Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 23, 2007 at7:00 p,m.,in the Council Chambers of the City of Arcadia, at 240 W.Huntington Drive, with Chairman Baderian presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: ABSENT: Commissioners Beranek, Hsu, Parrille and Baderian Baerg MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Hsu to excuse Commissioner Baerg from tonight's meeting. " Commissioner Parrille said that his home on Sharon Road is in close proximity,to the proposed site of the project on Baldwin Avenue for CUP 07-11 and, therefore, he asked to be excused from hearing this item Chairman Baderian aske(hhe applicant if he had any objections to excusing Commissioner Parrille and the applicant said he did not, 1. PUBLIC HEARING CUP 07-11 1741 Baldwin Avenue Takao Chikudate The applicant has requested a Conditional Use Permit for operation of an after school tutoringprogramwjth a maxiinum number of 40 students in an existing church building, Associate Planner Tom Upresented the staff report. Commissioner Beranek asked Mr, Li if the fact that the program was operating without a Conditional Use Permit mentioned was the result of complaints. from residents, Mr, Li said that' there were no complaints, the violation was discovered by Code Services Officers. Commissioner Hsu asked if the applicant had ceased operation since they received notice of the code violation. Mr, Li replied that they have, The public hearing was opened, Mr, Neil Sheridan, owner of the property across from the proposed school since 1967, expressed concem about traffic safety enforcement particularly on Lemon Avenue. He said that both Baldwin and Lemon are high speed streets with no impediments to slow down traffic. He pointed ,out that children will be walking from the proposed school at dusk during heavy traffic hours and he expressed hope that the streets will have well marked school crossings and traffic lights or a flashing sign for school crossings, Chairman Baderian asked the applicant, Mr, Takao Chikudate, if.he understood and was willing to comply with the conditions of approval in the staffreport, Mr, Chikudatesaid that he will comply, MOTION: It was nlOved by Commissioner Beranek, seconded by Commissioner Hsu,to close the public hearing, Without objection the public hearing was closed. Commissioner Beranek noted that the,Commissioners are assuming there will be one car per student but the staff report says one car per three students and he asked Mr, Li to PC MIN1ITES 10-23-07 Page 2 explain this diaancy, Mr,.Li explained that the nler in the staff report is based on the parking requirements established in the Municipal Code, Chairman Baderian noted that the proposed business hours are limited to 2:30 pm to 6:00 pm on Tuesday and Friday only. Chairman Baderian asked Mr, Wray for his comments regarding crosswalks in the area. Mr. Wray said that Lemon is wider and carries more traffic than most residential streets yet, according to traffic studies, the volume luis' not reached the point where more traffic control is required. He said there isa crosswalk on Baldwin which is not hesvily used and therefore, does not require more traffic control. Further, Mr, Wray noted that the applicant does not anticipate children walking to and from school but rather being dropped off and picked up by parents. Commissioner Beranek asked what circumstances require the addition of a signal or sign, Mr, Wray explained that traffic volume, number of pedestrians, number of accidents, effect on the neighborhood and whether use of the street is to be encouraged are among the factors evaluated in determining the need for a traffic signal or sign and that the standards are set by the state, MOTION: It was moved by Commissioner Beranek, seconded by Commissioner HSu, to approve Conditional Use Permit 07-11 subject totheconditioDS in the staffreport ROLL CALL: AYES: NOES: ABSENT: ABSTAIN: Commissioners Beranek, Hsu and Baderian None Baerg Parille A Resolution reflecting the decision of the Planning Commission will be presented for adoption at the next Commission meeting, There is a five working day appeal period after the adoption of the Resolution. 1, PUBLIC HEARING'MP 07-06rrR 07-14/ADR 07-14 SOl S. Third Ave./222E, EI Dorado Ken Kunishima The applicant is requesting Modifications, Architectural Design Review and an Oak Tree Remov8I permit for a proposed 2-unit residential condominium project on an R-2 zoned property: A. 13'-0" to 15'-0" street side yard setback along EI Dorado Street in lieu of the required 25 ~ -0" minimum. B, An 11'-0" street side yard setback along EI Dorado Street in lieu of the required 25' -0" minimum setback for a .second floor balcony. The'public hearing was opened, Mr, Ken Kunishima., the architect on the project, complimented staff on their work on the project. He said that the o~.er origiI1ally intended to use one unit as her retirement home and the other for her son and hisfainily, They had hoped to remodel and enlarge the building but they came to realize that because of parking requirements it would be better to tear down the existing houses and rebuild with parking on the first floor and living area on the second floor, In addition, the very large oak tree on the property creates,a number of design problems and so they are asking for a pennit to remove it, Chairman Baderian asked Mr. Kunishima if he had seen the letter from the,consulting arborist. Mr. .Kunishima said that he had and he was shocked that the arborist was recommending the addition of seven oak trees in place of the one to be reIlloved, He said that he didn't know where they would all fit. Chairman Baderian askedifMr, Kunishima found the compromise in the staffreport recommendations acceptable and he said he did, MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Parrille, to close the public hearing, Without objection the public hearing was closed, Chairman Baderian noted that staff is asking for only three trees to be planted in the staff report. Mr. Kruckeberg explained that the applicant is asking for permission to remove a very large oak tree but that there was no way to develop the site around it. AND PLANNING COMMISSION Councilman Amundson reported that the City Council is studying traffic issues and the proposed design for the, new city hall, Commissioner Beranekasked if joint City Council and Plaiming Commission meetings had ever been held in the city, Chairman Baderian said that joint meetings had been held a few years ago, Councilman Amtindsonsaid he thought this was a good idea and he suggested a study session, Chairman Baderiansuggested revisiting the issue after elections, MODIFICATION COMMITTEE MEETING ACTIONS CommissionerParrille said there was no Modification Committee meeting today, FURTHER MAnERS FROM STAFF Mr, Kruckeberg reminded the Commissioners of the special meeting on Tuesday, OctobedO, Resaid the Commissioners will meet at 4:00,pm for a tour, of the city followed by dinner in the Council Chambers and a discussion of the design review process and the effects it has had on what they have seen on their tour, Pc.MINUJ'ES 10-23-07 Pogo 6 .~ ',; . .
