MINUTES of 718/97 MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Bruelmer to approve the Minutes of July 8, 1997 as published. PUBLIC HEARING CUP 97-009 62~ Las Tunas Dr. Little Harvard Academy Consideration of a conditional use permit to operate a .tutorial school. The staff report was presented. Staff said that this use would occupy 2,600 sq. ft. of the 12,552 sq. ft. center. The applicant conducted a parldng SUIVey which was done for a one week period from 9:00 a.m. to 8:00 p.m.. Their current school is east of the subject site and they have outgrown"thatlocation. They provide carpooling"van and there is also a bicycle mck in front of units C and D. In reply to a question from the Commission, Ms. Butler stated that staff has not received any complaints about these type of uses. All the other tutoring centers are in simi1ar type centers and staff does not anticipate any problems. The public hearing was opened. Carla Benavidez, 103 W, Las Tunas, said she is the head teacher. She explained that they provide transportation for the kids from the origination school to their school. 80% of the chi1dren are picked up by their van and the remainder are dropped off by the parents who usnal1y carpool or use Dial-a-Ride. The parents do not "come all at once to pick up the cbi1dien and the piCk up time,is spread out. They have 5 employees.. Their bUsiness hours are 9:00 am. to 7:00 p.m., Monday through Friday, and 9:00 am. to 6:00 p.m. on Saturdays, The classes may begin as early 8S.2:30 p.m. and end by 6:00 p.m. Most of the children are there .from after school until 6:00 p.m. They have four different classrooms. They do not have a massof children that anive or leave all alany one time. No one else spoke in favor or in opposition to 1his item. MOTION It was moved by Commissioner Kalemkiarian, seconded by ColDlJlissioner Sleeter to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Kalemkiarian suggested reviewing 1his 9O-days after.!t has been in operation to make sure that there are no parking problems and Commissioner Sleeter agreed. Commissioner Huang was pleased that the.school provides its own transportation and thought that might help reduce any potential traflicproblems. Olainnan Murphy ",m.rlced that once again here is" a center which is very deficient in paJking based on code requirements, yet there are no acmai parldng problems. He visited the site on several occasions and was in agreement with Slaff's recommendations. After thinking his recommendation thoroughly, Commissioner Kalemkiarianrescinded his suggestion because nothing could be accomplished by reviewing this in 9O-days. Ms. Butler replied to a question by Commissioner Sleeter by saying that the granting of thispmking modificatinn does not constitute an approval of a general reduction of the parking requirements for the entire site. It is only for this CUP. Based on Ms. Butlers response; Commissioner Sleeter also agreed to witbdraw his recommendation for a 9O-ilay review. An:adia City P1anniDg Commission Page 2 7122197 , . . ROLL CALL: AYES: NOES: Commissioners Bell, Bruckner, Huang, Kalemkiarian, Sleeter, Murphy None Cbainnan Mmphy noted that there is a five worldng day appeal period after the adoption of the resolution. The resolution wiI\ be"adopted on August 12th. Appeals areto be filed by Wednesday, August 20th. NONPUBUC HEARING ITEM 3. RESOLUTION NO. ,1550 A resolution of the Planning Conunission of the City of Arcadia; California, gmnting CUP 97-007 to operate a 1,015 sq. ft. "Johnny Rockets" classic fifties restaurant with seating capacity of approXimately 7lpatroils at 400 S. Baldwin Ave. RESOLUTlONNO.1551 A resolution of the Planning Commission of the City of Arcadia, California, gmnting CUP 97.{)08 to operate a 13,084 sq. ft. "Todai" restaurnnt featuring Japanese and Chinese cuisine with seating. capacity of approximately 430 people, inclnding indoor and outdoor dining,. at 400 S. Baldwin Ave. Ms. Butler read the .titles of the resOlutions. MOTION It was .lJlI)ved by Commissioner Sleeter, seconded by .Commissioner Bruckner to adopt Resolutions 1550" and 1551 and to formally affirm the decisions of July 8, 1997 and the votes thereon. MATIERS FROM CITY COUNCIL CITY COUNCIL REPORTSlANNOUNCEMENTSlST A TEMENTS MayorHalbicb1 briefed the Planning Commission on =t developments that took place with regard to the Rodeffer property. He and Council Member Kuhn met with the Mayor of the City of EI Monte and discussed the relationships of the two cities and lhe development of lhe subject site. It is anticipated !bat it might take up to 12 years to fill it There are many agencies whose approvals. will be needed prior to this property being filled. She indicated that this property cannot be annexed to the City ofEI Monte, without the property owner's approval. , With reganI to the downtown study session, Commissioner Bruckner thought they had a good meeting. Discussion ensued with regard to parldng and Ms. Butler said !bat she bas been worlting on a parking survey but this bas taken a back.seat to economic development studies. The City's code requirements for parldng may be too high on some uses but most of the City's parldng requirementS are nol"far off from other cities. It is difficult to address all silnations in the Code.
