PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, June 22, 1999 at 7:15 p.rn. in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Paul Kalemkiarian presiding. ROLL CALL: PRESENT: Commissioners Huang, Murphy, Sleeter, Kalemkiarian ABSENT: Commissioner Bruckner MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Murphy to excuse Commissioner Bruckner from tonight's meeting. The motion passed by voice vote with none dissenting. If the tape indicates that he voted against it, then he would not want to change the Minutes but "would like to change it later tonight when the item. is discussed again. He wanted to delete the FAR. Ms. Butler replied that what was intended that both Commissioners Bruckner and Sleeler favored keeping the FAR. Commissioner Huang commented that on page 6 of the Minutes, the statistics that he reported from all three meetings was that all the speakers were property owners (with the exception of one), residing in a homeowners association and that they favored thechange.and those that did not reisde in a homeowners association were'against the proposal. PUBLIC HEARING TM 52877 &20-826 Golden West Ave. Hank Jong Consideration of a tentative map for a 5-unit industrial condominium project. The staff report was presented and the public hearing was opened. Hank Jong, 8&1 Monte Verde, was in agreement with all of the conditions in the staff report. No one spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Appeals are to be filed by Tuesday, July 6th. - 3. PUBLIC HEARING TPM 99-011 (pM 25582) 26 E. Camino Real Grace Hsu Consideration.of a tentative parcel map to subdivide a single-family residential lot into two new lots. The staff report was presented. The public hearing wl!S op~ned. John Chang, .U16 LoganritaAve., said that this lot split would benefit both the immediate area and the community. This IS a good project and now is the righttime to develop the property. There will be enough turnaround area in the cuI de sac. Ms. Butler explained that lot 2 would be slightly over 12,OOO'sq..ft. and,that the cuI de sac terminus was not deleted from the square footage shown, by the applicant. The project complies with all code requirements. 'Elaine ToUt, 35E. Winnie Way, said she is the adjacent neighbor and wondered why they are trying to do this? How-will this be done? All the neighbors are against extending Winnie Way. Their friends tried to do this several years ago and they were not allowed to. How is the applicant able to request this? Ms. Butler explained that the request is to divide the property at 26 E. Camino Real with one lot fronting on Camino Real and the other on the new cuI de sac. Many years ago someone tried to do something similar but they did not want to complete the terminus. They wanted to gain access across onto Winnie Way, which is not allowed by code. Dead end streets.are notallowed. In order to put a lot onto Winnie Way they would have to create a terminus, which is being proposed. Ms. Tout was against opening Winnie Way and making it a larger cuI de sac because it would bring . in more traffic. She felt a two-story home would invade her privacy. No one else spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Ms. Butler explained that 80' is required for a cuI de sac terrilinus. Commissioner Murphy said the lot split complies with code. Appeals are to be.filed by July 6th, 4. PUBLIC HEARING TPM99-012 (pM 25590) 360 Fairview Ave. Tritech Assoc. Consideration of a vesting tentative parcel map to create two lots: from one lot for the development of a two-story, 4;400 sq. it, houses on each new lot The staff report was presented. Staff explained that originally there were two legal lots built with one house. At the same time in the past, a portion of the property was subdivided, but the City has no records indicating when this was done. Ms. Butler indicated that the all the properties to the west 0050 Fairvieware zoned R-l 15,000 and all properties to the east 0047 Fairview are zoned R-O 12,500. The minimum lot width in the R-O zone is 100' and75' in the R-1 zone. The public hearing was opened. Tom Kao, Tritech Assoc., 735 W. Emerson, Monterey Park, said the existing buildings are old and wili be replaced with two new custom homes. This development will improve the area. With the exception of the 3-car garage condition, they are in agreement with all of the conditions in the staff report. He submitted photos of similar homes that they have constructed in other communities. 1 I I , i I I 1 I Robert Tong, Sanyao Int'I, 141 E. Duarte Rd., said they are proposing to construct 2-story homes that will cOmply with current zoning requirements. They agreed to reduce the height of the porch to 14' and increasing the landscape area. He asked that the Planning Commission allow the 3-car garages as they have proposed. There are new homes on Fairview with 3-car garages on the street. It would not be a good idea to turn the garage on one lot. It would not be symmetrical. The property atJ51 Naomi was developed with tandem parking.and it was difficult to sell the home. Michael Lucki, 350 Fairview, did not'want a large 2-story home towering over his property. He would lose his privacy. They recently purchased this property and he felt this would reduce property values, The lot split would not be cohesive to the neighborhood. It does not make sense. They like the rustic look of the area and this development would change the character and the neighborhood. Commissioner Murphy noted that if the properly was not subdivided they could build an even larger house. He asked if Mr. Lucki realized that? Mr..Lucki replied that he feared that the home would be too close to the property line and he would lose his privacy as a result. He preferred to keep the property as one parcel and build a large house that would have a greater setback. He remarked that even though the developer could build a much larger house if they did notsubdivide, that would not be unlikely. Bruce Willoughby, 365 Fairview, said he.resides directly across from this property. He asked who applied for. this request? Staff responded that the application was filed by the civil engineer on behalf of the property owner. Ms. Butler again explained the two different zones in the neighborhood and the minimum lot size requirementS for each. Mr. Willoughby said that this neighborhood is comprised of primarily single .story homes. To construct two monstrosities would not be compatible. It will have a negative impact. He did not like the monster homes that are being constructed in South Arcadia. In his opinion, they are ugly and ruin the visual environment of the street and reduce property values. What will happen to the old eucalyptus trees.clO the property? Vic Depalma, 332 Fairview, said there are no 3,000 sq. ft homes on the.streel. So how could a 4,400 sq. ft home be compatible? He did not like having 40% of the front being taken away by the 3-car garages. This will resemble a condominium project. lfsomeone wantS a 4,400 sq. ft home then they should buy a larger lot where the house would fit in better. This will affect the quality of life.in this area. Mrs. Richard Douglass, 347 Fairview, said the neighbors are against this.1ot split. They do not want a two-story house. She was concerned that they would lose trees as a result of this development and this will affect the City as a whole. This is a massive development that they do not want in their neighborhood. Muriel Dooling, 340 Fairview, knew exactly what would happen when they constructed these large homes. She explained that there is a very large home in the R-O portion of the streel - east of this property. She did not know how many people lived there. Families come, visit, stay for a while, leave and then others come in. Groups of people come and groups of people leave. It is like a glorified boarding house in the R-O zone. There is another house east of this house with similar situation. She feared that the same would happen if these homes are constructed. Arcadia City P18Dning Commission 5 611:2199 . . In rebuttal, Mr. Kao said that code requires a minimum of 15,000 for any new lots but both of the proposed lots exceed the minimum code requirement. They are not proposing to cut all the trees. They will be, removing the'unhealthy trees and will make every attempt to save the mature trees. Their intention is to build two custom homes. The existing homes are old and unsightly. Mr. Tong replied to a question by the Planning Commission, that he could provide a greater front yard setback but it would be difficult to reduce the width of the house. No one else spoke in favor of or in opposition to this item. Chairman Kalemkiarian c1osed,the public hearing. Staff explained that a tree preservation plan would be required. There would' be no mass. clearing of trees. Commissioner Murphy did not want the homes to look identical. He asked that the architect be a little more creative with future projects. He said that a 4,400 sq. ft. house on a 16,000 sq. ft. lot'is nota very large house by today's standards. They are attempting to deal with it by increasing the setbacks, lowering the pitch of the roof to soften the look of it. He did not see how they could deny it baSed on a 2.5' modification on the lot wiOth. Commissioner Sleeter agreed, The recommendations by staff, while they are not consistent with what is being recommended to the City Council are appropriate. He did not think that they could deny it because of a 2.5' deficiency. He did not want the3-car garage fronting'on the street. It is very important to get the 3-car garages off' the front of these narrow lots, By relocating the garage, they will be reducingthe.size and the visual scope. He did not want cookie cutter homes. They are reducing the height of the. entrance. Commissioner Huang was pleased to see that the architect is attempting to address some of the concerns raised by the neighbors by increasing the setback. He thought the tree preservation plan would help in saving the trees. Chairman Kalemkiarian felt they'should apply the code and not perl'ormarchitectural design review. They are not here to address the emotional appeal of the neighbors. They have to determine if the project complies with code and if not, whether it should be approved or not based on both the Zoning Ordinaoce IiDd the General Plan requirements. Both new lots are going to be larger than the minimum lot size requirements even though they may be substandard in the lot width by 2.5'. He felt that the additional front setback of 5' to 8' would address some of the concerns raised and. provide more space for landscaping. They could build a very large home on this property if it is. not subdivided. The homes that are being proposed for these properties are well below what is being recommended to the City Council in the R-O and R-l changes. Therefore, the mansionization,issue with these parcels is a moot point. MOTION It was moved by Chairman Kalemkiarian, seconded by Commissioner Sleeter to approve TPM 99-012 subject to the conditions in the staff report with the additional condition that the homes be setback an additional 5' from the front property line. Appeals are to be filed by July 6th. 5. PUBLIC HEARING CUP 99-009 500 N. Santa Anita Ave. (NE comer of Santa Anita Ave. and Colorado Blvd.) Andrew Paszlerko, Architect Consideration of a conditional use permit to convert an existing automobile service station into a self-serve gas station with a 1,600.sq. ft. Food Mart with beer and wine sales for off- site consumption. RESOLUTION NO. 1591 A resolution of the city of Arcadia, Ca1ifomia, granting CUP 99-009, to convert an existing automobile service station into a self-serve gas station with a 1,600 sq. ft. Food Mart with beer & wine sales for off-site consumption at500 N. Santa Anita Ave. The staff report was presented. I } i j In response to a question from the Planning Commission, staff explained the hours of operation for In 'N Out. They are open Sunday-Thursday 10:30 a.m. - }:OO a.m. and Friday and Saturdays 10:30 a,m. to 1 :30 a,m. The existing service station has perimeter lights and no additional ones are proposed at this time. There would be some lighting provided near where the air and water and pay phones are but there will not be additional light standards. There will be a light standard at the comer of Colorado Blvd. and Santa Anita Ave. that will illuminate the entire front portion. Staff does not want to place lights on the north and easterly property lines due to the adjacent residential properties. He thought that perimeter lighting in the landscape planters is the best solution. They are proposing one unisex restroom b.ecause the applicant felt that would be adequate basedupon the limited square footage of the convetiience mart. Ms. Butler remarked that based on the Police Department's observation, In 'N Out closes the parking area in the late evenings so only drive-up is available. They chain off the parking area. Staffhas not verified that because it is too late in the evening. The public hearing was opened. AndrewPasztefko, 2055 N. Alvarado St., Los Angeles, said the service station is currently open 6:00 a.m. to 12:00 a.m. They are sensitive to the neighbor's concerns and recognize that there are potential problems with them. They are requesting to operate 24 hours. There would be one staff meIilber for the sale of gasoline around"the-c1ock and to perform janitorial duties. Having an employee on the site 24-hours a"day provides security for the premises. If they closed at midnight An:adia city P1llDDing Commission 7 6122199 anyone could utilize their .ng lot. With having both an emPI! and a camera system, they would be able to police the parking lot. They are in agreement with the hours of operation for the food mart. They are not proposing additional lights. The convenience store would not be open 24- hours. Gas would be purchased at the walk-up window. They are not proposing any changes to the signs Gene Gioia, 21 E. Newman, the street north of the subject. property, spoke against the request. He was against the 24-hour operation and the sale of beer and wine. He said that their neighbofhood is bounded by the freeway to the north, the dental office to the west and both the Chevron Station and In 'N Out to the south. As a result, their street gets excess traffic from people that come off the freeway and make V-turns because they are going in the wrong direction. They also get patrons of In 'N Out who purchase their food and drive up to their street and park under a shade tree while enjoying their meal. They deposit their trash allover their street. There are many children in their neighborhood. Imagine what would it be like after this is open, a person buys his hamburger from In 'N Out, goes to Chevron to purchase beer and proceeds to his street to consume his meal. He did not want that happening on his street. Just recently, there was a robbery and the assailants jumped the fence to get to Newman because the get away car was parked there. Being open 24-hours would only increase this type of an activity. He asked what the requirements for selling beer and wine are? Isn't this location too close to the church across the street? Mr. Miller explained that the neighbors can protest the sale of beer and wine to the ABC. They will have an opportunity once the property has been posted. Mr. Gioia went on to say that they get transient population on their streel. He said the liquor store at the corner of First Ave. and Colorado closes at 10:00 p.m. and this would mean that all people would have to do is to go down the block to this facility and they can purchase liquor for another two hours. Bafbara Sutton, 26 E. Newman, was concerned with the sale of alcoholic beverages. She felt there would be trouble on their street as a result of the sale of beer and wine. The patrons of In 'N Out would purchase their meals and buy the liquor from the service station and consume them on their street because they are not permitted to consume alcoholic beverages on In 'N Out property. She asked the Planning Commission if they would want that type of a situation on their street? Albert Lee, 39 E. Colorado Blvd., concurred with the previous speakers. He was concerned with the sale of beer and wine and the 24-hour operation. He feltthat they should close at the end of business day. It is inevitable that traffic would be increased and thought staying open 24-hours a day would just exacerbate the problem. In rebuttal, Mr. Paszterko agreed that having trash on a residential area is undesirable. He assured the Planning Commission and the neighbors that they will employ conscientious staff. He asked that they have the opportunity to operate as proposed and the Planning Commission can monitor and if there are problems reduce the hours of operation. No one else spoke in favor of or in opposition to this item. Chairman Kalernkiarian closed the public hearing. Ms. Butler remarked that the codes were changed to assess affects on the neighbors. Arcadia city PImming Commission 8 6f1:1J99 Chairman Kalemkiarian sa'that the State would heavily condititlicenses if there is enough opposition and certainly a church has huge powers as well as the residents. Conditions could range from sale hours, prohibiting the sale of single beers and that only 6-packs can be sold. Thefollowing are the noticing requirements for ABC; all residential properly within a.300' radius and all churches and schools within a 600' radius. There is a $150 application fee. A sign is posted outside of the businessindicatiog that an application has been filed. The time to protest the request would be when the sign has been posted. An: investigator will come out and address all the issues that were raised and condition the license; The State then hears the protests and takes action. The State is very concerned with the sale of alcohol. Mr. Miller said they could condition the sale hours as long as they relate it to an impact that is reasonable or has been addressed with the testimony tonight particularly with regard to the adjacent residential uses, The condition would need to be tied into a real problem. The .Planning Commission can revisit this item after they have been in operation. Amendments could then be made if deemed necessary. Ms. Butler remarked that prior to when this was established the City did not require a CUP and a convenience store could go into any commercial zone by right. The codes were changed to assess affects on the neighbors. Chairman Kalemkiarilln said they should. limit all deliveries to 8:00 p.m., the project shall be reviewed after 6-month of being in operation, the sale of beer and wine shallbe limited to 10:00 p.m., add perimeter fencing to make it diffiCUlt to climb. Commissioner Murphy thought they should think long and hard about the relationship of this facility and In 'N Out and their relationship to the freeway. He felt there is a .cause for concern with this relationship. Possibly by limiting the sale of beer and wine it could address his concern. Mr. Miller replied that there should not be a substantial variance between the hours for the sale of alcohol on these premises vs. any other premises in the City. He cautioned that the conditions they are imposing on this applicant should not be any different than other uses in the City. Commissioner Sleeter thought that Royal Oaks Liquor Store closes at approximately 10:00 p,m. He thought thehours.should be compatible with,the liquor store. He thought this could make it easier to purchase liquor and potentially create more opportunity for traffic accidents. He was concerned with the relationship of In 'N Out and this facility. Chairman Kalemkiarian replied that the limit on the sale ofbeer and wine would be-the same as the liquor store. nearoy. Mr. Miller thought that inthepast.few years, the ABC has given greater deferenCe to City land use Concerns. To an eXtent, there would be a recognition of some of the conditions but if they go too far, the State will take the. position that the City is trying to preemptthem. . Commissioner Huang liked Chairman Kalemkiarian's recommendation on revisiting this in six months after they have been in operation. Commissioner Murphy was against posting secondary price signs. He did not think they needed it He thought their primary sign could b.e placed at an angle. He wanted to see the second sign Arcadia cityP!anninj; Commission 9 6!1:lJ99 removed and the area ligh'be brought up to today's standards. H!lt that they should impose a time limit on the sale of beer and wine. Staff did not think that additional signage is needed. A secondary price sign is allowed by code. It is not an additional sign beyond what is permitted. Usually, these are at a distance from the primary sign. Ms. Butler said there are other facilities in the City that have secondary price signs. Commissioner Huang added that the lights should be subject to staff'sreview. In response to a question by the Commission, staff replied that the current limit is either operating 24-hours or more than 16 hours a day between 12:00-6:00 am. Both Chairman Kalemkiarian and Commissioner Sleeter thought it would be difficult to be open 24- hours in Arcadia. Commissioner Sleeler.said this request is much.more severe than any other 24- hour request because it is in very close proximity to residential uses. He was against the 24-hour operation. Ms. Butler asked if the Planning Commission wanted to modify the hours of operation as proposed by staff? According to the applicant, they are currently operating from 6:00 am. to. midnight. Commissioner Huang had a concern with a 24-hour operation .but was in favor of the midnight time limit. Chairman Sleeter opted for midnight, especially, since this is their current hourS of operation and that is what they are permitted. Commissioner Murphy pointed out that both Arco and Unocal at the comer of Foothill Blvd, and Santa Anita are 24-hour operations. He could not see a big distinction between these two comers from the gasoline sales standpoint and not the operation of the convenience store. He did. not see it as a great problein and as a matter of fact he thought it enhances the safety of the area because the use is open and lit up. Ms. Butler said that the above two stations mentioned by Commissioner Murphy do not abut residential uses. Commissioner Sleeler was persuaded by Commissioner Murphy's remarks that it might be a good idea to operate 24-hours. MOTION It was moved by Commissioner Murphy, seconded by Commissioner Sleeler to approve CUP 99-009 subject to the conditions in the staff report with the additional conditions listed below: 1. 24-hour operation is permitted for the sale of gas An:odia City PlllDDing Commission 10 6tnI99 ROLL CALL: 2. The hours oftration for the convenience mart Shal' 6:00 a.m. to 10:00 p.m. on Monday through Thursday, 6:00 a.m. to 12:00 midnight on Fridays and Saturdays and 6:00 a.m. to 9:00 p.m. on Sundays. The project shall be reviewed by the Planning Commission 6-months after operation begins . Perimeter lighting along the north and east property lines shall be enhanced to meel current security standards as well as architectural styling and shall be installed so as not to be a nuisance to the adjacent residential uses. Property maintenance activities and all deliveries, including fuel shall be conducted between the hours of 7:00 am. to 8:00 p.m. The sale of alcoholic beverages shall cease at 10:00 p.m. on all days. 5' -0" wide decorative paving bands shall be installed at the driveway entrances. 3. 4. 5. 6. 7. He stated that there is no problem with seeing the price signs traveling northand.sound bound on Santa Anita and going east bounll on Colorado Blvd. The only problem could be forpeople traveling west bound on Colorado Blvd. He could not justify. placing a sign for westbound traffic on Colorado Blvd., whjchis lIlinimal.. It would not increase volume and generate revenues. To place another price sign is not utilizing good judgement and good planning. He.preferred that aU new signs were monument signs. He did not think they need two price signs at that comer. He thought less signs are better. Commissioner Sleeter agreed. PUBLIC HEARING CUP 99-010 627 W. Duarte Rd. Angela Wu Consideration of a conditional use permit to add 473 sq. ft. of outdoor dining area with beer and wine service to an existing restaurant. The hours of operation will be 11:00 a.m.. to 10:00 p.m., 7-days a week. RESOLUTION NO. 1592 A resolution of the city of Arcadia, California, granting CUP 99-010, to add 473 sq. ft. outdoor dining area to an existing restaurant at 627 W. Duarte Rd. The staff report.was presented. Staff explained that even though there is a parking deficiency staff did not observe any parking problems. Upon inspection staff noted that approximately 40% of the parking lotis unused. The public heariIlg was opened. Stan Szeto, 627 W. Duarte Rd., rlWresented Angela Wu. He remarked that they have another restaurant in the City - Sesame Grill. They are in agreement with all of the conditions in the staff report.
