will be parking problems. Staff has not observed any parking problems. The parking regulations have been designed to hopefully avoid problems, but if a business is extremely successful, even if they. comply or exceed the parkirtg requirements, there may still be a parking probiem. In this instance, there is a CUP with an approved parking modification. Ms. Butler said there is'alwiiys adequate spaces in the parking district. The restaurant can operate under the" eXisting CUP and the proposal before ihe Commission is to determine if the karaoke and the additional business hours should be granted. The parking is not an issue.anda modification was granted with,the existing CUP. She remarked that the "Downtown Revitalization Plan" prepared by Michael Freedman, whic;h has not been adopted by the City Council, does not recommend discouraging restaurant type uses but rather to encourage them with the hope that people will park at the parking district. Commissioner Kovacic felt there is a relationship between the.hour that. the. restaurant may remain open and the location where cars are parked. The public hearing was opened. Larry Lorin, 3475 Barhite, Pasadena,one of the partners briefly explained the backgrounds o/all,the partners.and how they became partners. He said that Paula Zdara is the owner of "100 to I Dub" andhasopefated that business for 16 years. The "l00'io 1 Dub" has never had any problems and has been running smoothly for many years. Jim Eldrige, was the \T..P. of Saga Corp. ",hich sold out to MarriollFoods in 19605. Marriott Foods is the establishment that caters hospitals and schools. He submitted photos of the restaurant before they began renovating to illustrate the-extent of deterioration prior totheir move. They have spent $75,000 to renovate the facility. He was excited about their proposal and.felt they needed to stay open urttil 2:00 a.m. to be able to compete with the other restaurants/bars in the immediate area. He remarked that all ;i!ong they thought they would be able to stay open until 2:00 a.m. and were.surprised when they discovered the time limits. In order to compete and help their ~ompetition, they need to have the same hours %peration. If they are forced to close at 12:00, they will be at a severe disadvantage to the other restaurants and bars in the immediate area. He said their establishment will be for the older crowd with music priinarily of the 40's and the.SO's. There will be no rap or hard rock music. They will be catering to an older crowd. The pinball machines are from the SO'S'and 60's and two coin operated pool tables. He briefly explained the design Inside and the types of food that will be served. He felt that Arcadia needs this type of an establishment for people to go to and have fun. otherwise, people will go to neighboring cities like S. Pasadena. If parking' is a problem, they will hire a valet company, which they have already contacted, to mitigate ,the parking problem. Patrons will drop their car in the front.and the valet will take the cars.to the parking district. Mr. Lorin went on to say that parking might be a problem from 6:00-10:00 p.rn. but people would not be coming in after that to eat. He anticipated that the restaurant would be 55~% of the business and the bar area would make up the difference. The noise level will. not be excesSive and would not be loud enough to be heard to the homes to the back, especially with two doors separating this area from the aIley. There is only one music machine which serves as.both a jukebox and the karaoke. He thought they would be.able to seat 100 people and did not know what the Fire Department's limit would be and commented that they did have Health Dept. approval. He said Arcadians need a place likE! this to go to instead of having to go to neighboring cities. Henoted that they wiIl be producing revenues for the City. Paula Zdara, 1203 Willow, Glendora, one of the partners, spoke.in favor of the proposal. She said that her family has owned the "100 to 1 Club" and they.have never been a burden to the City. They are in agreement with all of the conditions in the staff report with the exception of the hours. She felt they are more than qualified to operate a successful business, conSidering her experience of 15 years with the 100 to 1 Oub and employment with the race track. She submitted a petition signed by many of the residents and property owners to the rear of the subject site, inCluding the two immediately to the rear indicating their approval of their proposed hours of operation. In answer toa question by Commissioner Kovacic, staff said that the valet would be permitted to take the cars to the parking district. Bill Connolly, 21 S. First, previous owner of White Eyes, spoke in favor of the proposed use. During the time that he ha9 his business at the above address, he. never observed any parking problems. He frequentIygoes to the "100 to tOub" and enjoys the crowd. He said that the previous Council spent a lot of money to.hire,a consultant to make reconuneI\dations regarding downtown, and nOw this Council has not implemented any of them. He did not think that.this many restrictions should be placed onapotential business, especially considering all the vacancies in,the downtown area, because, thai will drive them away, subsequently taking their tax;money with them to neighboring cities. William Wong, 117~. Magna Vista, the property owner said lh!it he made,a mistake when he leased to the owners of "Love Boat". They created a lot of problems for rum as well as with the City. He believed that trus new tenant.would bean asSet to the City and did not think there would be parking problems. Mike Roberts, 11 0 Mill Run, Monrovia, said he is one of.the partners and said they will ,serve food until 1:00 a.m. The neighboring business will benefit from them because they will be bringing patronage to theatea, especiaIly the ones that are open late. They will keep a lot of the money ~ the City considering their proximity to the race track. . Kermit Hartzler, 1804 Windsor Rd., San,Marino, spoke against this:use. He is the property owner of .15-17 E.. Huntington Drive. He wasafraidof the clientele that would come to this location. HeJeared the loss of his tenanisand wondered what he would do if they did leave? If by any chance, his tenants would leave this location, he believed his property would depreciate. He thought this would be.a pool and pinball hall. A restaurantdoes not need to be open until 2:00 a.m. He asked how many of the Commissioners go out to a restaurant at 10:00 or 11:00,at night? In his opinion, this is not a restaurant, but a bar, He thoughtlhat approving this under a "restaurant" would be retrodevelopment rather than redevelopment. He asked that the Commission unanimously del)Y the request. He could noi understand how they Spent $75;000, without consulting the City regarding the regulations. In answer to questions, from the Commission he thought an offiCe type of use, such as an attorney or!, real estate office would be compatible and not a bar. In his opinion, the proposed use would be incompatible with the excellent.properties that are presently there and is not a suitable use for the downtown area. He was concerned with the parking situation and felt .vandalism would increase. He thought this business. would cost the City money instead of generating one. He explained that additional police would be required to monitor. The proposal would reduce property values. In response to questions fonn Commi~ioner Kovacic, he said there have already been sports bars'in the area that have nOl.been successful. .He did not think the. site is large enough to accommodate th~ use, especially with the eXisting parking situation. He commented that this use would be a prolllem for the residentSonAlta and explained that approximately 10 years ago, he lived on.Alta behind the Cheyenne Supper Oub and he recalled vandalism andparkfug problems created by their tenants. In response to comments made by Mr. Hartzler, Mr. Miller said the number of bars in a particular area'are not,an issue before the Commission. Zekie Lawson, 9 Alta, said he is the manager of the apartments at 5-9 Alta. They have had many problems with eating establishments on the south side of Huntington. They have found drtinkcustomers urinating in their carpOrts, the patrons block their cars and on several occasions they have needed police assistanCe. Because the apartments do not have adequate parking, they purchase parking permits annually from the City and find that sometimes. they cannot park on the. street, because the customers from the bars are. parking on Alta. He complained of the noise created by the'rock bands at the bars' that they can hear late at night. rn rebuttal, Mr. Lorin said that the bars that the previous gentleman was referring to have live perfonnances by rock bands, which is something that they will not be doing. He commented that Mr. Lawson's property is not directly behind their restaurant. and remarked that the petition that they submitted includes the signature of the property owner directly behind their restaurant. He felt their establishment would be an aSset and would enhance property values rather than decrease them. This would bea nice. atmosphere for people to go for lunch or dinner. He reiterated that parking would not bea problem after 11:00 p.m. The prpblem might occur from 6:00 p.m.-lO:OO p.m., during the dinner hOurs, but pointed out that many of the offices will be dosea at that time and street parking will become available and said ,that they will be required to provide one handicap parking space. He was in favor of closing the entrance from the alley but thought that the rear entrance might bea Fire Dept. requirement: He re~ked that the karaoke'machine and the juke.box are one machine and he did not think that the amplification fromit would get through two. exit doors located in the rear to'disturb the. properties'to the rear. MOTION It was moved by Commissioner Daggett, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with none dissenting. Ms; Butler responded to questions by Commissioner Kovacic, by saying that the ather bars anll restaurants are legal non-conforming because they were in operation prior to the requlrement of CUPs. In response to questions asked by the Commission, Mr. Miller noted that the Commission. can impose. a sunset clause to review the project after it has .been in operation for a certain time period. This will allow the Commission to see if there have been any problems as a result of the hours of operation. The CUP runs with the land, and if this cuP is granted, allY one can open a restaurant under the CUP. Arcadia City Planning Coininission 6/14/94 PageS . . Commission Hedlund commented that valet parking would not be a viable solution to the parking problem. He thought that peOple would tend to park on the residential streets rather than utilize valet parking. This probably could be a very successful operation and could add to the deterioration of the parking on the south side of Huntington. He was concerned with the lack of parking and the additional hours and its proximity to residential properties. He feItthere are other properties in the.City that would be a more suitable location. Commissioner Kovacic felt they are facing a dilemma; if they approve the project, it restricts the flexibility of the area to create parking'and on the other hand there is the plan to encourage this type of uses. He said. the Commission should ask if this is the right location for this establishment, especially with the limited parking and the impact on the residents to the south? Commissioner Huang said the downtown area needs successful businesses to revitalize it. He felt the. hours of operation are an important part of survival, especially in this economy. Commissioner Daggett.thought this is.a good concept He sympathized'with the residents on Alta. He did not want to discuss parking and said they should consider the hours and the karaoke and should stickstrictly the parameters of approval for this Commission. Chairman Oark f~It this would be a good project. There will be some impact on the residents to the south and that is the big difference with this area and S. Pasadena. He felt noise llivels can be controlled and said a sunset clause will allow them to review the hours of operation after they open. Commissioner Kovacic suggested limiting them to staying open until midnight on weekends. The only way he would consider staying open later would be.if they had a trial run of staying open until midnight, and'if there are. no problems then he would be in fayor of remaining open later. Commissioner Daggett thought their requesflo stay open unti12:oo a.m. should be approved. He would not be in favor of limiting. them to midnight and he thought their request should be approved as submitted.and see what happens. Commissioner Huang agreed with Commissioner Daggett and wanted to allow them to try.it for a set period of time. He thought they should be allowed to stay open. until 2:00 a.m. and it should,be monitored to see inhere are any problems. CommissionerHedlund commented that the parking problem alreadyexis~ and he could not see why they would .want a trial run to see if there is a problem. The'other restaurants/bars are legal non'"Confonning. Commissioner Kovacic,asked ifthe City is going in anyone direction with regard to the downtown area and are there any set goals? Ms. Butler'responded that the downtown revitalization plan done by Michael Friedman has been put on hold by the Council. Staff has not been directed t6 go forward with his recommendations. This concept tried to create. a retail area with restaurants ora "people downtown". Commissioner Daggett pointed out that the immediate residents to the rear submitted signatures indicating their approval. The applicant provided a petition with the signatUres of the majority of the people to the south. The neighbor.!n opposition, does not reside directly behind this property. Commissioner Kovacic recommended approving the CUP as suggested by staff and the additional.2 hours can be granted at a later date if there are no problems. He thought that the community should go in some. direction and there should bea goal. Is the goal to have a vibrani old Pasadena style area that people can walk safely at night and.if that is the goal, then that leads him to one decision. If the goal is to have a respectable restaurant row, then that leads 'him to another decision. . Arcadia City Planning Commission 6/14/94 Page 6 Mr. Miller said as Ms. Butler ex!ned the City has been working on the 'talization of downtown. Sqme of the . plan involved significant expenditures, so it was put on hold and then there was the election with three new membets. Commissioner Kovadc said the Commission is in favor of the concept of allowing the restaurant/bar being open untilmianight. The issue is whether they permit them to stay open the extra two hours to 2:00a.m. Commissioner Hedlund remarked that thisis not an ideal site. He. remarked that the applicant did not look into the conditions of the eXisting CUP, until after he spent a considerable amount of money renovating. MOTION Commissioner Kovadc moved to approve the CUP 94-006 subject to the conditions in the staff report but limiting the time until.to 12:00 a,m.butwithout prejudice to the applicant to come back to the Commission at a later date for the additional two hours. The motion died due to'a lackof a second. MOTION It was moved by Commissioner Huar\g, seconded by Commissioner Daggett to approve the CUP 94-006 subject to the conditions in the staff report with the condition that the Conunission review it after it has been in operation for six months, Commissioner Huang clarified and said the applicant will be permitted to stay open until 2:00 a.IiI, and after six months of being in operation, the Commission should review the.CUP again to see if there have been any problems. The Commission at that time can determine. whether to allow them to continue to stay open until 2:00 a.m. or to reduce the hours, depending on the outcome of the trial run. P.UBLIC HEARINGMP 94-004 12400akhaven Lane Handojo Tjiptorahardjo Consideration ofa modification to develop the proper.ty with a.new .two-storysingle-family residence with a subterranean garage in lieu of Munidpal Code Section 9252.2,21., which prohibits below grade or subterranean..parking. The staff report was presented. Staff explained that this property is not in a homeowners association. This is a new structure. The,modification is neCessary to. accommodate the design of the project. The public hearing was opened. Monica Kao,2225 W. Commonwealth, #207, Alhambra, the architect of the project said they are in agreement with all of the conditions in the staff report. The slope of the proposed driveway will be less,steep than the Arcadia City Plaming Commission 6/14/94 Page 7 . . existing. She explained the design of the driveway. She showed the model of the proposed home to better explain the requested modification. The existing house has a 25% slope, which is a non-confonning to the existing driveway to the garage. Mollie Spellman, 1236 Oakglen Ave., spoke against the proposed house. She was surprised that they did not obtain the association's approval and was opposed to the loss of her privacy which will occur if the home is built. She complained that.several years ago the property owner cut all the trees on. the hillside which attributed to their privacy and,since then this hill has been barren. If this house is approved, they will look out their window and see a inassive house instead of seeing greenery and treeS. She did nofagreewith approving a subterranean garage, which in her opinion was not in keeping with the neighborhood. She was against the whole idea. In rebuttal, the architect, Ms. Kao, explained that they will not be rernovingany trees and Said that she .was not involved with the removal of the trees several years.ago. With the topography of the. area, this is the best design, for the home that will work and noted that they will be building on the existing pad which the existing house is on. She indicated the materials thatwil\ be utilized and said that the structure will be stuccoed and the front portion will be granite. No one'elsespoke in favor orin opposition to this.item. MOTION It was moved by Commissioner .Daggett, seconded byC9mmissioner Kovadc to close the public hearing. The motion paSSed by voice vote with none dissenting, CommissionE!r KovaCic said. that without an architectural design.review bOard, they are greatly limited by what can be considered. Staff explained that it would noi be possible iobuild this house..if the garage was to be on grade. If the request is denied, it might delete the whole project. CommissionE!r Daggett said. that he does not approve of.subterralJean garage but in this case, there does not seem'to be any other choice. He noted that ,the building height is inconformanre. Discussion,ellSued regarding the average grade and the location where it is measured from and staff said that the average is taken from the existing gradE! that is covered by the building. ComniissionE!r Hedlund remarked that they would have a difficult time constructing the garage to the rear. CommissionEer Kovacic said that "they would have to live with less than 7,000 sq. ft..of living space". Staff pointed out that they are proposing to remove the existing playroom and as long as they comply with the setback requirements, they can put a garage'at'that location. PLANNING COMMISSION DETERMINATIONS 4. Determination that the proposed vacation of El Monte Street between Campus Drive and Duarte Road, is in conformance with the City's General Plan. The staff report was presented. Ms. Butler said that the General Plan does not discuss this and in reviewing the Circulation Element, there was no reference to this street Joe Lopez, Director of Public Works, said that his department recently did a traffic count on this portion of EI Monte Avenue and they counted 2700 cars traveled on this street, during a 24 hour period. An average of 330 cars traveled during the busiest time oftheday which was 8:00 a.m. and 3:oop.~ He did not know what the traffic count would be during the racing season. He was unable to say how many of these cars would utilize Park Avenue, if ll\e street vacation .is approved and what the affects would be on Park Ave. They studied several different choices and the vacatioll. ofEI Monte Ave. was the'one with the least amount of impact. The school can build a parking structure buUhis would cost approximately $6,000 perparking.space. Mr. Miller noted that there will be another public hearing before the City Council. He had substantial concerns with placing "No Through Traffic" sign on Park Ave. for the following reasons: 1. It is not authorized on the Vehicle Code 2. Not enforceable 3. It is.somewhat.misleading, it is a public street but the courts say they have to be through .streets, but we say they are not. 4. C;:iiy defense lawyers have warned him about the side affects of misleading people, perhaps creating a situation with liability consequences. . He went on to'say that this might discourage the people from using Park Ave. and helps'those people, but it creates a longer route.for people who no longer are going to be able to use El'Monte Ave. between Duarte and Campus. It may solve. one problem but creates another. Chairman Oark had a difficult time rationalizing this move and making people go all the way around to get to the other side. Commissioner Daggett was opposed to the vacation and agreed with the City Attorney. The traffic signs do not do any good because he resides on a street with one and people utilize Stanford St. to get to the race track. The vacation would provide 100 additional parking and he could not justify approving this for 100 parking spaces. He wanted them to make a presentation that they are in a great deal of distress without additional parking and there is absolutely no way they can afford to get it any other way. He.remarked that once the City gives up the street, there is no way of getting it back. He did not want to be a part of the body suggesting 2700 cars traveling through Park Ave. Assuming thereis acute parking problem, why can't the school encourage the children to carpool. He referred to the bagel bakery which was approved and they were required to post a.sign to encourage carpools. l:Ie remarked that if it is good for the private industry, it is good for the public schools. Commissioner Kovacic said that his children attend Arcadia High and in .his discussions with others, they feel that this plan does not make sense and ask how does the addition of ninth graderS increase the need for parking problem, except the teachers for those ninth graders. The present parking lot is not overutilized. Mostof the kids Arcadia City Planning CommisSion . 6/14/94 Page 9 . . park on Campus or Duarte because the seniors can go out to lunCh bum they park in the parking lot they cailnot get out. ~ Commissioner Huang said he frequently uses EI Monte Ave. and since there isa lot of traffic on Campus, he has to wail"a few. minutes at the intersection of El Monte and Campus before continuing. He said that he would begin. to use Park Ave. and felt that the other drivers would probably do the same, even if the sign is there. In response to a question by Commissioner Huang. Mr. Lopez said the closure of El Monte would result in about 100 spaces. There would be restricted parking on Campus Drive and Duarte that would increase the safety for pedestrians and traffic.
