2. PUlJLICHEARING TA 97-004
Consideration of a text amendment prohibiting clotheslli1es Within the front or street side yards of residentially
zoned properties.
The staff, report was presented.
Commissioner Bruckner thought it was stIaiglit forw3rd.
Commissioner Sleeter did not see the need for restricting clotheslines in the side yard. He explained that some lots
might be able ,to hang clothes in their side yard that would not be visible from the street He did not think they should
restrict them and thought itwould be unfair. He did not have'a probiem with the restriction in the front yard setback
Of on balC()nies.
Ms.,Butler explained that this text amendment would prohibit clothes being hung within the required street side yard
setback., Clothes hung inside the setback would be pennittect
It was the consensus of the Planning Commission that the wonling should be changed to "prohibiting the hanging of
1amuIry on clotheslines Of on any structures within the required front and street side yard areas. In multiple-family
zones, laundry may not be hung from any patio orbalcony;"
The public: hearing was opened
No one spoke in favor orin opposition to this item.
MOTION
It was moved by Commissioner Bruckner, seconded by Commissioner Kalemkiarian to recommend approval of
TA 97-004 to the City Council with the above changes.

3. PLANNING COMMISSION DETERMINATION

Determination that a niartiaI arts and fiUless business is an appropriate use in tbe CBD-I zone,
The staff report was presenied
Ms. Butler explained that the applicant had two options to proceed with his request One would be a text amendment
that would coSt the applicant approximately $2,000. What is before the Planning Commission is the other option
which did not costhim anything. She said there are some uses that are permitted in the zoning regulations; Le" C-I
and C-2 with an approved CUP, but are prohibited in'the downtown area based,upon ARA ResOlution 172. Martial

arts studios are prolullitedin the CBD zones. The CBD and CPD.l zones provide provisions in the COde that certain
uses can be pennitted if the City Council deems them appropriate. If the Planning Commission. and City Council
approve this request, then anyone may apply for a conditions! use permit at any location in this zone, Currently, there
is a martial arts studio operating which was in existence prior to ARA Reso. 172, therefore, it is legal non-conforming.
Chairman Mwphy thought that this discuSsion should be continued to the Planning Commission's October 2nd study
session.
The Planning Commission agreed
Commissioner Bruckner suggested that this item be placed on the October 2nd agenda. If this is approved, then the
Planning Commission can take appropriate action to recommend approval, thus eliminating any further delay for the
applicant
Ms. Butler explained that following the,October 2nd meeting, there will be another study session discussing the sign
issues in the doWntOwn area The Planning Commission's recommendations will be fo:rwarded to the City Council
The Oty Council will then determine wba1 action to take. If they decide to go with,a text amendment, then staff will
prepare the appropriate text amendment At,that time public hearings will be held before the Planning Commission
and the Oty Council and if approved, appropriate on1iDances will be prepared and adopted by the City Council. The
ordinance will become effective 30-days following adoption. This process will take approximately 6 months and, it
will not be an over, night process.
Chairman Mwphy suggested that staff contact the applicant and explain this to hiin and see if be would be willing to
continue as he has been until this process has been completed
MOTION
It was moved by Commissioner Kalemkiarian, seconded by Comm;o.;nuer Bruckner to table this until the
Planning Commission's October 2nd meeting.

Mayor HaIbicht discussed the reCent actions taken by the City Council with regard to the bndget ,At the last meeting,
Council Member Young had iiulicated that she did :not think enough cuts were made to balance the budget and the
other Council Members had agreed and it appears that they will be revisiting the budget They already anticipate a
shortfall of approximately $1 million for the next fiscal year and they feel instead of deferring the reductions they
should take action now, It is not anticipated that the Oty's revennes, will increase in the near future. Plans have been
submitted and ground breaking is scheduled for the "Extended Stay". This use will increase revenues but that will
take some time. 00... projects are in the planning stages but it will take some time until requests have been lied,
approved and the projects are completed

It was the consensus of the Planning Commission to .reschedule itto Wednesday, November 12th.
