PLEDGE OF ALLEGIANCE
The Planning Commission of the City of Arcadia met in regular session on Tuesday, May 24, 2005 at
7:00 p.m. in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington Dr. with
Chairman Baderian presiding.

MOTION:
It was moved by Commissioner Hsu, seconded by Commissioner. Lucas to read all resolutions by
title only and waive reading the full body of the resolution. The motion passed by voice vote
with none dissenting.

market.
Resolution No. 1730
A resolution of the City of Arcadia, California, granting CUP 2005-010 for the sale of beer and
wine within an existing specialty food market at 171 E.Live Oak Ave., Unit A.

The staff report was presented.
In answer to a question from Chairman Baderian, Ms. Butler stated that ABC would place restrictions on
a use depending on its proximity toa residential area. The proposed use is similar to any liquor store
and is not unique. Ms. Butler went on to say that the business was recently sold and the new owner
desires to sell beer and wine.
The public hearing was opened.
Stanley Szeto, 879 W. Ashiya Rd., Montebello, said he was representing the owner of the business and
that they are in agreement with all of the conditions in the staff report.
No one else spoke in favor of or in opposition to. this item.
MOTION:
It was moved by Commissioner Hsu, seconded by Commissioner Lucas to close the public
hearing. The motion passed by voice vote with no one dissenting.
MOTION:
It was moved by Commissioner Olson, seconded by Commissioner Hsu to approve CUP 2005-
0] 0 subject to the conditions in the staff report and adopt Resolution No. 1730.

2. PUBLIC HEARING MP 2005-004

Consideration of modifications"for a-new 3,9S0'sq.ft. two-story, single-family residence on a
reverse comer lot.
The staff report was presented and the public hearing was opened.
Marty Zialdcita, 1687 Hill Dr. Los Angeles, the designer of the project was preSent. He said that his
clients have resided at this address for] 1 years and feel that they need a larger home for their growing
family. Because this is a reverse cOmer lot, they ate limited by certain provisions and need this
modification. The requested 15' side yard setbackfor the second floor will provide for a larger ground
floor area. Request B, the 9'-0" to ] 0' -0" second story setback will also provide for a larger second
story and a little larger bedrooms. The lots limitations are the reason why they are here and it would be
a hardship if they were not permitted to do this. They are willing to amend some of the requested

setbacks on the second floor. He said the requests would allow them to have larger rooms, With
regard to the entry height, they feel it is appropriate but would be willing to comply with code. He
disagreed with staff with regard to compatibility of the home with the surrounding homes. There are
several houses in the immediate area that have larger columns. He asked the,Planning Commission to
approve this request beCause denial would be a hardship. The owners want to stay in the area and this
new home will help them realize their dream.
In reply to questions by Commissioner Lucas; Mr. Zialcita stated that they could modify request B so
that portions of the second floor comply with the] 2' but still have some areas that would have the 9' -0"
to ]0'-0" setbacks, so approximately 60"10 would comply with the ]2' setback. He said that the design
of the house is classical architecture.
Jeffrey Tedja, 1523 Holly Ave., said they have lived at this address for 11 years and although there are
many older homes in the area, there are many newer ones with these types of entries. They like the
environment and would like to build this home there. This home will accommodate their family because
their current house is small and they feel there is no room to move in the house. He could not
understand why others were able to have similar homes and he was being denied that right, They have
attempted to redesign this house to comply with staff'srecommendations several times and do not feel
that this is a major request.

It was moved by Commissioner Lucas, seconded by Commissioner Hsu to close the public
hearing. The motion passed by voice vote with no one dissenting.
Chairman Baderian wondered if the other homes in the area required modifications and Mr. Li did not
know what the neighboring properties required. Mr. Li feltthat duetothe length ofthe house (56'),
they should comply with the 12' setback.on the second floor.
Ms. Butler pointed out that the codes were changed recently and it is very likely that these homes were
constructed under the old code. The house, which is located to the northeast of the subject property,
would not be permitted under the new regulations, as well as some of the elements on some of the other
homes due to the code change. She indicated that the city does not have architectural design review for
this area. Although, the Planning Commission. can discuss the setbacks and mass, they cannot address
the design ofthe home.
At Chairman Baderian's request, Mr. Zialcita approached the podium and stated that the homeowner
would like to be able to encroach into the 12' setback.
Commissioner OlSon said that he would not have a problem with this project if they were only
requesting the 15' street side yard setback, considering that this is a reverse comer lot. To try and
construct anything that is "normal" in today's market is almost impossible on this size of a lot. He could
not justify a 14' high entry. He did not think that they meet the standards for granting these
modifications. With regard to Request B, he stated that there does not seem to be any reason to
encroach into the 12' setback, when they are going to be constructing a new home. he concurred with
staff's analysi,s.
