Consideration of a modification for a rebuild of a single-family residence.
The staff report was presented and the public hearing was opened.
Mr. Milhous, 185] Chantry Dr., felt this would be an asset to the City and said that they are in
agreement with all of the conditions in the staff report.

Chairman Bailerian closed the public hearing.
In reply to a question by Commissioner Hsu, Mr. Li stated that this is a unique lot. Due to the irregular
lot configuration, staffhad to determine which frontage would be considered as the front yard. There.is
only a foot difference between the two sides of the property along the street, both of which abut the
neighbors' side yards. Staff has recommended that dense landscaping be planted along the side yards to
mitigate encroachment..
Ms. Butler concurred and said this is indeed a unique lot, where there could be two front yards, abutting
the neighbors' side yards. Staff feels that the project as proposed provides adequate yard area.
Mr. Li explained that the staff feels there is adequate architectural relief and does not have any problems
with the deletion of the 5' requirement for the second story.

6. PUBLIC HEARING CUP 2003-007
171 E. Live Oak Ave., Units D & E
Carlon Tsai
Consideration of a Conditional Use Permit for a cafeltea house with seating for 30 patrons,
which includes an incidental outdoor eating area. The hours of operation are 11:00 a.m.-I 1:00
p.m., Monday-Thursday; and 1 I :OO-midnight, Friday-Sunday.
The staffireport was presented.
Mr. Li said that a parking study was not conducted. Staff feels that the employees should utilize the
parking along the alley. He was not sure if there was any lighting along the rear of the property.
Commissioner Olson felt that lighting should be provided in the rear.
Chairman Baderian asked if they had complied with the issued citation and Mr. Li replied that the
corrections have been made but did not know whether the fee was paid. Staff has noticed that the
parking in the rear is not utilized.

Carton Tsai, 2328 S.. Fifth Ave., representative of the owner, stated that there is lighting in the rear and
there is access from Unit D to the rear area. This unit will only be for dining purposeS. There are two
lights in the rear which provide sufficient lighting. Withregard.to the citation, the property owner has
paid it. There are other similar type uses with outside seating. They do not feel that they would be
attracting gang activity. Their current hours of operation are Sunday-Thursday, 11 :00 a.m. to 11 :00
p.m., Fridays and Saturdays, 11 :OOa.rn. to midnight.

Commissioner Olson remarked that because this is a CUP, they can revoke the license if there are
problems.
Ms. Butler said that apparently there have been problems With Ii couple of the other similar'type uses
and because the Police have made themselves more visible the gang activity has dropped. The Police
Dept. is concerned because small westend to llt'tract younger crowds and that attracts the gangs.
Chainnan Baderian did not want to single out this particular applicant He thought assuming,that there
woUld be gang activity might be jumping the gun. He thought that the applicant should be given the
opportunity to monitor themselves.
In answer to a question by Commissioner Hsu, Ms. Butler stated that a CUP Could be revoked if there
are problems. She explained the revocation proCess and said that at the hearing the Planning
Commission coUld revoke the CUP, eliminate the outdoor dining portion or impose additional
conditions. .
Chairman Baderian agreed withstalI's recommendation but wanted to make sure thanhe applicant was
provided every opportunity to prove he can control the situation He aIso noted that the hours of
operation in the staffreport differed.from what the applicant requested.
Commissioner Olson was concerned with staff's recommendation as well as the recommendation by the
Police Department.
Ms. Butler remarked that they impose the time limitation on some uses due to proximity to residential
'uses. She added that they could apply for outdoor dinning at a later date. It was also indicated thatthe
hours of operation slated in the staff report is incorrect The correct hours of operation would be
Sunday-Thursday, 11:00 a,rn. to I I :00 p.m., Fridays and Saturdays, 11:00 a.m. to tnidnight

based on staff's recommendation.

RESOLUTION NO. 1696
A Resolution of the City of Arcadia, California, granting CUP 2003-008 and ADR 2003-008
for the mOdular classroom and perimeter fence,at240 W. Colorado Blvd.
The staff report was presented and the public hearing was opened.
Virginia Watt, 240 W. Colorado Blvd, said they are in agreement with all of the conditions in the staff
report. She thanked Ms. Butler and Mr. Lambert for all their aSsistance.
In reply to a question by Chairman Baderian, Ms. Watt indicated that they anticipate to have their master
plan completed by December 2004. .

As Ms. Butler was presenting the staff report for T A 2003-002, Mr. Huang arrived and requested that
Chairman Baderian re-open the public hearing. Chairman Baderian declined indicating that the
Planning Commission already took action and informed Mr. Huang that he could appeal the Planning
Commission's.decision to tbe City Council.
9. PUBLIC HEARING TA 2003-002
Consideration of a text amendment revlsmg Sec. 9295.7.C requmng that new
commercial/industrial projects in excess of 10,000 SQ. ft. and/or major exterior
renovations/rehabilitation to commerciaIlindustrial projects in excess of 20,000 SQ.ft and
multiple-family projects containing 5 or more units shall be subject to design review by the
Planning Commission and a recQmmendation for cost recQvery.

In answer to a question by Commissioner Wen, Ms. Butler stated that staff tries to discourage
modifications on multiple-family projects. The purpose of this TA is to provide additional review of
larger projects. Pursuant to the current ADR procedure no public hearing notices will be mailed out
Neighbors will not be notified of new projects. Staff does not want this to become any more subjective
than.it already is. Projects should be based on the City's design guidelines and not on preferences. The
City has two consulting architects and two landscape architects that provide their design services on an
as needed basis. Staff utilizes these consultants mostly on commercial and large multiple-family
projects.
Commissioner Olson remarked that based on what Ms. Butler has indicated, the Planning Commission
would only review the design for projects with 5+ units and certain commercial/industrial projects. Ms.
Butler explained that the new procedure would not require the notification of the neighbors. The only
time that neighbors would be notified would be if there were modifications or if a CUP was required.
She remarked that currently public hearings are not required for projects that are permitted by right. In
the case of an architectural design review, a public hearing is not required unless there is a modification.
For example, if a project was being proposed next to a dwelling and it did not require modifications, the
neighbors would not be notified. And in the case of the appeal (on the design review) before the
Planning Comlriission tonight, thc applicant appealed staffs decision to the Planning Commission and
the neighbors were not notified of tonight's proceedings.
In answer to a question by Commissioner Hsu, Ms. Butler said that staff has 30 working days to review
an architectural design review when it is submitted. Each time an application is resubmitted, staff has
another 30 working days to review. Generally, projects are not approved the first time. Usually; a
typical project will go back a couple of times before it is approved. . The exception to that might be a
sma1l2-unitproject with an applicanl that is fully aware of the city's requirements. So, in essence, this
additional Planning Commission review may add three to four weeks to the totaheviewprocess. She
mentioned that this additional review would also necessitate preparation of staff reports for Planning
Commission review. She remarked that other cities have various methods of reviewing the projects.
Some have specific boards that are charged with only doing architectural design review. Staff felt that
instead of creating another board, the expertise of the Planning Commission would enable them to do
architectural design review. Staff feels comfortable with Piarming Comrnission doing this review. She
alsO noted that a copy of the staffreport and the agenda were mailed out to the Chamber of Commerce
and.the Board of Realtors.
Ms. Butler went on to say that the current architectura1 design review fees do not cover the time that
staff spends on projects. Many, many hours of staff time are spent with an applicant prior to..a project
being approved. By the time that a project is fine tuned-and reviewed by staffand.the.designconsultant;
the fee paid does not reflect actual time spent For example, staff spent many hours with Mr. Huang
whose project was on the tonight!s agenda
Commissioner Olson was in agreement with increasing the fees. If this was approved, and the Planning
Commission recommended a change on a plan, that action would be binding. Of course, the applicant
could appeal that decision to the City Council.

Commissioner Olson did not have a problem with how projects are being reviewed now. He could not
see why the Planning Commission should not review a 4-unit project but should review one with 5-
units, especially, since after both the staff and consultants would have reviewed the same project As
long as there is no modification, he did not see the need to have the Planning Commission review
multiple-family or commercial projects. He felt that should be left up to the professionals. He was
concerned with how far this would go. Would they then want to see each and every house that is being
proposed that does not need a modification? Where do they draw the line? He has seen what staff has
been doing for the last 15 years and he felt they have been doing a great job. He could not justify having
the Planning Commission review projects and add an extra layer of review, if a project complied with
code and did not have any modifications. He was in favor of increasing the fees but not the portion of
the T A that required Planning Commission approval.
Commissioner Hsu was concerned with increasing the time for the review. It would be almost double
the review time.
Commissioner Wen was also concerned with the additiomil review time.
In response to a question by Chairman Baderian, Ms. Butler did not know how many cities utilize
consultants. She was aware of the City of San Gabriel is'utilizing one of the City's consultants. Having
a consultant enabled the city to have another look at a project Each city handles architectural design
review. differently and have various policies on how they are handled.
Chairman Baderian felt that the city has an excellent staff and how they deal with projects. The. main
purpose of the architectural and landscape consultants are to r:eview the projects. He did not think that
this process needed to be 'fIXed' because in his opinion, it is not broken. He felt the City Council should
be aware that if the architectural design review fees are not adequate then they should be adjlisted to
cover costs. However, he did not think that the present review process should be changed to have the
Planning Commission review projects.
The Planning Commission asked that their comments be forwarded to the City Council.

MATTERS FROM CITY COUNCIL
Council Member Marshall discussed the birthday celebrations and the various activities that were
scheduled. She noted thatthe parade was canceIle<fbecause there was not much interest in it because it
was to be held on a Sunday morning. She said thatthe Arcadia book-is on sale and can be purchased.
The dedication for the Police building has been scheduled for October.
MATTERS FROM PLANNING COMMISSION
Commissioner Olson indicated that he would not be able to chair the next Modification Committee
meeting.
Chairman Baderian reminded the Planning Commission to review the distance map which. was
distributed to them that showed what would be within SOO' radius. He noticed that there are a couple of
'projects that.will be coming before.the Planning Commission which'would be within that radius, which
he would have to abstain from voting.
