The Planning Commission of the City of Arcadia met in regular session on Tuesday, February
12,2008 at 7:00 p;m., in the Council Chambers.ofthe City of Arcadia, at 240 W. Huntington
Drive, with Vice Chairman Beranek presiding.

MOTION:
It was moved by Commissioner Parrille, to read the Resolution by title only and waive

The applicant is requesting approval of a Tentative Map for an eight-unit residential
condominium subdivision.
Associate Planner Tom Li presented the staff report.
The public hearing was opened.
There were no. speakers.
MOTION:
It was moved by Commissioner Hsu, seconded by Commissioner Parrille to close the
public hearing.
Without objection the public hearing was closed.
Commissioner Parrille noted that the project is consistent with the General Plan and is a
reasonable use of the property.
MOTION:
It was moved by Commissioner Hsu, seconded by Commissioner Baerg, to approve
Tentative Map No. 70231 subject to the conditions in the staff report.

MODIFICATION APPLICATION NO. MP 07-09

The applicant is requesting a modification for a 20' -0" northerly street side yard setback
in lieu of the 35'-0" special setback for a proposed rebuild that would add 1,629 sq. ft. of
living space, a 660 sq. ft. basement, and a detached 713 sq. ft. garage to the previously
existing 2,563 sq. ft. single-stOl)' residence.

Note: The proted plans have b~n ap~rOVed by the sJIt Anita Oaks Architectural
Review Board. The applicant has revised the plans to comply with all the changes
requested by the Homeowners' Association.
Associate Planner Tom Li presented the staff report.
Commissioner Parrille asked if there had been any comments or objections from
neighbors.
Mr. Li said that he hadn'treceived any.
The public hearing was opened.
Mr. James Allen said that he is in partnership with the applicant, Mr. Kenny Tran. Mr.
Allen said that they addressed all the issues raised in the December 11 meeting and hope
for approval now.
There were no speakers in opposition to the project.

It was moved by Commissioner Parrille, seconded by Commissioner Hsu to close the
public hearing.
Without objection the public bearing was closed.
Commissioner Hsu noted that he was glad to see that the applicant and Homeowner's
Association worked together toward a solution and that he can now support this project.

Modification Application No. MP 07-09 subject to the conditions in the staffreport.

The applicant iLng the Hi~and ~ome Owners' aciation's Architectural
Review Board's denial to legalize an existing 382 sq. ft. wood deck in the front yard, and
the following three Modifications:
1. A 4'-6" front yard setback in lieu of the minimum 25'-0" required to maintain the
existing deck;
2. A zero southerly side yard setback in lieu of the minimum 8'-f/"required to maintain
the existing deck;
3. A 6' -0" separation between the existing deck and the main dwelling in lieu of the
required 10'-0" minimum.
Assistant Planner Steven Lee presented the staff report.
The public hearing was opened.
The applicant, Mr. Andrew Berkun, stated that removal of the deck would create an
unreasonable hardship for him and his family because the demolition would bea safety
hazard to his children. He also said that he felt that the exposed hill would be subject to
erosion. Mr. Berkun pointed out that he found fire retardant paint for the deck. He said
that his family has lived in the house for six years and the deck has been there much
longer. He further stated that there'is no evidence that a permit was not granted on.the
deck when it was frrst built. Mr. Berkun asked for a five year timeframe should he be
required to remove the deck.
The following did not provide their full names but spoke in favor of the appeaL
Ms. Joyce, a neighbor, said that her children play with the Berkun children and they
enjoy the deck. She said that removal of the deck presents a safety hazard.
Mr. Lee, another neighbor, spoke through Ms. Joyce who served as interpreter, Mr.Lee
said his two granddaughters also play at the Berkun house and he agrees that removal of
the deck presents a safety hazard.
The following spoke in opposition to the appeal.
Mr. Phil Consiglio, President oftbe Highland Homeowners' Association, said that the
Association reviewed the deck and felt that it is both a safety and fire hazard, it is not
consistent with the architecture.in the area, it violates too many ordinances and that the
hill is eroding beneath the deck. For these reasons, Mr. Consiglio, representing the
Homeowners' Association, recommends denial of the application. In the interests of
safety for the children who play there, Mr. Consiglio suggests a fence.
Commissioner Hsu asked if the Architectural Review Board reviewed the applicant's
response to their findings. Mr. Consiglio said that they haO but they found the solutions
they suggested to be inadequate. He suggested that if the applicant wants a deck he
should build one that meets city requirements.

Commissioner Baerg noted that the deck was built about fourteen years ago lending it some
legitimacy. He felt that approval of the deck wouldn't set a precedent because it is unique
to the property.
Commissioner Parrille pointed out that this is a difficult sitUation because the deck
probably can't be modified to meet standards.
Commissioner Hsu said that he visited the site and saw that code. requirements are not met.
He said he feels the deck is dangerous. and unsightly and should be bought up to rode or
tom down as recommended by the Homeowner's Association.
Vice Chairman Beranek said that feels that, except in the case of extreme mitigating
circumstances, the recommendations of the Homeowners' Associations should be
supported.
MOTION:
It was moved by Commissioner Beranek, seconded by Commissioner Hsu, to deny
Modification Application No. MP 07~11.
Commissioner Hsu asked for a recommendation from staff on the deadline for demolition
of the deck.
Mr. Kruckeberg said that itis reasonable to allow 30 to 60 days and this timeframe is
enforced through Code Services. He added that the timeframe selected was the choice of
the Commission.

demolition. Chairman Beranek confirmed that staffwill determine and enforce the

MODIFICATION COMMITI'EE MEETING AcnONS

Commissioner ParriIle reported that there was one item on the Modification Committee
agenda and it was continued to February 26, 2008.
FURTHER MATI'ERS FROM STAFF
Mr. Kruckeberg reported that the proposed design of the new city hall building was
presented at the last City Council meeting'and revisions were discussed. The Council
will review the revisions in study session inMarch.
Mr, Kruckeberg said that the General Plan contract was approved by the City Council
and that the city is recruiting volunteers for a citizen's advisory committee. He also, said
that the Parks fee was approved and the details of implementation are being developed.
He noted that the Community Development Administrator position closes this Thursday
and reviewed the status of the CarusoJWestfield'lawsuit.
Commissioner Parrille said he attended a seminar at Caltrans designed especially for
Planning Commissioners and found it to be very informative and helpful.
