PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, July 13; 1999 at 7:15 p.m. in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Pro Tern Richard Bruckner presiding. ROLL CALL: PRESENT: Commissioners Bruckner, Huang, Murphy, Sleeter ABSENT: Commissioner Kalemkiarian MOTION It was moved by Conimissioner Sleeter, seconded by Commissioner Murphy to excuse Commissioner Kalemkiarian from tonight's meeting. The motion passed .by voice vote wIth none dissenting. In response to a question by the Planning Commission, MS..Butler statedthat'.lighting,for ATMs are not mandatory by the City, but the applicant would probably provide lighting ~!: . The public hearing was opened. Roy Herbal, 2522 Aquasanta, Tustin, said they are in agreement with all of the conditions in the staff report. In reply to a question by the City Attorney, Mr. Herbal said once the customer drives up to the ATM, the machines would indicate a message when out of mOney. T1ieywere not anticipating placing an indicator at the entrance of the drive up that would indicate when the machine was empty. This will be exclusively for drive up use only. Chairman Pro Tern Bruckner closed the public hearing. MOTION It was moved by Commissioner Murphy, seconded by Commissioner Sleeter to approve CUP 99-011 and adopt Resolution No. 1593 subject to the conditions in the staff report. Appeals are to be filed by July 21st. ' 4. PUBLIC HEARING CUP 99-012 1104-1110 S..Baldwin Ave. David Hung Consideration ofa conditional. USe penn it to operate two restaurants (1,600 sq. ft., and 3,600 sq. ft.) and a flower shop/tea house (1,200 sq. ft.) that would be within a new retail shopping center. The center is currently under construction. The staff report was presented. Staff commented that the handicap parking spaces could be relocated if the, Planning Commission wanted to move them. He .said that the majority of the center would be occupied with retail uses. He felt that the applicant located the handicap spaces at the most appropriate locations on the property. Handicap spaces should not be near the driveway-because it is very busy, Chainnan Pro Tem Bruckner remarked that handicap-parking spaces require a ramp system. If they relocated them they might lose another parking, space. The public hearing was opened. Joe Borland, 660 W..Duarte Rd., asked that this item be tabled to a later date. He explained .that the applicants have been very irresponsible since the'beginning ofthi~ project They brought in a lotof dirt, They tore down his wall and did not even clean up the mess 11iiCl erected a shorter wall. He wanted one that was 6' high. He anticipated that patrons of their center would utilize his parking lot and jump over the short wall to go to this center. Their equipment has destroyed his parking lot They have destroyed trees along the north side of the property. He thought all of the above issues should be addressed prior to proceeding with this conditional use pennit. Staff explained that the project has not been finaled. The wall is not a code requirement. He has been assured that the damage to Mr. Borland's property will be repaired. The infill was so they would comply with drainage requirements. Certificates of Chairman Pro Tern Bruckner stated that the CUP is not for the center but for two restaurants within the center. Mr. Borland reiterated his .request of tabling this item. He was unhappy that the height of the wall was reduced. It was noted that the wall referred to by Mr. Borland was on the subject property and not Mr. Borland's property. .Robert Ritmer, 25501 Teppeko Dr., said.their contractor wili be at the site next week to pave the parking lot and will repair the damaged portion on Mr.oBorland's property. The new wall is 4' high which is higher than the original wall on Mr.. Borland's side. No one else spoke in. favor of orin opposition to this item. Chairman Pro Tern Bruckner closed the public hearing. Commissioner Murphy sympathized with Mr. Borland~s situation but the issues.he has raised are not related to the subject at hand. Chairman.Pro Tern Bruckner said that based on the applicant's testimony, the wall is higher now than what existed there before. The Planning Commission is .not reviewing the wall tonight. It is not a part of this discussion. Appeals are to be filed by August 4th. 5. PUBLIC HEARING TPM99-013 (pM 25626) 1702 S. Santa Anita Ave. David Chen Consideration of a tentative parcel map to subdivide a single-family residential lot into two new lots. Arcadia City'Planning Commission 4 7 !13/99 . . The staff report was presented. In response to a question by Commissioner Sleeter, staff remarked that this item was received prior to. the Planning Commission's June 22nd meeting. Commissioner Sleeter thought that it would have been helpful if the Planning Commission was informed of this pending application at the last meeting when they were considering the other subdivision at 26 E. Camino Real. The public hearing was opened. Ying Lee,.40 E. Winnie Way, submitted a letter signed by several of the neighbors objecting to..this subdivision. They objected to the large two-story homes with two-story entries and 3-car garages facing the street, that will eventually be cOnstructed which will result in the loss of their privacy. The city will undoubtedly reap the tax benefits but. he asked that the Planning Commission think about the residents in that neighborhood. Jan Chang, 1.1 16 Loganrita, the civil engineer of the project, said they are in, agreement With all of the conditions in the staff report. They will try to expedite the construction so there will be minimal disturbance in the neighborhood. No one else spoke in favor of or in opposition to this item.. Chairman Pro Terti Bruckner closed the public hearing and said the Planning Commission is to discuss the subdivision of the lotand not the design of the homes. The.project complies with code. Staff said that there have been no plans submitted to the city in developing the properties. Commissioner Sleeter remarked that the project complies with code. Hopefully, the City Council will adopt the new proposed changes that will help address some of the issues that were raised. RESOLUTION NO, 1591 A resolution of the Planning.Commission of the City of Arcadia, California, granting CUP 99-009, to convert an existing automobile service station into an automobile fueling station with a 1,600 sq. ft convenience martwith beer and wine sales for off-site consumption at 500 N. Santa Anita Ave. Ms. Butler read the title of the resolution. MOTION It was moved by Commissioner Murphy, seconded by Commissioner. MATTERS FROM CITY COUNCIL Coul}cil Member Marshall said the City Council will .be considering the proposed changes for the single-family zoned properties at their. July 20th meeting. She thought that the Planning Commission review has made iteasierfor the City Council to review the proposed text amendment. She stated that the City has hired a new Fire Chief. The Police Chief will be retiring in-September and.that the City Attorney will retire in November. Council Member Marshall said that the Police Dept. will be having a safety check for child seats, on Saturday at the Community Center. Everyone is invited to attend to have them checked. UPCOMiNG AGENDAITEMS Ms. Butler remarked that Santa Anita has filed applications for a Zone Change, Text Amendment and General Plan amendments. She gave a brief description of their proposed project. An EIR will. be needed for this project. They have not submitted a break down of the different uses. The Planning Commission and City Council will review the plans. Staff should.receive.the DEIR for the Anoakia project soon, which will need review by both the City Council and the Planning Commission. Ms. Butler explainedthatthe following positions have been filled: A. Kurt Keating - Code Services Officer B. Tracey Young- Business License Officer C.
