Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, February 26, 2008 at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive, with Chairman Baderian presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: ABSENT: Commissioners Baerg, Beranek, Hsu, and Baderian Commissioner Panille MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Hsu, to excuse Commissioner Panille from tonight's meeting. The motion passed by voice vote with none dissenting. OTHERS A TIENDING City Councilman Peter Amundson Development Services Director Jason Kruckeberg Assistant Planner Steven Lee Administrative Assistant Billie Tone SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON-PUBLIC BEARING MA TIERS - Five-minute time limit per person Mr, Vince Vargas requested the assistance of the Planning Commission in prevelrting the construction of a new cell tower at Orange Grove Park. He reminded the Commissioners that at the October 9, 2007 Planning Commission meeting, a proposed cell tower at the same site met with opposition from homeowners, the. Homeowner's Association and Architectural Design Review Board and there was a petition with over 240 signatures submitted by residents in opposition to the project. The project was detlied, Mr. Vargas said that now the project has resurfaced with the tower to be placed in the public right-of- way, but for all intents and purposes it will be on private property directly behind the owner's. home. An application has been submitted to the Public Works Department. He said the city should consider the wishes of the homeowners. On October 9,2007, Mr. Vargas noted that he presented evidence that other cities have been successful in pre~enting ~ .of application and he restated his reqA for Planning Commission asSistance With Issue. .. Chainnan Baderian suggested that Mr. Kruckeberg respond to Mr. Vargas with the status of this project. Mr. Kruckeberg said that Mr. Vargas is correct in his presentation off acts: He said that utilities have the right to apply for projects within the public right-of-way but that staff has more control over the project aesthetically if it is on city property or private property. The process for this type ofapplication includes review by various city departments including Development Services and ultimately the city manager makes the final determination. He also reminded the Commission that the possibility this tower could be proposed in the right-of-way was raised on the public record as part of the hearing. Chairman Baderian asked Mr. Kruckeberg to apprise the Commission of the status as this project progresses. 1. PUBLIC HEARING - TENTATIVE PARCEL MAP NO. 07-01 35 and 35'12 Lucille Street Rich Shen and Su Chin Lin Shen (Property Owners) The applicant is requesting approval of a tentative parcel map for two residential condominiums. Associate Planner Steven Lee presented the staff report. The public hearing was opened. There were no. speakers. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Beranek to close the public hearing. Without objection the public hearing was closed. MOTION: It was moved by Commissioner Beranek, seconded by Commissioner Hsu, to approve Tentative Parcel Map No. 07-01 subject to the conditions in the staff report. AND PLANNING COMMISSION Councilman Admundson reported that the court date on the lawsuit filed by Westfield against Caruso is April 17, there will be a ribbon cutting ceremony on March 4 for the affordable housing project on AIta Street and the Mayor's Community Breakfast will be held on April 11 at the Community Center. MODIFICATION COMMITTEE MEETING ACTIONS Mr. Kruckeberg reported that both the items on the Modification Committee agenda were approved. FURTHER MATIERS FROM STAFF Mr. Kruckeberg reviewed the handout on CEQA that was provided to each Commissioner particularly the flowchart showing the steps required for staff to comply with CEQA regulations. Mr. Kruckeberg reported that the Council will consider the method of implementation of the new parkS fees which were approved in January and will be effective on March 14.
