Huntington Drive, with Chairman Pro Tempore Parrille presiding. FORMATION OF A CITY-WIDE LIGHTING DISTRICT Arcadia, City Public Works Services Department Deputy Public Works Services Director Tom Tait presented an overview of the proposed City-Wide Lighting DiStrict and the current status of the project Chairman Pro Tempore Parrille thanked Mr. Tait for the information. PUBLIC BEARINGS 2. CONDmONAL USE PERMIT NO. CUP 08-08 288 East.LiveOak Avenue Sam Ahn (Property Owner) The applicant is requesting a Conditional Use Permit with a parking modification to allow three (3) eating establishments andlor restaurants with a combined total,t1oor space of 4,427 square-feet, and a combined maximum of 124 seats within the existing 5,934 square-foot commercial building adjacent to the north side of the Albertson's supermarket Assistant Planner Jennifer Turcios presented the staff report. Commissioner Baerg noted that the traffic study was conducted on the nights of June 13 and 14 and Ms. Turcios confirmed this. The public hearing was opened. Mr. nm Dorr, the architect on the project, representing the applicant, offered to answer the Commissioners' qu~stions: Commissioner, Hsu asked who the prospective tenants of the building are. Mr. Dorr said that Subway will lease one unit and the Other two units are currently uncommitted. Commisllioner Hsu asked if the applicant was aware that the sale of alcohol is prohibited at the site. Mr. Dorr confirmed that the applicant is aware of this,as well as all other conditions of approval, and that.he is willing to comply. PC MINUTES 9-23-08 Page 2 , i . . MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Baerg to close the public hearing, Without objection the public hearing was closed. Commissioner Baerg said that he was not persuaded that the parking is adequate since there is a deficit of 62 spaces. He noted that parking has always been a problem at the subject portion of the site, Commissioner Hsu asked if approval of this application will cover any prospective tenants as well as the Subway and Ms, Turcios confirmed that it would. MOTION: It was moved by Commissioner Hsu, seconded by Chairman Pro Tempore Parrille, to approve Conditional Use Permit No. CUP 08-08 subject to the conditions of approval in the staff report. ROLL CALL: AYES: NOES: ABSENT: CommissionersHsu,and Parrille Commissioner Baerg Commissioners Baderian and Beranek A Resolution,reflectingthe decision of the Planning Commission will be presented for adoption at the next Commission meeting. There isa,five working day appeal period after the adoption of the Resolution. 3. CONDITIONAL USE PERMIT NO. CUP 08-12 21 Morlan Place Rusnak Mercedes-Benz (Lessee) The applicant is requesting a Conditional Use Permit to allow vehicle storage lIIld parking associated with Rusnak Mercedes-Benz. The operations of the existing church will not be altered, RESOLUTION NO. 1780 A Reso]ution of the Planning Commission of the City of Arcadia, California, approving Conditional Use Permit No. CUP 08-] 2 for vehicle storage and parking associated with Rusnak Mercedes-Benz at 2] Morlan Place. Mr. Kasamapresented the staffreport. The public hearing was opened. PC MINUTES 9-~8 Page 3 . . \, Commissioner Hsu noted that the new church location on Live Oak Avenue will not be ready for quite some time and he asked what options the church has if Rusnak does not remove cars when requested, as agreed. Mr. Kruckeberg'advised that when the church's special events require it, the agreement states that advance notification to the city woUld instigate negotiations with Rusnak to make the necessary arrangements. Chairman Pro TemporePanille asked for confirmation that no auto repair would be conducted on this property and Mr,Kruckeberg assured him that only auto storage would be permitted, and that auto repair is not allowed. Mr. Brian Beatt representing Rusnak offered to answer questions. He said that Rusnak has entered into this type of arrangement at other locations and will comply with all conditions of approval. ' Chairman Pro Tempore Parrilleasked if anyone wished to speak in opposition to this project. There were none. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Baerg to close the public hearing. Without objection the public hearing was closed. CONSENT ITEMS 4. DETERMINATION OFUSE AND GENERAL PLAN CONSISTENCY 37W, HUntington Drive Arcadia,Self Storage The proposal iSlO utilize the self-storage building and property located at 37W. Huntington Drive (Arcadia Self Storage) for the storage of auto parts for Rusnak Mercedes-Beoz and to have an office and vehicle storage for an automobile rental company, PC MINUTES , 9-23-ll8 Page 4 1/ . Mr. Kasama presented the staffreport . Chairman Pro Tempore Panille noted that he rents two units in this storage building but that since he would derive no benefit from this proposal, he doesn't believe this presents a conflict of interest, The Commission voiced no objection to ChainnanPro Tempore ParriUe's participation on, this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Baerg, to find and determine that the uses are compatible and in conformance with General Plan. DETERMINATION OF GENERAL PLAN CONSISTENCY NO. 08-01 To determine if the disposition of Winnie Way Park for residential use is consistent with the City's General plan. Senior Planner Lisa Flores presented the staff report. Chairman Pro TemporeParrille asked if there are other parks for use by pet owners ,and Ms, Floresepointed outthatthere is a dog park area at Eisenho",er Park Mr. Kruckeberg explained that the 2,300 square-foot property known as Winnie Way Park Is owned by the City because the owner had failed to pay taxes. The city provides landscaping and maintenance. When the applicant expressed interest in purchasing the property, staff checked with Public Works and Parks aild Recreation to see if there were any objections, and there were none. Benson Tse, the applicant, stated that he wishes to purchase the lot and combine it with the adjacent lot,to the north and then subdivide into two lots to build two single family residences; one facing Camino Reai and the other faeingWinnie Way, Chairman Pro Tempore Panille, stated that the park appears to be used frequently by residents and that he sees definite benefits to the city to retaining this area for public use, MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Baerg, to find and determine that the disposition ofWmnie Way Park for residential use.is consistent with the General Plan. RESOLUTION NO. 1777 A Resolution of the Planning Commission of the City of Arcadia, California, denying Conditional Use Permit Application No, CUP 08-10 to reViSe a previously approved Conditional Use Permit (CUP 06-16/City Council Resolution No, 6593 and Planning Commission Resolution No, 1768) for a badminton club and corresponding Parking Modification at 12336 Lower Azusa Road, MOTION: It was moved by Commissioner Baerg, seconded by Commissioner Hsu, to adopt Resolution No. 1777. AND PLANNING COMMISSION Councilman Kovacic reported that the City Council approved the text amendments that were presented at the last Planning Commission meeting excluding the one on parking which was sent back to staff for revision. He,said that the Council decided noHo enter into an ,agreement with KARE Youth League-regarding the purchase ,ofa portion, of the Arcadia PAR 3 Golf Course. The Council voted to support the display of holiday decorations in the downtown PC MINUIl!S 9-~8 Page 6 . . area. Councilman Kovacic reminded the Commissioners that tomorrow is opening day for the Oak Tree meet and that this Saturday the Fire Department will host an open house at their headquarters fire station. He said that on Sunday there will bea block party on,his block and that the city has a protocol for this type of activity. He noted that this is a good way to get to know your neighbors. On Monday, September 29, the Superior Court will hear the Caruso EIRcase, on October 4 the water district will hold it's annual Water Fest at the County Park, and the Breeder's Cup will take place on October 24 and 25. MODIFICATION COMMITTEE MEETING ACTIONS Chairman Pro Tempore l'arrille reported that all three items on the agenda this morning were approved, as were the two items on the September 9 agenda.
