A petition in opposition of the request submitted by some adjoining businesses . A letter in favor of the request from All Star Liquors . PUBLIC HEARING TPM 2005-02 45 Genoa K& K Development Consideration of a tentative parcel map for a 3-unit residential condominium project, The staff report was presented and the public hearing was opened, No one spoke in favor of or in opposition to this item, " . . MOTION: It was moved by Commissioner Lucas, seconded by Commissioner Hsu to close the public hearing, The motion passed by voice vote with no one dissenting, MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Lucas to approve TPM 2005- 02 subject to the conditions in the staff report, ROLLCALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None Chairman Baderian noted that there is a ten-day appeal period, Appeals are to be filed by Monday; April 22nd, 2. PUBUC HEARING CUP 200~ and ADR 2004,.022 3 E, Duarte Road Alex Gurski ofWD Partners (Architect) on behalf ofE-Z Lube Consideration of a conditional use permit and architectural design review to construct and operate an automobile service station, engaging in the sale of motor fuels with automobile lubrication service and a 210sq, ft, convenience store The staff report was presented, In reply to a question by Commissioner Lucas, Mr, Li indicated that staff felt that the design was deficient because the double-sided bays would be open at all times and be visible, He said that they would have to comply with AQMD standards, Ms, Butler explained that the Transportation Master Plan, which was prepared in 2000, took into consideration the uses present at that time, The General Plan pertains to land use and the potential impact of uses on various iirtersections, There has been a significant increase in traffic on all intersections since this study was prepared; consequently, the same firm has been hired to conduct another study: In answer to a question by Commissioner Hsu, Mr, Li said that Jiffy Lube has a similar configuration but only one side of it faces a street, He said there would be summer/winter hours; summer would be from May I to October 31 and winter would be from November 1 to April 30, The public hearing was opened, Raymond Meyers, 152 W. Wistaria, said that this property has been in his wife's family since 1928, This is a source of income for them but the property has been vacant for a couple of years, With the help of their realtor, they reviewed several alternatives for the site and have now brought forth to the Planning Commission the best proposal for both the City and one that would compliment the corner. This is a very nice deSign, The use will provide jobs for the community and provide income for his family, The project is in line with the City's mission statement and goals, He stated that neighboring cities have E-Z Lube, such as San Marino and Pasadena, He urged the Planning Commission to approve the use, Bardawijn Hannahh, WD Partners. 15420 Laguna Canyon Rd" Irvine, said that he is the Permitting and Planning Manager and is before the Planning Commission representing E-Z Lube and the property owners, He said that there was a service station at this site for over 75 years, They have worked very closely with staff and have had three major redrafts of the proposal, Originally, the bays opened up to the street, similar to ftffy Lube, Per staff's suggestions, they angled the building so the bays would be off centered and that would mitigate the visual effect, The building will look similar to a fire station with a fun brick element. There will be 15 trees planted along Duarte Rd, and Santa Anita Ave" with various, textures and colors, as required by the landscape guidelines that were provided, With the use of planting, they will soften the look of the trash area, There will also be benning, He went on to say that all work would be done inside the building, He provided an explanation of the visual effects of the building from all directions and explained that the building will not be visible from far away and the bays are even less visible. The.use will be,visuaIly hatmonious with the surrounding uses, The CEQA checklist completed by staff approves the project and'indicates that there will be "less than significant" impact, He urged the Planning Commission to approve the use, In answer to questions by Commissioner Lucas, Mr, Hannahh indicated that the berms would be parallel to Duarte Rd, and Santa Anita Ave, on the inside of the sidewalks, There is some landscaping along the north and west property lines and the berming would be against the existing wall, He went on to say that this is not a standard design for E-Z Lube because the building has been upgraded for Arcadia, The improvements have been the 'brick exterior, the repositioning of the building on the lot, the increased landscaping and the berming, Alan Yu, 1000 S, Santa Anita, owner of Arco Service Station said that he has owned this station for 15 years and has seen traffic worsen significantly, He said that he represented those who signed the petition, which has already been distributed, all of whom do not want this use at this site, They are all concerned about the traffic at the intersection, There is a potential for an accident here, There is too much pedestrian traffic in the area, with the IibrllTY, and the various schools nearby to. have another service station, In rebuttal, Mr, Hannahh pointed out that the Transportation Master Plan which was done in, 2000 included the traffic .generated by ,the previous service station, therefore, the trips from any servicestation- . at this site were already included and per the staff report it was indicated that the net trips would not be increased, He indicated that Mr, Yu is the owner of a service station and naturally would not want a competitor nearby, The majority of their business will be done on weekends and late afternoons and that should alleviate the concerns about school traffic, He also reminded the Planning Commission that this use is a permitted one in this zone, The difference between this site and the one in San Marino is that the other will not have a fueling station; the buildings are the same size but the parcel there is smaller, No one else spoke in filvor of orin opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Olson to close the public hearing, The motion passed by voice vote with no one dissenting, ' Commissioner Lucas felt that the. design of the project showed creativity in design, He drove the area to get a visual sense of the proposed use and felt that the additional landscaping would reduce the issues and concerns raised by staff. Commissioner Hsu said that is a problem area and it is a busy intersection especially during peak hours, Commissioner Olson was also concerned about the traffic in the area, especially when school is in session, However, based on other permitted uses he was not sure that anything else would be better in terms of traffic, He felt that the applicant has worked hard to mitigate staff's concerns, This would be ail improvement to the comer, Commissioner Wen agreed and said that the project was very well presented, He would not have any problems with the proposal if it were just a lubrication service, He was concerned about the service station and the lubrication combination. Chairman Baderian was also concerned about the traffic but looking at the CEQA checklist he noticed that that there would not be a significant impact, He did not think that the findings listed in the staff report to deny the project would apply, He applauded the applicant for working diligently with staff and addressing any potential concerns and the visual impacts from the open bays, Ms, Butler added that if the Planning Commission approves the project, they should add a "right-turn- only" condition, to be posted at the driveway, on both Duarte Rd, and Santa Anita Ave, MOTION: It was moved by Commissioner Lucas, seconded by Commissioner Wen to amend CUP 2005-05 and ADR 2004-022, subject to the conditions in the staff report and direct staff to prepare the appropriate resolution;for adoption, ROLL CALL: AYES: NOES: Commissioners Lucas, Olson, Wen, Baderian Commissioner Hsu Chairman Baderian noted that there is a five worki~-day appeal period after the adoption of the resolution, The resolution will be adopted on April 26 . MIN.UTES OF 3/22/5 RECOMMENDATION: Approve MOTION: It was moved by Commissioner Olson, seconded by Commissioner Wen to approve the Minutes 00/22/5 as published amended, ROLL CALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None MATTERS FROM CITY COUNCIL AND PLANNING COMMISSION Commissioner Lucas indicated that he attended the Scoping Meeting for the Caruso project and was impressed with the meeting, He went on to say that he would be absent from the June 14th meeting, Commissioner Hsu said he would be absent on June 28th MODIFICATION COMMITTEE MEETING ACTIONS Commissioner Olson,summarized the Modification Committee actions, MATIERS FROM STAFF 1.
