The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 28, 2003
at 7:00 p.m. in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington Dr. with
Chairman Baderian presiding.

Consideration of a tentative parcel map for a lot line adjustment and a waiver of the parcel
map.
The staff report was presented,
Ms, Butler said these types of projects would not be coming to the Planning Commission in the future
because the process is being changed SO that it will be handled administratively.
The public hearing was opened,

The staff report was presented,
In answer to a question by Commissioner Hsu, Mr. Lambert said that based upon the lotsize they could
have up to 13 units but they are only proposing 8 units.

The public hearing was opened,
Cindy Wu, ] ]823 Slauson, Santa Fe Springs, said they arein agreement with all of the conditions in the
staff report.
Joel Sun, 215 S. Third, No.8, said the tenants were swprised when then received a letter informing them
of the proposed plans. There are 16 units there now; or ] 6 families. This is so close to the holidays and
they were given a very short time to move. The number of affordable housing units will be reduced as a
result oftherernoval of the of these units,
William Dixon, 2] I S, Third, said they have been given 60-days to leave. Many families will have to
relocate and change schools, They will incur moving costs and relocation fees, He also noted that since
the owners have planned this they have not been maintaining the units. For example, the pipes are
leaking and the area is not rn8intained and is dirty.
QiUxia Sun, 217 S. Third, owner of the home next door felt that since this would reduce the density, it
would be a good plan.
Ms. Butler said that anyone interested in seeing the design can come to the Planning office and see the
plans. The purpose of the proceedings tonight is only to decide'whether the newly built units will be
sold as condominiums or apartments. It is not to decide whether or not to build the units or not or to
discuss the design of the project After the public hearing is closed, the Planning Commission will
decide on whether to approve the subdivision or not.
Kenny Wang, 2]5 S, Third, no 6, felt this was unfair, especially considering the fact that they have only
given minimal notice to vacate. It is the end of the year and it will not be easy to find another location
similar ~o this as fur as pricing. They will definitely,need longer time to find another apartment and they
should be compensated for their troubles.
Ms. Wu, representing the applicant, was unable to reply to questions and said. that the property owner
was not at the meeting.
No one else spoke in favor of or in opposition to this item.
Chairman Baderian closed the public hearing,
Commissioner Olson said this is a tough deCision, They are charged with making land use decisions but
their decision will impact many people. He hoped that the applicant would be a little more considerate
and follow all the applicable laws. He sympathized with the tenants but the Planning Commission is to
render a decision on the land use issue, The project as proposed meets all requirements. He hoped that
the property owner would give them ample time. to relocate,
Commissioner Wen iIgreed. It is almost the end of the year and getting close to the holidays. The
Planning Commission's jurisdiction is the land use issue. He said that this is a relatively small building
with ] 6 units. But, what would happen if more tenants were displaced, Could the City do something
about increasing the 60-day requirement?

Ms. Butler indicated that the city does not have any programs to assist renters. The 60-day requirement
is based on the Subdivision Map Act. Of course, it would be better if property owners are. more
sensitive but the City does not have anything that would address that issue. Last year, there was a
similar type issue with a 50-unit project and in that case the developer gave the tenants several months
notice. But, the property owner is complying with code.
Commissioner Hsu asked how this would impact the affordable housing stock of the City?
Ms. Butler replied that not all apartments are classified as affordable housing, although some of the
older apartment units are more affordable than the new units. The existing units are not counted as part
of the goals for housing.
Commissioner Olson said that any code violations should be addressed. He felt that the buildings
should be maintained in living condition as long as they have not been demolished. He said that if any
of the tenants have leases, they may wish to obtain legal counsel.

3. PUBLIC HEARING CUP 2003-010 & ADR 2003-028
208-212 E. Duarte Rd.
Robert Daggett
Consideration ofa conditional use permit for a tutoring center with 85 students in an existing
5,070 sq. ft. commercial building. The proposed hours are Monday-Friday, 3:00 p.m. to 6:30
p.m. and Saturdays from9:00.am. to.5:00 p.m.
RESOLUTION NO. 1700
A Resolution of the City of Arcadia, California, granting CUP 2003-010 and ADR 2003-028
for a tutoring-center at 208-212 E. DuarteRd.
The staff report was presented.
Chairman Baderian asked if additional parking would be required for different types of uses?

Ms. Butler said the requirement does not distinguish between realty office or a general office use
because the Code is the same. The applicant would have to be careful about who they lease that portion
to so there is not parking issue. There is plenty of parking on site and the type of use would be
controlled through the business license procedure.
Commissioner Wen asked if this could be transformed to an adult training facility? Ms. Butler replied
that they are limited from gradeS 1-9 and would need a new CUP for the other type of use.
The public hearing was opened.
Bob Daggett,-232 N. Lake Ave., Pasadena, said that they would like to amend the request to include 10lh
graders. This was an error on the applicant's part and they would like to correct it and have the Planning
Commission consider it. The hours of operation would not change.
Chairman Baderian indicated that some 10fll graders have the ability to drive.
Mr. Daggett did not know whether they would drive or not and could not be more precise. They would
not be concentrnting their efforts on increasing the number of 10fll graders. They do not have immediate
plans for the building to the rear and do not intend to lease it as a separate use. It will probably be a
study hall or a library. The hours ofoperstion would coincide with staff's hours so they would not have
to return for tutoring or similar purposes.
Christian Chow, 203 California, supported this request. Her son attended this facility and it was
extremely helpful, This would be good for Arcadia.residents. Itis.a good after school program. It is a
convenient location.
No one else spoke in favor of or in opposition to this item.
Chairman Baderianclosed the public hearing.
Commissioner Hsu said he drove by and this would bea welcoming improvement.
Commissioner Olson suggested the City to look at the bushes in the alley off of Second.
MOTION:
It was moved by Commissioner.Hsu,. seconded by Commissioner Wen to approve CUP 2003-
010 and ADR 2003-028 subject to the conditions listed in the staff report and adopt
Resolution No. 1700. with the amendment to increase it to.include grades 1-10.

4. PUBLIC HEARING TA 2003-003
Consideration of a text amendment deleting Section 9278.8 allowing churches in all zones with
an approved conditional use permit and adding a new section 9275,1.43 allowing churches in
the R'-O, R-I, R-2 and R-3 and C-O zones with an approved. conditional use permit and adding
a definition of church to Chapter 2, Part 2 Definitions.
The staff report was presented and the public hearing was opened.
No one spoke in favor of or in opposition to this item.
Chairman Baderian closed the public hearing.
Commissioner Olson said that as usual staff has done an excellent job and this makes perfect sense.
Chairman Baderian agreed in evaluation and grasping the intent of the future utilization of projects
dealing with chUrches or placecfworship.

MATTERS FROM CITY COUNCIL
Council Member Marshall indicated that the City has a new mayor, Mayor John Wuo. She also
announced the upcoming.City events.
MATTERS FROM PLANNING COMMISSION
Chairman Baderian' said that since they will be having a joint study session with City Council, he
thought it would be a good idea to have some items of discussion. He suggested meeting sometime in
January to discuss possible items to be placed on the agenda and possibly they would meet with the City
Council after the election.

Ms. Butler said that the city has hired a consultant for the general plan and zoning issues. The City has
also sent out the RFP in search of a consultant for the new sign regulations. Staff is also looking for new
guidelines for parking:
