Arcadia City Council Chambers COnference Room The Planiling Commission of the City of Arcadia met in a special session on Tuesday, February 27, at 6:00 p.m, in the Arcadia Council Chambers Conference Room of the City of Arcadia, at 240 W. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON-PUBLIC HEARING MA TIERS - Five-minute time limit per person None PUBLIC HEARING ITEMS Commissioner Parrille abstained from hearing Item 1, CUP 07~01, because he is on the Board of Directors of Stars, a competing gymnastics organization. Chairman Olson agreed and noted that since four members of the Commission would be present; there would sti11 be a quorum. !J . . . I. PUBLIC HEARING CUP 07-01 West Coast Elite Gynmastics (proposed tenant) 900 S. Santa Anita Ave. West Coast Elite Gyumastics has submitted an application for a Conditional Use Permit to convert a 15,000 square foot warehouse into a gynmastics training facility with a maximum of 36 gymnasts at anyone time. The staff report was presented by Associate Planner Tom Li. Commissioner Baderian asked if there would be enough parking to accommodate spectators when competitions are held Mr, Li said.the parking code does not cover this situation but Mr. Y.ruckeberg pointed out Condition No.5 limiting the number of competitions to four per year. The public hearing was opened. The applicant, George Yu, 900 South Santa Anita Avenue, explained that the instructor to student ratio was quite low and that if they want to add more students in the future they would apply for anew permit. Commissioner Baderian asked Mr, Yu ifhe had read and .lD1derstood the conditions of approval. Mr. Yu replied that he had and that they are willing to comply with any conditions that the city makes. MOTION: It was moved by Commissioner, Baderian, secollded by Commissioner Hsu, to close the public hearing. Without objection the public hearing was closed. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Beranek, to approve Conditional Use Permit 07-01 as recommended by staff, subject to the conditions in the staff report. AYES: NOES: ABSTAIN: Commissioners Baderian, Beranek, Hsu, and Olson None Commissioner Pani1le Chairman Olson noted that the appeal period would begin after the adoption of the Resolution. The Resolution will be provided.at the next Planning Commission meeting. PC MINlITES urT~7 Page 2 . . . 2. PUBUCHEARlNG CUP 07-02 Michael Yu (Yuzu Fusion Bistro) 651 W. Duarte Road, #C Michael Yu bas submitted an application for a Conditional Use Permit for a 1,102 square foot restaurant with seating for 33 people. The Staff Report was presented by Assistant Planner Steven Lee. The public hearing was opened. Michael Yo, the applicant, said he IIDderstood staft's concern about the limited parking . . and he presented a parking study that he had compiled. He.said that his parking study showed that there are always parking spaces available. He also said that representatives from the neighboring medical building had agreed to provide an additional twenty spaces for use by Yuzu customers and that employee parking off-site would be strictly enforced. He felt these steps provided a solution to the parking situation. Commissioner Baderian asked Mr. Yu ifhe was the original owner of the business. Mr. Yu said that he was. Commissioner Baderian asked him ifhe was advised by staff when he first opened the business that because of limited parking the restaurant wouid be limited to take out, Mr. Yu replied that he had been.advised. Commissioner Hsu asked about the type of agreement Mr. Yu had with the Medical building owners and he said that it was a verbal agreement but that he expected to formalize the agreement if his application was approved. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Hsu, to close the public hearing. Without objection the public hearing was closed, Commissioner ParriUe stated that the area involved is currently overwhelmed with insufficient parking and the caiter strip of Duarte Road is always backed up by cars turning into the shopping center. CommissionerHsu also said there is a gross lack of parking in the whole area and that the crosswalk is becoming hazardouS. MOTION: It was moved by Commissioner Baderian, seconded by Commissioner Hsu, to deny Conditional Use. Permit 07-02. MATTERS FROM CITY COUNCIL AND PLANNING COMMISSION Mr. Kruckeberg said that the Caruso hearings would be held on March 19 and again on March 21 ifnecessmy. He asked the Commissioners if they wanted to meet before the March 19 Caruso hearing or on March 13 to conduct other business. They agreed to meet on March 13 at their regularly scheduled time. MODIFICATION COMMITfEE MEETING ACTIONS Chairman Olson said that all four items on the Modification Committee agenda were approved. It has been cited fur numerous building, health and welfare, and fire safety violations. Please refer to the enclosed letter of October 20, 1995, from RDy E. Streeter, then Inspection Services Manager for the City of Arcadia, to Isabella NichoJs. owner of the property; and the Memorandum of September 26, 1995, from Roy Streeter to Laura Chafe, Fire Inspector. Most of these issues remain unresolved and the repairs unmade. To lease this building out fur use by children should require that their health and safety be guaranteed to the greatest extent possible. Please make sure that either Isabella Nichols as the owner, Steve Nichols as the person mal"iging the.property, or Nichols Egg Ranch as the tenant that caused many of these problems to beginwitb, bring the building up to Code and make all necessary repairs prior to leasing it out - especially where the welfare of chiIdrenis concerned. I. Proper access and clearance to electrical service panel and sub-panels blocked by equipment and storage. 2. Many open electrical boxes, open knockouts and some broken, disjointed and abandoned conduits within the building. 3. Non-metallic cable (Romex) being used as extension cords supplying power for the maintenance repair of coolers. , 4. Storage of a vehicle in a B-2 occupancy. 5_ Open battery storage. 6. Storage atop the coolers along the south wall (these coolers are not designed to support storage). 7. StQrage racks norproperlysecured for seismic activity. 8. Electrical conduit supplying power to the air compressor not properly secured to the walL 9. Condensate lines from cooler equipment penetrating the building's southern exterior fire-rated wall and extended across southern property line and routed on the ground to the front of building. , . 10. Water supplying landscaping is directly connected to the potable water system without backt10w prevention. II. Open plumbing vent in the women's toilet room. 12. Arc and Gas welding being conducted in a B-2 occupancy. 13. Break room COnstnlcted without approval or permits. 14_ 20 foot x 40 foot second story office constructed without approval or permits.. 15. Installation ofitems number 13 and 14 violate California State Title-24 laws, which require that, handicapped ~ilet facilities be provided for both sexes. ~ '~ . . . - . . 16. Subsequent review of the files indicate the following: 16.1 No electrical or mechanical pennits for the installation of cooler equipment. 16.2 No penn it or Fire Depanment approval for the installation of a propane tank at the exterior of the building. 16.2 ~o electrical or mechanical pennits for the installation of air conditioning equipment located on the roof of the building. 16.3 No electrical or mechanical pennit for the installation of an air compressor. 17. Business is in violation of Resolution 1021 which grants a zone variance for the sale of eggs and uses incidental to the sale of eggs and general storage. The original drawinllS for the buildimt fronted on Santa Anita Avenue. indicate that an ~ - - . underground fuel tank was to be installed on the north side of the building. There is no record in our files to indicate the installation or removal of this tank. Some of the above listed violations are very serious and pose health and safety problems for the employees and general public (open plumbing vents, unsafe electrical wiring and fire hazards due to the storage of a vehicle and motor parts and the operation of arc and gas welding). Vehicle storage (a B-1 occupancy) and welding (an H-4 occupancy) require one-hour occupancy separations and additional requirements for ventilation. Now that the City is aware of these violations. immediate action must he taken to have them abated.
