PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 27, 1998 at 7:15 p.m. in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Paul Kalemkiarian presiding. Associate Planner.1ames Kasama Assistant Planner John Halminski SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Ms. Butler indicated that two letters. were received with regard to item 6 on the agenda, the revocation of Home Occupation Permit No. 84-74. One of the letters was.from the property owner and the other was from Barbara Kissel, the neighbor at 325 San LuisRey Rd. Both letters were opposed to the revocation. Also a packet was received pertaining to item 2 on the agenda. ROLL CALL: AYES: NOES: Commissioners Bruckner, Huang, Murphy, Sleeter, Kalemkiarian None 2. CONTINUED PUBLIC HEARING CUP 98-018 141 E. Duarte Rd, Dr. Daniel Wong, Truth Theological Seminary Consideration of conditional use permit for a theological seminary to occupy an existing .9,400 sq. ft. two-story office building. The staffreport was presented. Staffsaid that the existing use is for an office use with a parking requirement of 4 parking space per 1,000 gross sq. ft., or approximately 40 spaces. The existing CUP for the 1,344 sq. ft. tutorial center included a modification for the parking requirements. There was a modification for 3-4 parking spaces when the building was originally developed. He indicated that the building codes determine the nuniber of people in an office use and the chapel section would have a higher density and the least dense space would be the library. The activity would be concentrated on week days, up to 9:00 p.m., and not on weekends. They would have to comply with ADA requirements. They are required to provide handicap restroom facilities on the second floor butthey would not be required to have an elevator but the stair ways to the second floor would need to be accessible to the greatest extreme. They would be required to have guard rails so the only persons that could not access the second floor would be wheel chair bound persons. Ms. Butler further explained that if the conditions of approval outlined in the report were complied with that would mitigate the parking issue. The public hearing was opened. Arthur Snyder, 1000 Sunset nlvd., #200, Los Angeles, spoke on behalf of the applicant. He explained that there is a need for Chinese speaking ministers. Due to the large wave of immigration of monolingual Chinese speaking persons that have immigrated to this country, the existing pastors are overwhelmed and are unable to serve adequately those who have been displaced from their traditional culture and are seeking a new life in this country. For these reasons, several of the churches who have accepted the challenge and have joined together to sponsor the founding of a small seminary where capable ministers of Chinese language can train young Christian men and women for ministry to this generation of immigrants. This application would not mean that there is a line of students waiting to get into the seminary now. Those who are working toward the establishment of the seminary will be pleased if there are 10 students in a year from now. They are hoping to have 20 students in two years and ultimately their goal would be to have 40 students. Due to the above mentioned reasons, the seminary feels that the Arcadia City PllDDliog Commissioo 2 111I27198 concerns raised by staff in th~tT report are not over stated. The suleport indicates that there could potentially be 409 teachers and students at this location. This would not happen and if it did they would be looking for a larger facility that would accommodate them. Without the need of a CUP, this building could have 269 people occupying it based on office usage. He was certain that there would be no more than 30 seminary related persons on the premises at any on time in the next two years. These are people who are trying to teach honesty to their people and would not try to cheat the City. He asked that they keep in mind that these are a group of people whose lives are committed to the Christian faith and to teaching it to young people. It is simply impossible for them to violate the law in this regard and situation. He noted that they obtained the signatures of every residential neighbor that they were able to contact, as well as the existing businesses in the area and ten existing churches in the community all of whom supporting this use. He asked that the Planning Commission approve their request and suggested the following conditions of approval as stated in his letter: 1. Classes shall be limited 20 students. 2. No more than one class may be in session at anyone time. 3. No more than 30 persons may occupy the Seminary at any time, except that on Monday mornings from 11:00 a.m. to 12:00 p.m., chlJpel services may be held, with a maximum attendance of 40 persons. 4. A public hearing shall be set one. year from the date of the occupancy of the building by the Seminary, at which time testimony will be heard on the question of compliance by the Seminary with the conditions of this grant and any modifications which may appear appropriate, at which time the grant may be modified or terminated, at the discretion of the Planning CommIssion. .' 5. A full and complete set of these conditions shall be posted at a prominent location a~ the Seminary, and shall be provided to each student and each staff member upon enrollment at the Seminary. Mr. Snyder stated that the students that attend this seminary are not already ordained but are there to be ordained. The faculty are generally ordained ministers. Theodore Chang, 2048 Wbitebluff Dr., San Dimas, said that the typical length of study is 2-3 years as a full time student. Master of Arts in TheOlogical study is 2 years. The Doctor of Ministry is 3 years. Chairman Kalemkiarian said this seems like a large location for 20-30 students and asked if they have visited other locations? Mr. Chang said they found this location to be the most suitable. This location complies with the Department ofEducationlBureau of Post Secondary Education requirements. These agencies require library, video/audio, computer data base, archive, reference and commentary areas. An:odia City PIarming Commissioo 3 10/27/98 Mr. Snyder inteljected that evclthey had 7 students they would be reled to have these facilities because they are certified. He indicated that the photos that are submitted are from Biola University. This is a.larger facility. They are in agreement of all the conditions in the staff report. Commissioner Huang said that the report submitted by the Seminary shows a lot of support by the community. He asked in their process of collecting the signatures, did they receive or encounter any opposition? According to the staff report the hours of operation varies but they are open until late evenings. There is a concem regarding the parking. Will it be possible to reschedule their hours so the concentration of the activity will take place earlier in the day and later in the day so the impact will be minimized? Their location is a commercial street and parking and traffic will be most congested during mid day and late aftemoon. If classes could be scheduled.so they take place earlier in the day and that there is less activity in mid day it would help with traffic and parking situation. He suggested having larger classes in the evenings when traffic or parking concerns are less. Dr. . Daniel Wong, 2048 Whitebluff Dr., San Dimas, said they visited almost all the neighbors and businesses and churches in the surrounding area. 38 of the neighbors and businesses signed the petition showing their support. Many of them signed most enthusiastically. They visited many Christian churches and ten pastors signed the petition including Dr. Phil Wood, the Chaiiman of Evangelical Fellowship in the City of Arcadia and Senior Pastor of United Methodist Church. He did not find anyone against their proposal. Mr. Chang said they would take Commissioner Huang's suggestion regarding the hours of operation. Monday night would be the most significant time wpen pastors in the Arcadia area would be involved ill seminars. The reasons they will be having evening classes would be because they want their students to be able to serve in a church, which means they would have>to fit in to the church's schedule. They would use the remainder <;>ftheirtime to take courSes. Mr. Snyder did not believe there would be a parking problem. The students would not be driving a lot. They are there to study the word of God. He stated that the conditions that he suggested would mitigate the Planning Commission's concerns. The State requires that they have .two classrooms but reiterated that they are requesting to be allowed to onlyhave one class at any one time. Commissioner. Murphy felt that more than half of their facility is made up of incidental rooms and only two rooms are actual classrooms. Mr. Snyder said that this is the minimal seminary facility in California and they cannot get any smaller than what they areproposmg. He said originally he felt the same way that Commissioner Murphy did. When they are attracting pastors from the community to come and be professors they have to provide a place that would be ""theirs". i t t t i f Raymond Petzhold, 832 W. Huntington Dr., said he is the English pastor at Mandarin Baptist Church located at the comer of Colorado and Santa Anita. Their church agreed to allow the seminary to utilize their facility if they needed a larger location. for a gathering. In working with the youth in the community, they believe the church ministers to a very deep need especially to one parent families when one parent is overseas working and the other is here with the children. There is alremendous need for family and they have a resource coming into the community that the ministers could tap in. The people that would be there are mature people with high moral standards who want to be ministers and to serve the community. He has known Dr. Chang for seven years and was Ar<adia City PIamiing Commissioo 4 10/27198 confident that this request wolbe a tremendous asset to the commutbecause they are bringing in peace makers and reconcilers whose purpose is to minister to the families. John Brown, 76 W. Wistaria, said he is a member of the Mandarin Baptist Church. He has known Pastor Chang since they have been members of this church. The Planning Commission can believe in what Pastor Chang says because he will not do otherwise. As a citizen, he preferred to have a seminary in the community that will provide peace and harmony to the community. If Pastor Chang feels that the seminary will be bringing in God's influence into the community, then that is what will happen. If he says that he will limit the attendance, then that is what he will do. Daniel Hsu, 18226 Vintage St., Northridge, Pastor of the Mandarin Baptist Church in San Fernando Valley, a board member of the seminary said he is speaking tonight on behalf of the board. Several denominations are being represented by this seminary on the board and faculty. Their board consists of members from Texas and Canada. The affect of this seminary will not only be important for this community, it will be beneficial for the Chinese community as a whole. No one else spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Commissioner Sleeter thought this would be a good use and he concurred with the alternative conditions as suggested by Mr. Snyder. He was pleased with their attempts in getting the approval of their neighbors and it indicated.to him the level gf commitment. Commissioner Huang said he did not hear of any opposition, therefore, he would be in favor of the proposed use. Commissioner Murphy agreed and said Mr. Snyder's conditions should be incorporated into the resolution and amend condition 1. He suggested revisiting this in six months. Mr. Millet said that in the past, projects have been brought back in six months for review. He thought that wording should be incorporated indicating that the CUP can be brought back at' any time. MOTION It was moved by Commissioner Bruckner, secOnded by Commissioner Sleeter to approve CUP 98-018 subject to the conditions in the staff report and incorporating conditions as listed by Mr. Snyder. Condition 1 should be deleted and should be. substituted with Mr. Snyder's suggestions with changes to item C to Mondays and this CUP be revisited in six months. Areodi. City PIamiing Commission s 10/27/98 RESOLUTION NO. 1578 . . A resolution of the Planning Commission of the City of Arcadia, California, granting CUP 98-018, for a theological seminary at 141 E. Duarte Rd. Ms. Butler read the titles of the resolutions. MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Murphy to adopt Resolution Nos. 1578 and to formallyaf'flrm the decision of October 27th and the vote thereon. ROLL CALL: AYES: NOES: Commissioners Bruckner, Huang, Murphy, Sleeter, Kalemkiarian None Chairman Kalemkiarian noted that there is a five-working day appeal period after the adoption of the resolution. The resolution will be adopted on October 27th. Appeals are to be filed by Tuesday, November 3rd. 3. PUBLIC HEARING TM 52689 408 S. Second Ave. Hank Jong Consideration of tentative map for a 6-unit residential condominium project. The staff report was presented. Staff indicated that on September 22od, the Planning Commission reviewed the architectural design review plans and approved the project. The public hearing was opened. No one spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. PUBLIC HEARING MP 98-012 & ADR 98-031 426 Diamond Ave. SLS Design Consideration of modifications for a 2-unit residential condominium project. The staff report was presented. Commissioner Murphy was concerned with the 25' back out area because the protruding area of the unit is actual living space. If a car is parked closest to the entrance area of units A and B, will that car be able to back out without having to pull back and forth several times? It appeared to him that there will not be a clear way to back out. Staff said the size of the car would determine how easily the car could.bemaneuvered. In the single- family zone the minimum back out is 25' and staff feels that based. on the low density of the project that a 25' back out would be sufficient. The curved line around unit A is a 6" high planter curb that separates the landscaping from the driveway. Mr. Nicholson said.there are probably over a 100 developments in the City that have a 25' back out and staff has not received any negative .input. Commissioner Murphy was not concerned with the back out distance but more with the structures next to the back out area .' Mr. Nicholson replied that they not only look at the back out but also the turning radius and usually it coincides with the 25' . Staff did not foresee a problem with the proposed back .out area. '. Staff said that.the planters that are indicated would be required as a part of request "B"which will provide a space for a vine to crawl upon to the wall and break up the long wall. As a condition of approval the 2' high wall on the east side located in the front yard area will be decorative. ::i The public hearing was opened. Vincent Tsoi, 1111 Corporate Center Dr., #202, Monterey Park, addressed some of the concerns raised by the Planning Commission. Regarding the back out space, he found there are other multiple-family developments on 50' wide lots currently being developed with 25' back out space. A 30' back out space is desirable but not always possible. They are in agreement with all of the conditions in the staff report. f. i i ! Chairman Kalernkiarian said that on the east elevation one window has shutters and the others don't and asked Mr. Tsoi to explain. He thought the windows should either all have shutters to provide continuity and. symmetry Of not have them at all. Mr. Tsoi said that shutters were placed on windows fronting the street and were not placed on all the windows due to the expense. Arcadio City PIarming Commission 7 J 0;'27/98 . . Mr. Nicholson said that shutters were not placed on some of the windows because they would be too close to each other. He suggested that possibly the shutters should be removed and grids (traditional inserts) put in all the windows. Chai!1llan Kalemkiarian preferred to see something different and Mr. Nicholson said they would work with the architect. Chi Tong, 118 S, Daisy Ave., Pasadena, was concerned with the development of a parcel that has had one single-family home and now is being developed with a 2-unit condominium. She thought it would be very congested. In rebuttal, Mr. Tsoi said the two adjacent properties are single-family homes but there are quite a few lots to the west that have already been developed with apartments and condominiums. No one else spoke in favor of or in opposition to this item. Chairman Kalemk.iarian closed the public hearing. Commissioner Murphy did not object to the development of the lot but he did not like the elevations. He asked that staff work with the applicant to improve the elevations. He thought the north elevation with two box shaped windows could be improved and are out of scale with the arched windows on the flfSt floor. He was pleased to see.an. architecturally different design but thought this project had room for improvement. Mr. Nicholson said staff spends a lot of time with the architect to come up with a little diversity in a design instead ofhavingcook.ie cutter developments. Staff's expertise is not to design projects, they are planners and rely on the architect to convey what his client is seeking and they work together on that. Overall, he felt the design was positive but amenities could be added to rework the windows. He suggested more elongated windows to go with the horizontal lines on the building and together with the grids it would soften the elevation. Ms. Butler said that reducing the size of the window on the north side of unit A would create a better elevation. Chaiiman Kalernkiarian thought that a project should have a theme and things should not be thrown together. He did not like stucco window treatments and felt there are better ways to build. Commissioner Bruckner said the building is almost traditional colonial with the rafter ends visible and then there are the arched windows. This'is a combination of styles. He did not think that styles should be mixed, it should be one or the other. MOTION It was moved by Commissioner Murphy, seconded by COnlmissioner Bruckner to approve MP 98-012 & ADR 98-031 subject to the conditions in the staff report with the additional condition that staff revisit the elevation. PUBLIC HEARING TPM 98-021 37 EI Dorado Ave. Tritech Assoc. Consideration of tentative parcel map for a 2-unit residential condominium project. The staff report was presented. Staff stated that architectural drawings have been submitted for the 2-units and they are in the process of making revisions. Mr. Nicholson remarked that they will comply but the architect.is making revisions now and will be returning them to stafffor review. The statement in the staff report is for information purposes only and does not have a bearing on the actual subdivision. CommissionerMurphy thought that the staff'report and the recommendations conflict. Commissioner Bruckner suggested deleting "design" from the sentence and Ms. Butler and Commissioner Murphy agreed: The public hearing was opened. Tom Cao, Tritech Assoc., 735 W. Emerson Ave., Monterey Park, said they are in agreement with all of the conditions in the staff report. No one else spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. MOTION It was moved by Commissioner Bruckner, seconded by Commissioner Huang to approve TPM 98-021 subject to the conditions in the staff report with the mod.ification listed above. Appeals are to be f1Ied by Monday, November 9th . Arcadia city Piamting: Commission 9 10I2719ll . . 6. PUBLIC HEARING REVOCA nON OF H.O.P. 84-74 319 San Luis Rey R.d. James and Ravelle Kozak Consideration of revocation of a Home Occupation Permit (HOP) for the assembly and mail order sales of keys and key rings. Mr. Miller said the stsff report will be presenting evidence to support the revocation and he recommended that the Planning Commission open the public hearing and the stsff report will be a part of the public hearing. The public hearing was opened and the stsffreport was presented. Stsffsaid the two letters that were received and distributed do not address the issue that is before the Planning Commission - the revocation of the HOP. He said the department received a complaint and then pursued it The applicant agreed to each condition of the HOP when the permit was originally granted. Stsff has not been to the site since October 6th. The next inspection is scheduled the week of November 11th. Ms. Butler said she was involved in drafting the home occupation ordinance. Sometimes people that obtain a HOP intend to have a small business but in this case the business grew. The intent of the HOP is not to allow this type of an.activiiyto take place on a residentially zoned property. When someone gets beyond it, they need to look at other alternatives and moving their business to an appropriate zoned site. Tile purpose of the HOP was to allow business but at the same time preserve and maintain the residential character. The City at one time did not want Home Occupation and when the regulations were drafted, they were drafted to such a degree that there would be no chang\! in the character and dwelling of the neighborhood i.e., if someone drove by they could not tell that.there was business being conducted in a particular house. '. Commissioner Sleeter said he walks by this home daily and until he saw the presented materia1 he had no idea of what was takiilg place at the house. He said that a neighbor across the street from the subject site has a workshop but that is clearly a hobby. When he walks by on the weekends he can hear his wood working equipment which is very noisy, yet he has never heard anything from the subject site. Clearly this is something that has grown.beyond what its initial intent was. Ms. Butler said that a business license is required as well as a HOP and inspections are not done. She remarked that she should be able to walk the street and site and not be able to tell that there is a business being operated from the house. Stsff said some of the noted violations could affect the safety of not only the subject property but also the neighborhood. The electrical and other safety violations are tied in to the improper use of the property. !fit was not for the machine.shop they would nothave the electrical code.and safety violations. Mr. Miller said this is a community of homes - a residential area. There are certain things that don't belong in residential neighborhood and the reasons may not necessarily be apparent to the neighbors. Some of the reasons are directly related to safety. The HOP states in the "Purpose" Arcadia City PIamiing Commission 10 10/27/98 Section 9285.1 that "it is to at, home occupations in residential us_nes which are compatible with a residential environment and upgrade the living environment of the community." Staff responded to a question by Chairman Kalemkiarian, that this was the first complaint that was received by the department. No one ever called to report of any deliveries or a violation of any of the other conditions of approval. It appeared to staff that there might be some employees on site but staff could not verify. No one spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Commissioner Bruckner said many cities do not have a home occupation ordinance. He thought that it is very important that they uphold the intent of the ordinance and hold people to the intent of it to allow people to conduct businesses in their home without disrupting the neighborhood or presenting a health or safety problem to the neighbors. It appears by looking at the photos that this is clearly in non"compliance with the ordinance and he wanted to stay close to the intent of the ordinance. He did not want to make exceptions or changes and he favored stalPsrecommendation on this action. This is far from the original intent of the ordinance. Ms. Butler said that the applicant could not reapply. They can apply for another home occupation and they would investigate it more. thorough]y. This is not the type of a use that should be located in a residential zone. Commissioner Bruckner said if the neighbors were aware of the what was going on there they would have a problem because it is a safety issue although it is not a visible problem. lfhe was a neighbor, it would be very distressing knowing he lived next door. Commissioner Sleeter said the neighbor to thenortb was obviously aware of what was going on there and regardless that does not make it acceptable. The business is beyond the scope of the intent of the ordinance. He thought there might be a need for more vigilance on the part of the City in reviewing renewals of these permits in the future. This is clearly a safety hazard and the photos speak a volume. He suggested that staff inspect Home Occupations when they are reviewed, Ms. Butler said it is very doubtful thatstaffwill make inspections at renewal times. There are over a thousand HOPs in the City and .only one business license officer. Unfortunately, staff hears about these when complaints are made but this case is not the norm and only the exception. Most businesses are computer oriented, mail order, import/export, interior decorators, architects. This is not the typical Home Occupation. Commissioner Sleeter said that businesses usually .grow and seVeral years after they have been granted the permit, the business might change and they do not match what the original permit was issued for. He suggested that HOPs be randomly reviewed 4-5 years after approval Chainnan Kalemkiarian wondered how the equipment was delivered and could not imagine the machinery being delivered because they are so large. Commissioner Murphy was concerned with the drums of cutting oil and felt it would be a clean up problem. He did not think they had any choice but torevoke the permit. Arcadia City PJaoomgComrriissi... 11 10/27/98 . . Staff replied that the Fire Marshall was speechless after seeing the drums. Neighbors will usually contact the department to report any problems. Commissioner Sleeter said the property owners are both peace officers and the public expects them to live to a higher performance standard. What they did is not right. In defense of the property owners, Ms. Butler said they did clean up the property once they were notified without argument. Mr. Kozak indicated that they had been looking for another location. MOTION It was moved by Commissioner Murphy, seconded by Commissioner Bruckner to revoke the HOP and that staff prepare the appropriate revocation notice. E. Live Oak Ave. RESOLUTION NO. 1581 Aresolution of the Planning Commission of the City of Arcadia, California, granting CUP 98-021, to operate a 235 seat restaurant at 400 E. Huntington Dr. RESOLUTION NO. 1582 A resolution of the Planning Commission of the City of Arcadia, California, granting CUP 98-022, to expand an existing restaurant at 308 E. Huntington Dr. Ms. Butler read the titles of the resolutions. Appeals are to be filed by Tuesday, November 3n1. An elderly tenant was present to speak with regard to the item pertaining to 408 S. Second. Chairman Kalemkiarian explained that the Planning Commission already took action on that item and could not take his testimony. The tentant asked that Mr. Chen give him time to relocate. With his limited income, it is difficult to find a location that would be suitable for him. He is looking for a one-bedroom apartment with a stall shower. Due to health reasons, he cannot have a bath tub shower and it has been very difficult to find a location. Mr. Miller said that even if he was participating during the public hearing period of the subject item, hinequest is not within the jurisdiction of the Planning Commission. There is nothing that the City can do with regard to the timing of the development to help him relocate. Staff will informally ask the property owner to give this tenant more time to relocate.
