PLEDGE OF ALLEGIANCE
The Planning Commission of the City of Arcadia met in regular session on Tuesday, May 26, 1998
at 7:15 p.m. in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with
Chairman John Murphy presiding.

MOTION
It was moved by Commissioner Sleeter, seconded by Commissioner Huang to excuse
Commissioner Bruckner from tonight's meeting. The motion passed by voice vote with none
dissenting.

3. PUBLIC HEARING CUP 98-011

Chevron USA Products Company
Consideration of a conditional use permit for a 24 hour, self-serve gas station with
a 2,000 sq. ft. convenience mart with beer and wine sales for off-site consumption.
The staff report was presented and it was specifically indicated that the existing eucalyptus trees
along the north property line will be removed due to the new property line wall but they wilL replant
three 15 gallon trees of the same type. Staffwas satisfied with the size of the proposed replacement
trees beca'l8e eucalyptus trees grow fairly quickly.
In response to questions from the Commission, staff said that the CWTent service station is open 24
hours and that there are CWTently 4 pumps. The new station will have four new pumps, which will
be accessible on both sides for a total of 8 fueling positions. The underground storage tanks have
been upgraded and the site has been tested. Staff anticipated that there would be a reduction in noise
because a convenience mart is generally less noisy than automotive repair activities. Staff indicated
that there is a church and uchoolto the north on Santa Anita that may be within 500 feet.
The public hearing was opened.
Romulo Matanguihan ofRE.M Engineering Co., Inc., the applicant's agent, stated that they are in
agreement with all of the conditions of approval in the staff report. He indicated thatthe proposed
project will be an improvement of the site and will provide better circulation. The two driveways on
Live Oak will be consolidated into one driveway.
In response to a question by Commissioner Sleeter, Mr. Matanguihan said that he believed that
locating the air and water equipment to the area near the handicap parking will provide adequate
access for customers to use the equipment.
In reply to a question by Commissioner Bell, Mr. Matangllihan said that customers can easily pull in
from Santa Anita Avenue and go to the pumps and it would provide safe access to the convenience

mart. This site layout was selected due to safety and circulation considerations and he did not feel
that the turning radius would be a problem. In their diagrams, it is shown how a tanker truck will
enter and exit the site as well lis how a ear would access the fueling area. He said that there will be
bollards at the ends of the pump islands, and.!- 6"raised walkway in front of the convenience mart.
Staff stated that the 6" curb was eliminated .from the plan so that the entry to the convenience mart is
level with the driving'surface. Inreply'to a question by Commissioner Sleeter, staff said that there
isn't anything to prevent a vehicle from suddenly accelerating into the building from the fueling
pump area, and that, it is doubtful that a 6" curb would prevent the same thing.
Mr. Matanguihan said that if the pumps were to be placed differently on the property, there would
not be room forfour.islands.
Commissioner Sleeter said he did, not think they would comply with setbacks if they did that.
There was discussion among the Planning Commissioners with regard to how cars would enter the
site and which directions the vehicles would face.
Staff said there is an access. easement along the northern portion of this property for the parking area
of the adjacent restaurant that prevents the convenience mart from being located in that area.
Commissioner Huang asked that since there will not be a 6" curb, would the applicant object to
enhancing the decorative brick paving to cover the entire walkway? Presently it is proposed as only
very thin bands. More decorative material would better define thewa1kwayfromthe vehicular area.
Jon Wu of R.E:M. Eilgineering said that they originally provided a 6" raised sidewalk but that
required them to have a large sloped area in front of the building for ADA purposes, but that
interfered with vehicular movement. There is an 18" raised planter along the northerly portion of the
convenience mart. It is their opinion that whether there is a 6" curb,or not there is no way to
definitely prevent an accident.
Chairman Murphy asked about the "pedestrian. area, n when the tanks were upgraded, and was any
contamination found on the site.
Commissioner Bell remarked that the. wa1kway provides a sense. of safety. It is an area where one
could stand before stepping out'into the vehicular area where they should be more careful.
Commissioner Huang wanted to better define the walkway area for pedestrians, otherwise vehicle
drivers tend to perceive that the entire concrete area is their territory.
Mr. Wu said the walkway can be further enhanced. He did not know when the replacement tanks
were upgraded, but thought it would have been in the late 19808. He indicated that there is presently
no site contamination and did not know if there was any found when the tanks wererep1aced.
Jerry Weaver, of Chevron USA, said the tanks wererep1aced in 1993 and that if there had been any
contamination, it would have been cleaned up at that time.
No one else spoke in favor of this item, and there was no opposition presented to this item.

It was moved by Commissioner Sleeter, seconded by Commissioner Huang to close the
public hearing. The motion passed by voice vote with none dissenting.
Commissioner Bell said she thought it would help to have protective bollards in front of the
walkway to protect the building and the customers, and asked if they are used. at other locations.
Staffsaid that bollardshave been seen at other similar uses but that they are:not a typical installation.
They could be located about 6 to 8 feet apart.
Commissioner Kalemkiarian said he likes the idea of having protective bollards.
Commissioner Bell said that looking at the top page of the plans, it shows, "NEW A/C PAVING,"
and asked, "Doesn't' AlC PAVING' mean asphalt?"
Staff said that is correct, but the concrete area encompasses the area in front of the. convenience mart
as well as the pump islands.
Chairman Murphy said the concrete area appears to be a large pad, almost a square starting at the
west ends of the pump islands and going to the property line to the east, approximately SO feet from
the north property line.
The applicant said that the large concrete pad area delineates the area to be used by both pedestrians
and vehicles. The rest of the site is paved with asphalt.
Chairman Murphy said that he is confident that Chevron's engineers are very knowledgeable about
these facilities, and that they know what they are doing. He also felt that the City staff is fully
capable of thoroughly reviewing this and that their decisions should be relied on. They should not
try.to second "guess what is right or wrong. He thought this proposal was well laid out. He did not
have any objections.
Commissioner Bell said she. wanted to see more color concrete or brick in the area adjacent to the
convenience mart which is called out as, "NEW CONCRETE W AIXW A Y." Commissioner Sleeter
agreed, and Commissioner Huang suggested leaving the final design of the walkway subject to
review and approval by staff
MOTION
It was moved by Commissioner Kalemkiarian, seconded by Commissioner Sleeter to approve
CUP 98-011 and ADR 98-005 subject to the conditions in the staff report with the added
condition that the walkway be further ,,"hanced subject to approval by staff

Chairman Murphy noted that there is a five working day appeal period after adoption of the
