HEARING ITEMS 1. PUBLIC HEARING CUP 91-16 10 West Live Oak Avenue Shawna Desbois The applicant is requesting an,amendinent to Conditional Use Permit No, 91-16 to permit an array of six (6) aritennae panels and a 2' diameter dish on an existing monopole for a new wireless telecommunication facility (d.b.a. Metro PCS), ~ . RESOLUTION. NO. 1751 . A Resolution of the Plamiing Commission of the City of Arcadia, California, approving an amendment to Conditional Use Permit 91-16 to permit an array of six (6) antennae panels and a 2' diameter dish on an existing monopole for a new wireless telecommunications facility (d,b,a, Metro PCS). The staffreportwaspresented by Associate Planner Jim Kasama, The public hearing was opened. Ms, Lucy Bames, a consuhant for Metro PCS, offered to answer questions from the Commissioners. Commissioner Baderian asked why the applicant wanted to amend the permit at'this point. Ms, Barnes explained that the Conditional Use Permit was originally approved about 15 years ago for another carrier and that they are anew carrier who wishes to co- locate additional equipment on the existing monopole. Commissioner Hsu asked if a study had been conducted to determine whether the existing pole could ,accommodate the ,additional equipment, Ms. Barnes explained that a study is usually done to check the structural integrity of the monopole, Commissioner Baderian asked Ms, Bames if the applicant had read and understood the: report and Ms, Barnes assured.the Commissioners that the applicant had no issues with the conditions of approval, There were no additional. speakers, MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Hsu, to close the public hearing, Without objection the public hearing was closed, MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Parrille, to approve the amendment to Conditional Use Permit 91-16 and adopt Resolution No. 1751 as recommended by staff, subject to the conditions in the staffreport. AYES: NOES: Commissioners Baderian, Beranek, Hsu, Parrille and Olson None Chairman Olson noted that there is ,a five working day appeal' period after the adoption of the Resolution, Appeals are to be filed by December 19 . PUBLIC HEARING CUP 06-12 AND ADR 06-27 850 South Baldwin Avenue Bruce Fung (Arcadia Garden Cafe) The applicant is requesting a Conditional Use Permit and Architectural Design Review to enclose the covered portion of an existing patio dining area to enlarge the fOQdpreparation and service area, and to amend the conditions of approval of CUP 97-3 that allowed the patio dining area; The staff report was presented by Associate Planner rim Kasama. Commissioner Hsu asked for clarification on the seating and parking arrangement currently'in effect at the restaurant and Commissioner Parrille. asked if the Police and Fire Departments had been consUlted on this request. Associate Planner Kasama explained that inpilt from Police and Fire was not requested for these types of projects and he also reviewed the current seating and parking arrangement, The public hear4lg was opened. Mr, Lee, El Monte, and Mr, All, represented the owner in seeking approval to enclose the patio reducing the number of parking spaces, He said.ifitis required by the city, the owner will continue to provide valet parking service, MOTION: It was moved by Commissioner Baderillll; seconded by Commissioner Beranek to close the public hearing, Without objection the public hearing was closed. Commissioners Baderian and Panille expressed concern that the reduction in parking spaces will create congestion on Baldwin Avenue. ~ "-",,", Commissioner Olson asked under what circumstances the Police and Fire Departments are asked for input on projects. Mr, Kruckeberg explained that Police and Fire are only consulted when there.are specific public safety issues, Associate Planner Kasama added that Police and Fire look at the building in terms of / accessibility in case of emergency, This building is in the front of the lot so their access': from the street; notthrough the parking lot. / Commissioner Olson ask,ed if the applicant could continue with valet parking afte}' area is enclosed and if this would satisfy city parking requirements, AssociatePl Kasama said that valet parking would, in.fact, eliminate the parking space deW Mr. Kruckeberg said that the CoIDDlission could approve enclosing the ~t'/ Architectural Design Review but add the condition that valet parking is)'/ r , . . Commissioner Beranek pointed outthat Chez Sateau generated fewer cars because the diners tended to stay longer than they do at Arcadia Garden Cafe, He said that he never saw the Chez Sateau parking lot more than sixty percent full and that he doesn't share concerns about traffic congestion, Commissioner Baderian suggested amending condition number 3 to require continuation of vaiet patking based upon the need to maintain the authorized number of spaces for this type of business, Commissioners Baderian, Hsu, Parrille and Olson discussed the feasibility of some kind of feedback on the project to see if the parking situation is working over time.. Mr, Kruckeberg pointed out that if the motion ,on the table is approved, the requirements would'be met and there would be.DO need for a condition to reView the parking situation later. However, the Commissioners can ask staff'to return informally for a review of the parking situation at a later date. PUBUC HEARING MP 06-'10 AND SFADR 06-'50 1722 South Sixth Avenue James Jaquez, architectfor.Alex.andCathy Vasquez , The applicant is requesting approval of an Architectural Design Review and modifications from,thestreet side yard requirements along Nonnan Avenue (AMC Sec. 9252:2.3,2) for a proposed two-story rebuild: The staff report was presented by Associate Planner run Kasama, The public hearing was opened, Mr, James Jaquez, the architect on the project, said that the three modifications requested are architectural felitures and are not intended to add footage but to improve aesthetics, PC AGENDA J2,i2~ Page 6 . . Commissioner Parrille asked to clarify how much larger the revised design will make the house, Associate Planner KaSama said the house will be about 500 to 600 square feet larger, Commissioner Parril1easked if there was any discussion about the size of the house when it was initially presented to the Commission, Mr. Kasama said therewas not and that the increased size of the house presented no co!lflict with the Municipal Code. PUBLIC HEARING TEXT AMENDMENT 0...2 AND GENERAL PLAN AMENDMENT 06-02 Citywide The City is proposing amendments to the Arcadia Municipal Code and General Plan as follows: Amending the definition of Floor Area Ratio in the City's General Plan and the Arcadia Municipal Code; amending the process for reviewing amendments to Estahlished.Setback Line regulations to:part 3 of CWipter 3 of the Arcadia Municipal Code; ahd adding Temporary Storage Container regulations within singJe-familyresidential zones, The staff report was presented by Jason Kruckeberg and Corky Nicholson. Mr,Kruckeberg said that this Text Amendment is designed to clean up inconsistencies in the code with respect to floor area ratio, Commissioner ParriJle asked who is responsible for monitoring temporary storage container regulation compliance, Mr, Nicholson said Code Services and/or Building Inspectors could issue citations for non compliance. Commissioner Beranek asked if the containers can be locked and Mr, Nicholson assured him that they can, PC AGENDA 12.12.06 Page 7 . . Commissioner Baderian asked who is responsible for removing the containers when they are no longer needed, Mr. Nicholson said it is the responsibility of the contractor.. The public hearing was opened, MOTION: It was moved by Commissioner Beranek, seConded by Commissioner Parrille to close the public hearing, Without objection the public hearing was closed. Commissioner Baderian asked it; given the last Planning Commission meeting on the Shops at Santa Anita project, the timing was good, bad or indifferent for this proposal, Mr,Knickeberg said this is really just cleaning up mistakes and added ifwe have definitions that work and that apply we should clean this up now. Commissioner Baderian said he supports the concept and just wants to make sure that when it is presented to the City Council it is based upon the need to clean up the Municipal Code and to be consistent and not to benefit any particular project, Commissioner Baderiansaid he hoped the comments of the Commission would be conveyed to the City Council and thathe commendsstatTfor addressing situations that are not efficient within the General Plan and Zoning Code, Commissioner Olson said this proposal makes a lot of sense and he is pleased to see this action taken and passed on to the City Council. MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Panille to recommend approval of Text Amendment 06-02 and General Plan Amendment 06-02, as recommended bystaff:to the City Council. AYES: NOES: Commissioner Baderian,Beranek, Hsu, Parrille and Olson None MATI'ERS FROM CITY COUNCIL AND PLANNING COMMISSION Councilman Amundson congratulated the Commissioners on a well organized meeting on November 28, He also said that he had recently met with Supervisor Antonovich and they talked about the work on Chantry Flats, RosemeadBoulevard and the Gold Line, Councilman Amundson wished everyone a good Christmas and holiday season, Commissioner Beranek asked Councilman Amundson about involvement with the Council of Governments and Mr, Amundson said he would have information at the next meeting. MODIFICATION COMMITI'EE MEETING AcnONS Chairman Olson said the ModifiCation Committee approved one item subject to conditions, He also, thanked the Commissioners and staff for their work on behalf of the Commission and said he was looking forward to working with everyone again next year, MATI'ERS FROM STAFF Mr, Kruckeberg distributed and reviewed a report of the number of cases processed by the Planning Department in 2006. He pointed out the impact of the Single Family Architectural Design Review process instituted in 2006, Commissioner Parrille asked. if the increase in population density is an issue of concern for the planning Commission. Mr, Kruckeberg said that compared to other multi-family zones in the region, .Arcadia's density is actually quite low and that the style of development experienced here is not lending itself to increased density. He also noted, however, that population density is always an issue.of consideration by staff in their review of project proposals.
