The Planning Comn\jssion of the City of Arcadia met in. regular session on Tuesday, January 25, 1994 at 7:30
p.m. in the Council Chambers of the Arcadia Oty Hall, 240 West Huntington Drive, with Chairman Tom

The staff report was presented. The Staff indicated they received two letters in opposition to the project from
Peggy Ulbrich, 2401 S. Third Ave., and from Ric~d &: ~rances Rabolini, 2515 S. Fourth Ave.
DISCUSSION
Commissioner Hedlund.askedif what they have before them is what the traffic engineers recommended.
Donna Butler replied no, the plans before,them;showa wall that extends easterly from the property line to
the first driveway out to Live Oak Ave, The traffic consultant suggested a driveway approJdmatly where
the loading area is located allowing trucks to enter the loading area directly from Live Oak.
Discussed this proposal with the Public Works Department,and we feel there could be problems with. trucks
crossing Live Oak,at an unsignalized intersection. Also we feeUt could create a confIictwjth both eastbound
and westbound traffic on Live Oak Ave. The purpose of the solid wall was to reduce the visibility and the
noise from the loading area..
Commissioner Hedlund had concern regarding how large semi-trucks could get out of the loading area,
Ms, Butler said would exit onto Tyler.
Commissioner Kovacic asked about condition number seven that talks about the hours that delivery is
prohibited and wanted to know if there was a reason that peak hours were not induded as a condition.
Ms. Butler replied no.
Commissioner Kovacic ,asked ablJut condition number ten, the Police department's.recommendation concerning
the fencing, but they did not address. the issue of lighting. Kovacic asked if there was a coder'equirement that
will take care of that or is lighting something we should address to the Commission.
Ms. Butler replied that 20'-0" highlights are proposed in,the parking area. The lights are required to be
screened and directed away fro adjoining streets and property, '
Commissioner Daggett asked about operating 24 hOUrs a day, does that mean they will be selling liquor 24
hours a day, Another concern was the 2 pylon signs.
Ms. Butler said the applicant could address the !ialeof liquor. In regards to the pylon.sip, they are
conceptual in nature. The signs on Tyler dOes not meet ourvehiculai visibility requirement. The signs will
have to be approved by the Planning Division.

Commissioner Daggett also asked the distance between the east side of the, new proposed building and the
exisisling building for the electrical and power line easement. He was concerned if there will be enough room
for pedeStrian usage.
Ms. Butler replied that there is a space there, but it is for easement use only.
The public hearing' was opened.
In Favor
Michael Rue, President ofcMarkelplace Properties, 13522 Newport Ave" Ste. 202, Tustin, CA, 92680, stated
that before they even approached the City with their project they approached the neighbors in the vicinity
of the property and asked for their input on the project. October 21, 1993 wa.s the first meeting at a local
Church on Lynrose and there were'approximately 100 people in attendance. At the meeting we made a
presentation of the project and there were many comments both positive and negative. Those present Were
asked to fill out a questionaire; 70.4% indicated they were in favor of the layout; 77.8% were in, favor of the
building design; 68.5% were.in favor of the projeCt. The'second meeting was held at the Arcadia, Monrovia,
Duarte Town Council on November 16, 1993, this meeting was not as heavily attended.
On the conditions we would Hke number 7 to be modified slightly to allow delivery to starht 6:00 a.m. in lieu
of7:OO a.m. so that we can get those trucks in on,non.peakhours,
Albertonswill have approximatley 15 semi-trucks a week; usually a maximum.of 2 in any on day.
Landscaping ' will be planted on the east side of the building: there will not be a wall; we are trying to.avoid a
situation were people might,congegate and want to keep it open so that if the police drive down they can see
all the activity going on behind this building as well as the side of the building. There will be no walls on
the south side of the building; there will be landscaping. The building to the east will cover up about half of
the back oHhis building. There are 10 exsisting mature ficus trees along the south side of the property and
they were proposing. to plant more trees.
Commissioner Oark asked Mr. Rue what they were proposing in addition to the treeson the south. side of the
structure and adjacent to the .parking lot,
Mr, Rue replied, since the original design the building has been reduced a foot and a half in height. The
second thing we did to soften the wall was to propose a 4 foot retaining wall adjacent to the the property line
a.nd plant a landscape berm adjacent to the southerly market wall.
Commissioner Kovacic asked what Mr. Rue felt ~boutthe delivery layout, arufif he felt there was a better
design, Kovacideltil is .an, awkward way to deliver groceries.
Mr. Rue,repHed'that this is notan unusual design when you have a fairly tight piece of property adjacent to
residential. We could have pulled the building ,forward and put the loading dock.in the'rear and basically
had the trucks circling the building to get out, but the noise created from that would be undesirable. This .
proposal is not .000rJii'st choice for delivery, but it works. The primary reason for this proposal is to keep the
trucks and noise as far away from residential as possible.
Commissioner Kovadcasked about delivery hours and.avoiding peak hours. He wanted to know if,Mr. Rue
was requesting an open window from 6:00 a.m. tolD p.m. and. wanted to know if there were any hours in that
time frame that he could safely avoid.
Mr. Rue felt thatMr, Derrick could speak to that question better.

Jay Nelson, Linscott, Law & Greenspan Engineers, 1580.Corporate Dr., Ste. 122, Costa Mesa, CA, stated that
his firm prepared the traffic study, What they have done has been outlined in the staff report, traffic
impacts at3 key'intersections, they also have done exsisting,moming and evening peak hour countsafthose
locations. They added additional traffic growth. to the existing conditions and then, added the projections for,
the traffic at the completion of the center. ,Based on the traffic and parking analysis'Weco!,c1uded there
would not beasignificant traffic impact at those intersections. In acldition a lot of the.traffic that wiUbe
entering the center is existing traffic from the neighborhood.
'CommissionerClark.asked Mr. Nelson ,approximately how much will the traffic increase?
Mr. Nelson indicated the increase 'in' traffic volume from the project will be 115 trips in the morning peak
hours. 75 of thoSe willbe'inbound, 40 outbound witha,total of 115 trips. The peakhours are from 7-9:00 a.m: A
little over a car and a half per ,minute. In theevening'hours it will be 450 based,on the standard traffic
generation rates. This is based on 3 key intersection, the. level of service which is. rated; on a scale of A through
F, and those level of services are not expected to change.
Commissioner Ciark asked about theintersection'of Third and Live Oak, right and left turns on to Live Oak
from Third.
Mr. Nelson replied that the right turns are not thatdifficull; hOWever, the left turns are difficult The project
is actuallyamovement.from Thir~,Streetaway from the project, so this movement will not be increased by
this. project. .It is an exsisting condition. Thevolumes were low enough on ThirdSt. that it does not warrant a
traffle signal.
Commissioner Kovacic asked.ifthis.plan is the optimum,way to circulate traffic or would you have other
driveways located on the site.
Mr..Nelson replied thatstrict1y from a.traffic standpoint they would like to see a driveway to serve the
loading area by itself,so trucks don:rhave to circulate through the site.
Jeff Dierck, Albertson's Senior Real Estate Representative for the Los Angeles County area, 1180 W, Lambert
Rd., Brea, CA, noted Albertson's will be restricted by the ABC (Alcoholic Beverage Control). The latest
alcohol can be sold is 2:00 a:m., and in some cases the ABC will restrict a marketto 12:00 p.m.
Alberton'swill have a problelTl restricting the deliveries between 11:00 a.m. to 2:QO p.m, They would be glad
to deliver between 10:00 p.m. and 6:00 a,m. The reason' they punn a sound wall along Live Oakw!,ssoyou
would not hear noise from the trash compactor and trucks. They.also believe that the mostexpedient way to
deliver groceries is an additional ,break in the wall; however, they have reviewed the situation with our
trucldng'department and they feel 1 00% ,comfortable with the proposed design.
Commissioner Clark asked what they would,anticipate the delivery hours to be given the hours recommended
by staff.
Mr. Dierck replied 6:00 a.m. to 7:30 a.m. and'7:3O p.m. to 10:00 p.m.

Mr. Dierck replied 4:00 p,m. to 7:00 p.m.
Sy Perkowitz, Architect, 911 Studebaker Rd., Long Beach, CA,specializesin neighborhood shopping centers.
The layo\Jt of the shopping center is functional. They have bee'l,sensitive to the residential area; the center

Carolyn Fiegler, 11159 Daines Dr., Arcadia, member of the Monrovia, Arcadia, Duarte Town Council, she had
six residents in the direct vicinity of the proposed market that called her expressing approval to the new
project resulting from the meeting held by Mr. Rue. Two of them'reported that they are elderlyand handicap
and they feel that they would greatly benefit from the market. From her own view and the view from the
south ,Arcadian's, in the County area she feels it will greatly benefit them, but would like dial-a-ride to
provide transportation to the markets that the County part of Arcadia also spends their money and shops at.
Also for the,breaks in the wall she hoped that there would be something besides wrought iron that will be
used.
In Opposition
Ted Parker. 25005. Third, Arcadia,.felt he got the information quite late. He had concerns with traffic on
Third Ave. He felt that cars exiting on Live Oak from the market will turn up Third St. to go north. Hefelt
the traffic study had no regard for the residential streets. He is concerned that cars will chose to go out Live
Oak, becauseTyler is already so congested. He also .fears the, traffic on Third will make it imposible for him
to get out of his driveway. Mr. Parker is concerned with .potential traffic backup on Second and Longden,
which will require a signal.
In the Police report it states that if there is any increase in traffic which Mr, Parker said there will certainly
be an increase,' there is a potential traffic problem for bicylist, vehicles and or pedestrians, He further states
that in the. report the police were going to try'to'mitigate this, mitigate means to lessen. not mean to
eliminate.
Mr, Parker feels the study should be done with more intersections and streets. The report ~ouldbe more
meaningful if it included Second.and Longden, Third and Longden, Fourth and Longden, Third and Live Oak,
Fourth and Live Oak, Sixth and Live Oak'and,even Santa Anita and Live Oak.
Commissioner Kovacic,aske<tMr, Parker what other type of use would he suggest for this property.
Mr; Parker.replied he. envisioned a school.
Andrew Bobb. 1.1104 E. LynroseSt,. Arcadia.was concerned with the traffic generated on Lynrose, cars use that
street to get to. Santa Anita.and they ha'(e already had several accidents on that street. Tyler is like a
freeway already and he is afraid the:additional traffic will make'it even more dangerous for young children
crossing the street. He is alSo,concerned about the alleys that run behind,those street will, generate more
traffic. Itwas mentioned that Albertson's is the only supermarket in t~t area, tlus is not.true .there is a
Ralph's. He doesn't feel the,neighborhood can support21arge supeimarket's in this,area. Suggested the
property be turned into a park.
Jerome JenSen. 5639 Cochin Ave., Arcadia. feels that the easement behind thestore.will.breedtransients,he is
concerned with the property values and impact. He feels the vine. and ivy idea to soften the building is a bad
idea because it breeds rodents. His other concern deals with graffiti, right now it is nota problem but feels it
will become a problem. Finally everyone he has taIked to is negative, not positive about this project.
Dan Verstuya, 5638 Cochin Ave., Arcadia, was concernedwith,traffic on Lynrose and Fama. He is concerned
with cars parking on Lynrose and would like a red CUrb on Lynrose. He suggestedlhe design of the building
would look more residential if they started al'lO'-o" and increasing gradually withslope<hoof.
Alex Vag(), 5619 Marshburn Ave:, Arcadia,.said he personally is not opposed because he does not have an
altematiUdea, howev'erhe would prefer a business that.had hours from 8:00 a.m., to 5 :00 p.m. He suggested
four way stop. signs along all of the intersections. Also, he,is very concerned with rodents andcockioaches.
He also wanted to know what kind of extra protection would be provided for the residents that live in the
county area.

Patricia Ames, 2222S, Secend, Arcadia, also agrees with the traffic cencerns. She feels this area .is basically
a residential area and does !leUeel a supermarket will de well. She,is <!lso concerned with putting industrial
lights en the site and the neise preblems, She feelnhe preject sheuld be scratched.
Terry Edgingten,.2413 S. Third Ave.,}\rcadia, is also cencerned with safety .of ehildren.and,thetraffic. She
suggested sidewalks and speed bumps en Third Ave.
Sylvia Hem, 2525.S, Secend Ave., Arcadia, spoke against the project, and Albertson's. She is veryccncerned
with traffic and ne sidewalks. She feels that the children are net safe with the new proposal at:ld the traffic
that t~is will. generate. She feels that Albertsen's is geing te fail. She deesncffeel there'is a need fer twe
supennarkets in the area.
Ces Sawer, 5628 Marshburn Ave., Arcadia, shared his concern .over the traffic .on Tyler, he doesnctfeel that
Tyler can handle the traffic that. this prcjectwi1\ generate.
Rebert Lucas, 5639 N,.Farna Ave., Arcadia, lives,6n the south/west comer ef,Farna and LynreSe. The preperty
accress the street has always been a bone bf centention, He is concerned wilit the traffic en Farna and
~intenance .of the area, and the pedestrian access en Lynrose. He fears it will result in parking en Lynrese
Ave. He is alse ce!,cerned with d17liveries and trash pick-up. As far as the preject is concerned he is not
tatally against it. HeJears that Albertan's will natlive up ta the .ordinances.
Leuise Parker, 2500 S. Third, attended .one .of the Albertson's meetings and theught it was a nice design. One
thing they have,necentrel ever is the traffic which. makes it an undesirable preject. The traffic this project
will generate will create,majer problems in the residential area. They werenatgiven preper neticeand net
eneugh time tegetmare neighbors tegether. She feels that fer the sake .of publicrelatiorui more people sheuld
be netified,.andde mere than what isJegally required. She feels that net only will the property values'ge
dewn but she feels that insurance rates will ge up.
AI Brandveld, 2411 Third Ave., Arcadia, is very cencerned with traffic. The speed .of the traffic is between 35
ta SO. mph. He is concerned with the trashthatthis preject may create an the streets, already frem. the 7-11 he
finds empty beer bettles on the street, wrappers, etc.
Raymand Kettle, 5673 Heddart, Arcadia, was very cencerned with the lighting and the effect on the
residences.
Dale Edgingten, 2413 S. Third Ave" Arcadia, feels this project is poorly designed. The architect even said
that this is a very difficult site for a grocery stere, becauSE! .of the building locatian, traffic, etc. This property
is best used fora limited cemmercial use with ne constant traffic problems.
Sverana Malabanan, 5757 W, Century Blvd., Ste. 80S, Las Angeles, representative .of 7-11, is netfer.ar against
the preject.The .owner is'in Hang Keng.
Roland E, 'Hill, 2530,Feurth Ave., Arcadia, is concerned with mere traffic en Faurth Ave. as a result .of the
market. During 7:00 a,m, and 9:00 a;m, there iu let .of ",est bound ' traffic en Live Oak Ave; In the evening
between the heurs .013:30 p.m. and 6:30 p.m, thereis heavy traffic east bound. Heis cancerned with
accesSibility. He feels alight manufacturing busineSs with !lermal business heurs we\lld be nice and weuld
provide jebs in the area.

On the issue of the parking along Lynrose, if it is the City or County's wish. to eliminat.e parking on Lynrose he
would have no problem with that.
With respecuo the traffic problem, most of it is already exsisting condition,
This is a covenience oriented use. It is not designed to.attract people outside of a 1 to 1 1/2 mile radius of the
site, The traffic should be viewed as noi more but reallocated.
As far as appropriate uses for the,property, it has been his experience that it is very unusual to have light
maimfacturing in residential areas. It is overwhelming the number of retail uses on Live Oak.

DISCUSSION
Commissioner Kovacic asked Donna Butler from'a planning perspective how do you differentiate a C~M from a
C-2.
Donna Butler replied that a .C-M zone allows light maunfacturing uses, as well as commercial,'retail and
office uses. The C-2 zone is for commercial use only and dOes not allow light manufacturing,
Commissioner Huang wanted to make a 'comment about the problem with the,sitting of the retail buildings.
He feels Live Oak is'similar to Huntington Dr., he feels that the buildings should sit on the property line.
The way the project!is sitting in his opinion does not contribute to the street character.
Commissioner. Kovacic tried to picture in his mind.if there are similar supennarket.properties,; he noted
Ralphs and a Vons on Second and Foothill, Von's PavilIions on Baldwin and Golden West, Hughes at
Huniington and. Sunset, so in detennining if this is a unique case, it is not. He asked Donna ButleriHhethinks
Ralphs on second would be sitnilar.
Donna Butler said yes, and also the Alpha Beta on Duarte and Second would be similar; it also is adjacent to
residential.
Commissioner Kova~ic asked if Donna,was aware.of any complaints from the residents near the Alpha Beta
due tothesupennarket.
Donna Butler replied she was not aware of any.
Commissioner Clark expressed some concern over the potential traffic, however, he also feels that there is a.
lot of conjecture as to the actual impact the project will have on traffic. He doesn't feel that Second, Third and
Fourth Ave, will be turned into a freeway either.He,did not think.there would,be that many people; and felt
AlbertsOn's will bea good neighbor,
Commissioner Hedlund thoughUhe market would be a good addition to the neighborhood. He expressed
concern with traffic, parking and circulation. He would like to see the parking confined to the parking lot and
not into the neighborhood, he, thoughi the pedestrian i1ccess on Lynrose should be eliminated. He liked the
wrought iron pop outs. He.did not feel there will be additional traffic because of Albertson's. He was
concerned regarding the loading area and thought theeliminatlon of the shops would resolve the problem of
deliveries.

Commissioner Kovacic agreed with the property owner's right to use the property int is properly zoned. Both
the General Plan and' the Zoning allows what is pfQposed. . He feels that a. park ()r ~ool are .unreasonable to
expect. He was COncerned With the'50 foot setback. He feels thatmaintaining'a 50 foot.setbaclds great to
protect the residents to the south. He does notlike the loading-situation.
Commissioner: Daggett does not want to be ina position the Planning Commission could decide the use of a
property owned bya private citizen. He was not concerned about the traffic generated in the immedia.te area,
because he feels it will be generated by the immediate neighborhood. He agreed with Commission.er Hedlund
regarding closing off the pedestrian access ohLynrose. He also shares concern With Commissioner. Hedlund
over the delivery arrangements, but thought.the screening of the dock area has been very cleverly done.
Commissioner Hedlund and Commissioner Daggett discussed some a1temate,ideasfor deliveries. One of the
ideas was to elhnlnate, the shops.
Donna Butler statl!d that the shops and restaurant aie pennltted uses in the C-M zone,

It was moved by Commissioner Kovacic, seconded by Commissioner Daggett to reopen.the public hearing so
questions from the applicant regarding delivery alternatives could be discussed. The motion passed by Voice
vote with none dissenting.
Mrs, Parker objected and said that ifthey had more time they could have been.better prepared for tonight.
City Attorney Mike Miller explained. to Mrs, Parker that she can file an appeal, to the City, Council if she,
wishes.
Mr, Rue re-emphaSized that there will be a maximum of ~o trucks a day that Will be using this loading area
in off peak.hours. !f you move the shops the trucks will still'have to use this loading area. !fyou remove the
shops everyone will be able to look back into that dock area. Nothing Will be solved by removing the shops.

It was movect'by Commissioner Buang, seconded by Commissioner Daggett to close the public hearing. The
motion passed by voice vote with none dissenting.
Commissioner Hllang expressed his feeling'thathe would like to see the retail building front'on.Live Oak.
Ms, Butler explained that if the shops were moved to front on Live Oak, access to the loading dock would be
between the inarketand the retail building. This would force pedestrians'to cros~ the driveway to the loading
area, creating a potential problem by mixing pedestrian With delivery, trucks. Also, the idea of having retail
buildings adjacent to the-streetis for strip commercial retail area. The uses to the east are office/industrial
uses and there is very minimaLfoot traffic in the area.
Commissioner Kovadcwantedto know if he is the only person concerned with the 50 foot setback on Lynrose
Ave.
Commissioner Hedlund does not see a problem with it.
Commissioner GIark agrees With no pedestrian access from. Lynrose, but has no problems with the current
location of the retail shops.
Commissioner Daggett stated that number 100f the conditions has been elimfnated,and that they need to add
some condtions.

It was moved by Commissioner Daggett, seconded by Commissioner Hedlund that CUP 93-lnl be
approved witn the conditions set forth in the staff report specifically #1-16 excluding #10 and adding
#17-Eliminate pedestrian access in the south wall along Lynrose St, #18 the applicant shall redesign
the south wall of the market facing LynroseStreet to create more architectural drama, and,#19 to
have staff study traffic and an alternate left turn mechanism at the comer of Live Oak .and Third, and
Fourth.
