The Planning Commission of the City of Arcadia met in regular session on Tuesday, May 27,
2008 at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive,
with Chairman Baderian presiding.

It was moved by Commissioner Parrille, to read the Resolution by title only and waive
reading the full text of the Resolution. The motion passed by voice vote with none
dissenting.

1. PUBLIC HEARING - CONDmONAL USE PERMIT 08-03

The applicant is requesting a revision to an existing Conditional Use Permit
(CUP 05-11) with a parlring modification to convert.an approximately 500
square,.foot storage room of an existing dance studio into an office use.

The hours of operation will be Monday through Friday, from 5:00 a.m. to
3:00 p.m.
The staff report was presented by Associate Planner Tom Li.
Chairman Baderian asked if the dance studio and on-line trading businesses were related
in any way. Mr. Li said they were not He explained that the on-line trading business
would not be open to the public and that there was only one tenant and a few friends who
would occupy the space.
, Commissioner Parille asked how many work stations would be installed. Mr. Li said there
would be three to four work stations.
Commissioner Baerg asked Mr. Li. to explain wliy the Planning Commission is involved in
this case. Mr.Li said that although office use is permitted in the zone, a Conditional Use
Permit had been granted to use this space as a dance studio in 2005. Therefore, the
Conditional Use Permit must be modified to allow a portion of this space to be used as an
office.
Public hearing was opened by Chairman Baderian.
Mr. Russell Smith, the applicant, said that he and two to three friends will use this space to
trade on their own accounts with the same broker/dealer. He explained that there would be
no customer traffic. Mr. Smith said they usually begin their day around 4:30 or 5:00 8.rn.
and leave by 2:30 p.rn.
Chairman Baderian asked. Mr. Smith if he had read the staff report and if they would be
able to comply with all the conditions. Mr. Smith said they had no objection to the
conditions of approval and would comply.
No one spoke in opposition.
MOTION:
It was moved by Commissioner Beranek, seconded by Commissioner Parrille to close the
public hearing.
Without objection the public hearing was closed.
MOTION:
It was moved by Commissioner Hsu, seconded by Commissioner Beranek, to approve
Conditional Use Permit No. 08-03 subject to the conditions in the staff report, and to
direct staff to prepare a Resolution for adoption at the next Commission meeting.

2. PUBLIC BEARING - ZONE CHANGE 08-01 AND
TEXT AMENDMENT 08-01

City of Arcadia
The City is proposing Zone Change No. ZC 08-01 to change the zoning of the
City-owned subject properties from "Unzoned" to "S-2 Public Purpose Zone" with an
"H8 Special Height" overlay zoning on the Methodist Hospital site.
The City is also proposing Text Amendment No. TA 08-01 for the following
changes to Chapter 2 of Article IX (Zoning Regulations) of the Arcadia Municipal
Code:
1. Add to Section 9274.1.1 under Uses Permitted in the S-2 Public Purpose Zone:
"Hospitals, non-profit or for profit"
2. Amend Section 9276.2.2 under Height Limit in the HSpecial Height Regulations
to change Zone H8 as foUows: "Eight (8) stories or ~ ninety-five (95) feet."
3. Add to Section 9276.2.6 under Regulations for the H Special Height Regulations:
"ACCESSORY ROOFI'OP ITEMS. An additionol ten (10) feetis allowedfor
architecturalfeatures, chimneys and vents, equipment, and other rooftpp stnlctures.

adequately screened ..
These zone changes and text amendments are limited to the application of a zoning
designation to the City-owned properties and adjustments to the zoning regulations
so that the existing improvements and the'currenthospital expansion will be in
conformance with the new zoning. No new projects are enabled by these
zone changes and text amendments.
The staff report was presented by Community Development Administrator Jim Kasama.
Commissioner Beranek asked why it is necessary to define the zoning at these sites at
this time since the use is not changing. Mr.I<a....ma explained that current planning and
zoning laws require zoning designations as the public has a right to know what the
approved uses of a particular property are. He pointed out that the rear portion of the
Police Department is zoned S-2.
Chairman Baderian asked if the Chamber of Commerce and Red Cross had been notified
and Mr. Ka""ma said they had.

Without objection the public hearing was closed.

recommend approval of Zone Change 08-01 and Text Amendment 08-01.

CONSENT ITEMS
3. RESOLUTION 1771
A Resolution of the Planning Commission of the City of Arcadia, California,
granting Conditional Use Permit No. CUP 08-02 to operate a convenience store
twenty-four (24) hours a day, seven (7) days a week with the sale of alcoholic
beverages for off-premises consumption at 5 West Live Oak Avenue.

It was moved by Commissioner Parrille, seconded by Commissioner Hsu to adopt
Resolution 1771.

MATIERS FROM CITY COUNCll.. AND PLANNING COMMISSION
Councilman Kovacic reported that budget discussions dominated the last Council
meeting. He said that City Manager Don Penman asked staff to reduce the proposed
budget with spending cuts or revenue enhancements to avoid reliance on'reserve funds.
Councilman Kovacic said that the Council continued discussions on the Par 3 Golf
Course and KARE Youth League's continuing'interest in buying 8' portion of the Golf
CourSe. He further noted that the Council is still working on resolving the cell tower
policy issue. Lastly, Councilman Kovacic noted the passing of Charles Gilb, a prominent
citizen of Arcadia who served four terms as mayor and who, along with his wife, Ruth,
was the driving force behind several important municipal projects including the City's
historical museum.
Commissioner Beranek reported on the League of California Cities conference that he
attended in Sacramento. He said that he enjoyed the conference and felt that he learned a
lot. He noted that neXt year the conference will be in Anaheim. He also reported that he
attended a UCLA Extension cOurse on General Plans and found it to be mostly
informative.
Chairman Baderian said that he felt the General Plan interviews were very productive and
the consultant did a good job. He said that some cities are very concerned about water
supply and they are requiring applicants for new projects to show that there is enough
water to supply the new sites,
MODIFICA nON COMMlTIEE.MEE.TING ACTIONS
Mr. Kasama said there were two cases approved atthe Modification.Committee meeting.
Commissioner Parrille said that he will not be available to attend the next Modification
Committee meeting on June 10 and Commissioner Beranek agreed to attend in his place.
FURTHER MATIERS FROM STAFF
Mr. Kasama distributed a list of project updates for review by the Planning Commission.
He also said that the Cal-Poly Planning class won an academic award for the project they
presented to the City.
