'"' Arudia City Planning Commission Tuesday, February 22, 2005 7:00 p.m. in the Arudia City Cooncil Chambers PLEDGE OF ALLEGIANCE The Planning Commission of the City of Arcadia met in regular session on Tuesday, February 22, 2005 at 7:00 p.m in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington Dr. with Chainnan Baderian presiding. PUBLIC HEARING TM 62234 161 Colorado PI. Hsien- Tein Project Investment, LLC Consideration of a tentative map for a 78-unit senior condominium project. The staff report was presented. In reply to a question by Commissioner Wen, Mr. Lambert indicated that there would be two floor plans; one that is 1,000 sq. ft. and another that is 1,300 sq. ft. Mr. Lambert. explained the age requirements for the property owners and their spouse and. stated that the age limit was amended by the City Council during the appeal process to be consistent with State laws. . . ~ In reply to a question by Commissioner Hsu, Mr. Lambert said that according to the City Attorney there is no provision in State law to restrict the age of owners for a "senior" development, However, for "senior" projects that have less than 35-units, the ownership age can be restricted. The public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION: It was moved by Commissione~ Olson, seconded by Commissioner Hsu to close the public hearing. The motion passed by voice vote with no one dissenting. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Hsu to approve TM 62234 subject to the conditions in the staff report. PUBLIC BEARING TPM 2005-01 800 W. Huntington Dr. B & M Chen, Inc. Consideration ofa tentative parcel map fora 4-unit residential condominium project. The staff report was presented and the public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Wen, seconded by Commissioner Olson to close the public hearing: The motion passed by voice vote with no one dissenting. PUBLIC HEARING CUP 2005-03 21 W. Duarte Rd., Unit B Chung! Wu Consideration of a conditional use permit for a tutoring center with 30 students in an existing I,SOO sq. ft. commercial unit. . The staff report was presented. In response to a question by Commissioner Lucas, Mr. Li said that the Building Official has reviewed the plans and is aware of the existing restroom. He noted that there is another restroom in the shared area. Commissioner Lucas asked what the difference was between a tutoringllearning center and a child care center? He wondered if these were child care centers in disguise and asked if they actually had a curriculum? Ms. Butler replied that they are not required to supply their curriculum to the City. She noted that these are indeed different than childcare centers. These facilities cater to students who come there between 1- 2 hours aild offer specific classes. Childcare centers are-licensed by the State but these uSes do not require that approval. In answer to a comment by Commissioner Wen, Ms. Butler indicated that the building is handicap accessible. The public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Hsu to close the public hearing. The motion passed by voice vote with no one dissenting, Commissioner Lucas commented that there seems to be a significant number oftutoriaUleaming centers. He deduced that either they are creating masked daycare centers or the schools are not measuring up and parents feel they need this type of service. He felt as if there is something going on that does not meet the eye. He did not want to deny this request but was just making an observation. Arcadia Cily Planning Commission 3 2/221S . . - Ms. Butler replied that there are numerous of tutoring uses because they provide an edge for the students who want to further their education. It is not that the public schools are not doing enough; it is just that these learning centers help the students. In today's society, there is a need to provide more education due to the comp"liLion. In her conversation with other communities, they are also experiencing a surge in similar uses. Chairman Baderian asked if the applicant was aware of,the "right turn only" condition and Mr. Li replied that he attempted to contact the applicant but was unsuccessful. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Hsuto approve CUP 2005" 03 subject to the conditions in,the staff report, ROLL CALL: AYES: NOES: Commissioners Hsu, Lucas, Olson, Wen, Baderian None Chainnan Baderian noted that there is a five working-day appeal period after the adoption of the resolution. The resolution will be adopted on March 8. Appeals are to be filed by March 15,2005. 4. PUBLIC HEARING MP 200~2 245 W. Longden Ave. James Qiu Consideration ofamodification for an existing 6'-9" westerly side yard setback in lieu of 10'- 2" required for a re-build project. The staff report was presented. Commissioner Hsu asked if the design of the home complies with the guidelines and Ms. Butler replied that in this area there is no architectural design review. The public hearing was opened. James Qiu, 245 W. Longden, the designer of the project.said Building Services has already approved the project. The recent rains have damaged the walls and this has forced them to remove more than 50% of the wall coverings. He noted that the westerly setback would not be changed and indicated that they are in agreement with all of the conditions in the staff report. No one else spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Wen to close the public hearing. PUBLIC HEARING TA 2005-02 Consideration of a text amendment relating to Boarding Houses in the single-,farnily and multiple-family residential zones. The staff report was presented. Ms. Butler indicated thatfarnily members would be exempt. The purpose of this text amendment is not. to prohibit family members from living in the home but to avoid a sub-leasing situation; where someone may rent a residence and lease the rooms to others. There have been situations where the City has had to deal with the problem. There were several pregnancy homes, where expectant mothers would sublease a room until after the.birth of the child. There was also an incident where several students were renting a home and then subleasing rooms to others. Commissioner Wen felt this was a good change, except he was concerned with how this would be implemented; i.e.; the manner in which staff would become aware of these. He felt there should be a better solution. than relying on complaints. He wondered if the Police Dept. could assist with finding violators? Ms. Butler replied that the Police Department was very instrumental when they were dealing with the pregnancy homes. She explained the process after violators have been discovered. The public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Olson to close the public hearing. The motion passed by voice vote with no one dissenting. MOTION: It was moved by Commissioner Olson, seconded by Commissioner Wen to recommend approval ofTA 2005-02 to the City Council. CITY COUNCIL ACTIONS & PLANNING COMMISSION AGENDA ITEMS Ms. Butler anticipated that a public hearing would be scheduled before the Planning Commission as early as May to discuss architectural design review for single-family projects.
