ARCADIA CITY PLANNING COMMISSION
Tuesday, October 10, 2006, 7:00 P.M.

,The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 10,
2006, at 7:00 p.m., in the Arcadia Council Chambers of the City of Arcadia, at 240 W.
Huntington Drive, with Chairman Olson presiding.

SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS
Community Development Administrator Jason Kruckeberg asked the Commissioners to
hear Agenda Items 1 and 2 in reverse order and the Commissioners agreed.
Mr. Kruckeberg also noted that Associate Planner Jim Kasarna had distributed a copy of
the first page of the staffreport for Agenda Item 2 which had been revised.

Kevin and Teresa Lustig have submitted an application for a 4'-6" westerly side yard
setback in lieu of 10'-0" required to allow a compatible continuation of the existing wall
line for the proposed one-story addition that is less than 30'-0" in length (proposed at 18'-
6").
There is a five working day appeal period. Appeals are to be filed by October 18.

The public hearing was opened.
There were no speakers; the applicants were present but el~ not to speak.

2. PUBUC HEARING MP~lO AND SF ADR NO. 06-50
1722 S. Sixth Avenue
James Jaquez, architect for Alex and Cathy Vasquez
James Jaquez has submitted an application for modifications to a proposed rebuild to add
. 2,135 square feet of living space including a second floor. The applicant requests
modifications from the northerly street side yard setback requirements (along Norman
Ave.) for the first and second floors; modifications. from the required 7'-9" southerly first
floor side yard setback requirement; modifications from the 35'-0" special setback along
Sixth Avenue 'for the first floor; and, ArchitecturaI Design Review of the proposed
project.
There is a five working day appeal period. Appeals are to be filed by October 18.
Commissioner Hsu verified with staff that his personal residence was not close enough to
the project site to require excusing himself from deliberations.
The staff report was presented by Associate Planner Jim Kasama.
The public hearing was opened.

James Jaquez, ~Plicant and architect on the project~esented the owners. He
briefly reviewed the setbacks in question and noted that the neighbors did not object to
the plan. He said that the variations in the setbacks were used to break up the lines of the
house and avoid the big bOxfeel. Mr. Jaquez stated that the applicant wanted to leave the
design as it is despite the staffrecommendation.
Commissioner Baderian asked Mr. Jaquez if he had met with staff to review requirements
while he was working on the design. Mr. Jaquez said that he had. However, he and the
owners proposed this particular design because it would allow more backyard space even
though it did not meet with staft's recommendations.
Commissioner Beranek noted that the bedrooms and bathrooms are very spacious and
suggested reducing their size to meet code requirements. Mr. Jaquez said that newer
homes haveJarger bedrooms and bathrooms and that those shown in the plans are not
unusual.

Commissioner Parrille noted that every time the Commission allows modifrcations to
setbacks they are, in effect, changing zoning requirements. He slated his support for
staff recommendations enforcing zoningregulations.
Commissioner Baderian asked if the Commission were to deny items l.b-e, would
architectural changes be necessary. He,a1so asked if these changes could be approved by
staff or if the applicant would have to submit the revised plans to the Commission for
approval. He asked if a forty-five day time frame was reasonable to accomplish the
redesign and approval of plans. Mr. Kruckeberg replied that forty-five days was
definitely enough time for staff to review revised plans but that he didn't know how much
time the applicant would need to revise the plans.
Commissioner Beranek noted that for the last ten to fifteen years, Arcadia residents have
expressed a desire for controls on the size of houses and to this end staff has worked to
revise the code. He said that the Commission's responsibility was to determine when the
code. should not be applied because of special circumstances. In this case, there doesn't
appear to be any special circumstances precluding application of the code.
Commissioner Hsu noted that these' situations are usually worked out between the
applicant and staff. He said that, sometimes, as in this'case, there are. reasons to scale
back the plans and support staffrecommendations. .

COmmiSSion!lon expressed support for staffrecoo!!ations and suggested that
staff should take responsibility for review of the redesigned project.
Commissioner Baderian suggested the motion include a provision that the applicant work
with staff to modifY the plans to meet city code requirements.
Commissioner Olson said that, if staff is satisfied with the revisions there would be no
need for the Commission to hear the case again. Commissioner Hsu pointed out that this
would be an ArchitecturaIDesign Review rather than a Modification.
Commissioner Parrille stated that the motion should direct staff and the applicant to
modify the design to staft's approval so that the Commission would not have to review
the project again.
MOTION:
It was moved by Commissioner Beranek, seconded by Commissioner Parrille, to deny
modification requests l.b-e and approve modification requests l.a, 2.a and b, and 3.a and
b, subject to the conditions in the staff report and subject to the condition that staff work
with the applicant to redesign the project under the approved modifications.

MATI'ERS FROM CITY COUNCIL AND PLANNING COMMISSION
Councilman Amundson said that the city will soon be the owner of Arcadia Storage and
will be the landlord for an undetermined length of time. He also said tbat the City
Council will soon begin a review of lighting districts within the city. The Council is
expecting a lot of input from residents since everyone Will be affected. Councilman

Amundson repo~that the Draft EIR for the Shops at ~ Anita is scheduled to be
available by October 20 or 23 and there will bea meeting at the end of the ,month of
November on the Draft EIR
MODIFICATION COMMITTEE MEETING ACTIONS
Chairman Olson reviewed the actions of the Modification Committee this morning.
MAnERS FROM STAFF
Mr. Kruckeberg said that the Planning Commission meeting of November 28 will be held
at the Community Center to accommodate the 400 to 500 attendees anticipated to hear
comments on the Draft EIR for the Caruso project.
CommissionerParrille asked if there is a time limit for speakers at the meeting and if
written commentary would be accepted. Mr. Kruckeberg said that a time limit was
advisable and could be set. Typically, the limit for speakers is three minutes and it would
be enfurced by the Commission. He also said that written comments will be accepted and
a reply prepared to all comments. These documents will be available for review by the
Commission.
Mr. Kruckeberg said that there are no agenda items presently scheduled for October 24
and none anticipated.
Chairman Olson said if there was no need to meet on October 24 the meeting would
adjoumto November 14;
