In the absence of the Secretary, Frank Forbes served ss.Secretary pro tem. ' PRESENT: Commissioners Anderson, Balser, Knopp, PI-att. Robert- son and Sorenson ABSENT: Commissioner Berky OTHERS PRESEIiI'l': Forbes, Hulse, Mansur, Nioklin, Rogers and McGlasson The minutes of the meeting of February 23, 19$4. were approved as written and mailed. Pursuant to notice given. a public hearing was held on the appl1- cation of the Industrial Brush Company. 114 St. Joseph Street. requesting a zone variance to permit the entire Easterly 4.0 teet of Lots 34. 35 and 36, Block 79. santa Anita Tra.ct, to be used for light manufacturing purposes and to restrict Lot 3. Block 79, for automobile parking purposes. Mr. English. representing the Industrial BI'ush Company. addressed the Commission and stated that no 1mmediate expan- sion in business is contemplated but if expansion is necessary in the f'utUl"e. it is the desire of the oompany that the zoning permit such exp~sion and that adequate parking be provided across the alley. No othel' person desired to be heard and no colllll1UD1oations were received. The Chairman declared the hearing closed and referred the matter to the Commission and the Planning Consultant for consideration. The applioation of Helen S. Howser for a zone variance to permit the erection 0 t an automobile filling station at the southeast corner of Colorado Street and Oakhurst Lane, on which a publio hearing was held on February 9. 1.954, was considered. Reports from the City Manafer, the Planning Consultant and the City Attorney were read. It was the consensus of' opinion of the Commissioners that business should not be allowed to enoroaoh in the residential areas. Motion by Mr.' PI-att that the City Attorney be instructed to draw the neoessary I'esoo lution to reoommend the denial .of' the applioation. Said motion was seoonded by Mr. Balser and oarried by the following vote: AYES: Commissioners Balsor. Knopp, Pratt, Robertson and Sorenson. NOJ::S: None ABSENT: Commissioner Berley NOT VOTING: Commissioner Anderson In the matter of the application at La Verna H. Morse for Q zona variance to allow the gE'owing and sale of orohids and similar plants at the southeast oorner of' Foothill Boulevard and Michillinda Avenue. s communioation was received from Glenn Hiatt, the true part in inter- est under an option to purchase the subject property. requesting that - 1 - 3-9-5h ( . . , the application for the variance be withdrawn and that fUrther pro- ceedings relative thereto be terminated. MOl'se heretofore re- quested a v81'iance at the southeast corner of Foothill Boulevard. ond Miohillinda Avenue to permit the growing. pl'opagating and sale of orch.tds and similar plants. upon which application a publIc he81'ing was held on February 9, 195'4; and WHEREAS, Glenn Hiatt, the true party in interest, has in writ- ing requested a withdrawal of such application; and WHEREAS, the faC'ts presented at suoh he!l1'ing fail to show the necessi ty for gI'anting the requested varlanee from Ordinance No. 160; NOW, THEREFORE, the Planning Commission recommends to the City Counoil the denial of the application and that the applicants be ad- vised accordingly. The application of Edgar DeWees, 1416 South FOUl'th Avenue, to divide property was reported on by Mr. Sorenson and Mr. Balser. Motion by Mr. Sorenson, seconded by Mr. Balser and carried that pel'- mission to divide the north 231.2$ feet of the west 280.92 feet of Lot 44. Tract No. 608. into three parcels being two 70-foot lots off the northerly portion of' the property, leaving a 91.25-foot remainder be recommended for approval provided all side yard requirements per- t&1n1ng to the house on the southerly parcel be oomplied with. The request of Robert Stettler and George Lewis to divide prop- erty on Oakhurst Lane was reported on by Ur. Pratt. Motion by Ml'. Pratt. seconded by Mr. Balser. and oarried that the matter be hald in abeyance until the next meeting and that the City Engineer be re- quested to view the property and submit his recommendation. Tentative map of Tract No. 18855. located at the north end of Watson Dr! va and Le.e Drive, was reported on by the Subdi vision Com- mittee. A communioation fro~ Robinson Bros., subdividers, requested the acceptance of a 50-foot street ill3tead of the usual 60 feet on / account of the shallow depth of the lots. Reports from the Planning Consultant and the City Engineer were read. Motion. by Mr. Pratt, seconded py Mr. Balser and carried that tentative map of Tract No. 18855 be reoommended for approval subject to the oonditions sot out in the letter of the City Engineer and subject to the subdividers sub- mitting plot plans for the proposed improvement of Lots I, 4c, 5 and 8 to be reoeived not later than the tima the final map is submitted for approval. In the matter of the application of Martin Kordick to divide property at Wigwam Avenue and Laurel Avenue, a report fI'om the Plan- ning Consultant pointed out that this WaG part of' a previous lot split which required that the pl'operty be maintained a s one parcel. The proposed new division would create four parcels, two of which would back up to the Santa Anita Wash and would be of suoh dimensions that variances would be necessary for the construction of residences. He recommended the denial or the application. Mr. William r'rederick, 316 j:;ast La Sierr.a 1lI'ive, addressed th~ Commission and discussed a map, showing the location of proposed houses on the lots. Motion by Mr. Pratt, seoonded by Mr. Anderson and c81'I'ied that the application to divide a portion of Lot II, Block 89, Santa Anita Tract. be reoommended for denial. The request of ~~. A. T. Fratus for a yard variance at 1222 - 2 - 3-9-54 . . South Third Avenue was considerod. The above property is a corner lot and the request Vias to peI'mlt a rear yard of twelve feet behind the attached garage and with a side yard of 20 feet~om the side street line to the garage. Motion by Mr. Robertson, seconded by Mr. Sorenson and carried that the request be reoommended i'or approval as being in substantial compliance with the requirements of the zoning ordinance. The request of Joseph Surra for a yard variance at'2l3l South Filth Avenue was considered. This property is a OO1"ner lot and the request v/as for a 19-foot rear yard behind the attached garage in- stead of the reqllirod 25 feet. Motion by Mr. Sorenson, seconded by fllr. Balser and. carried thut the request be recommended for approval as being in substantial compliance with the requirements of the zon- ing ordinance. Motion by Mr. Sorenson, seconded by Mr. Balser and carried that both Mr. Fratus and Mr. Surra get approval of adjacent property owners prio!" to presenting their requests to the Oity Oouncil for confirmation. The rinal map or Tract No. 19589. located south of Foothill Boulevnvd and. west of Rancho Road was presented for approval. It was tlw consensus of opinion of the Commission that the subdivider should be ;:oequired to improve those portions offered for dedication as fUture stre~tB. Motion by Mr. Pratt, seconded by Mr. Robertson and V carried that the final Inap of Tract No. 19589 be reoommended for ap- proval subject to the conditions set out in the lette:r of the City EnginueJ:O and subject to the improvemsTlt viith ollI'bs and gutters of the portion shown as fUture street. The request of Harold S. Keeler. 623 I'fest Palm Drive, to divide property was referred to 1IJl:to. So:renson and Mr. KnOpp to investigate. The request of Nadine Alsing, 411 East Longden Avenue, to divide property was re1'erred to Mr. Sorenson and Mr. Balser to investigate. The request 01' NOI'man ','J. Klein. 616 West Walnut Avenue, to divide property was referred to Rw. Pratt and Mr. Robertson to investigate. The request of Manuel Garcia, 1110 South Ei~lth Avenue, to divide prope:rty was referred to fiII'. Berky and Mr. Balser to investigate. A tentative map of Tract No. 18702, located partly in Sierra / Madre and partly in Aroadia. and Tract No. 20211, both located north of Elkins Avenue, was referred to the Subdivision Commlttee for in- vestigation. The city Engineer called attention to the fact that the Planning Commission should oonsider some control of the development of parkway areas, espeoially in multiple residential zones, pertaining particu- lB.Y.'ly to tho construction of sldewal. ks:, the materials of which they shall be constructed and the location of walks in relation to the curb lines. At the suggestion of Mr. Pratt, the Oity Engineer was re- quested to preplU's a reoommendation for the control of such areas. The Planning Consultant :reported that he had made a study of proposed Zones a-l, C-2 and C-3 end hoped to have his repOI't ready by the next meeting. The city Attorney presented Resolution No. 139. recommending that funeral parlors and mortuaries be included VI.ithin the category of theatres, auditoriums and other similar places of assembly inSOfar as req~ired automobile parking area-is concerned. Motion by Mr. Sorenson. seconded by Mr. Balssr .and carried that. Resolution No. 139 be adopted. The City Attorney presented ResolutIon No. 140 instituting pro- ceedings fa!' the amendment of Ordinance No. 760 ta exclude the main- tenance and operation of funeral parlors and mortuaries from uses perm,issible in Zone C-2 and including them as a special use under Section 16. Motion by Mr. Balser, secan4ed by Mr. Anderson and oar- ried that the reading of the body of the resolution be waived. Motion by Mr. PIoatt. seoonded by MI'. Sorenson .and oarr:!.ed that Resolution No. 140 be adopted. . The City Attorney presented Resolution No..ll~ instituting pro- ceedings for the amendment of Ordinance No. 760 rl'garding the location of private swimming pools in required yards. Moti?n by Mr. Balser, seconded b~' Mr. Robertson and carried that the read::.ng of the body of the resolution be waived. Motion by Mr. Anderson~ s~conded by Mr. Pratt and oarried that Resolution No..141 be adopted. The City Attorney presented Resolution No. 142. r~commandlng the approval 01' the application of Herbert A. Mollno and ot1:;:rs for a zone change on certain property on Duarte Road from Zone ~-2 to Zone C-3 upon the conditions set out in the resolution. Motion by Mr.. KnoPP. seconded by rill'. Robertson and oazTied that the reQdi1l~ of the body 9f the resolution be waived. Motion by Mr. Sorenson, s~condGd by Mr. Knopp and carrIed that Resolution No. 142 be adopted. The City Attorney,presented Resolution No. 143. recommandin~ the granting of the petition of George H. Jelinek and others for rezoLing certain property on Duarte Road from Zone R-l to Zone R-2 subjeot t~ the conditions set out in the resolution. Motion by Mr. Rober~son" ssconded by Mr. Balser and carried that the reading of the body of t1." resolution be waived. Motion by,Mr. Pratt, seconded by Mr. Sorenson and ca~ried that R~solution No. 143 be adopted. Motion by Mr. Pratt, seoonded by Ail'. Sorenson and carried that the City Council be requested to require the delivery of the deeJa for street purposes specified in Resolutions No. 142 and ~3 prior to the time the requested zone changes might .b,e of1'io1a11y approved. city Attorney Nioklin informed the Commission that an ordinance amending the zoning ordinance and incorporating most of the previous reoommendations of the Co~nission was being drawn. Upon questions from the Commission, ~w. Hulse stated that the City Council had Dot yet sot a date for the oonsideration of the application for change of zone on Fairview Avenuo. between Baldwin Avenue and Holly Avenue.
