PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 27, 2001 at 7:15 p,m in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Pro Tern Olson presiding. ROLL CALL: PRESENT: ABSENT: Commissioners Baderian, Huang, Murphy, Olson Cummissioner Kalemkiarian MOTION It was moved by Commissioner Olson, seconded by Commissioner Baderian to excuse Commissioner Kalemkiarian from tonight's meetiIig. MOTION It was moved by Commissioner Olson, seconded by Commissioner Baderian to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. 1. CONTINUED PUBLIC HEARING CUP 01-026 657 W, Duarte Rd. Carlos and Elizabeth Andrino ConSideration of a conditional use permit to operate a children's daycare and preschool facility from 6:30 a;m. to 6:30p,m., 5-days a week. The staff report was presented. Mr, Kasama ,explained the parking code requirements for nursery schools, The Planning Cominission should determine what,is adequate, They have designated one space as the loading area. Staff asked for a traffic report and the item was continued to allow them time to get one, however one was not subrilitted. In response to a question from Commissioner Baderian, he said that the intensity of the use could be reduced if they reduced the number of children. The applicant is requesting to have 125 children, The public hearing was opened. Elizabeth Andrino, 550 Catalpa, said that most of the parents would be parking and physically dropping off and picking up their kids at the center, A circular driveway would not'be feasible and practicaLfor this instance, although, in a typical nursery type situation that would work. They anticipated having 43 children to be there after school and 57 preschoolers duriilg the day. Their traffic would be staggered because the parents work various hours. They would not have all the kids there at the same time, Likewise, kids would be dropped off and picked up at various times, This would not be like an elementary school where the kids must be there by a certain time. Even though they would be open at 6:30 a,m., they would not have all 125 kids there at that time. For the abovementioned reasons, it is difficult to see why there would be a traffic problem or why it is evenaTI issue. They feel there is a need for this in the community, especially in this part of town. She said ,kids that would be there after school would be between 6-12 years old and would arrive after 2:30 when school is out, The hours for the Arcadia City Planning Commission 2 11121/01 , . . preschool would be from 9:00 a.m to l2:00 noon, They are hoping that they can contract with the School District and either use a school bus or a private van,that would pick up children before and after school for day care, She,indicated that the schools in the city that offer daycare close by 5:30 p,m, This indicates'to her that most kids are picked up by 5:30 and do not need day care after that time. Carlos Andrino, 550 Catalpa, said that requiring them to provide a traffic study is unrealistic. They would not be haVing all tbe kids arrive and depart at the same time, They figured that the preschool kids would arrive between 7:30-9:30 a,m, He has visited several other centers that are also sJlbstandard in their parking, Even though their off site parking is 200' over what code requires, their employees will utilize the Burlington Coat Factory's parking. There is a'need for this in the community, In response to a question by Commissioner Baderian, Ms, Andrino said that this would be their first day care center but she has over lO years of experience in the education field, She is now a stay-home mom but would like to open this facility, This would not be a Qabysitting facility, rather they would be offering an enrichment program. They are not only going to be caring for the children, they are also going to be their teachers, They !lave tried to find another location but this has been the best one that they found. MoSt similar uses are substandard in their parking, In reply to a question by Commissioner Murphy, Ms, Andrino said that the loading and unloading space was suggested by staff. Their employees will utilize the parking at Burlington Coat Factory who has given them permission to utilize 8 parking spaces. Their parking is exclusively fotthe parents who are dropping off.and picking up their children. If they were successful in their negotiations with the Arcadia School District, then that space would be for the bus or the van that would be transporting the children, They anticipate thatthe bus or van would get there between 2:30 p.m. and 3:00 p,m. after school is out. Joe Borland, 657 W, Duarte Rd" said this is a great use for all Arcadians and those who work in the City. This will defmitely be good for his physical therapy business, Finally, all the workers in the surrounding medical buildings will have a near location where they can take their children to for day care. This will be the state of the art day care. Parents can go on the internet and check on their children. Parking is not an.issue nor a problem, in fact, he shares his parking with the bank. No one else spoke in favor of or in opposition to this item Chairman Pro Tern Olson closed the public hearing; In response to a question, Mr. Kasama .said the parking is substandard. They had requested that the applicant provide a traffic and parking count but they did not do the sUrvey, the trash enclosure is included in the plot plan, Ms, Butler said that if the Planning Commission decides to approve this, co'ndition 3 listed in the staff report should be deleted because'the off~site parking does not comply with code. Staff would not be able to requite a covenant for something that does not comply with code and police it. The distance between Burlington Coat Factory and this site is over500', Staff would not be able to enforce it. Commissioner Baderian said they are caught between a need to provide adequate day care in the area and not affecting parking and the traffic. He was not sure that the traffic issue has been addressed, The applicant is not in agreement with the staff report, He was concerned with the impacts on the City, if this was approved. He did not think there is good circulation and was concerned with small children running into the parking lot where people would be backing in and out of stalls constantly. He saw it as having a potential for an extremely hazardous situation. 1bis has the making ofa problem if they utilize the front area as a drop off area. This is a parking lot with a lot of children. This location is too close to a very busy intersection. They have not conducted a traffic study. Traffic backs up to this center at every red light, There is no easy egress and ingress to the site. Getting in and out of this driveway is a problem for a good portion of the day. Commissioner Huang agreed regarding traffic and parking. He also thought that there is a need for this in the community but this is not the right location, He suggested that they hire a traffic consultant and have Planning Commission review'the application again. Chairman Pro Tem Olson said that clearly this is a great idea and there is,a day care needed in this area but this is not a good location. He was convinced that there is a better suited location for this type ofa use in the City, He was concerned with ingress and egress off the site, MOTION It was moved by Commissioner Baderian, seconded by Commissioner Murphy to deny CUP 01- 026 and direct staff to prepare the appropriate resolution. ROLL CALL: AYES: NOES: ABSENT: Commissioners Baderian, Huang, Murphy, Olson None Comrnissioner'Kalemkiarian Chairman Pro Tem Olson noted that there is a five working day appeal period after the adopton of the rsolution. The resolution will be adopted on December 11th. Appeals are to be filed by December 19th, 3. PUBLIC HEARING TM 53700 210-232 S, Second Ave. Hank Jong Consideration of a tentative parceLmap for a 1 O-unit condominium project. The staff report was presented and the public hearing was opened, Scott Cheng, 11823 Slauson Ave:, Santa Fe Springs, said they are in ,l!greernent with all of the conditions in the staff report, No one else spoke in Javor of or in opposition to this item. Chairman Pro Tem Olson closed the public hearing, MOTION It was moved by Commissioner Murphy, seconded by Commissioner Huang to file the Negative Declaration and approve TM 53700 subject to the conditions listed in the staff report. RESOLUTION NO. 1665 A resolution of the. Planning Commission of the City of Arcadia, California, granting the appeal of the Rancho Santa Anita Residents Association's denial ofa 2-story.home at 821 San Vicente Rd, Ms; Butler read the title ofthe resolution. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Olson to adopt Resolution No, 1665 and to formally affirm the decision of November 13111 and the votes thereon, ROLL CALL: AYES: NOES: ABSTAIN: ABSENT: Commissioners Baderian, Huang, Olson None Commissioner Murphy Commissioner Kalemkiarian Chairman Pro Tem Olson noted that there is a five working day appeal period after the adoption of the resolution, Appeals are to be filed by December 5111 , MATTERS FROM CITY COUNCIL Council Member Marshall said that the City Council would be discussing reeycling at their next meeting, This is a very serious decision that will affect homeowners and will need their cooperation for it to be successful. The City must comply with State requirements.
