HomeMy WebLinkAboutItem 11a - Adjourned Regular Meeting Minutes of February 7, 202202-07-2022 ARCADIA CITY COUNCIL ADJOURNED REGULAR MEETING MINUTES MONDAY, FEBRUARY 7, 2022 CALL TO ORDER – Mayor Tay called the Study Session Meeting to order at 6:00 p.m. with all four Council Members present. PUBLIC COMMENTS – No one appeared. STUDY SESSION a. Report, discussion, and direction regarding the Newcastle Park Project update. Public Works Services Director Cranmer provided the PowerPoint presentation. After City Council discussion, it was the consensus of the City Council to direct City Staff to continue to pursue a grant opportunity and to delay the project in the meantime. The Study Session ended at 6:30 p.m. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding potential litigation – one (1) case The City Council did not convene in Closed Session. Adjourned Regular Meeting City Council Chamber, 7:00 p.m. 1. CALL TO ORDER – Mayor Tay called the Adjourned Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Secretary Riaz Khan, Mosque of San Gabriel 3. PLEDGE OF ALLEGIANCE – City Clerk Gene Glasco 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Verlato, Cheng, and Tay ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS Assistant City Attorney Maurer announced that prior to the Adjourned Regular Meeting, the City Council held a Special Meeting containing one Study Session item to discuss the Newcastle Park project, which included a potential grant opportunity. The City Council recommended that City Staff continue to pursue that grant opportunity. The City Council did not go into Closed Session. 02-07-2022 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto reminded the audience to submit all public comment cards prior to the Mayor calling for public comment. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Beck, and seconded by Council Member Verlato, to read all ordinances and resolutions by title only and waive the reading in full and the City Council concurred. 8. PRESENTATIONS a. Los Angeles County Public Works Santa Anita Debris Dam Update. Dai Bui of the Los Angeles County Public Works presented a PowerPoint presentation regarding the Santa Anita Debris Dam. 9. PUBLIC HEARING a. Public Hearing to receive input from the Community and take possible action on draft maps regarding the redrawing of City Council Election District Boundaries. Recommended Action: Receive Public Input and Provide Direction Jeff Simonetti, the demographer from NDC, presented a PowerPoint presentation regarding the draft maps for the third public hearing Council Member Verlato presented three maps. Mayor Tay opened the Public Hearing. Jason Lee, an Arcadia resident, provided his objection to Maps 101, 106, 107,108 and 109. Edmund Liu, an Arcadia resident, indicated that he is in favor of Map 111; he stated that he was surprised by the maps provided by Council Member Verlato as they were not submitted timely based on the January 15, 2022, deadline referenced on the City’s website. A motion to close the Public Hearing was made by Council Member Verlato, seconded by Council Member Beck, and seeing no objection, Mayor Tay declared the Public Hearing closed. After City Council discussion, a motion was made by Mayor Pro Tem Cheng and seconded by Council Member Verlato to have City Council submit a limit of two additional maps each by the end of the business day on February 22, 2022, and to continue this Public Hearing to March 1, 2022. The motion passed unanimously. AYES: Cheng, Verlato, Beck and Tay NOES: None ABSENT: None 02-07-2022 10. PUBLIC COMMENTS Michelle, an Arcadia resident of District 5, urged City Council to hold a Special Election for District 5 and shared her disappointment with the City Council for not appointing someone to fill the vacancy in District 5. Lucy, an Arcadia resident of District 5, stated that she reviewed the maps and based on the current maps, she recommends the City Council select Map 103; she reminded the City Council and City staff that the City is out of compliance with the City Charter by not filling the vacancy in District 5 or calling for a Special Election. Susan Guo, an Arcadia resident, expressed her disappointment with the submission of the 3 maps presented by Council Member Verlato, and stated the importance of transparency to the public. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck indicated that tonight was the first time he saw Council Member Verlato’s maps; he announced that the Women’s Club was nominated to be a historic resource to the City at the January 25, Planning Commission meeting; he reported that the Regular City Council meeting was continued because he had a heart attack on January 26; and he wished the best of luck to the Los Angeles Rams in the Super Bowl. Council Member Verlato clarified why she submitted her maps on January 30; she announced that on February 2, she attended the Blue Ribbon Commission on Homelessness meeting; she further announced that on February 1, she attended the San Gabriel Valley Council of Governments homelessness meeting; on February 7, she attended a meeting with the San Gabriel Valley Council of Governments Executive Board regarding a proposed ballot initiative to repeal SB 9; and she attended the Arcadia PTA Council meeting; she thanked Public Works staff for repairing the water main break on Alta Oaks; she remined the public that the Homeless Point- in-Time count is on February 22; she further reminded everyone that February 15 is the Special Election for State Assembly; and she wished everyone a Happy Valentine’s Day. Mayor Pro Tem Cheng thanked the City Council for all they do; he expressed his gratitude for the volunteer work that Council Member Beck participates in; he indicated that the City Council is united and share a common goal to proudly represent the City. City Clerk Gene Glasco announced that he has been unable to attend City Council meetings due to health issues; he anticipates returning to City Council meetings next month; he thanked City staff for helping restore his power following the wind storm. Mayor Pro Tem Cheng recommended that City Council explore emergency services for senior residents; and requested that this matter be placed on a future agenda for further discussion. The City Council concurred. Mayor Tay indicated that the City Council will work together to complete the redistricting process. 11. CONSENT CALENDAR a. Special and Regular Meeting Minutes of January 18, 2022. Recommended Action: Approve 02-07-2022 b. Ordinance No. 2384 Amending the Arcadia Municipal Code by adding Sections 4290.2, 4290.3, 4290.4 and 4294 to Part 9 of Chapter 2 of Article IV (“The Public Welfare, Morals and Policy Code”) with an exemption from the California Environmental Quality Act (“CEQA”), to establish smoking prohibitions for Multi-Family Residential Units, Commercial and Retail entryways, and Outdoor Dining facilities. Recommended Action: Adopt c. Resolution No. 7405 declaring that weeds, brush, rubbish, and refuse upon or in front of specified property in the City are a seasonal and recurrent public nuisance, and declaring an intention to provide for the abatement thereof. Recommended Action: Adopt d. Resolution No. 7406 amending Resolution No. 7380 establishing compensation and related benefits for employees represented by the Arcadia City Employees Association (Utility Billing Specialist). Recommended Action: Adopt e. Revision to the existing classification specifications for Deputy Public Works Services Director. Recommended Action: Approve f. Purchase Order with Motorola Solutions, Inc. for the purchase of eight dual-band Motorola APX8500 mobile radios, one tri-band Motorola APX8000XE portable radio, and four dual-band Motorola APX8000XE portable radios in an amount not to exceed $127,000 for Fiscal Year 2021-22. Recommended Action: Waive the Formal Bid Process and Approve g. Find that, due to the COVID-19 state of emergency, state and local officials continue to recommend measures to promote social distancing, and therefore the City Council and all other City Boards and Commissions may meet virtually. Recommended Action: Make Findings It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on a roll call vote to approve Consent Calendar Items 12.a. through 12.g. AYES: Beck, Verlato, Cheng, and Tay NOES: None ABSENT: None 12. CITY MANAGER a. Design options for a Memorial Courtyard at the Museum Education Center in honor of Carol Libby. Recommended Action: Select Design Option City Manager Lazzaretto reported that City Staff would be able to implement this project in-house within the budget previously proposed. It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on a roll call vote to go with the Staff’s recommendation for Plan B with the Museum Parking Lot Add- on for a total cost of $38,500, a plaque would be added with Council Members names and 02-07-2022 additionally the metal fence around the statue would be removed and replaced with a soft hedge or rose bushes, and it was determined that the project is categorically exempt from CEQA. AYES: Beck, Verlato, and Cheng NOES: Tay ABSENT: None b. Report, discussion, and direction regarding filling the unexpired term for City Council District 5, including resolutions necessary to call a Special Municipal Election. Recommended Action: Provide Direction Resolution No. 7408 calling and giving notice of a Special Municipal Election to be held in City Electoral District 5 on Tuesday, June 7, 2022, to fill a vacancy on the City Council as required by the provisions of the City Charter and the laws of the State of California relating to Charter cities. Recommended Action: Adopt Resolution No. 7409 adopting regulations for candidates for elective office pertaining to candidates statements submitted to the voters at a Special Municipal Election to be held on Tuesday, June 7, 2022. Recommended Action: Adopt Resolution No. 7410 requesting the Board of Supervisors of the County of Los Angeles to consolidate a Special Municipal Election to be held on Tuesday, June 7, 2022, with the Statewide Primary Election to be held on the same date pursuant to Section 10403 of the California Elections Code. Recommended Action: Adopt Resolution No. 7411 amending the Fiscal Year 2021-22 General Fund Budget authorizing a supplemental appropriation from the General Fund Reserve in the amount of $20,000 for a Special Municipal Election to be held on Tuesday, June 7, 2022, and related election services. Recommended Action: Adopt A motion was made by Council Member Beck and seconded by Council Member Verlato to appoint Angela Hui to fill the unexpired term until a Special Election could be held in District 5 to fill the vacancy. A substitute motion to have a Special Election in June was made by Mayor Pro Tem Cheng and seconded by Mayor Tay. The substitute motion failed on a 2-2 roll call vote. AYES: Cheng and Tay NOES: Beck and Verlato ABSENT: None A roll call vote on the original motion to appoint Angela Hui to fill the unexpired term until a District 5 Special Election could be held was taken and failed to achieve the three affirmative votes required by the City Charter. AYES: Beck and Verlato ABSTAIN: Cheng NOES: Tay 02-07-2022 ABSENT: None A motion was made by Council Member Verlato and seconded by Council Member Beck to appoint Angela Hui to fill the unexpired term of District 5 until November. The motion failed on a 2-2 roll call vote. AYES: Verlato and Beck NOES: Cheng and Tay ABSENT: None A motion was made by Mayor Pro Tem Cheng and seconded by Mayor Tay to appoint Terrence Shay to fill the unexpired term for District 5 until a Special Election in June could be held. The motion failed on a 2-2 roll call vote. AYES: Cheng and Tay NOES: Beck and Verlato ABSENT: None No further action was taken on this item. 13.
