The staff report was presented and the public hearing was opened

MOTION
It was moved by Commissioner Huang,. seconded by Commissioner Murphy to close the public bearing. The
motion passed by voice vote with none dissenting.

Consideration of a conditional use permit to operate a school for 30 children from K-8.
The staff report was presented
In response to questions from the Commission, staff said that they could have a maximum of 108 students for all 9
classes. Staff did not anticipate a problem with parldng because the children do not drive. If the school decides to
increase the number of students, they would need another CUP. The play area is located at the southwest portion of
the lot and would be fenced off and. is far from any streets. This would be the easiest location for the playground with
temporary barriers during school hours.
The. public hearing was opened
Father Charles Ward, Our Lady of Angels Church, 1100 W. Duarte Rd., said there' would be no summer school and
they would have the traditional school year. The southwest portion of the lot is utilized on: Sundays as parking.
However; on weekdays this area is not used. Unless, there is a special mass such as Good Friday or Feast Day the
parking lot is not ntiH7ed. On occasions where the congregation is present in tun capacity, there is no school. In the.
past 5 years, there has been no activity during the weekdays and the only one preselit at all times has been theparisb
secretaly. He anticipated that if this was approved, there would be a maximum of 12 cars per day and he felt there
would be plenty of room for parking.

Commissioner. Mtuphy expressed concern with the playground area and wondered what the students could do during
recess? He felt they needed an appropriate place as a playground and not a parldng lot The kids should have
playground toys that they can climb on and swings DOt portable toys.
Father Ward thought the southwest portion of the property was the best place for the playground and said they could
provide portable games. The teachers would help the students recreate with sports equipment that would give them
exercise. He indicated thatthey could provide snow fencing as temporary baniers.
Mr. Nicholson remaIked that staff would review the proposed plans for the play'area and thought that games such as
hopscotch and Four Square could be painted on the asphalt
In reply to questions from Commissioners, Father Ward replied that the stair wells would remain unlocked during
school hours. He remaIked that their building is handicap accessible.

Kay WiIliains, 1227S. Ten:Jple City Blvd, said she waS'representing the tenants at the condominium units directly
south of the subject property. She stated the overflow of cars from Sunday masses spills onto the streets and the
parishioners have even blocked off their driveway so they can not get in and out They 'enjoy the quite of the church
now. They were concerned with.the 8th grade students leavingthe:schoolandvann.1i7ing their property.
In rebuttal, Father Ward.apologized on behalf of any parishioner that might have blocked off their driveway and said
he would bring that to their attention. With regard to.the 8th graders leaving the premises, .he replied by saying that
they children would not be able to leave the school without permission and that would be grounds for being expelled.
No one else spoke in favor of or in opposition to this item.

It was moved by Commissioner Bell, seconded by Commissioner Mtuphy to close the public hearing. The
motion passed by voice vote with DOne dissenting.
Commissioner Bell thought this was a fme use of the facility. The ratio of 12:1 was wonderful. Although she wished
they had a bigger area for the kids to play, she remarl<ed that many kids in elementary schools play on black top and
thought that. is perfectly acceptable.
Commissioner Huang agreed and suggested that in the future staff ask for a larger and more secured area for parldng
lot and playground area.
Chairman Sleeter, Commissioners Bell and Mtuphy thought thai snow baniers would'be a good idea.
Mr. Nichoison thought they could utilize temporary fencing and maintain an adequate distance from the.south property
line.
Commissioner Mtuphy thought that condition 4 should be amended to read:
"4. .That an appropriate portion of the parldng area sbaII be designated as an outdoor play area during weekly
school hours, its location, configuration, play equipment/general design subject to the review and approval of
the DevelopmentServices Department" .
Staff noted that site plan shows the existing landscaping.

cOnditions in the staff report with the amendment as noted above.

Chainnan. Sleeter noted that there is a five woddng day appeal period after' the adoption of the resolution. The
resolution will be adopted on July 8th. Appeals are to bemed by Tuesday,July 15th.
4. PUBLIC HEARING CUP 97-'006

Considerati<?n ora conditional use perutitfor a proposed new restaurant with seating for 32 persons.and relate
paddng modification.
The staff report was presented.
In response to questions by the Commission, staff. said that the previous use bad asked for seating for 19 persons. The
parldng requirements are different for eating establishmentsvs. restaurants. Eating.establishments require 20 parldng
spaces per 1,000 sq. ft of gross floor area, restaurants require 10 parldng spaces per 1,000 sq. ft of gross floor area.
The public hearing was opened.
Elaine Chu, 417 E.. AngeUa Ave., Rosemead, said they are in agreement with all of the conditions in the staff report
They thoughtthis would be a good use in this area since there are no vegetarian restaurantswitbin a S'miIe mdius.
They do have another restaunmt in a different state.
No one spoke in favor of or in opposition to this item.

It was moved by Commissioner Huang, seconded by Commissioner Bell to close the public hearing. The
motion passed by voice vote with none dissenting.
Commissioner Mmphy thought this was a good location for this use, especially since theparldng is never close to
capacity althis comer of the center. .

Mr. NichOlson informed the Commission of applications that have been filed and scheduled for public hearings,
Mr. Miller announced that the Court of Appeal completely reversed the trail court decision that Arcadia CUP for
filling the Rodeffer Quany was invalid under CEQA. This means that the CUP is valid and that E1 Monte does not get
any attorney fees.
