The Planning Commission of the City of Arcadia met in regular session on Tuesday, September
25, at 7:00 p.m" in the Arcadia Council Chambers of the City of Arcadia, at 240 W. Huntington
Drive, with CbairmanPro Tem Beranek presiding,

Without objection the public hearing was closed.

It was moved by Commissioner Hsu, seconded by Commissioner ParriUe, to approve
Tentative Parcel Map 07-03, subject to the conditions in the staff report.

The applicant has submitted an application for a proposed tentative parcel map for a
three-unit residential condominium.
Associate Planner Tom Li presented the staff report,
Commissioner Parrille asked what the minimum building,size was in the R-3 zone and
Mr. Li said it is based on the number of bedrooms and ranges from 800 square feet to
BOO square feet fora two to three bedroom unit. Mr. Li further noted that there is no
maximum size. ., .
The public hearing was opened.
Alice Soo, representing the applicant, said that the applicant is willing to comply with all
conditions of approval.
MOTION:
It was moved by Commissioner Baerg, seconded by Commissioner Hsu, to close the
public hearing.

Commissioner Parrilleasked if the Arcadia School District had been notified of the
project since it is directly across the street from First Avenue Middle Schooi and if~
had voiced any objections.
Mr. Li said that the School District had been notified and there were no objections.

The staff report was presented by Assistant Planner Steven Lee, AdditionaIpictures of
the site were distributed to the Commissioners,
The public hearing was opened.
Mr. Peter Chao. the applicant, said that he has been a resident of the city for over eight
years and pur~hased his home this year, He said that when he was notified that the
yellow paint on his house was a code violation, he repainted to a lighter shade. At that
time, Mr, Chao said his wife, Phoebe, took paint samples of the red trim to Planning
Services to obtain approval of the color and she was told that it was acceptable. Mr.
Chao showed the Commissioners pictures of other houses in the area with unusual color
schemes and ,further stated that he had three pages of signatures from neighbors stating
that they approved of the color scheme of his house. He said that he feels Planning
Services is not being fair to him. he does not want to repaint his house,and he feels that
his rights as a citizen are being violated.
Mrs. Phoebe Chao said she chose red ,for the trim on the house because a famous Feng
Shui master told 'her that surrounding herself with the color red would insure good luck.
She ,further stated that she was assured by Planning Services that if the yellow was

changed to aller shade the rest would beacceptable.s, Chao said there are many
houses in thfl city that do not conform to the code, In fact, some paint their entire garage
red.
There were no other spe8kers on this item.
MOTION:
It was moved ,by Commissioner Parrille, seconded by Commissioner Hsu, to close the
public hearing,
Without objection the public hearing was closed.
Commissioner Baerg said that he drives by this house at least once a week and he agrees
that the color scheme is not compatible with the neighborhood, nor does it meet design
guidelines, particularly the red arches and garage door which give the house a fast food
restaurant appearance. He asked if a compromise. allowing the red front door and
eliminating the red arches and garage door, would be appropriate,
Mr. Kruckeberg explained that the Commission can make any determination they think
best including a compromise.
Commissioner Parrille noted that there are regulations regarding color of paint andthat
the Commission should be consistent in their decisions.
Commissioner Hsu said that he would consider a compromise, perhaps leaving the front
door,red and repainting the other red accents' a more subdued color.
Commissioner Beranek stated that the house is not,in harmony with the neighborhood,
CommissionerParriIle asked what options the applicant has if the Commission denies
their appeal,
Mr. Kruckeberg said that this is the first appeal of a design case to come before the
Commission. He pointed out that the Commission can deny the application with
direction to the applicant as to how to meet the requirements or the Commission can
flatly deny the application in which case the applicant can appeal to the City Councilor
work with staff to find an acceptable color, He noted that in the past, staff has always
tried to work with the applicant to reach a satisfactory conclusion. '
MOTION:
It was moved by Commissioner Bernaek, seconded by Commissioner ParriIle, to deny
Administrative Single Family Architectural Design Review 07-22.

CONSENT ITEMS
4. MINUTES OF AUGUST 14, 2007, AND AUGUST 28, 2007
RECOMMENDATION: Approve
Commissioner Beranek asked if there were any corrections to the minutes, There being no
corrections, Commissioner Beranek called for a roll call to approve the minutes of August
14 and August 28 as submitted

MAnERS FROM CITY COUNCIL AND PLANNING COMMISSION
Councilman Amundson reported that the City Councilis working on the Parks and
Recreation Master Plan and the lighting district project. They are also working to resolve
issues at Eisenhower Park where residents report that outside groups have taken over the
park and they have asked for City Council assistance inredalming it.
Commissioner Beranek noted that the Harvest Moon celebration last week created
parking cOngestion on First Avenue. Mr. Kruckeberg said that a shuttle service was
available for attendees to help alleviate the parking problem and attendees were
encouraged to use it Councilman Amundson agreed to advise the City Council oftbe
situation,
Commissioner Parrille said there was a ,car club meeting in the parking lot at Vons
Pavilions last Saturday night and he noticed that the Police were there. He asked if the
City Council was aware of this event Councilman Amundson said that they were not
aware of it and that he would initiate an inquiry.
MonlFicATION COMMITrEE MEETING ACTIONS
Commissioner Parrille reported that MC 07-28 and SFADR 07-45 were approved by the
Modification Committee allowing certain setbacks for a patio cover.
FURTHER MATI'ERS FROM STAFF
Mr. Kruckeberg distributed pictures of various cell tower options. He noted that the city
has approval authority as loog as the proposed site is 00 privately owned property.
Councilman Amundson asked if the city can.require'the applicants to share cell towers.
Mr. Kruckeberg said that providers are encoUraged to collOcate whenever possible.

Conunissioner ParriIle asked if there is a possibility that eventually a ceIl tower project
might be denied based on the excessive number of cell towers in the city.
Mr, Kruckeberg said that the proliferation of poles mayor may not be a basis for
regulation. He reminded the Commissioners that although they have the right to deny a
project and their decision could be challenged that might be the most effective method of
regulating the issue ona particular project
Mr. Kruckeberg reminded the Commissioners of their city tour on October 30 and told
them that an RFP for the General Plan update project will be released Thursday. He also
mentioned that there is a General Plan Seminar at UCLA the end ofJanuary. He said that
the appeal of the Nobel Institute project and continued hearing of the LA Fitness project
will be heard by the City Council on October 2.
