The Planning Commission of the City of Arcadia met in regular session on Toesday, July 8,.1997 at 7:15 p.1O. in the
Council Chambers.ofthe Arcadia City Hall, 240 W. Huntington Drive, with Chairman John Mwphy presiding.

with a seating capacity of approximately 71 patrons. .
The staff report was presented and the public hearing was opened.
David Bowen, 4350 La Jolla Village. Dr., San Diego, said he was representing the Hahn Co. He said they are in
agreement with all of the conditions in the staff report. This is a uniqoe architeetwa1 challenge, they will be

Chairman Mmphy asked what would happen if Johnny Rockets was not successful andfuiled at.thislocation?
Mr. Bowen responded that if that happens they would lease it to. another establishment They want to have a restaUIllDt
at the center court.

It was moved by Commissioner Kalemkiariao, seconded by Commissioner Sleeter to close the public hearing.
The motion passed by voice votewithnooe dissenting,
Commissioner KalemkiaIian. remarlred that this would be a good use of unused space and Commissioner Sleeter
agreed.

the conditions in the staff report.

, Chairman Mmphy noted that there is a five working day appeal period after the adoption of the resolotion. The
resolotion will be adopted on July 22nd. Appeals are to be filed by Tnesday, Joly 29th.
3. PUBLIC HEARING CUP 97..008

Santa Anita Fashion Park
Consideration of a conditional use permit to operate a 13,084 sq. it. "Todai" restaurant featuring both Japanese
and Chinese cuisine with a seating capacity of approximately 430 people, this includes indoor and outdoor
dining area.
The staff rqxut was presented
In response to questions from the Commission, staff said that the sign would'be considered as part of the architectmaI
design review (ADR). He showed which sign would be n.i1i7ed This site contained a 6,200 sq, it. restaurant
previously but it did not occupy outdoor space. Currently the ooly restaurant that has outdoor dining at. the mall is
Nordstrom Coffee Shop.
The public hearing was opened.
Jonae AImslrong, 400 S. Baldwin,' the General Manager for Santa. Anita Fashion Park, asked if the hours could be
extended until a 1itIIe after the closing of the mall, depending on howiate the patrons are thi:re. There is a Todai
restaurant in the Glendale GaIleria. It is a buffet type restaUIllDt that offelS Sushi, Japanese and Chinese cuisine,

upscalebnffet style restaurant Prices for lunch are an average of $15. They will uIi1ize the main mall entrance. The
exits in the outside area are basicaiIy for fire escape.

Staff indicated that they would apply for a beer and wioeliceose;
Commissioner Kalemkiarian asked about the material of the metal canopy?
Kunio Inoue, 1515 W. 190th St, Ganlena, the architect of the project said the canopy would be aluminum and the
interior will have 16' high exposed ceilings. The 1aD.dscaping on the gazebo will bebougaiovillea or a similar type
vine, They will be utiliZing clear glass. They will construct 2' high concrete block planter, with a 4' high clear glass
on top. The wall will be split face to match the color of the existing blillding.
Commi<sioner Brockner was concerned and wanted to be sure that the addition would match the stncco on the existing
bni1diog. It would affect .the look of the mall.
Staff explained that the block wall would be compatible with the existing mall. They would utilize material to match
the existing. He indicated that staff would prefer solid glass instead of Plexiglas that can turn yellow in time,
No one else spoke in favor of or in opposition to this item.

motion passed \)y voice vote with DOne dissenting.
Commissioner Hoang said that he has dined at two different locations and was impressed. One was in West CoviiJa.
In nply to a comment by Commissioner Sleeter who thought it might be easier to grantthe extended hoDlS .at this time
and not have .the applicant retumat a later date with an amendment, staff said the hours in the staff report were taken
from the application filed by the applicant
Ms. Butler did oot think that either' of the restaurants should have time restrictions because none of the other
restamaots at the mall have them. She soggested deleting that condition. The mall controls the boursof operation.
Mr. Miller said the Planning Commission can delete that condition from both of the applications with separate
motions. .

MATTERS FROM CITY COUNCIL
CITY COUNCn. REPORTS/ANNOUNCEMENTS/STATEMENTS
Mayor HaJbicht said that the City Council will'be having astndy session at 6:00 p,I8. on July 15th to discuss the
following issues'in the downtown area:
1. The loss ofparlrlog spaces as a result of the new landscaping
2. The restriction of office use on the fust floor and allowing only retaiI uses on the fust.floor
3. A moratorium on hair and nail salons
4, Outdoor display of merchandise
Ms, Butler indicated that a petition was submitted to the City by a lady who has a business on Foothill Blvd. regarding
the display of outdoor display of merchandise. The CBD zone allows the display of certain merchandise,
With regard to the lifting on the restriction of retaiI uses, the City Council in essence would be abandoning the plan
which was laid out previoosly. It this is'changed, it will have an affect in this area where it would no longer be a walk
around business area and it would be as it was before, With regard to the parlrlog, he indicated that it would be very
costly to remove the landscaping to make room for parldog'spaces, This meeting will be an opportunity for themjo
address these issues.
A brief disciJssion ensoed regarding the Farmer's Mmxet and how it has been started in other communities.
Commissioner Bruckner commented that it has ouly be one and a half year.; since the improvements were made to the
downtown area In his opinion, thai is really not a long time and they must have patience to see the results. He also
noted that it would also take some time for a FarmersMmket to become successfo1,
Ms. Butler stated that any change would involve a text amendment which would reqUire a public hearing before the
P1aoniog Commission. .
A brief discussion ensoed regarding the Farmer's Mm:ket and how it has been started in other communities,
MayorHmbicht gave a brief explanation of Prop. 218 and the proposedFJre Suppression District and how the process
will be handled. The vote itself does not establish the district bnt it informs the. City Council of the citizens' desire.
Only 50% of the casted votes are necessary. ,Arcadia is in a onique sitoationbecaose it-is the fust city, in the area, to
by to impose anew tax ~er the passing of Prop. 218. Other cities such as Monrovia and Duarte are alsocondnctiog

He said that the City Cooncil exempted other governmental agencies and decided not to tax the County and the School
District. He reDllIlked that the City has.the biggest numberofvotes (90 votes), followed by Sai1ta Anita (35 votes),
followed by the mall (10 or 11 votes), 79"/0 of the votes lie in the bands ofsiogle-family homes. This is not simi1ar to
an election and the ballots are nOl seael
InI'esP,ODSe to a question by the Commission, Mr. Miller said that he would check to see if the hospital is on City
property, He explained that if the protests level does not preclude approval, then the City Council will have to
aflirmativelyact that night and pass the resolution to adopt the assessment district and if the protest level is no, is over
the requisite amnunt over the 50%, then they will not be able to take any action that night The Govc:mor signed
urgency legis1ation c1arifying this proposition. This is a protest procedure utilizing a ballot and not really like an
election. .
Mayor Hmbicht indicated that the budget has been balanced utilizing .reserves and if the Fire Suppression District does
not pass; then the budget will.be re-opened. Althongh:he could not predict what action the Council would take as a
whole, he would vote for cutting the money ont of the budget because he did not want to cootioneutilizing the
reserves, These will be cots that.all residents .would notice and feeL The City does not have that moch fat in the

budget. Based on a report yesterday, approximately 20"10 have casted their vote. His business is opinion surveys and
they i:Io a lot of mail surveys, and in his experience, they flOll that if people are going to respond, they would genemIly
tend to respond Within !he first few days.
