Arcadia City Planning Commission Tnesday, JDDe 12, 2004 7:00 p.rn. in the Arcadia City Conndl Chambers PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, June 22, 2004 at 7:00 p.m. in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington Dr. with Chairman Baderian presiding. ROLL CALL: PRESENT: ABSENT: Commissioners Hsu, Lucas, Olson,.Wen, Baderian None OTHERS ATTENDING Community Development Administrator Donna Butler Associate Planner Joe Lambert Senior Administrative Assistant Silva Vergel MOTION It was moved by Commissioner Wen, seconded by Commissioner Hsu to read all resolutions by title only and waive reading theful1 body of the resolution. The motion passed by voice vote with.no one dissenting. ROLLCALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None SUPPLEMENTAL. INFORMATION FROM STAFF REGARDING AGENDA ITEMS' Ms. Butler indicated that revised conditional of approval were distributed for TM 60151 as well as a prioritized list of topics of discussion with City Council. TIME RESERVED FOR THOSE IN THE .AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON-PUBLIC HEARING MATTERS (5 MINUTE LIMIT PER PERSON) The following persons spoke in favor of Celeste's Kitchen located at 136 Las Tunas Dr. AIl indicated they have dined at said restaurant and never. encountered any parking problems. They concurred about the quality of the food. at the establishment which is excel1ent and that it.is a nice atmosphere. Claremont Robert Bauer 4307 Ivar, Rosemead Ms. Butler explained the public hearing procedure and the appeal process. She said that the Planning Commission cannot change their decision of June 8th and tonight's proceedings are only affirming the decision that they made at the hearing. Nancy Robles, 1400 Nubia St., Baldwin Park, said that she is the applicant's spouse and they are very saddened with what has been happening. They feel guilty that they have to ask their customers to come t~ th~ hearing to support them. She indicated that parking is_not an3ssue atthis location. Oscar Sierra, 14001 Nubia St., Baldwin Park, said that he was unprepared at the first public hearing because he had never experienced anything like this before. After the public hearing he told his customers of what had happened. He was confident that they could work with the auto body and arrive at an agreement to utilize their parking considering that they do not have a lot of business. At this time, he cannot relocate because. it is cost prohibitive. During the week, they are not very busy and are busier on Saturdays and Sundays. Their hours are also limited on Sundays when they are open from 8:00 a.m. to 3:30 p.m. On a daily basis they have between.20-25 customers; on Saturdays about 50-70 customers and on Sundays they have about 80-90 customers. 1. PUBLIC HEARING TM 60151 1122-1128 W. Duarte Rd. Twen Ma Consideration ora tentative map for a 33-unit senior condominium project. Commissioner Olson abstained from this item. The staff report was presented and the public hearing was opened. Heather nams, Tritech Assoc., the civil engineer for the project said they are in agreement with all of the conditions. No one else spoke in favor of or in opposition to this item. MOTION:. It was moved by Commissioner Wen, seconded by Comniissioner Hsu to close the public hearing. the motion passed by voice vote with no one dissenting. ROLL CALL: Arcadia City. AYES: NOES: ABSTAIN: Commissioners Hsu, Lucas, Wen, Baderian None Commissioner Olson MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Wen to approve TM 60151 subject to the conditions in the staff report. ROLL CALL: AYES: NOES: ABSTAIN: Commissioners Hsu, Lucas, Wen, Baderian None Commissioner Olson Chairman Baderian noted that there is a ten-day appeal period. Appeals are to be filedby July 2. 2. PUBUC HEARING Z 2004-002 650 W. Huntington Dr. Jimmy Lee - CDA Consideration of a zone change from C-OlProfessional Office to R-3/Multiple-Family Residential. The staff report was presented. In answer to a question by Commissioner Hsu, Ms. Butler stated that they could build up to 36 units but more than likely they will not build to that density. The public hearing was opened. Jeff Lee, 650 W. Huntington Dr., rep~esenting the property owner, said he was present to answer any questions from the Planning Commission. No one else spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Wen to close the public hearing. In answer to a question by Commissioner Olson, Ms. Butler said that the properties to the east and west are developed with multiple-family projects. If this zone change is approved and the building is demolished, they would have to construct multiple-family units. Chairman Baderian was pleased that the property was being brought into consistency with the General Plan. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Lucas to recommend approval ofZ 2004-002 to the City Council. PLANNING COMMISSION DETERMINATION Finding of consi~ency with the Arcadia General Plan for the acquisition and disposition of land for the proposed Morlan Place Project Ms. Butler explained that this is a mandatory step in this process. At Coinmissioner Lucas's request, Mr. Pete Kinnhan explained that the Arcadia Redevelopmellt Agency has been working with Rusnak for severai years. There isa possibility of an expansion in a few years. Staff is stil1 working on a draft dOcument for the proposed expansion, which would include the five properties delineated on the map. Staff is not asking for approval of the project but that the Planning Commission determine that the proposed use is consistent with the General Plan. The proposed use is commercial and the General Plan designation is also commercial and staff is looking for a determination from the Planning Commission that the two are consistent Commissioner Lucas was concerned that this would predispose the use of the property and Mr. Kinnahan replied that this determination is not a blanket "approval. They would need to go through the various procedures for the proposed use. Commissioner Lucas expressed his concerns and Ms. Butler replied that this is at the beginning stages. The applicant will be required to go through architectural design review, obtain a conditional use permit and must go through the various permitting process. All of this will take a couple of years but this is the fITst step in the process and it is a mandatory finding. The Planning Commission is being asked to determine that the proposed use; a retail use, is consistent with the General Plan designation of the property, which is commercial. The Planning Commission requires no other action at this time. The Disposition and Development Agreement has not been approved yet. MOTION: Arcadia CitY PIaiming Commission 4 612214 . . RESOLUTION NO. 1707 A resolution of the Planning Commission of the City of Arcadia, California denying CUP 2004-005 to allow seating at an existing take-out food establishemnt to accommodate 68 patrons including incidental outdoor dining at 136 Las Tunas Dr. MOTION It ,vas moved by Commissioner Olson, seconded by Commissioner Hsu to adopt Resolution No. 1707 and to formally affirm the decision of June 8, 2004 and the votes thereon. RESOLUTION NO. 1709 A resolution of the Planning Commission of the City of Arcadia, California denying CUP 2004-007 for a tUtoring center with 24 Students in an existing building at 650 W.Duarte Rd. MOTION It was moved by Commissioner Olson, seconded by Commissioner Wen to adopt Resolution No. 1709 and toformallyaffinn the. decision ofJune 8,2004 and the votes thereon. - - ROLL CALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None Chairman Baderian noted that there is a five working day appeal period. RECOMMENDATION: Approve Commissioner Hsu clarified and expanded on his statements on Page 2 of the Minutes regarding the parking of inoperable vehicles and the agreement to utilize that parking. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Hsu to approve the Minutes as amended. ROLL CALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None MATTERS FROM CITY COUNCIL None MATTERS FROM PLANNING COMMISSION Topics of discussion at joint stUdy session with City Council. Ms. Butler said that a copy of the prioritized list was distributed to the Planning Commission earlier as well as Commissioner Hsu's list. She Indicated that the meeting would be held in the Development Services Department Conference Room at 6:00 p.m., Tuesday, June 29, 2004. Commissioner Olson said that he was speaking with the City Manager; Bill Kelly, after the Modification Committee meeting regarding how many applications come before the Modification Committee that require side yard modifications for additions that are over 30 linear feet and how this should be amended so. staff could act on this administratively, not only saving money for the homeowner but also expediting the process for the residents. Ms. Butler explained the history of setback requirements and said that currently any side yard modification for a first floor addition tliat is less than 30 linear feel can be reviewed and approved administratively. This application requires the review and signatures of all contiguous homeowners on- both the application and the plans. The fee for this process is $195. This is a quick process for residents with a five working day appeal period after the approval. For additions that are more than 30 linear feel, the Modification Committee reviews the request, costing $510. This process takes much longer and also has a five working day appeal period. Commissioner Olson added that the cost difference is significant between the two and the code should be amended for these types of modifications. He felt staff could do this administratively and said that most of these are for older homes that do not comply with current setback requirements. He said that this change should only be for single-story additions. Arcadia city Planning Commission 6 6/22/4 . . Ms. Butler indicated that she would summarize the list that was submitted to the Planning Commission tonight and incorporate Commissioner Hsu's list and forward it to Mr. Kelly. MODIFICATION COMMITTEE MEETING ACTIONS Commissioner Olson summarized the Modification Committee actions. MATTERS FROM STAFF I. CITY COUNCIL ACTIONS 2.
