MINUTES Arcadia City Planning Commission Tuesday, November 12,2002 7:00 p.m. in tbe Arcadia Library PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 12, 2002 at 7:00 p.m. in the Arcadia Library of the City of Arcadia, at 20 W. DUarte Rd. with Chairman Olson presiding. ROLL CALL: PRESENT: ABSENT: Commissioners Baderian, Hsu, Wen, Olson Commissioner Lucas MOTION It was moved by Commissioner Baderian, seconded by Chairman Olson to excuse Commissioner Lucas fromtonight'smeeting. The motion passed with voice vote with no one dissenting. The motion passed by voice vote with none dissenting. 1. Fairview Hank Jong Consideration of a tentative map for a 6-unit residential condominium project. The staff report was presented. In response to a question by Commissioner Hsu, Ms. Butler replied that the trees near the street could only be removed if Public Works Services Dept. approves the removal. The driveway for the project is located on the westerly side and shows one of the trees, a smaller one, that will be removed. Based upon the tract map, it appearS that the larger tree Will remain. The public hearing was opened. Scott Chang, 11823 Slauson, Santa Fe Springs, said they are in agreement with all of the conditions listed in the staff report. No .one else spoke in mvor of or in opposition to this item Chairman Olson closed the public hearing. In response to a question by Commissioner Hsu, Ms. Butler replied that Planning Services approved the design of the project in September. MOTION It was moved by Commissioner Baderian, seconded by Comrni~sioner Wen to approve TM 53864, subject to the conditions listed in the staff report and file the Negative Declaration. Consideration of a tentative map for a 9~unit residential condominium project. , The staff report was presented and the public hearing was. opened. Scott Chang, 11823 Slauson, Santa Fe Springs, said they are in agreement with all ofthe conditions listed in the staff report. Karleen Orchott, 519 S. Fifth Ave., said that their landlord, who owns both properties, has continuously denied that he has sold their properties. It is wrong for the owners to lie to the occupants. The residents of these two properties are unaware of the proposal. They have been told that their property is a fire hazard. The renters at the subject site have only been given a 30-day notice. This has been a fiasco. They do not know their rights. Many farnilieswill have to be uprooted. It is only right for people to know the events that will be taking place, since their lives will be disturbed'in this manner, especially, when they are long time residents. It is going to be very difficult for them to find affordable housing in the city. This is no longer a community of homes but a community of condomums. This has been extremely disturbing and frustrating. Fred Orchott, 519 S. Fifth, said they have resided here for 25 years. Ht:agreed with comments that were made by his wife. More than 20 families will be affected by this and they will all be affected during the holidays. This is indeed a community of condominiUms. He felt that the city is indifferent to people that have lived in the city for this long and that the City Council is not sympathetic to them and this was evident when they turned away Habitat for,Humanity. He was dissatisfied with what.has been going on. He is terrified of getting his mail because he is expecting an eviction notice to be there any day. People that have kids will have to be uprooted and be forced to look for affordable housing in other COmmunities. The kids will have to be taken out of school. He thanked thee Planning Commission for giving him the opportunity to speak up. The Planning Commission seems to be more worried about saving oak trees than how they are affecting people. Chairman Olson explained that the public hearing tonight is regarding 525 S. Fifth Ave. and not any other property. The only decision that the Planning Commission is making tonight is the type of development. The property owner has the right to improve his property. There is an application before them and they must take action. . David Machinski, .525 S. F~h, said he resides on the subject property and the landlord has denied knowledge of the development, yet they have been given 30 days to move. Chairman Olson'remarkedthat the Planning Comrnission'does not have any jurisdiction over these'types of issues, or if a property owner decides to sell his property. The Planning Commission is charged with ensuring that the development is consistent with the General Plan and the zoning ordinance. These issues are between the property owner and the buyerimd the City does not get involved in these issues. It is a civil matter. He suggested they contactanattomey to see about their legal rights. He was very sympathetic to the tenants and although he understood their dilemma and frustration, unfortunately, they cannot consider the ramifications of a development on the tenants as part of this proceeding. PUBLIC HEARING TM 54078 1510-1516 S. Baldwin Ave. Hank Jong Consideration of a tentative map for a 9-unit residential condorniniumproject. The staffreport was presented. In reply to a queStion by Commissioner Hsu, Mr. Li stated that the project is consistent with the Zoning and the General Plan. The current General,PIan designation for the subject property is multiple-fiunily. The public hearing was opened. ScOtt Chang, 11823 Slauson, Santa Fe Springs, said they are in agreement with all of the conditions listed in the staff report. In reply to a question by Commissioner Hsu, Mr. Chang replied that they would comply with all the requirements. . Chairman Olson said that prior to receiving their demolition petmit, they would need clearance from AQMD and certain tests would have to be conducted. No one else spoke in favor of of in opposition to this item. Chairman.Olson closed the public hearing. RESOLUTION NO. 1682 A resolution of the Planning Commission of the City of Arcadia, California, approving an appeal of the Santa Anita OakS Homeowners' Association's Architectural Review Board's conditional approvlil ofa one-story addition and remodel at618 Gloria Rd. Ms. Butler read the title of the resolution. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Hsu to adopt Resolution Nos. 1682 and formally affirm the decisions of October 22nd and the votes thereon. Appeals are to be filed by November 20th.
