HomeMy WebLinkAboutCRC Minutes: 02/10/2022CHARTER REVIEW COMMITTEE SPECIAL MEETING MINUTES THURSDAY, FEBRUARY 10, 2022 CHARTER REVIEW COMMITTEE SPECIAL MEETING CALL TO ORDER — Committee Chair Helms called the meeting to order at 10:00 a.m. in the Council Chambers Conference Room ROLL CALL OF COMMITTEE MEMBERS: PRESENT: Lee Kuo, Anthony Leung, Li Zhang, Sheng Chang, and James Helms Jr. ABSENT: Jagdeep Singh It was the consensus of the Committee that Committee Member Jagdeep Singh be excused from this meeting. 1. PUBLIC COMMENTS — None 2. REPORTS FROM STAFF LIAISONS — None 3. REPORTS FROM CHARTER REVIEW COMMITTEE MEMBERS — None 4. DISCUSSION ITEMS a. Special Meeting Minutes of January 21. 2022 Vice Chair Chang recognized a misspelling of his name on a motion in the Special Meeting Minutes. Deputy City Clerk Arellano advised that the correction would be made. It was moved by Committee Member Kuo, seconded by Vice Chair Chang, and carried on roll call vote to approve the January 21, 2022, Special Meeting Minutes. AYES: Committee Members Kuo, Leung, Zhang, Chang, and Helms NOES: None ABSENT: Singh b. Proposed Charter Amendments Committee Members reviewed the handout provided for Section 403 and a discussion ensued. Any writings or documents provided to a majority of the Charter Review Committee regarding any item on this agenda will be made available for public inspection at City Hall, 240 W. Huntington Drive, Arcadia, CA 91007 during normal business hours. A motion was made by Committee Member Kuo, and seconded by Vice Chair Chang, to approve the staff amendments to Section 403 with an amendment to remove subsection (f). AYES: Committee Members Kuo, Leung, Zhang, Chang, and Helms NOES: None ABSENT: Singh Committee Members reviewed the handout provided for Section 404 and a discussion ensued. A motion was made by Committee Member Kuo, and seconded by Chair Helms, to modify the first paragraph of Section 404 that the Council shall adopt a Resolution or Ordinance to implement the rotation, and as an alternate recommendation propose the provided rotation as provided by staff in the Section 404 handout. AYES: Committee Members Kuo, Leung, Zhang, and Helms NOES: None ABSENT: Singh ABSTAIN: Chang Committee Members reviewed the handout provided for Section 407 and a discussion ensued. A motion was made by Committee Member Kuo, and seconded by Committee Member Leung, to approve the amendments provided by staff to Section 407. AYES: Committee Members Kuo, Leung, Zhang, Chang, and Helms NOES: None ABSENT: Singh Committee Members circled back to Section 401 and a discussion ensued regarding the handout provided by Chair Helms. Committee Members Kuo, Leung and Chang were in favor of option #2. Committee Members Zhang and Helms were in favor of option #1. A motion was made by Committee Member Kuo, and seconded by Committee Member Leung, to keep the Committee's original recommendation of a maximum of three, four year terms, with the alternate recommendation for three, four year terms of which only two may be in consecutive order. AYES: Committee Members Kuo, Leung, Chang, and Helms NOES: Zhang ABSENT: Singh Committee Members discussed Article XIV, Board of Education. City Attorney Maurer explained that there are provisions in the California Constitution that require an affirmative vote of registered voters within the School District to make a change to this section of the Charter, and the School District boundaries are not coterminous with the City's boundaries. As a result, it is recommended that City reconsider its recommendation to remove Article XIV from the Charter. It was the consensus of the Committee to withdraw their recommendation to remove Article XIV, Board of Education from the Charter. c. November 2022 Ballot Measure Question Committee Members discussed including provisions in the Charter to impose an increase to the Transient Occupancy Tax and a new Sports Wagering Tax on activities at Santa Anita Race Track if California voters approve a ballot measure to allow for sports wagering statewide at the November 2022 election. It was the consensus of the Charter Committee to discuss at the next meeting.
