PUBLIC HEARING TA 2002-001 Consideration of a text amendment revising the list of "Uses Subject to a Conditional Use Permit" in the CBD/Central Business District Zone to include Automobile Fl1eling Stations (Le. a self-serve gas station with a convenience mart). The staff report was presented and the public hearing was opened. Leon Felus, 14000 PaIaman Way, Marina Del Rey, said that a convenience mart would be compatible in the area. The convenience mart would be more consistent with a gas station. The servicing of automobiles will be discOntinUed. No one else spoke in favor of or in.opposition to this item. Duarte Rd. Toheed Asghar Consideration of a conditional use permit to re-open an existing automobile service station with three service bays. RESOLUTION NO. 1673 A resolution of the Planning Commission of the City of Arcadia, California, granting CUP 2- 10 for. a service station at 900 W. Duarte Rd. The staff report was presented. In,reply to a question by Commissioner Murphy, Mr. Li said they would have to bring the tanks into compliance, there should be no retail sales of food or beverages. If they decide that they would like to have that, then they would have to apply for a CUP. The public hearing was opened. Tohced.Asghar, 8644 Fairmonth, Playa del Rey, said they are in agreement with all of the conditions listed in the.staff report. He asked that the new landscaping requirement be waived because his current sign sits at this location. The sign at the adjacent center is equivalent in height. His new sign would have to be three-sided to be visible to all the traffic, therefore, he asked that he be permitted to keep his e:xisting pole sign. In reply to a question by Commissioner Baderian Mr. Asghar said that he did express hisconcem to Mr. Li and he was advised to bring up this issue at the meeting. Mr. Asghar said that since he is proposing to increase the height of the block wa~ the new proposed monument sign would be blocked from view. Chairman Pro TemOlson.closed the public hearing. .II] reply to a question by Commissioner Baderian, Mr. Li felt that the'sign could be incorporated into the landscaping. Presently, the design gUidelines discourage pOle signs. Staff will work with the applicant to revise the design. Ms. Butler said that if the bollards were removed then the landscape area could be increased. Recent developments have been required to remove their existing pole signs and replaced them with monument signs. The City's design guidelines discourage pole signs and whenever an opportunity arises that a pole sign can be replaced, this change is recommended. Monument signs are common at service stationS and there does not appear to be any visibility problems. Commissioner Huang supported staff's recommend8tion. Fairview Ave. Sanyao Int'l Consideration of modifications for a proposed 2-unitresidential condominium project. The staffreport was presented and the public hearing was opened. James Mallen, 436 Fairview, felt that the requests are out ofline with what is in the area. He feared that it would block their visibility when they are coming ,in and out of their driveway. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner, Baderian Seconded by Commissioner Huang to continue the public hearing to'the August 13th meeting. Santa Anita George Fasching Consideration of a conditional use permit and architectural design review (ADR) to construct a new 24-hour self-serve gas. station and 1,215 sq. ft. convenience mart with the sale of beer and wine for off~site consumption. The staffreport was presented. In reply to a question from Commissioner Murphy, Mr. Ka""ma said tliat the project 'would require ADR The design could be subject to change after ARA reviews it. The Planning Commission is charged with approving the CUP and the cQnvenience mart but the ARA could revise the design. The 3' dedication is fora bus bench and trash enclosure. Ms. Butler further stated that the design will be reviewed by the ARA. Ultimately, the ARA would review this request and act upon it. This project has been reviewed by ARA staff and their comments have been incorporated in Planning's review and recommendations. The public hearing was opened. Arcadia City Planning Commission 6 7123102 . . George Fasching, 1451 Oaklawn Rd., said he was in agreement with conditions 1,2,3,5, 7, 8, 9 and 10. He was in disagreement with the conditions regarding signage and the median. With regard to the median he stated that the opening in the median has been there for over 31 years. There has never been a traffic accident as a result of this opening from his patrons who are traveling northbound on Santa Anita and use this opening to turn left into his carwash. The opening in this median is important in the success of his carwash. The traffic report indicates that the opening of the gas station at the corner would not have an impact. The same traffic report did not anticipate an increase for the traffic traveling north on Santa Anita. There is nothing that indicates the existing situation would change as a result of his proposal and the addition of the gas station would not have an impact. When someone traveling northbound on Simta Anita is trying to access the carwash, they must travel a very short distance in the opposing traffic (traffic traveling southbound on Santa Anita) to get to the driveway of the carwash. He has attempted to alleviate that risk by relocating his driveway directly across from the opening of the median so the traffic would not be going in the opposite direction to get to the carwash. The issue regarding the closing of the median, at his expense, was never br~lUght up. The only comment regarding the median was that the City no longer approved this type of a design. The City's traffic engineer felt that people would tend to use it more if the driveway and the opening ofthe median were more in line; that it would encourage more use. But, in his opinion, this would make fur a. better project and satisfy any concerns regarding safety issues with people having to drive against traffic. He did not like the design as proposed by staff. He did not think that it would be logical to close off the median, especially at his expense. He wanted there to be a definite division between the service station and 'the carwash. Mr. Fasching went on to say that the 5' wide sidewalk is more than adequate. There is hardly any pedestrian traffic. He has discussed the location of the utility pole with Edison.and has agreed that they can place the light standards directly on.his property. With regard to the sign, he indicated that it has been there for 25 years. It is synonymous with his carwash <Il1d is an Arcadia landmark. It has been a part of the business for25 years. Relocating it would make it more difficuh to read the board. He did not want to have his pole sign replaced with a monument sign. He requested that the existing sign merely be relocated and not be replaced by a monument sign. The sign is not out of place. In answer to a question by Commissioner Murphy, Mr. Fasching said that the replacement of said sign would necessitate the removal of mature ficus trees. He would have to dedicate an area 3 'xI2' for the bus bench. He,said that the traffic signal Would need to be moved further south; It would not obscure the view of the fountain. He felt that the number of trees required are excessive. He wanted to replant and incorporate the ficus trees which are more mature than what the City has requested. He felt that hedge trees would be more appfl~priate as buffer and wotilO not block visiBility between the fueling station and thecarwash. In reply to a comment by Commissioner Baderian, Mr. Fasching Said that he did not request to be open 24 hours. The hours were suggested by staff. Mr. Kasama said that since the use is within 150' of residential, if Mr. Fasching decided at a later date'that he wanted to be open.24 hours, he would need another CUP, therefore, that request was already included to give him the option. Mr. Fasching said that a fueling station and a convenience mart are uses that compliment each other. Gas stations with lube hays are a thing of the past. What he has proposed will also compliment the car wash. He explained the dilemma that he had with Mobil Gas. Mobil will no longer provide gas to him Arcadia City Planning Commission 7 7123102 . . because he does not have the high sales that they are looking for. He has been working with Ultramar which has approved his station but he is obligated to construct a gas station at that cOmer. Commissioner Huang suggested that the design elements such as the use of brick veneer and color of buildings on the carwash, the convenience mart and the service ,station be the same so the buildings are tied in with each other. Mr. Fasching agreed. He was in agreement with having the opportunity to be open 24 hours. Sheila Boyd, 35 Cornell Dr;, was concerned about quality of life, heath and safety issues. There are several gas stations witl1in a mile radiUs. She did not think that they need another one in their neighborhood. Her priIIlary concern was the convenience mart that would be selling alcohOlic beverages. Anyone wanting liquor can go to Chevron or the liquor store which is just a block east on Colorado Blvd. There are enough facilities that sell alcoholic beverages and she did not think that there was a need for another one in the area. The parking lot ofthe church is always used by kids who go to In N Out, go across the street and buy their beer and go to the church,parking lot and haIJg out. She was also concerned with young people who could jump the wall from Newcastle Park after a game of handball, will go over and purchase liquor and go back to celebrate. She also noted that the phone at the carwash keeps ringing and that affects the quality of life, The sign is visible from their home lII!d there is trash in the area She was concerned about the safety of single women who live in the area. She also noted that less than a mile away there is a school and this would be an easy access for them to get alcoholic beverages. Ryan Petzhell, 302 S. Second, said that he is the English speaking pastor at the church across from the subject site. This is the second request for a convenience mart in the immediate area that would be. selling alcoholic beverages. His congregation is concerned with the off'site consumption Of alcoholic beverages. The ease in the availability (If alcoholic beverages in the immediate area would be very tempting to the youth of the community. He felt that they need to reduce the availability of alcoholic beverages to discourage use by the younger generation and not make it easily available. He feared that another convenience mart in the area that would be selling alcoholic beverages would create problems and puts the youth of this community at risk. Steve Pairsi, 414 San Miguel Dr., opposed the availability of the sale alcoholic beverages 24 houra day. He ,was concerned about the,inctease of traffic. at this;intersection. In N Out is already a hll!lgout for the young and now they will have alcoholic beverages easily available to them. Mr. Fasching declined to make a rebuttal. No one else spoke in favor of or in opposition to tills item. Chairman Pro Tem Olson closed the public hearing. In reply to a question by Commissioner Murphy, Mr. Ka"""'" indicated thatthere have been no reports ()fproblems with Chevron's convenience mart. There are different circumstances at Chevron because it is adjacent to residential uses. They are permitted to sell gas 24 hours a day but the sale of beer and wine is limited to 10:00 p.m. Arcadia City Pliuming Commission 8 7123102 . . Commissioner Huang said what he heard from all three of speakers against this request was their concern over the sale of beer and wine 24 hours a day. Mr. Fasching indicated that he did not want to have.a 24 hour operation. He thought the hours Should be the same as Chevron. Commissioner Baderian was in agreement with paralleling the hours of Chevron. Chairman Pro Tem Olson was not only concerned about the cODSunJption of the sale of the beer and wine but he was also concerned with loitering in the chUrch parking lot. He suggested biocking off the church parking lot to discourage that problem Commissioner Murphy said that ABC will review this application for the sale of alcoholic beverages. So, this issue would be controlled at the State level. He agreed with Mr, FasChing with regard to the median. He saw no reason why the median should be closed. He asked why staff was picking this time to discuss the closing off of the median and then to add insult to injury by requiring Mr. Fasching to pay for it. It makes absolutely no sense to do that and is extremely unreasonable to require that he close off the median. The traffic report indicates that there is no problem. Ed Cline, the City's Traffic Engineer, said that there isa basic safuty concern as the traffic increases along Santa Anita. They counted a total of 29 left turns into the carwash from people traveling north bound on Santa: Anita They also witnessed several traffic violations from people actually making a left turn out of the carwash to travel north bound on Santa Anita. One concern is that many drivers feel uncomfortable traveling the wrong way on Santa Anita: but if the driveway aligns with the entrance of the carwash he felt there would be more people making a left turn. They look for an opportunity to correct things and take remedial action whenever possible. He felt that leaving the median open could be problematic. Phil Wray, the City Engineer, said that the City is requesting a 3' deQication. This dedication would allow for the placement of the bus bench as well as any city or utility.flXtures'such as,abus stop sign, no parking sign or street lights. This dedication would provide the opportunity for any future improvements and make sure that public fixtures would not interfere with the sidewalk. Any obstacles that are there noW would be removed and placed in this 3' dedication area. It is inappropriate to place public fixtures on private property. Pockets of easements do not make sense. The City attempts to solve problems as the opportunity rises. The 3' dedication will not change the character of the property, it is just a legal requirement. Mr. Fasching would not be required to clear up the area. There will still be a 5' sidewalk and a 3' dedication after it. He thought since the closing offofthe median affects the carwash and has benefited them solely, they should be responsible for it, instead of having the City bear the cost in the future. ' ". , Commissioner Murphy's primary concern was that the applicant has gone a long way to comply with the conditi()ns. He did not think that the pole sign should be removed, considering the fact that monument signs are not required by code and he would have to remove mature trees to accomplish it. That is stepping over the line and that they should not be over burdening the applicant. The sign is a landmark. It was noted that Chevron was permitted to keeptherr pole sign when they remodeled. Commissioner Baderian wanted conSistency and hated to have the trees removed. Arcadia City 'Planning Commission 9 7123/02 . . Mr. KasaIlla said that the pole sign identifies the car wash. There will be two monument signs for the gas station subject to the review and approval of staff; although, he was not aware of their location. Chairman Pro Tem Olson agreed with Commissioner Murphy. The pole sign has been there for a very long time and he could agree to keep it, especially since trees would be saved. The other businesses at the intersection all have pole signs. The lining up of the median opening with the driveway makes senSe, although, it raiSes an issue of patrons making a left turn onto Santa Anita from the carwash. He wondered if the lining up wotild actuaIly create a problem? Mr. Wray said that their research has revealed that along Santa Anita with the exception of the turn to Forest Ave. all turi1 pockets are toward a street and not for the benefit of an mdividual property considering that this opening is so close to a major intersection. Mr. Cline indicated that if there is a problem the City will have to deal with it later, whereas, this could be handled and resolved now. Commissioner Huang did not think that relocating officus trees would be advisable and he did not think they would survive. Ms. Butler replied that there could be a condition that 'if that occurs, the applicant would be required to plant other trees. In response to a question by Commissioner Huang, Ms. Butler explained that the sidewalk in a.typical conunercial area is 8' wide, in this case it is 5'. Staff is requesting the additional 3' to accommodate a 5' sidewalk as well as a 3' wide area for the future placement of any public utility fixtures. These fixtures are not typically placed on private property, rather they are placed in the public right-of-way. As far as aesthetics, the property will not look any different. She also noted that Mr. Fasching did request to be open 24 hours in liis original application that was submitted. Mr. Wray pointed out that the 3' dedication would be consistent with the General Plan amendment that was recentIyapproved. The 3' dedication could be presented in a form of an irrevocable offer of dedication where the City would decline it until the City needs it. In essence; he would still have the property and the City would take it over when it is needed. The area for the bus pad would be needed now but the remainder of the dedication would not be needed. There would not be a violation of the ADA requirements. Commissioner Murphy could not see any reason for the dedication. Has the City required it from other property owners along Santa Anita? Ms; Butler responded that the irrevocable offer to. dedicate has been done on other properties. MOTION It was moved by Commissioner Murphy, seconded byCommissionef Baderian to approve CUP 2002-011 and ADR 2001-055 and file the Negative Declaration subject to the conditions listed in the staff report with the following amendments: ~ That the applicant be permitted to relocate his existing pole sign further south on Santa Anita Ave. Arcadia City Planning.Commission 10 712l102 . . ~ That the applicant not be required to close the median, and that the City can close it without liability to the subject property owner. (condition 6b). ~ That the applicant submit an irrevocable offer to dedicate 3' along Santa Anita except for a 3'xI2' bus bench pad, which shall be dedicated and built in conjunction with the fueling station (condition 6<:) ~ That the applicant is to work with staff with regard to the trees along the perimeter of the fueling station site, with business visibility in mind (condition 5e). ~ That the fueling station may be open 24 hours a day but the sale of beer and wine are to cease by 10:00 p.m., 7 days a week. ~ All other conditions are to remain as stipulated in the. staff report (conditions I, 2, 3, 5a-d, 5f-j, 7, 8, 9 and 10) ROLL CALL: AYES: NOES: ABSENT: Commissioners Baderian, Huang, Murphy, Olson None Commissioner Kalemkiarian Chairman Pro Tern Olson noted that there is a. five working day appeal period after the adoption of the resolution. Appeals are to be filed by July 31st. 9. PUBLIC HEARING CUP 2002-012 41 W. Santa Clara St. Thomas Clarke Consideration of a conditional use permit and parking modification to allow an academic prep school and a learning center to occupy an existing office building. The staff report was presented. In response to a question by Commissioner Baderian, Mr. Nicholson stated that currently the applicant has, a tutoring facility. He explained the parking requirement and how it was calculated. Ms. Butler further stated that one parking space is required for every five fIXed or permanent seating for churches and auditoriums. The public hearing was opened. Thomas Clarke, 72 N. Arroyo Blvd., Pasadena, said they are in agreement with all of the conditions in the staff report. He said that their classes are. in groups of8-10 kids at any time. They offer classroom situations. The students that would go here are ones that are not served in traditional type schools such as kids that have lost their self esteem. They do not offer traditional type schooling, therefore, they do not need.a traditional style ofa school building. They need to have space to separate the kids so they can achieve their goal. this office building is more s\1ited for tlieir need. They will have 150 fixed seats and the parking should be based upon that number. He assured the Planning Commission that most of the children who would be eligible to drive would not be driving back and forth to school He anticipated that only 25% of those kids would drive. The requested parking spaces for their use is unreasonable. Many of the kids take public transportation and most are dropped off or carpool He felt they have more than enough parking. He was willing to work with staff if any probiem arises, with the possible solution of staggering their opening hours so not to interfere with rush hour or offering van pools. He was confident that the building will serve their need and they could address all the issues that have been raised. He felt they could enforce the traffic with the parents. He feh the area would benefit from their use. They have been good for the community. They do not have outside bells so that would not disturb the neighbors. They have ample space inside and will have personal trainers for physical Arcadia City PJaMing Commission 12 7123102 . . education. He noted that an office use would generate more traffic because adults would be utilizing the building and would be driving. In response to a question by Commissioner Baderian, Mr. Clarke said that they will have an average of 10 students per class. He anticipated that approximately 45 students would be eligible to drive and they would have a staff of 15. If everyone drove they would need 60 parking spaces but he assured the Planning Commission that parents would not allow their children to drive. To assume that all the children that are eligible to drive is an impossibility. He anticipated having an empty parking lot. Although, it is possible to have more cars on certain dates, such as Back to School, he would be wiiIing to stagger those so to eliminate the parking problem. Earl Richey 134 Esperenza, Sierra Madre, said that he has an office on Huntington Dr. He was confident that traffic would not be an issue and remarked that Santa Clara is underutilized. Santa Clara is a 4-lane street just the' same as Santa Anita but it has much less traffic. He thought that they would only need 30 parking spaces based upon ,their .fixed seats. ThiS is the best building for their use in the area Geriuna Denzil, 184 W. Montecito, said that Mr. Clarke has been providing education for children who have fallen through the cracks of traditional public schools. The public schools have failed to provide the proper schooling for these kids. The parents that are here have needed this type of a SChool for their children. This school has offered a wonderful opportunity for their children. She felt that Mr. Clarke has been very reasonable and is willing to work with the City. She indicated that her daughter is a junior but she i1ssured the Planning Commission that she would not be driving to school. Charles Blanke, 939 Arcadia, said that his daughter attends this school. If the City holds out for a commercial use, they would ultimately .end up with more people at the site, all of whom would be driving. This is an excellent school. Ria Richey, 134 Esperenza, Sierra Madre, said that her youngest child has been attending this school for 1.5 years. Not all children learn the same way. This school addresses the kids that don't fit in. The children that attend this school do much better with this style teaching. She has never seen a parking problem at this site. Steve McGaughlin, 820 Chehalem Rd., La Canada, there area,few schools available that he can refe! to when kids cannot attend traditional schools. He thought that the class ratio was excellent. They do a wonderful job. Tom Mahoney, 2762 Paloma, Pasadena, said that he conducted an informal traffic survey and counted a total of 6 cars coming to the school from 7:45 to 8: 15 this morning. So, there is not much traffic. He did not think that traffic would be an issue. Chery Franco, 1668 E. Clarva, Altadena, said that for the first time in many years her son has actually had a successful school year. He attends this school. Parents share the driving responsibility. They carpool with each other and that reduces the traffic. She has never seen a traffic problem. Steve Kirby, (no address given), said the kids are thoroughly well adjusted aild the administration and the education is outstanding. Commissioner Baderian said that based on what he has heard tonight and how many kids are expected to drive, he did not think that there would be a parking problem. Commissioner Murphy could not see a problem with the use. His impression was that this would be a good use based on what has been presented. He was convinced that Mr. Clarke would use good judgment. Chairman Pro Tern Olson agreed. He also could not see a problem, as long as the CUP would be monitored. He thought they should review it 6. months after it has been,in operation. Commissioner Baderian concurred. He commented that the Planning Cornmissionappreciates the staff reports which provide the Planning Commission with the opportunity to review vllJ"ious elements of any recommendation. The Planning Commission relies on stllfPs thoroughness and this gives them the opportunity to review all aspects and consider all possible variations and potential mitigations.
