PLANNING COMMISSION 'PRESENTATION
On behalf of the Planning Commission, Chairman Daggett presented Commissioner Clark with a.resolution. The
Commission thanked him for his many years of service.
Commissioner Clark thanked the Commission and urged the Commission to remember thaiNcadia isa "Community
of Homes". He asked that when the Commission considers the Santa Anita Entertainment Complex'to keep in mind
the traffic and circulation issues.

27, 1995 as amended. The motion passed by voice vote with none dissenting.

2. PUBLIC HEARING CUP 94-004

Goldstein's Bagel Bakery
Consideration of removal of theon-site parking' restriction which currently prohibits parking within the site's
front driveway area.
The staff report was presented.
In response, to Commission's questions, staff said that presently there are no marked parking spaces.
The pUblic hearing was opened:
Bridgette Goldstein, 412.N, Santa Anita. said they have .001 observed any problems. It is a quick stop for their
customers who are in and out fast. The traffic in this area is usually entered from the ailey.
Commissioner Kalemkiarian asked in what direction does most of the traffic enter the subject parking area?
Mrs. Goldstein said itis difficult to say which direction is mostly used but the patrons are there fora short period of
time. When they enter from the alley into this area, they generally pull back and exit.
No one spoke in favor of or in opposition to this item.
MOTION
It was moved by Commissioner Kovacic. seconded by Commissioner Kalemkiarian to close the public
hearing. The motion passed by voice vote with none dissenting.
Commissioner Kalemkiarian said he will reiterate whathe said atthe first meeting. The few times that he went there he
got himselfin,a precarious position trying t<1get in and out of this area. At the lastmeeting,.he felt a lot of things could
have been done to mitigate this such as widening of the driveway atthe sewer drain or roping off this area completely
but the Commission decided to impose a parking restriction inste<id to prevent an accident. He was against removing
the parking restriction. He thoughtthat the direction of the traffic should be restricted so people do not get stuck
there. In his opinion. this is a very dangerous situation.

Commissioner Kovacic asked .if IheCommission.removes this requirement do Ihey lose their continuing jurisdiction
over the parking based on the language? .
Mr. Miller said the Commission can add continuing jurisdiction as a product of tonig~t's hearing. He is a frequent
visitor of this establishmen at different times of the day because of its proximity to City Hall. He has studied this issue
carefully arld did not think that it was Goldstein's fault People look at Ihat.parking sign, ignore iI, get Iheir bagels and
go. It is a rule and Ihe law is simply not applicable. The Police will not send any officers there and the applicants have
allempted 10 enforce it unsuccessfully. This isa parking prohibition, that does not work. He has not seen a situation
as described by Commissioner Kalemkiarian and he did not see any liapility consequence from relieving this particular
condition. He thought i!'is a waste of space that could'be beller ulilized. This condition.is unenforceable..
Commissioner Kovacic preferred having continuing jurisdiction. He thought if a couple of stalls were marked people
would,at least know how to park in that area. The presentsituation is confusing and people do not know whether it is
parallel or diagonal parking. He goes there occasIonally and has not seen any problems. He felt il is either a parking
area'or it isn1 and if it is going to be.parking it should look like one.
Chairrmm Daggellasked that nthisarea is not parking, then What is it?
Commissioner KovaCic replied thafit could.be'a waiting area. He contemplated two parallel marked stalls so people
who decide to use the area will utilize.it property.
Commissioner Kalemkiarian said he pulled into this area and found cars parked on both sides. He could not get'into
the driveway area nor back into the alley: He.had to wait for the lraffic to clear from "In N Out" so the car in the alley
could get out allowing him to back out.
Commissioner Bell was disappointed with the design. The Commission has spent a lot of time on how traffic should
maneuver here and it has been a waste. of time. She did not think the patio area should be located there and since
everYone wants to park there!t should be converted to parking and provide parking where it is needed.
Staff saidthaUhe;patio was staff's suggestion. The C~y i~ trying.to encourage outdoor patio area. It was noted that
not all the customers try to park in the front During the first Jew months, when people were first visiting this
establishment, there might have ,been some confusion. If their patrons parked in the front and encountered
problems; then they most likely would not park there again. Over the last Ihree months that staff ha.s been making
site' inspections and we havre not observed a situation where someone was boxed in. Staff did not see a parking
problem and will more than likely hear. from either customers or adjacent property owners if there are any.
Commissioner Murphy said that a more serious problem than the parking in the front is the stacking up of .carsJrom "In
N Out". Recently, due to the narrow Width of the driveway, he had to wait for the tr~1ffic coming outofthe driveway to
clear before he could enter. He was stuck on Santa Anita and was unable to get'in. He thought that is a far more
seriouS problem than what is being discussed tonight. He felt they are making a whole lot out. of nothing. It is their
business. The Police Dept. and staff don't feellhis is a problem. They should be allowed to run their business as
they see fit Although there might be isolated problems, he thought they are making a lot out of nothing.

take no further action.
Commissioner Kovacic asked if the Commission would be relieved of any continuing jurisdiction?
Commissioner Murhpy replied that Iheywould per staff's recommendation.

Commissioner Kovacic thought that al Ihe very least, they should have continuing jurisdiction. He said the
Commission is acceding to the applicant's wishes to be left alone because things are working prelly well and he did

not, disagree with that request. He felt.lhat if they painted and striped the area, it would resolve the problem biitthe
applicant chose not to. do that and placed a sign that is ignored. If they don't want people to parK there, then the next
best thing would beta paint. two parking stalls sa people will know where to park or have a directional arrow. Because
they do not want to impose additiona.l restrictions. on them, then the Commissian should have the opportunity to
review it in three to,si~ months.
Commissioner Murphy did not have a problem with reviewing it in the future but felt this is just more unnecessary work
for staff; There does not seem to. be a good solution.
Commissioner Kalemkiarian remarked that a wider diameter is needed to park there. If the west side was marked for
parking, then cars could pull into there'from either the driveway or the alley and still leave room to maneuver.
Commissioner Kovacic indicated that he did hear many adverse comments when it first opened but he has not heard
any in a long time. He.felt that if Commissioner Kalemkiarian has doubts about this and CammissionerBell does not
feel comfortable With the design, then the Commission should take another look at it in a few months.
Staff said thalhe.and the City Attomey have met with the applicants on several occasions and they have always been
willing to meet whatever the City's requirements: Staff has always had full cooperation from them and felt certain that
if ever there were any problems broughf to. staff's attentian, they cauld be resolved with the applicant. He did not see
a problem with designating parking spaces but custamers could still pull into. the driveway and nat utilize the
designated spaces.
Commissioner Murphy remarked that it would still not solve the problem that Commissianer Kalemkiarian
encounterecL
Commissianer Kalemkiarian said it might delineate at least what is expected of. the cansumer. He observed another
situation recently, where.cars were parked on both sides and no ane could go up that driveway in either direction.
Does staff feel this could be.a problem/ar atraffic,accident?
Commissioner Kalemkiarian said that a person traveling northbound on Santa Anita cannat see if there are cars
backed up to get in to the drive thraugh and by the time he gets past the drive through to turn'into the driveway, they
are pretty much committed. On,another occasion,a cai was paiked in the non-red aiea on Santa Anita, so all the cars
that Were attempting to go to the drive through, were forced into the traffic lane .on Santa Anita. He feared this might
be a serio.us prablem.
Ms. Butler said that .staff is unable to dictate what can is dane on a particular site 'and can mark the area but trying to
dictate how people maneuver in and out is difficult. Staff has been consistent with inspecting this site and has
checked 'With the;Police Dept. because of concerns with the access in the front People tend'to maneuver in and out
of there and it seems to work out because they stay therefor a short duration. This is a .difficult problem and as
Commissioner Murphy indicated one that is not insurmountable. Stail has n9t hll,d any complaints from anyone and
has continuously inspected the site for possible problems. She remarked that the Commiss.ion can review it in six
months to see if there are any problems as a result of eliminating the candition. If problems arise before the six
months,. it can be brought to the Commission before then. She indicated thatthere is no easy solution.
Comm.issioner KovaciC said that the applicant is requesting the' removal of the no parking signs which are ignored. In
his opinion, they either go with.the..present condition, take out the no parking signor doa little bit of creative st.riping.
However, if staff is stating the.striping will not do any good, then he will vote for Cammissioner Murphy's motion.
Ms. Butler was unsure whether striping wauld create additions problems or resolve the present situation.
Commissioner Murphy said if a parKing spot is created, then it essentially is okay to park there. H~ felt iUs up to. the
owners to decide if it i.s hurting their business. He did not hear any safety issues raised and if there was then he
would share the cancerns of the Commissioners who are reluctant-to. remove the restriction. The only problem
seems to be a little inconvenience. If it is not causing the business any harm, they ought to be able to ru'n the
business the way they see fit. If they are satisfied:with parking and it works, so be it.
Commissioner Kalemkiarian asked if the Commission or the City could be held liable. due to either tonight's or
previous discussions in case of a problem?
Mr. Miller replied that they would not be. They would be covered by' discretionary immunity which has been a
defense used by the City successfully on many occasions. It might be a little different if based an evidence the

Commission's decision created a clearly dangerous condition on public property. There has been no record of any
problems.
Staff said their original plans did show two spaces in t~e front area and in the original staff report the parking was
removed because the overall width of. the driveway did nol comply with the Code requirements to accommodate both
parking stall and. a driveway access. Staff felt thatthe primarily parking lot is in the rear and to designate parking inthe
front would encourage parking; which was'something staff did not want.
Commissioner Kovacic asked if staff does not want to encourage parking why not leave it as is?
.Staff replied thatas Mr..Miller indicated it is a matter of enforcing a situation where there isa .no parking sign and is
virtually unenforceable.
Mr. Miller stated why have a law that is being ignored? Why institutionalize something that does not work? It is
bothersome to see people disregard a law.
Commissioner Kovacic thought that it is bizarre that it is the City's position thattl)ey do not want parking there and the
way it will be solved is by removing the no parking sign.
Mr. Miller indicated that the City would prefer not to have a law that will nofbe enforced.

Commissioner Bell asked if directional arrows can be posted and if the motion can include that?
Commissioner Murpl1Y suggested voting on the motion as stated and if it is' denied then another motion can be
made.

front of the entrance, subject to the approval ofthe Community Development Division, and to revisit this
issue in six'months.
The motion died for a lack of a second.

Mrs. GOldstein indicated that they would not necessarily remmo>:e the no parking sign. They have tried to be as clear
with their customers as they possibly can. There are signs in the front, on the counter and they have informed their
customers. She did not object to painting an arrow but thought it might cause problems in the alley.
Mr. Goldstein said having parking stalls in the front will make people want to park there. It will worsen the situation.
Mrs. Goldstein said when they first opened, there might have been some problems but they have not had any.
Mr. Miller indicated that they might have placed signs but have not taken the extra step to talk to the people and
telling' them not to park there and he thoughtthat would be the way to resolve it. Because they do not want to that,
the City has a law that is not being enforced.
In response to a comment made by Mrs. Goldstein, Mr. Miller said he saw a copy ofa letter Which was sent to their
manager. He said that he could count many occasions when people. parked in violation of that sign and nobody did
anything and on one occasion Mr. Goldstein was present. As the City Attorney, he has to ask what good is a
condition that is not beingenfor.ced? It is his responsibility to take people to court who do not apply their conditions
and if the Goldsteins do not want to comply, then maybe they should also be taken to court.
Mrs. Goldstein said they would be exasperating a non-existing problem if there were parking spaces there. .11 that is
what the City wants, they will comply and that area will be utilized more than, howit is presently being used. They did
not object to the Commission reviewing this in six. months.
Mr; Miller said there is a problem of signs that are not being enforced.
Mrs. Goldstein acknowledged that it is difficult to enforce the signing and did not want to have the burden of having to
call the Police every time someone,violated the parking requirement. They would probably leave the sign there, but
would not want to stripe it. They woul.a like to keep the flexibility of having two-way traffic. They do not want there to
be problems. for their customers. They would prefer to remove the no parking restriction from the front, although
more than likely, they would keep the no parking sign and another one..with a directional arrow to the parking to the
rear. They feel uncomfortable breaking a promise to the City by allowing people to park there and they are trying hard
to get people notto.
Ms. Butler said the existing no parkingsign cites a specific code section and technically it is eriforceable by the Police
Dept. An option wouldbe to remove the existing sign and replace it with one without citing a code section. This
would be somethingthattheapplicant is restricting, and it would not be up to the Cityto'enforce.
Mrs. Goldstein concurred. II the Commission wants the sign they will put inhere.
Mr. Miller agreed and said he was concemed with a sign being posted.therethat was not being enforced. He thought
it would .be a good compromise.

NON PUBLIC HEARING ITEMS
3. INCIDENTAL OUTDOOR DINING IN COMMERCIAL OR INDUSTRIAL ZONES
A report. regarding incidental outdoor dining in commercial or industrial zoned properties without. requiring a
new conditional use permit.
(For Discussion Purposes Only - No Action Necessary)
The staff report was presented.
In answer to a question by' Commissioner Murphy, staff said that an "incidental use" would be defined in the text
amendment and parameters would be placed. An "incidental use" would be when a small eating establishment,
wishes to add a few tables and chairs. In the past staff has limited that number not to exceed four tables and twelve
chairs. This is something that the City is trying to encourage.
Ms. Butler further explained that outdoor dining would accommodate patrons who smoke. The City is trying to
streamline some of the process. The regulations for this would be similar to the sidewalk dining permitted on public
right-of-way which is very specific. They would have to meet certain criteria. and would have to go through a certain
process subject to the City's approval. In the long run, this will benefit everybody. If someone wanted 20-30 seats,
they would have to go through the CUP process. The maximum seating would be 12 which has been something tliat
has been allowed for incidental uses for eating establishments. The purpose for tonight's meeting is to get the
Commission's thoughts.
In answer to a question by Commissioner Kovacic, staff said that underthe current regulations they can put seats in
the public right-of-way withouta CUP but'in order to put them closerto the building, they would need a CUP. Staffis
trying to achieve consistency. People feel it is a hardship that they cannot pui tables and chairson the sidewalk.
Rod's on Huntington needs a CUP for placing the tables and chairs and it has been brought to their attention. If he
chose to put them on the Huntingtgn side, he woulcl only need to apply for the, Sidewalk Dining Permit but because
where he has placed them is not public righFof-way, he needs.a CUP.
Ms. Butler said that another commonly seen situation is in shopping centers where the shops are set back far from
the curb like Starbucks on Naomi. Staff is trying to encourage this type of an activity in centers and provide the
flexibility in the Code.

appropriate text amendment for further consideration.

MATTERS FROM CITY COUNCIL
CITY COUNCIL REPORTS / ANNOUNCEMENTS /STATEMENTS
Council Member Chang recapped .the actions taken by the City Council at recent meeiings. He indicated that the
Council is.working on resolving the shopping cart problems, Council Member Young has been elected by the Council
to be the candidate for the San Gabriel Basin Water Board vacancy that become available due to the election of
Assemblyman Bob Margett, There are four other candidates'for this seat and the decision will be in a couple of
months. 'The Council established theCharter.revision Committee. Each Council Member nominated one person to
this Committee. The Committee is comprised of Robert Harblclit, Craig Lucas, Ed Huang, Jim Helms. and Vincent
FoUeywho will go through the Charter and see if any revisions are necessary.

He indicated that he has received many letters of concern regarding the Santa Anita Entertainment Complex. The
library project is moving ahead. He has received some complaints and comments from people who are unable to turn
eastbound on Huntington when traveling northbound on Second.
MATTERS FROM THE PLANNING COMMISSION
REPORTS/ANNOUNCEMENTS/STATEMENTS
Commissioner Kovacic said that a lot of emphasis was placed on the City's housing commitments but no one
mentioned the impact on the schools. Will the General Plan analysis look at the impact on the schools and make
recommendations or is the School Board.supposed to come up with those types of recommendations? If the General
Plan contemplates increasing the population, will it also look at the impact on the schools?
Ms. Butler said staff is working with the SchoolDistricton this. The City's consultants have talked'with Dr. Towner and
Mr. Davis. The City will not make recommendations but will incorporate their comments and findings in the General
Plan,
In response to a question by CommissionerBell regarding the Jacaranda trees proposed in the downtown'area, Ms,
Butler suggested,speaking with Peter Kinnahan in the Economic Development Office.
MODIFICATION COMMITTEE MEETING ACTIONS
Commissioner Huang recapped the Modification Committee's actions.
In response to a comment made by Commissioner Kalemkiarian regarding one of the items on the Modification
Committee Agenda, staff said the requirement has not changed for height limitation for walls/fences in the front yard.
The actual fencing' and pilaster complied with the height but the light standards exceeded.the height,limitation.
Commissioner Kovacic remarked that item #1 seems to.be an architectural design review and he did not think that this
area had one.
Staff said there'is no design review for this area. On the day of their final, staff noticed that they did not fully comply
with the original plans presented to the Modification CO,mmittee. That plan called for brick masonry on the front of a
new two-story residence, but instead they had replaced it with,brown granite. No other homes on the street had this
type of a material and staff did'nol'feel that he had the authority to approve it The applicant was informed that due to
the change, thei.Modification Committee' would need to review it and determine if it is appropriate. At the meeting,
Commissioner Huang pointed out that although he did not object to the granite, the original brick presented a little bit
more visual relief and a softer feel for the building.
Commissioner Kovacic remarked that when he has chaired the Modification Committee meetings, there were
instances where only an elevation is presented andthere:is no,designation of type of materials.
Staff said that in t~is'case, the plans submitted were veryspecific. He felt that if something is presented to anybody at
the top level with the best /TIaterials,and during the building process, that is not carried.through, it is misleading to the
body that was reviewing it
With regard to another modification on the agenda, staff said that two of the oak trees were diseased and in reviewing
the overall proposal with the property owner, staff felt therewas:enough room without overcrowding the existing trees
on the property to at least have one new tree planted. Staff recalled a case where it cost a property owner $30,000 to
move a mature oak tree that died within one year. Staff tries not logo through Ihat route and would rather have a
younger ireethat seem to .take very well and staff has had good results.

2. UPCOMING AGENDA ITEMS
Ms. Butler announced the applications that have been filed and will be before the Commission as public hearings.
There was discussion regarding Modification Committee membership. Ms. Butler indicated that one of the questions
raised recently has been that some Commissioners are more conservative than others and in acting on Modification
Committee, sometimes that does not provide a consistency when one person may go before a board and if the item
is continued or more than one meeting is necessary for the Committee to render a dec;ision, the same Commissioner
may not be acting on it that originally had an opportunity to see the modification. About five years ago, one
Commissioner served as the Chair for the Modification Committee for one year and the Chair at that tim!J requested
rotating the schedule. Staff feels that this'does provide consistency and acknowledges that one year term does put
a burden.on one particular person. II the Chairperson is unable to make it, then another Commissioner can chair the
meeting. This does not require any resolution and was done administratively.
Commissioner Kovacic stated that he did remember the system and that it was the Vice Chairman that served. as Chair
for the Modification Committee. He felUt does provide consistency although a one year term is 100 long for one
person to serve. He preferred a six month term and'for people who do not wo'rk in the area it is inconvenient to stay.
He wondered if the time of the meeting could be. changed to meet before the Planning Commission me,eting. He
was not that concemed,with the time of the meeting but he felt the length of the term is'more important. He did not
object to serving for the first six months. He wondered if they could meet earlier in the moming? He would be able to
serve the first six month.term as long as that is'the Commission's pleasure.
Commissioner Murphy agreed.
Ms. Butler thought a six month. term would be good and agreed that a one year term is'too long. She indicated that it
does not necessarily have to be the Vice Chairman that serves. She thought that it would be possible to meet'earlier
during the day. City Hiill opens at 7:30a.m. and the'Committee can meet a17:45 or'8:00 a.m. She wanted to present
this to the City Manager and Deputy City Manager and get their thoughts. The same staff members are on the
Modification Committee. When someone is absent then someone else might replace them but generally it is the
same,people serving on the Committee.
Commissioner Huang indicated that he would be unable to serve a six month,term.
Chairman Daggett thought that they could rotate on a'quarterly basis. Part of the process of being a commissioner is
being able to participate'in all facets of the action.
Commissioner' Murphy discussed anodd looking, 16' high rock,climbing structure that has been constructed in his
neighborhood. It appearsnoUo conlliciwiththe Building Co'debecause.itis a permanent structure and is attached to
the.house by angle iron. He asked if the Code should be amended to. address this type of a situation?
Ms. Butler replied that cases like this are very far and few in between and are very unique l'!ituations. This is not
something that has been a serious problems. .11 they wish staff to address this, it should be a consensus to pursue
looking into il. They will require approval by the homeowners assoCiation (HOA).
Commissioner Kovacic said'that when he served on the Village association, they did have a skateboard ramp and
they had several hearings concerning that item.
Ms. Butler indicated that the HOA does have architectiJral design review over it, since anything over 2' high requires
their approval. "("his does comply w.ithall setback requirements and the owner has been notified that prior to the
issuance of a building permit, the HOA must approve it If the HOA approves it, any property owner can appeal that
decision to the Planning Commission.
