Arcadia City Planning Commission Tuesday, January'26, 1999 7:15 p.m. in the Council Chambers Planning Commission proceedings are tape-recorded and on file in the office of the Community Development Division. PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 26, ]999 at 7:15 p,m. in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Paul Kalemkiarian presiding. ' ROLL CALL: PRESENT: Commissioners Huang, Murphy, Sleeter, Kalemkiarian ABSENT: Commissioner Bruckner MOTION It was moved by Commissioner Huang, seconded by Coriuilissioner Sleeter to excuse Commissioner Bruckner from tonight's meeting. The,moti6n passed by voice vote with none dissenting. OTHERS ATTENDING City Attorney Michael.Mi11er Community Development Administrator Donna Butler Associate Planner Jim Kasama Assistant Planner Candyce Burnett Secretary Silva Vergel Council Member Roncelli called at 7:20 p.m. He indicated that he just returned from Las Vegas and if the Planning Commission needed him to attend the meeting he would, otherwise, he would not be present at tonight's meeting. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Ms. Butler remarked that staff distributed missing sheets from one .ofthe staff reports. MOTION It was moved by Commissioner Sleeter, seconded by Commissioner Mutphy to approve the Minutes of January ) 21h as amended. PWLIC HEARING MP 99-001 & ADR 98-045 330 Diamond St Sanyao Int'l Consideration of modifications for a proposed 2"unitresidential condominium project. The staff report was presented and the public hearing was opened. Robert Tong, 141 E. Duarte. Rd. said he was representing the applicant and they were in agreement with all of the conditions in the staff report ' Randy Xiu, 338 DiamondSt, was concemedwith the location ofthetrilsh enclosure. He thought it was too close to his home. It would be directly across from his dining room. He was worried about the odor. Ms, Butler remarked that there have never been problems with any of the other trash enclosures with other developments. This trash enclosure is for that umt only, is covered on top and only houses regular size trashcans. It<is'notintended for the large bins. It was noted that the trash enclosure is enclosed within the building. No one else spoke in'favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Commissioner Murphy was in favor of the use. MOTION An:Idia City Planning Commission 2 1126/99 !twas moved by clmissioner Murphy, seconded by comlsioner Huang to approve MP 99.001 subject to the conditions in the staff report. ROLL CALL: AYES: NOES: ABSENT: Commissioners Huang, Murphy, Sleeter, Kalemkiarian None Commissioner Bruckner Chairman Kalemkiarian noted that there is a fiveworking-day appeal period. Appeals areto be filed by Wednesday, February 3rd. Consideration of modifications for a 16-unit residential condominium project. The staff report was presented and the public hearing was opened, No one spoke in favor of or in opposition to this item, MOTION It was moved by Commissioner Huang, seconded by Commissioner Sleeter to continue the public hearing to the Planning Commission's February 23rd meeting. PUBLICHEARINGTMS2747 417 California St. Hank long Consideration of a tentative,parcel map for a 7-"Unitresidential condominium project. The staff report was presented and the public hearing was opened. Janet Triche, 417 Califomia, said four months ago they moved into this address. They were very upset that they were not informed of the owner's'intentions. The move was very costly to them and Arcadia City PIinning Coiomission 3 1126199 now they are forced to lo~or another location and move again, llere anything that the City can do to assist them? Can the property owner do that? Ms. Butler replied that unfortunately the City couldn't get involved. It is the property owner's right to develop his property. She might contaci the Housing Authority to inquire about their rights, No one else spoke in favor of or in opposition to this item, Chainnan Kalemkiarian closed the public hearing. MOTION It was moved by Commissioner Huang, seconded by Commissioner Sleeter to approve TM 52747 subject to the conditions in the staff report. Appeals are to be filed by Friday, February 5th, 5.PUBLlCHEARING CUP 99-002 411 E, Huntington'Dr:, #211 Study Works Corp. Consideration of conditional use permit and related parking modification for a,SAT review and consultation service for a maximum of 10 students per session in an 1,258 sq. it commercial space. ,RESOLUTION NO. 1586, granting CUP 99-002 for an SAT review and consultation service at 411 E. Huntington Dr., #21 I. The staff report was presented and the. public hearing was opened, Miles Pewitt, 4405 EW Hwy" Bethesda"MD, said they are in agreement with all of the conditions in the staff report. He indicated that'their busiest day would be Sundays when most of the businesses in the center are closed. They will instruc.t their students to utilize the parking structure and give them the code to enter the building using the back door. He asked that the Planning Commission allow them to open at 10:00 a.m, from June through. August because there is a need in those months for more, classes and they would like to hold classes earlier in the day. On weekdays the classes are from 6:00-8:00 p.m. and on Fridays they will have classes from 4:00-6:00 p.m. They have other locations throughout the Los Angeles area and have never experienced any problems. Most of the students will be 16-17 years'old. Most carpool in or are dropped offby their parents. In response to a question by the Planning Commission, he stated that on Sundays the students are there for 5 hours and have a 3D-minute break. He remarked that it would be a boost for the businesses in the area because their clientele would frequent them. Arcadia City Pianning Commission 4 1/26/99 . . Chairman Kalemkiarian closed the public hearing, Commissioner Sleeter said other than a possible parking problem which would be mitigated by utilizing the parking structure this would be a good use for the center. The Planning Commission has approved similar tYpe uses and has never heard of any problems associated with the use, Chairman,Kalemkiarian thought that it would be easier for them to use the parking structure instead of utilizing the ground level parking. With regard to security, Ms. Butler said that the security gate would be closed atalhimes. Access to the 3rd floor of the building is easy from the parking structure, She indicated that the Planning Commission could add a,condition with regard to allowing them to open early for two months in the summer time, Commissioner Murphy was uncomfortable with the breaks that the students would get and wondered what they would do at thattinie. He feared they might get into trouble. Commissioner Huang'felt the addition of this business would be an asset for the other businesses in the center. MOTION It was moved by Commissioner Sleeter, seConded by Commissioner Huang to approve CUP 99-002 and to adopt Resolution No., 1586 and with the additional cOnditions listed below: 1. That the students be instructed to utilize the parking structure for parking. 2. That they be allowed to begin classes from lO:OO,a,m. from June through August. Commissioner Huang recapped the actions taken by the Modification Committee., MATTERS FROM STAFF 1. CITY COUNCIL ACTIONS 2, UPCOMING AGENDA IlEMS Ms. Butler recapped the upcoming projects before the Planning Commission and recent actions taken by the City Council. She noted that the developer filed the applications to develop the Anoakia site. A-focused EIRwould be required.
