PLEDGE OF ALLEGIANCE
The PlanniIIg Commission of the City of Arcadia met in regular session on Tuesday, September 25,
2001 at7:15 p.m in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with
Chairman Kalemkiarian presiding.

MOTION
It was moved by Commissioner Olson, seconded by Commissioner Huang to read all resolutions
by title only and waive reading the full body ofthe resolution. The motion passed by voice vote
with none dissenting.

Consideration ofa tentative parcel map for a lot line adjustment.
The staff report was, presented and the public hearing was opened.
Bart Stryker, 1450 N. Tustin, Santa Ana, said they are in agreement with all of the conditions in the staff
report.
Noone else spoke in fitvor of or in opposition to this item.
Chairman Kalemkiarian closed the public hearing.
MOTION
It was moved by Commissioner Huang, seconded by Commissioner Baderian to approve TPM
01 -0 II subject to the conditions listed in the staff report, and to approve the Negative
Declaration.

Universal Tea Inc.
Consideration of a conditional use permit to operate a retail book store and 10 station computer
arcade from 11 :00 a.m. to 12:00 a.m, 7-days a week.
RESOLUTION NO. 1654
A resolution of the Planning Commission of the City of Arcadia, granting CUP 01-024 for a
retail bookstore with 10 station computerJab at 8.15 W. Naomi, #F.
The staff report was presented.
In response to a question by Commissioner Murphy, staff said there has only been one incident with this
type ofause and that has been addressed. No other complaints have been filed. The bike rack will ,be
located at the rear ofthe establishment which is a parking area.
Mr. Nicholson said there isparkingat the rear of these shops with ,access to them

Tony Chen, 2839 Longden, Temple City, and Sammy Wong, said there are ten seating/reading rooms
where people can review and enjoy the reading material. They will have a sec\Jrityguard after 9:00 p.m.
Their customers will have access to the internet and be al:He to play games on line. They also have
software for sale which would be available as demo. The tea shop is open until midnight 7-days a week.
The tear parking is underutilized where they would like to install a bike rack
Mr. Nicholson said they would work with the applicant with regard to the bike rack. There is ample
parking in the rear and it is well lit. He did not think that it'would be detrimental to dedicate one space
for a bike rack.

Commissioner Olson said that this use is a little different. The uses that they have reviewed have had
many more stations. These are new uses.and they have not had much feedback. He thought that 10
stations are minimal. He did not object to the hours of operation and said it coincides with the hours of
the tea shop, and this site does not back up to any residential. It is interesting thatthey would be offering
free access to senior citizens. It would also be good advertising if they would offer one free hour for
kids.
MOTION
It was moved by Commissioner Olson, seconded by Commissioner Baderian to approve CUP
01-024, subject to the conditions listed in the staff report, adopt the Negative Declaration and
adopt Resolution No. 1654.

A. A modification for a 25' westerly side yard setback for a garage in lieu of the 30'
required special setback along Lovell Ave.

The staff report was presented.
Staffsaid that the request is for the encroachment of the fence into the protected zone of the oak tree and
not for a height modification. Code allows a maximum of 3' high fence and columns.
Commi~sioner Olson said the plans show a4' high wrought iron fence around the property.
Staff responded that. along the street side yard property line they are allowed to have a 5' high fence but
along the front yard area they are limited to a maximum of3'.
Tl)e public hearing was opened.
Cathy Chen, 539 N. Leroy, said they are requesting the 25' rear yard setback which would provide them
with a large enough rear yard. There"areJ oak trees in this area. This 25' would allow them to,have the
same setback as the adjacent property.
Ms. , ButIer said that even if they maintained the 35' setback the, foundaiion would be within the drip line
of the oak tree.
Commissioner Murphy said with a 35' setback they would not need to remove the, oak tree and would
probably be able to save the tree. Is the sole reason for the 25' setback to align with the neighbor's
property?
Mr. Nicholson replied that even with a 35' setback they would be encroaching into the canopy of the
tree and it would affect the tree. As a condition of approval they can ask for replacement oak trees. The
arborist has suggested other locations for replacement trees.

Chairman Kalemkiarian closed the public hearing,
Commissioner Baderian wanted to have 2 more trees planted.
Commissioner Olson said oak trees are slow growing. Lately, the Modification Committee has been
requiring 36" boxed trees when they review requests but they do not necessarily specify type of tree
because some trees perform better in different conditions. He wanted to see two 36" boxed trees planted
subject to an arborist'sapprovaL He felt the choice, of tree could depend on the applicant He did not
object to the setback on the garage. This is a comer lot ,and that does hamper the development. He did
not have any problems with the,25' setback..
Chairman Kalemkiatian thought that at least one of the trees should be an oak. If they take one out they
should replaceit with another, after all, oak trees are protected in the City.
ML Nicholson said there is a formula to determine the value of an oak tree. Usually, they recommend
two trees. Staff agreed with the Chairman with regard to the oak tree replacement so they would be
meeting the intent of the code.
Ms. Butler cautioned them with regard to the location of the oak tree. Oak trees are very temperamentaL
They will tend to die if they are over watered or not taken care of. If they require two trees, that
provides them the flexibility oftypes of trees subjectto City and arborist's approvaL
MOTION
It was moved by Commissioner Olson,;seconded by Commissioner Baderian to approve MP 01-
on & ADR 01-024, slibject to the conditions listed in the staff ,report with the additional
condition that the wrought iron fence isa maximum 00' in height in the front yard and that two
36" boxed trees are to be planted subject to an arborist's approval. One of said trees is to be an
oak. '

Consideration of s modification for a 57'-8" to 59'-0" westerly front yard setback in lieu of
67'-6" required for a new two-story single-family dwelling. The required setback of 67'-6" is
the average front yard setback of the two nearest developed properties.
The staff report was presented.

Mr. Nicholson stated the R-O zone requires a minimum 35' front yard setback. In cases where 60% or
more of the properties have a larger front yard setback, the front yard setback is the average of the two
nearest developed lotS.
Ms. Butler said that in this case the average of the two adjacent lots is greater than the front yard setback
of60% of the lots in the area.
The public hearing Was opened.
Tim Clark., 50 I E. Fair Oaks Ave., Pasadena, the designer of the project, felt his clients are being
unfairly penalized because of the setbacks of their two adjacent neighbors. Most of the properties in the
area have a 55' setback. There is no property to the south. They are Jocating the new house at the same
location at the current.home.
Commissioner Murphy complimented the designer for this project.

Staff indicated that the average setback on the street is 55'. The required setback of 67' -6" is the
average of the two adjacent neighbors.

6. PUBLIC HEARING HOUSING ELEMENT
Consideration of the Housing Element Update for the period 2000-2005. The Housing
Element consists of the following components; Housing Needs Assessment, Housing
Constraints, Housing Resoutces and Housing Plan.
The staff report was presented.
Jessica Barkley and Veronica Tam of Cotton Bridges and Associates were present. They provided a
brief Power Point presentation that discussed in part:
.:. What is a Housing Element - it is a policy-oriented document that sets forth a five-year Strategy
for addressing housing needs.

and resources; and goals, policies and programs
.:. Demographic characteristics - the current population based on 2000 Census, age distribution and
race/ethnicity breakdown

tenure
.:. Housing stock conditions -78% of housing units are older than 30 years, generally housing is in
good condition., private rehabilitation efforts have maintained quality, elderly and low income
residents may need rehabilitation assistance

income and upper income. The income distribution is from the 1990 census.

development would not be an option for affordable housing. Potential sites for senior housing.

Commissioner Baderian asked why there are no fITst time home buyer programs?
Ms. Butler'replied that the City has set aside funds for various projects and would like to develop a
senior housing project. By providing fITst time homebuyer programs the City would have to use these
funds. They are working with realtors who are actively looking fur sites for such a development The
City is holding moiley aside with the hopes offmding a site, purchasing,and developing. There are time
limits on when the funds should be used.
