PUBLIC BEARING 821 San Vicente Ibrahim lrawan Consideration of an appeal of the Rancho Santa Anita Residents Association's (BOA) Architectural Review Board's (ARB) denial of a proposed 5,888 'sq. ft. home with an attached 926 sq. ft. 3-car garage. In addition, the applicant is requesting a modification to permit a front entry height of20'-0" in lieu ofa maximum height of 14'-0", and an encroachment into the drip line of an existing oak tree that is currently within the property's front yard area. The staff report was presented. Ms. Butler explained that when the applicant appealed the ARB's decision to the City, he submitted revised plans which had a reduced the height of the entry to 14'. The City discovered this discrepancy and the applicant submitted the plans that the ARB reviewed and voted on. The ARB Chairperson confirmed that the later plans were ones that they reviewed and took action on. They must appeal the plans that the ARB reviewed. She explained the front yard setback requirement. The public hearing was opened. Colin Greene, Hanlon & Greene, 215 N. Marengo Ave., Pasadena, said that according to code if the house has a 75+ setback it is not subject to the 14' height limitation. In this case the home meets that criteria because the front entry is between 75'-78'. In speaking with staff; they felt that the foyer and the entry complied with code. This type of an entry is consistent with many other homes in the community. In light of the fact that there is a large oak tree located in the front yard, this entry is far less obtrusive than the other entries depicted in the photos presented and ones approved by the Pil!nning Commission in the past. He noted that all surrounding property owners have reviewed the plans and have seen an artist's rendering. There are many people in the audience who have attended the meeting tonight who are in favor of the proposal. Arcadia City Planning Commission 4 J 1113/01 . . In reply to comments by Commissioner Huang, Mr. Green replied that the initial entrance is 14' high back to the door which is under that limit, then there is a separation, then the upper story of the house from the foyer. In reading the AMC, they feh the intent was to allow for this type of a design and entrance. He felt the way it is written is that the City does not want an 18' high door or entrance but if it is somehow separated, as in this case, then it is acceptable. Don Crenshaw, 126 St. Joseph St;, the architect, said the front covered porch is 14' high, then it goes back 6' to the entry door. The entry door lines up with the window above because the inside entry is two-story. The plane of the window is the same as the door. In speaking with staff, he was informed that this could be worked out with the applicant by moving the door back by 2'. Chairman Kalemkiarianasked if there were any objections to changing the shape of the window so that it does not create that line? Mr. Crenshaw said looking at it from the inside the door and the window line up. Mr. Green remarked that the arborist's report notes where the front entry and the house would be relative to the oak tree. Ms. Butler said the a 14' high entry meets code requirement. Tony Henrich, 431 Altura Rd., President of the HOA, distributed a handout to the Planning Commission. He remarked that he has visited many different charming and prestigious cities and communities. You cannot take what is a beautiful home from Santa Barbara and put in Charleston, it would just not fit in. It would not be compatible. Thc house could be the most beautiful home but it may not necessarily fit in a particular community. He cited a quote'from a previous Chairperson"which in part stated that "good architecture character is based upon the principals of harmony and proportion of the elements of the structure as well as the relationship of such principals to adjacent structures and other structures in the neighborhood". This strikes at the heart of their decision. The charter from the City Council stipulates that their guidelines are to promote and maintain the quality of homes, protect the property values, predict predominant characters of homes, assure contemporary standards of harmony, assure building structures and landscape are all in harmony. They are also to assure that designs are not garish or unrelated to the area. Good architecture is based upon harmony and proportions and how it relates to other structures in the neighborhood. Lou Papas, }20 Harvard, serving on the ARB. Their_ goals as ,ARB are, to adhere to the City's Resolution and to assure that any development conforms with the majority of the homes in the area for the purpose of maintaining harmony in the neighborhood. The ARB has been instructed by the HOA to work to maintain the defming character of the area pursuant to the element of style. The element of style as dictated by the HOA is to look for a horizontal feeling when viewed from the street. So, when looking at a house from the street, their homes almost uniformly have a horizontal feel as opposed to a vertical feel. They are mandated to look for simple roof appearances, strong and articulated eave lines, scale of the windows, doors, main entries, the harmonious use of materials and the use of lJlultiple materials in the construction of homes. In other words, they do not have homes that are generally just stucco, they have combination of brick, stucco, masonry, wood, siding. They also look for landscaping with the final view of the home. The rendering before the Planning Commission provided by the applicant is one that the ARB has never seen as a board. The plan that the Planning Commission is looking at has been , revised 4-5 times and it has gotten confusing because the plans that were originally submitted which was ultimately rejected by the ARB was not the one that was ultimately submitted to Arcadia City Planning Commission s 11/13/01 . . the City. The ARB is to look for a defined architectural style. In this project there is no defined architectural style., The ARB tried to work with the homeowner and ultimately the architect stopped attending the meetings. Ms. Butler indicated that the plans before the Planning Commission tonight are the ones that were submitted to the ARB. These were the plans that the ARB voted on. The City had the applicant resubmit the plans that were originally submitted to the ARB. The plans here tonight are the ones denied by the ARB. This has been confirmed by the ARB ChairperSon. Originally, the applicant submitted plans that were not seen by the ARB but the plans here are ones the one that the ARB acted on. Commissioner Huang said tbat Mr. Papas stated that as a board one of the criteria they look at is a horizontal. reeling. Is there a document that indicates this issue? Mr. Papas replied that it is nota specifically written standard. The HOA turned in a document dealing with elements of style and there is specific language in there dealing with what they look for and one of the, elements, is the horizontal style vs. the vertical feel. Ms. Butler clarified that Mr. Heinrich did submit information to the City. But, it is important to note that the information on their criteria has not been adopted by the City. It is not a part of the official ARB regulations, It is something that they have developed but has not been approved by the City. She . . . indicated that the City does not have standards for single-fumily residences. This document was submitted for City~s Comments. The document had a lot of information relating to landscaping and other items, which are not in the jurisdiction of a homeowners association. The City does not adopt standards for any of the HOAs. This is something that they use asa guideline for their association only not something that has been approved by the City. Dale Brown, 507 Monte Vista, member of ARB, said those guidelines were given to the homeowner when they f1TSt approached the ARB. Design is very personal. There is consistency with the homes in their area, One issue they look at is the roof of a home. Typically on a two-Story home, the roof is one of the predominant elements of the home. The eaves typically come down to about the head of the window and are articulated through exposed raft rounds or some other details but when looking at an elevation the eaves come down to approximately 2.5' from the front of the home coming down to a point roughly at the head of the window. This brings the scale of home down., The entry is usually not the dominant element on the elevation of the front of the home. Typically homes have two to three materials with a combination of brick, masonry, pIaster, stucco or-siding. Unless"it is a very traditional style home, typically, in a ranch style home, the second floor is setback from the front of the house - usually softened by a front porch or other elements. There is a difference between the plane of the home on the first floor and the plane of the front of the home on the second floor. There are a variety of styles of homes in their area. He went through the handout that was distributed and discussed briefly the various styles of the homes. He said compatibility must be relative to those prominent styles. In these homes, the roofs have a different character from the rest of the home. Typically, the eaves are.above the windows. There is exposed wall above windows. The eaves do not project out and if they do they are usually a molded cornice. Typically, the rooflines and the other elements are subtle. Most of the homes in the area have ceiling heights between 8' to 8'-3" for the fIrst and second floors but this home has a I 0' first floor and a 9' second floor. With these dimensions and without reducing the height of the eaves a vertical appearance is created. They are concerned about the horizontal nature, the entry and the single use of material. This home has a very strong entry and a curved two-story window to the right. These are two very strong vertical elements which are incompatible with each other. He remarked that the ~ia City Planning Commi5$ion 6 fl/13101 . . home should be compatible and needs to be appropriate without the use of landscaping to mitigate its appearance. In response to a question by Chairman Kalemkiarian, Mr. Brown replied that they are proposing to use light gray color smooth stucco. Ahhough, when done, the windows will pop out, they believe that-it is a fairly monolithic appearance. They do not object to the use of smooth stucco but that. and a relatively smooth concrete trim together are not an element of a historic style. They do not feel that it is compatible. Heidi Elder, said she resides next door to the proposed home. She said that standing on her sidewalk she looks up at her home which is a typical home in the area She feared how this home would look considering its proposed height. The ambiance of the area is what attracted her here. She said that although, she did sign the petition, she never saw or reviewed the plans. She knew he would be making changes but she did not koow whatthose changes woUld be. In rebuttal, Mr. Greene said that the intent of the Resolution is not to stifle creativity. He indicated that Mr. Brown talked about a variety of styles os homes.. most of which are reflected on the submitted board of photos. Looking at the photos this house looks like it will fit in. It appeared to him that the ARB is . very limited with what can and cannot be done. It seemed to him that they are trying to prevent individuality. He could not find anything that stated what types of home can be built. In reply to a question by Chairman Kalemkiarian, Mr. Crenshaw tried to describe the home which he said is "courttry French with concrete tile roof'. The house and pre-cast will be painted gray with a charcoal colored roof. He did not know what the property owners intended to. do with the fence which is existing; He showed. the fence on the rendering because it is existing, He said they had 5 official meetings with the ARB, in addition to a couple of informal meetings. He has designed homes in this HOAin recent years. Commissioner Baderian left at 8:30 p;m. Mr. Crenshaw explained the changes they made at the ARB~s request. The ARB requested that they break up the verticalfeel and add a horizontal appearance ilnd they feel they have accomplished that. Commissioner Huang remarked that the ARB does,not seem'to like the architectUral features, They are requesting that the eaves be brought down to the top of the windows. They are requesting that more than one building material be used. Which one of these have they done? Mr.. Crenshaw explained that it is physically impossible to bring down the eaves with a J 0' ceiling. They would need to reduce the pitch to accomplish that He did not know how to achieve that without clipping the ceiling of the house without having an angle on the inside to achieve that look. With regard to the use of multiple materials, he explained that the owner did not want to use stone or brick and preferred the use of stucco. Barry Churbach, 60S N. Old Ranch Rd., said that he is the other adjacent neighbor. He welcomed this home in his neighborhood and did not object to it. He felt that it is harmonious and will be compatible. He is also concerned with property values and compatibility. He felt that property values would be negatively affected if the ARB tries to dictate the types of homes in the area. No one else spoke in favor of or in opposition to this item. Arcadia City Planning Commission 7 11113/01 . . Chairman Kalemkiarian closed the public hearing. Ms. Butler said that the plans comply with code as revised but what is p~sented to the Planning Commission as part of the exhibit does not meet code. She did hot think that the ARB saw the cross section. What they saw is the elevation that is at the bottom of the exhibit which was presented. Staff is in favorofa 14' height entry way. Commissioner Huang said thathe reviewed the reasons for denial by the HOA. One was that the two- story elevation and scale was not in character with the area. There are many two-story homes in the area. They objected to the two-story living room combined with the high entry. The living room is interior space and a personal preference and has nothing to do with the exterior of the building which will affecUhe neighborhood. They discussed multiple eave lines, which in their opinion creates "visual clutter". In his opinion, a single eave line is too simplistic, whereas, the multiple eave lines enrich the appearance. A house of this size should have more than a single eave line. He was unclear with the HOA's remarks on the compatibili!y of the vertical and horizontal elements on the front ~de. Commissioner Olson said that Mr, Brown said that they should view homes without landscaping. But, in this particular case, there is a beautiful oak tree in the front yard. In his opinion, landscaping is a very important element. If they were to wipe out all the landscaping in the City and just have building, they would all be shocked as to what they saw. This home has been designed such that the beautiful oak tree located in the front yard would be saved. The tree also helps mitigate the visual affects from the street. There is only a 2-car garage on the street on a house that, is ona fairly wide. lot. There are homes in the city with aJ-car garage on smaller lots. He felt this home represents the changes that the City Council has made in the code. He did not object to the contemporary appearance of the home. They need to look and accept change and for what pe(jple are looking for the future. With the exception of one neighbor who has changed her mind, the people that are most impacted by this.houseseem to be in favor of it and think it will improve their l.1eighborhood, don't see it as a detriment and reel it is in harmony with the. area. He was disappointed that this matter has dragged on-for over one year and it has not gotten very far. Chairman Kalemkiarian said generally both the ARB and staff's recommendations and decisions are very strong with the Planning Commission. The Planning Commission does not tend to rule against either one often; It is difficuh supporting the ARB's decision partially because the house is setback almost 80'. Given the lot coverage ratio permitted in the City, the proposed house is much smaller than what actually can be constructed and still cOl!lPly wjthJ:oqe. Techllically, they Can build a much larger home on this lot and still comply with code. He believed in proper!y owners' rights. MOTION It was moved by Commissioner Olson, seconded by Commissioner Huang to approve the appeal and overrule the Rancho Santa Anita Resident's Association's denial, fmdingthat 'the proposed project is architecturally harmonious and compatible and direct staff to prepare the appropriate resolution incorporating the Planning Commission's decision and findings in support of that decision. PUBLIC HEARING MP 01-016 & ADR01-027 41 Fano St. Sanyao 101'] Consideration of modifications for a 3-unit condominium project. The staff report was presented and the public hearing was opened. Robert Tong, 255 Santa Clara, said he convillced the property owner to reduce the size of the units and to have the garages not facing the street. They tried a different design .and a new idea. They are in agreement with all of the conditions in the staff report. Commissioner Huang commended the architect on his efforts in trying to shift the garage locations on a narrow lot and on this design. No .one else spoke in favor of or in opposition to this item. Matt Vantuch, 326 El Dorado, said they are in agreement with all of the conditions in the staff report with the exception that they woli!d like to be open 7 -days a week. Staff. indicated that the applicant did not present any plans for the back patio although they did discuss it. They can have seating for up to 12 but-anything overthat would need a new CUP. No one else spoke in favor of or in opposition to this item. Chairman Kalemkiarian closed the public hearing. Staff indicated that the seating in the rear would not require a CUP if it is less than 12. Staff had no objection with being. open 7-days awee~. Ms. Butler said that incidental outdoor dining is available with a maximum ofl2 seats. Anythingover that would require a CUP.
