Because of this reason, most service stations are now being converted to "automobile fueling stations" with convenience stores: The benefits of having an on-site convenience store are: . Customer satisfaction - this provides convenience to customers and city residents who can'purchase gas and also drop into the convenience store to purchase items such as a gallon of milk. . Tax revenues for the City- their convenience stores are well stocked and geneme significant sales. Their sales average between $20,000-$30,000 for a 2,000 sq.ft. convenience store. This generates revenues for theaty, . These types offacilities reduce vehicle trips, i.e., one can purchase gas and other needed items In one trip. . The new convenience stores an: designed to be inviting, brighter and . less cluttered. He asked staff about the n:quirement for the number of employees. He asked that the Commissi,on increase the square footage as proposed to 2,000 sq. ft. Staff's 1,000 sq. ft. recommc:iDdation is very limited. In order for them tojustify remodeling, he asked that the Planning Commission inaease the square footage. Most of their stores are from 1,2()O-1,800 sq. ft., excluding the storage area (approximately 2,500 sq. ft. bonding). In response to an inqniry from Mr. Miller, Mr. Brooks indicated that they did not intend to ~e any type of videos for sale. He went on to say that they did riot ilbje<:t to providing air and water pumps. Restrooms are part of their design. He also indicated that they provide sqlll11lte restrooms for menlwomen and not a unisex restroom. In answerto.a questlonby Cbaitman Mmpby. Mr. Brooks said that usual1ythey have one cashier and one attendant Ms. Butler explained that there should be no less than one attendant for every 8 fueling stations. Siaff feels that it would be 100 difficult .to monitor the convenience' store, perform as cashier, watch the fuel pumps and dispense gasoline. Mr. Brooks replied to a question by Commj~oner Kalemkiarian that they did'not obje<:t to the number of employees but that they did not understand it and bad requested an explanation. They do not have any new iocations in mind at this time but he felt confident that after this text amendment is passed they would be actiVely looking for potential upgJ3de of existing locations. They would like to offer the sale of beer and wine and their attendants will be trnined to sell it responsibly and ask for proper identification. Commissioner Kalemkiarian femarked that the Stite is very conscientious aboot the sale of alcohol. Commissioner Hua:ng asked what type of preventive measures have been taken to discoW1lges crime and. if they have bad any problems with crime? Mr. Brooks stated that their. buildings are. designed to offer a sense of safety to the potential custometS. They try to have good relations with the.\ocal Jaw enforcement Their stores offer visibility and an: well lit which deters crime. Anyone can easily see inside their stores. The industry is very conscientious of the safety and inost do not cJutterthe windows with signs or merchandise to provide visibility. They trnin their employees to recognize a problem before it actually becomes a problem. For example, in some of their stores they noticed that the availability of a pay phone promoted loitering, so they have been in""'lIn,g pay phon:es witbllut the call bacl< feature. Crime at their store not only hurts the community, italso hmts them. The beer and sodas are stocl<ed from the bacl<so there is square footage in the back. He indicated that some of their convenience stores have full service McDonalds with drive.,thrus. Although they are not requesting that at this. time, they would be e1ated if the Commission would include that as part of this text amendment No one else spoke in favor or in opposition to this item. Comm;"";ooer Kalemkiarian said that 1,000 gross floor area would be very tight and suggested increasing that to 1,500 sq.ft. Arcadia City Planning Commission Page 3 8/12/97 . . Commissioner Sleeter agreed aDd remarked that they are pI'esently allowed 210 net sq. it and increasing it to 1,000 gross sq. it would really not bea.greatina-easefrom what is pn:senIIy permitted. He asked that the City Attorney better clarify the video and adult WIder item "E". Commissioner Huang """RrlcAd that he clearly Wlderstands why the-applicant would request the 2,000 sq. it and said that the City should think of the revenues that these might generate. They should not limit them and allow the tax dollars to go into neighboring cities. The larger the store, the more variety of items which would encourage sales thus ina-ease tax revenues. Withreganl to the possible crime, he stated that it would be a good idea to provide landscaping at least around three sides of the building. He noted that they would be able to review the project at the time that a CUP is filed and brought forWani to the Commission. Commissioner Kalemkiarian said that they would be able to dictate the size during the CUP process. Commissioner Bell asked if the size of the retail area would be dependent on the available parldng? Ms. Butler replied that the parking for a retail business is 5 spaces per 1,000 sq. it but staff felt that in this case it should be 3 spaces pez-l,OOO sq. it because there is notthe same need as a typical retail store. Chainnan.Mmphy preferred to be conservatiye and stated that they could increase the square footage if necessary. He felt it would be better to go upward than to go down on the square footage, He remarked that 1,000 sq. ft. is too smaI1 and 2,000 sq. ft. is too large. Ms. Butler said they could measure the square footage from the face oftbe walk~in refrigemtoJstogive them more flexibility. A minimum of 5% landscaping is required. Chainnan Mmphy asked about Item "0" and felt it should read; "advertising pertaining to retail conven1encesilles...". He also said that Section 9275.4.7.4 should also prohibit smogteSting and certification. The. majority of the Commission was in agreement with the 1,500 sq. ft. limitation. Commissioner Huang preferred, 2,000 sq. ft. and Commissioner. Bell wanted 1,000 sq. it The Commission's was in favor of the text amelidmentwith the changes 1isted below: 1. Item # 9275A,7.4. Thissectlon shoull! also prohibit smog teSting and certi:lication. Add "there sha1l be no storage, sale, display or advertisement for sale or lease of motor vehicles, trucks or tJaI1ers on the subject site." 2. Item "B" sha1l state: "The station sha1l be equipped with an emergency pump shutoff switch in a location approved by theFJre Department". 3. Item "D" detete the word "existing" from ". "inside finish of the permanent walls of the existing building". With regani to where the square footage should be measured the sen1ence should read; " ...silles area is 1ined with walk- in refrigerated display cases the square footage sha1l be measured from the doors of the refrigerated unit" 4. Item "G"should read; "advertising pertaining to the convenient martsha1l noL" 5. Item "H" The secotid sen1ence should read; "When a fractional figure is found as a remaindetin computations made to determine the amount of required off-5treetparldng, such fraction sha1l be constmed to be the ne.xt largest whole number." 6. Tmth Ave. Gordon and HelenJohnson Consideration of a.lot line adjustment to enlarge the backyard of 1735 S. Tenth Ave. The staff report was presented and the public hearing was opened. Gonion Johnson, 1733-35 S. Tenth, remarked that the pmpose for going through this'is to retain the back portion for the property at 1735 S. Tenth. Noone else spoke'infavor or in.opposition to this item. MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Kalemkiarian to close the public bearing. PUBlJC HEARING TPM 97-007 402-404 Lemon Ave. Susan Krost and Alexandra Hulline Consideration of a tentative parcel map to subdivide the existing lot into two lots. In reply to a question from Commissioner Sleeter, Ms. Butler stated that the proof of necessity is that they cannot aeate two legal lots and keep the existing house. The Planning Commission cannot categorically role out that no side yanI setback.modifications be.granted in.the future. Any side yard setback modification would be reviewed by the Modification Committee. The pubJ.ichearing was opened. Jack Couey, 700 EdgeviewDr., Siena Madre, the architect of the project said the properties will be occupied by two sisters who will be neighboR. Any future addition will require approvals. They will do minor improVements . but nothing with significant impact No one else spoke in favor or in opposition to this item. The staffrepon was presented and the public hearing was opened. Tom Cao, Tritech Assoc., 735 W. Emerson, said they are in agreement with.all of the conditions in the staff report. He indicated that they could build 13-units on this lot and still comply with Code but they are ,"upusing 7-units only. They are also providing more parldng spaces than what is required Grace Tan, 215 S. Fifth, spoke against this subdivision. She was concemedabout. the safety of the children in the neigbbolbood due to the additional vehicular traffic that these units would aeate and the increase in the density. This is a quiet neigbbodlood and she feared that the proposal would jeopardize their peace. She was concerned about deaeased property values. The R-3 zone would aIlowtbem 10 construct 13-units but they are only proposing 7-units. He remarl<ed that the signatures on the opposition letter are from l"<i(lents who are far removed from this area. He pointed out that someres1de in the.1300 block of S. FJfth, yet this development is in the 200 block. No one else spoke in favor or in opposition 10 this item. MOTION II was moved by CommisSioner Kalem1darian, seconded by Commissioner Bell to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Kalemkiarian was pleased with the proposed number of units as opposed to what they could build as pennilted by code. He indicated that they are dealing with the land use and thought this would be a reasonable improvement. Commissioner Bell reD13Ikedthat this is a small single-family street. Staff said this is a mixed"usearea zoned R-3 that is slowly being converted to multiple-family. The east side of the street is in the City of Monrovia. Chainnan Mmphy said this isa routineprocedme and noted that it complies with code reqUirements. Commissioner Huang agreed and .said that they have provided nice size units without.any modifications. RESOLUTION NO. 1553 Aresolution of the Planning Commission of the City of Arcadia, Ca1ifornia, grilIltingldenying an ~mendment to Reso. 1546, to opemte an outdoor dining area with seating capacity for 40 persons at 850 S. Baldwin Ave. The staffIqlOrt was presented. Staff said that environmental documents in the CUP addressed the bBIbecne and additional smoke and it was determined that it would not create additional smoke. Naomi, said that they are in agreement with all of the conditions in the staffreport. No onc else spoke in favor or in opposition 10 this Item. Commissioner Sleeter was pleased.with the design and thatthere was not a garage facing:the street and remarked that that is a refreshing change. . Appeals are to be filed by Wednesday, August 20th. 8. PUBLIC HEARING MC 97-035 1308 Standish PI. WaiLee for the Lu Property Consideration of a request to apply a stucco finish to an existing block wall in lieu of the required condition that the wall be of deoorntive masonry block. The stucco finish will be on the neighbor's side only. The stmr report was presented. Staff said that when thepbotos were taken tbechain link fence was abutting the wall. The adjacent property owner questioned the integrity of the wall and the Building Inspector inspected it andfelt that'it wasstructuraUy safe. It was sta1rs opinion that this is an aesthetic problem only. It appealS that the wall is not level and there are dips and valleys within the top portion of the wall. Commissioner Sleeter felt that the word "substantial" should be changed to "full" in condition 5 of the staff report. Commissioner Huang asked ita landscape plan bad been submitted? Staff replied that no plans had been submitted as of June 24,1997. The public hearing was opened. Wai Lee, 701 S. FIISt, said he is representing Mr. Lu. He asked that staff explain what "brown coat" is. Staff explained that brown coating is .applied to the exterior face of the wall and it provides a pre-surface prior to stuccoing in a permanent fashion. Staff was not aware of any other way of doing this and would consider any other metbod'that wonldlead to a permanent stucco finish. Mr. Lee.said they are in agreemeotwith all of the conditions in the staff report. He remarked that he was not aware that they had to landscape the entire length of the wall. In response to a question by Commissioner Huang, Mr. Lee explained that they feel that if they stucco the wall that should be acceptable and noted that there isa 30'1ong CBJpOrt adjacent to the wail and part of the frontage already bas landscaped with trees and shrubbery. They did not feel.tha1 they should have 10 laodscape behind the cmport where DO one can see. Staff conc:wred with the applicant and explained that it is impossible to seethe wall from Standish PI. He believed the concerns expressed.from the adjacent neighbors were mostly revolving around their view of the wall. The bome and the detached garage block out the wall from Standish PI. Chuck Fullington, 1303 Mayflower, said this wall runs 103' at the rear of his property. The original agreement was 10 have a decorative block wall He pointed out that there is a full grown Chinese Elm tree aod be !hought that it would crack the wall. He fell a stucco wall would not be acceptable and !hougbtthat.the tree would eventually crack it and the wall would then look uosigbtly. He wanted a decorntive block wall built and felt the existing wall should be demolished. He commented that the structure in the back of the lot waS'Constructed In two weeks and it is 8112' from his property aod they needed a minimum of 25'. This structure bas two windows looking into his backyard. He bas a . pool in his backyard and bas lost his privacy as a result of this addition whicbis so close to his property. They are DOt meeliog the original condition of approval. He asked for a proper wall to be CODstIUcted that would stand !he test of time and would not failllkea stucco wall would. In response to a question by theCommissioo, Mr. Fullington said that if they properly I~Nl.caped.it would alleviate his concems'ofwindows on the addition. Commissioner Kalemkiariao remarked.tha1 if the stucco is done properly it should last many years. Bertha Hultman, 1331 S.Mayflower, said Mr. Lu elected not to remove the tree and to keep, the addition and tried to sneak thi$.wallin. The wall is uneven and explained that at one end it is 5' high and at !he other 6' high. She disagreedwitb theremaIlc that the tree would not bann the wall and was,sure it would uproot it within .1-1/2 years. She felt the tree should be removed and then II decorative block wall should be constructed as approved -by !he Modification Committee. In rebuttal, Mr. Lee said that-Mr. Lu bad been naive in the way be proceeded with this. It was not his.intention to save any money because be bas certaiuJy paid mncb !'lore now in fees and fines. Wi!h regard to.the two windows on !he addition, Mr. Lu removed one and bas placed frosted g1ass on the.other to provide privacy for his neighbor. He remaIlced that they could not see into the neighbor's backyard because of the wall. He stated that they did ootintend to sneak in this wall to save money. 11 would have been less costly for Mr. Lu,if be.bad done it the o!her way but because of the "language barriers" he misunderstood. He remmked stucco is considered as decorntiveblock: and said !he wall is I' from !he tree. They will repair the impetfectioos. Ms. HultJOan disagreed that !here was a language barrier and said thaI'Mr. Lu was e1ated and understood completely wbat be bad to do at the Modification Commitiee when he was told that be would not have to remove the addition. Mr. Lee took !he blame for the language barrier and said that be was on vacation. It would be a hardship No one else spoke in favor or in opposition to this item. MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Bell. to close the public bearing. The motion passed by voice vote with none dissenting. Commissioner Bell said sbe was the CbaiJperson at the Modification Committee and sbe did not get the impression that Mr. Lu did nnt undezstaod. She felt it was a poor decision to build the wall and thought it was ridicoIous to have built it so close to a tree. This was poorly designed. She would consider stuccoing this wall burtbougbt that the tree and wall should be remoVed. Arcadia City P1anning Commission Page 10 8/12197 . . Commissioner Sleeter agreed. He saw a pattern of disreganl for the process and thought that the development process should be enforced. He was in favor of upholding the Modification CommiUee~s decision. Commissioner Kalemkiarlan thought that Mr. Lu should do what he had agreed to and Chairman Murphy agreed. Ms. Butler thought. the ColDIllission should give a maximum time period for compliance and if they do not comply they would be subject to litigation. Commissioner Kalemkiarlan thoughtbetwCj:ll 30-60 days.
